Notice of this meeting was posted at Town Hall on December 23, 2016 and this agenda was posted on June 2, Notice of this meeting was published in the Citizen of Morris County and the Daily Record Newspapers on December 23, 2016 and a copy of this agenda was forwarded to each of the town s official newspapers on June 2, PROCLAMATION WHEREAS, on October 2, 2016, the Boonton Police Department received a report that someone had fallen down a cliff in Grace Lord Park. Fire Chief R.J. Ryerson heard the dispatch from Communications Officer Ryan Chmura and quickly joined Police Officer Michael Gulla and Sergeant Royce Stafford who had already begun a search. Soon Past Fire Chief Carl Wendt was on the scene manning the command vehicle; and WHEREAS, searchers spotted a teenager clinging to the rocks about 30 feet above the Rockaway River rapids. Battalion Chief Dave Kaplan threw the boy a line which was then anchored to a tree by Past Chief Richard Osborne and a rescue plan was quickly formulated. Carl Wendt rappelled down the embankment to the boy. Fire Lieutenant Nick Petonak and Firefighters Mike Mullaney and Bill Wallace set up line systems which were used by Firefighter Bob DeStefano and Fire Lieutenant Shane Dencker and Past Fire Chief Peter Herbert to rappel to help secure the teen. Firefighter Scott Hollinghurst lowered the basket and a hauling system was set up by Fire Captain Chris Petonak and Firefighter James Westura. The boy was brought up to safety and to a waiting ambulance.; and WHEREAS, these individuals worked together and with other members of the BPD, the BFD and the Kiwanis Ambulance Service to bring a happy resolution to the dangerous situation. We admire their teamwork, advanced training, quick wits and sharp skills. We salute them for their bravery and their dedication to the safety and well-being of the public. NOW THEREFORE, I, Matthew DiLauri, Mayor of the Town of Boonton on behalf of the Board of Alderman and the People of Boonton do hereby recognize BPD members, Communications Officer Ryan Chmura, Patrolman Michael Gulla and Sergeant Royce Stafford and BFD members, Lieutenant Shane Dencker, Firefighter Robert DeStefano, Past Chief Peter Herbert, Firefighter Scott Hollinghurst, Battalion Chief David Kaplan, Firefighter Michael Mullaney, Past Chief Richard Osborne, Captain Chris Petonak, Lieutenant Nick Petonak, Fire Chief R.J. Ryerson, Firefighter William Wallace, Past Chief Carl Wendt and Firefighter James Westura for the excellent work they did in saving a life at the cliffs on the Rockaway River on October 2, Thank you all for a job well done. 1

2 CORRESPONDENCE Alderman Plaisted Girl Scout Troop 5046 came before the Mayor and Board requesting approval to install dog waste stations at various locations throughout the town. Mayor DiLauri suggested two could be placed near the metal steps on upper Main Street leading down to the Canalside Park and at the post office. Alderman Piccioni recommended they work with Mike Petonak, DPW to agree on the other locations. Alderman Piccioni made a motion to approve their request which was seconded by Alderman Wekilsky with the stipulation of working with the DPW in placement. Alderman Piccioni made a motion to approve this request, seconded by Alderman Miniter-motion carried. Mayor DiLauri recommended that the landscapers work with the DPW in their placement of their signs. 2

3 Alderman Piccioni made a motion to approve this request, seconded by Alderman Wekilsky motion approved. Alderman Piccioni made a motion to accept this letter; Alderman Miniter seconded the motion. Mayor DiLauri advised that this is 2017 s installment of funding from the NJDOT for road paving. 3

4 Alderman Piccioni made a motion to approve these requests which were seconded by Alderman Miniter; motion carried. Alderman Tullock asked if it would be possible to move this event one week earlier in order to give the local retailers the opportunity to extend the shopping season. Alderman Piccioni made a motion to approve these requests, Alderman Wekilsky seconded the motion the request was approved. Mayor DiLauri indicated that the Clerk has been advised to notify the RVRSA of the date of the parade because of their scheduled construction along Washington Street. 4

5 MEETING OPEN TO THE PUBLIC Mayor DiLauri opened this portion of the meeting to the Public. Having nobody come forward, he closed this portion of the meeting. CONSENT AGENDA Alderman Eoga Resolution RESOLUTION RESOLUTION TO ADOPT MINUTES OF THE MAYOR AND BOARD OF ALDERMEN MEETINGS BE IT RESOLVED by the Mayor and Board of Aldermen of the Town of Boonton, County of Morris and State of New Jersey, that the Minutes from the following meetings are hereby approved as typed and filed in the Town Clerk s office: May 15, 2017 RESOLUTION RESOLUTION TO APPROVE PAYMENT OF VOUCHERS WHEREAS, vouchers for payment have been submitted to the Mayor and Board of Aldermen by the various municipal departments. NOW THEREFORE, BE IT RESOLVED by the Mayor and Board of Aldermen of the Town of Boonton, County of Morris and State of New Jersey, all vouchers approved by the respective committees be and are hereby ordered paid. RESOLUTION RESOLUTION TO CANCEL WATER/SEWER CHARGES BE IT RESOLVED by the Mayor and Board of Aldermen of the Town of Boonton, County of Morris and the State of New Jersey, that the following water/sewer charges be and are hereby canceled: Account Address Reason Amount Washington St. Bad Reading $ 8.44 RESOLUTION RESOLUTION APPOINTING PART-TIME INSPECTORS FOR THE AVALON BAY PROJECT WHEREAS, Avalon Bay Communities, Inc. is currently constructing a project on Division Street, Boonton, NJ; and WHEREAS, pursuant to Construction Official Russ Heiney s recommendation, backup plumbing/mechanical inspectors and electrical inspectors will be needed throughout this project; and WHEREAS, Mr. Heiney has recommended Mr. Keith Lynch, Town of Boonton Plumbing Inspector, as the Fire Inspector and a backup for Building Inspector for the Avalon Bay project; and WHEREAS, Mr. Heiney has recommended Mr. Robert Rosendale as the Building Inspector for the Avalon Bay project. NOW THEREFORE, BE IT RESOLVED, that Mr. Keith Lynch and Mr. Robert Rosendale be and are hereby appointed at an hourly rate of $45.00/per hour for their work on the Avalon Bay Construction project on Division Street, Boonton, NJ. RESOLUTION RESOLUTION OF THE MAYOR AND BOARD OF ALDERMEN OF THE TOWN OF BOONTON, NEW JERSEY, AWARDING A PROFESSIONAL SERVICES CONTRACT TO BURGIS ASSOCIATES, INC. FOR PROFESSIONAL PLANNING SERVICES RELATIVE TO THE TOWN OF BOONTON HOUSING ELEMENT AND FAIR SHARE PLAN WHEREAS, the Town of Boonton is desirous of obtaining professional planning services relative to the Housing Element and Fair Share Plan; and WHEREAS, the Mayor and Board of Aldermen deem it in the best interests of the residents of the Town of Boonton to retain the services of Burgis Associates, Inc., a corporation in the State of New Jersey, having its principal offices at 25 Westwood Avenue, Westwood, NJ 07675; and WHEREAS, the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq., permits the hiring of professional services without advertising and public bid and requires that the resolution authorizing same be available for public inspection; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Aldermen of the Town of Boonton, New Jersey, as follows: 5

That the Administrator and Clerk be and are hereby authorized to execute a contract on the Town s behalf with Burgis Associates, Inc. for professional planning services relative to the Housing Element and Fair Share Plan. 2. This contract is awarded without competitive bidding as a professional service in accordance with N.J.S.A. 40A:11-5(1)(a)(i) of the Local Public Contracts Law because the contract is awarded for services to be performed by a person or persons licensed and authorized by law to practice a recognized profession and the services to be rendered are of an unspecific nature not compatible with competitive bidding. 3. The term of services shall be from the date of acceptance of the agreement until its completion, in full accord with the terms and conditions thereof. The total fee for planning services for this project shall not exceed $35,000.00, in accordance with the proposal submitted by Joseph H. Burgis, P.P., AICP, dated March 1, This award is contingent upon certification by the Chief Financial Officer that sufficient funding exists therefore. 5. Notice of this action shall be published in The Daily Record newspaper within ten (10) days of the passage thereof. I hereby certify that $ 35, is available in Account # Yolanda Dykes, CFO RESOLUTION RESOLUTION OF THE MAYOR AND BOARD OF ALDERMEN OF THE TOWN OF BOONTON, NEW JERSEY, AWARDING A PROFESSIONAL SERVICES CONTRACT TO GOVERNMENT MANAGEMENT ADVISORS, LLC FOR PROFESSIONAL SERVICES RELATIVE TO POLICE DISPATCH ALTERNATIVES WHEREAS, the Town of Boonton adopted Resolution in January, 2017, awarding a professional services contract to Government Management Advisors, LLC for services relative to a police dispatch alternative; and WHEREAS, an amended contract is now required to increase the fee for services from $2, to not to exceed $5,000 pursuant to the proposal submitted by Gregory Fehrenbach, Government Management Advisors, LLC; and WHEREAS, the Mayor and Board of Aldermen deem it in the best interests of the residents of the Town of Boonton to retain the services of Government Management Advisors, 40 Yorktown Road, East Brunswick, NJ; and WHEREAS, the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq., permits the hiring of professional services without advertising and public bid and requires that the resolution authorizing same be available for public inspection; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Aldermen of the Town of Boonton, New Jersey, as follows: 1. RESOLUTION RESOLUTION TO AMEND THE ADOPTED BUDGET FOR ADDITIONAL ITEMS OF REVENUE AND OFFSETTING APPROPRIATIONS (Chapter 159) WHEREAS, NJSA 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such item shall have 7

8 been made available by law and the amount thereof was not determined at the time of the adoption of the budget; and WHEREAS, said Director may also approve the insertion of an item of appropriation for an equal amount; and WHEREAS, the Town of Boonton has received a Distracted Driving Mobilization Grant in the amount of $4, from the Division of Highway Traffic Safety, and wishes to amend its 2017 budget to include this amount as a revenue. NOW THEREFORE, BE IT RESOLVED by the Mayor and Board of Aldermen of the Town of Boonton, in the County of Morris, State of New Jersey, the Town hereby requests the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2017 in the sum of $4, which is now available as a revenue from: Miscellaneous Revenues: Special Items of General Revenue anticipated with prior written Consent of the Director of the Division of Local Government Services: Public and Private Revenues offset with appropriations; and BE IT FURTHER RESOLVED that the sum of $4, be and is hereby appropriated under the caption of: General Appropriations: (A) Operations Excluded from CAPS Public and Private Programs offset by Revenues; and BE IT FURTHER RESOLVED that the town clerk forward the Certification form approved for Municipal Use to the Director of Local Government Services for approval. 9 COMMITTEE Economic Development MAYOR & BOARD OF ALDERMEN COMMITTEE REPORTS CHAIRMAN JAMES LYNCH In Mr. Lynch s absence, Mayor DiLauri reported that they are working with Morris County Economic Development on a listening campaign for businesses. They reached out to business owners as well as the larger taxpayers to get their opinions of what they would like to see here in Boonton. The public may now participate discussing a transit village study and are invited to attend listening sessions being held on June 16 and 17 at the Boonton Holmes Library. A survey is also available through the boontontransitvillage.org website. Finance & Personnel Ordinance & Codification MICHAEL EOGA SCOTT MINITER At their recent meeting, contract negotiations were discussed. Mayor DiLauri added that they also heard a presentation on an energy aggregate program about lowering energy bills. A meeting is being scheduled to discuss various ordinances to be created or amended. Police & Parking BOBBY TULLOCK There are various openings within the police department; Dispatcher, Parking Enforcement Officer and Police Department secretary. We have also requested a new Civil Service list of eligible candidates to fill a police officer opening. Parking: Alderman Tullock explained some ideas of adding parking spaces at the post office property and wanted to see how this board felt. Mayor DiLauri added that Congressman Frelinghuysen also has connections with the post office and can help us with this if the board is interested. Alderman Eoga made a motion for Mayor DiLauri to approach the post office with these ideas, and Alderman Wekilsky seconded motion approved. Alderman Tullock also asked the Board if they would agree to add meters to parking spaces on the 100 block of Union Street. This is the only street off of Main Street that does not have meters on the first block. Alderman Piccioni made a motion to install the meters Alderman Miniter seconded motion carried. The committee is also looking into other areas where parking may be available. One is the former Boonton Electric property on Division Street. The owners of the property may be agreeable to let the Town use this site for parking, however, a tax abatement may need to be considered. POLICE: Chief Mayhood indicated that the left-hand turn prohibition out of John Hill School is legal. Also, crossing guards will be working later in the day because of the Homework Club. The two new police recruits are out of the Academy and are now working. They ll continue their training for the next few months. There is a program called CARES for preventative measures after an overdose occurs and the department is incorporating it as a supplement to our NARCAM program. Line striping will begin shortly. Traffic calming devices will also be set up soon. Mayor DiLauri indicated that the County plans on repaving West Main Street from Hawkins Place to Boonton Avenue. Because there are concerns from our fire department and emergency services, he asked the board if they would be interested in asking the County to postpone paving for a week in order for engineers to come here to town hall and review the plans for parking. Alderman Wekilsky made a motion to ask for a delay of one week in order for engineers to review plans, which was seconded by Alderman Eoga motion carried. Upon Alderman Wekilsky s question about traffic on Toner Road and the ramp onto Rt. 287, he was told various ideas are being explored. Public Works & Property KEITH PRICE The Town met with JCPL and discussed lighting. The Mayor and Board previously approved the installation of Cobra lights at some locations on Main Street. There is a need for two extra cobra lights to be located on Main and Mechanic and Main and Church. The cost would be an additional $516 a year. JCPL would do the free installation. He asked the Board to think about whether this should be done. Also discussed at 9

10 their meeting was changing the current lights to LED lighting. Perhaps a TAP grant could be obtained in order to fund this project. Further investigation will take place. Regarding the temporary prohibition of right hand turns onto Division Street from Main, Alderman Piccioni asked if an ordinance would now be created. The sidewalk inventory has now been completed and they are finishing up the list into an Excel spreadsheet. Mayor DiLauri stated the goal is for us to see how many trees have caused damage to sidewalks in order to begin planning funding in the 2018 budget. Board of Education LIAISONS Scott Miniter reported that the Board has requested crossing guard s hours be extended to cover the Homework Club at John Hill School. Also, they asked for the status of the no left hand turn prohibition as well as reducing speed on Lathrop Avenue. There is a bill in the State level to triple the cost of fines for speeding in school zones. The Safe Routes to Schools is on schedule and should be done before the start of school in September. School water supplies were an issue several months ago and the state is now reimbursing schools for money spent on this subject. BHS has now partnered with CCM to work with students to get prepared for college. There are five (5) openings now on the Boonton Board of Education for the November election. Board of Health Boonton Fire Commissioner Boonton Holmes Library Boonton Main Street, Inc. Grants Michael Eoga reported that the Board will introduce an ordinance to raise the age of purchasing tobacco products, including vapes to 21. Chief Ryerson reported that the Fire Department recently participated in a parade in Clinton NJ and won a variety of First Place trophies. The Fire Department also participated in another rescue in Boonton Township this past week. Michael Eoga reported that the 3 rd Floor is now complete and they are in the process of creating a rental policy. James Plaisted congratulated Boonton Main Street for a very successful First Friday and Rock & Brew this weekend. James Plaisted reported that he has a list of grants to send out to the rest of the Board. He was contacted by Monica Scozzafava who pointed out that Boonton could be qualified for a grant to repair the bridge in Grace Lord Park. She will be forwarding more information to him. Regarding the Rockaway River slope failure, our present engineering study shows the repair to cost $1.9M. There is support from Senator Booker s office who is lobbying for us for possible funding/grants. Mayor DiLauri asked the Board if they are prepared to make a decision about the Rockaway River Slope at the next meeting on June 19, Alderman Eoga and Wekilsky were advised to have materials available for that meeting. Upon the consensus of the Board, on June 19, the Mayor and Board of Aldermen will be voting on the Rockaway River Slope Collapse in the amount of $1.95M. Historic Preservation Commission Housing Authority Kiwanis Bobby Tullock requested that he receive all code enforcement violations to businesses along Main Street to forward to the HPC for their meeting on Wednesday. James Plaisted reported although they were unable to hold a meeting because of the lack of a quorum, they discussed the RAD program. Also, Sherry Sims has requested they be put on the 2-year waiting list for the Privatization of the Housing Authority regarding bank funding and loans. Keith Price/Mayor DiLauri indicated that they are looking for a volunteer business manager that will include billing. He will be creating a summary and putting it out to the public shortly. Alderman Price added that in order for them to be licensed for billing, they must create new by-laws which they are currently working on. Municipal Alliance Parks & Recreation Cy Wekilsky reported that they will continue working with local businesses regarding the use of tobacco and vape products by minors. Keith Price reported they are finalizing their Use of Parks policy. Summer camp registration is underway. 10

11 There will be an outdoor movie night on June 29, The Summer Social will be held on July 12 during one of the summer concerts. He reported that there is now a committee looking into having a dog park within the town, however, they have only held one meeting to date. Mayor DiLauri stated that the Master Plan process would also be needed in the creation of this park. Planning Board James Lynch/Mayor DiLauri reported that the Park Woods project off of Fanny Road and Ely testimony is continuing with the Planning Board. RESOLUTION RESOLUTION TO RECESS INTO CLOSED SESSION WHEREAS, Section 8 of the Open Public Meetings Act, Chapter 231 P.L permits the exclusion of the public from a meeting in certain circumstances; and WHEREAS, this public body is of the opinion that such circumstances presently exist. NOW THEREFORE, BE IT RESOLVED by the Mayor and Board of Aldermen of the Town of Boonton in the County of Morris and State of New Jersey as follows: 1. The public shall be excluded from discussion of and action upon the hereinafter specified subject matters. 2. The general nature of the subject matter to be discussed is as follows: a) Personnel b) Attorney-Client Privilege c) Litigation d) Contract Negotiations 3. It is anticipated at this time that the above stated subject matter will be made public at the conclusion of each individual specified submit matter. 4. This resolution shall take effect immediately. 5.
