Alvarez III, Executive Director Re: Responses to Public Comment at Commission Meeting on January 26, 2012 Commenter, Terry Bagby, commented that he had learned of an that discouraged residents from attending Commission Meetings. He further stated that he never had an opportunity to participate in mediation referenced in a correspondence to HUD (US Department of Housing and Urban Development). Lastly, he suggested better maintenance on the elevator in the building where he lives. Staff Response: A subsequent was distributed outlining the intent of the poorly worded that Mr. Bagley referenced. Also, Secretary Alvarez outlined the SFHA and the Commissions policy on public comment at the Board meeting, as well, as any member of the public is welcome to attend the commission meeting and address the commission through public comment. The elevator at Clementina is operational and is routinely serviced and repaired. Staff continues its attempts to contact Mr. Bagby to discuss any additional issues he may have, but has been unsuccessful to date. Commenter Ruby Foots requested that her daughter s Section 8 voucher be exchanged with an offer of Public Housing and inquired further as to whether, if the Section 8 voucher is granted, her daughter could move to the first floor of Westside Courts. Staff Response: Management of the Authority met with Ms. Foots on January 27, 2012 and consulted her on what her daughter s options are. Ms. Foot s daughter has a section 8 voucher and can use that voucher to find a new unit closer to Ms. Foot (who lives at Westside Court). Ms. Foot s daughter is also on the Public Housing waitlist at approximately no

9 Commenter Suzanne Gamble indicated that one of the kitchen drawers in her unit does not slide correctly. Staff Response: The drawer was repaired on January 30, Commenter Paul Currier inquired about heating rebates and also asked about the last tenant election at his building and Tenants Association funds from the last fiscal cycle. Staff Response: Mr. Currier met with Staff on Friday, February 3, 2012 to discuss the Tenant Association elections in his building (JFK). Ms. Palpallatoc, and staff, as needed, will work with Mr. Currier to audit the election results at JFK to ensure the elections were conducted properly. Regarding the heating rebates, it appears that some tenants may have been promised rebates from PG&E if weather stripping were placed in their respective unit. However, as JFK is on a master meter, individual rebates are not provided to tenants. SFHA is working with its Energy Performance contractor AMERESCO for a strategy to resolve the weather stripping and energy efficiency needs at JFK tower. Commenter Uzuri Pease stated that the sink in her apartment unit is leaking and needs to be fixed. Staff Response: The repair was completed on January 27, Commenters Bobbi Lopez, Uzuri Pease, and Monica Dagestino all expressed concerns about low staffing levels of property managers, clerk, and maintenance workers and the resulting negative impact that it is having on operations, safety and turnaround time on work orders. In addition, Ms. Lopez claimed the constant reassignment of duties for SEIU employees have made it too difficult to perform work duties. Staff Response: Staff met with SEIU on January 31, 2012 to discuss staffing and work assignments. As a result of that meeting, staff will reopen the Joint Labor Management Committee meetings with SEIU in order address and resolve SEIU s concerns. Staff will meet with SEIU at least once per month until their concerns are resolved. Commenter Loreal Brown stated that she requested a transfer from Robert P. Pitts due to an incident involving her daughter. She is still waiting to move. She requested an update on the status of her transfer. 9

10 Staff Response: Ms. Brown accepted a transfer to Holly Courts. The apartment is being made ready for her to move in. Commenters Diva, and Helena Ting stated that they continue to have concerns regarding rent accounting at Park Merced and in particular the large number of pending evictions there. I addition, Ms. Ting insists that she is still being overcharged for her rent at Park Merced. Staff Response: SFHA staff met with Park Merced Property Management on Friday, February 3, Ongoing discussion will continue until these issues are fully resolved. Additionally, Ms. Ting received correspondence from the Authority on February 1, 2012, confirming that her rent calculation concerns with Park Merced have been resolved. 10

Amos Brown called meeting to order at 4:00pm Item 2: Motion: Item 3: Approval of Agenda Commissioner Dr. Veronica Hunnicutt moved to approve agenda Commissioner Safai seconded motion Vote: All approved Public Comments on items not on the agenda Commenter, Terry Bagby stated that there was an sent out suggesting that residents should not attend Commission Meetings to voice complaints. Mr. Bagby commented that he was not invited to go to mediation pertaining to his HUD complaint and that his building needs more maintenance, especially elevator maintenance. Commenter, Ramona Collie complimented Rev. Brown on his speech at Naomi Kelly s event. Commenter, Ruby Foots requested that her daughter s Section 8 Voucher be converted to Public Housing and, if so, can her daughter move to a first floor unit in Westside Courts near her? 23

24 Commenter, Suzanne Gamble requested assistance with her kitchen drawer, which does not slide properly. Further, Ms. Gamble questioned the timeliness to resolve work orders. Commenter, Paul Currier asked where the Heat Techs are. Mr. Currier further requested information pertaining to the tenant association including where the money is that was in their account and how the SFHA is investigating the theft of $16,000 from the last board? Commenter, Uzuri Pease, requested assistance with the sink in her unit because it is leaking. Ms. Pease requested more maintenance staff for housing. Ms. Pease acknowledged the work done to bring the lights back to working order in Potrero Terrace. Commenter, B. Lopez, of SEIU suggested a willingness to adapt to changes in the Authority but that with larger caseloads employees are unable to catch up with backlogged work. Commenter, Loreal Brown, resident at Robert B. Pitts, requested information on her transfer status because her daughter had been victimized and they had not yet been moved. Commenter, Monica Dagestino, resident at Potrero Annex, stated that less staff does not enable the rest of staff to walk the property endangering those in the property. Commenter, Diva, resident at Park Merced requested that SFHA purchase manuals for HCV participants at Park Merced regarding Tenants rights and address the large number of evictions at Park Merced. Commenter, Helani Ting, resident at Park Merced, stated that she continues to be overcharged for rent. Chairman Brown, requested a review of the Brown Act requirements. Item 4: Item 5: Secretary s Report A. Henry A. Alvarez III, Secretary, stated that any individual can communicate with the Board. The Secretary confirmed that Ms. Ting s concern is being resolved. The Secretary acknowledged receipt of two checks from the John Stewart Company for lease payments in the amount of $98,000 and $21,000. Tenant Representative Report 1. Citywide Council Senior Disabled (CCSD) Dorothy Raimey, President of CCSD, stated that her term in office ends January 31, Ms. Raimey requested a meeting between the staff and Tenant Association to 24

25 review the rules and By-laws. Ms. Raimey stated that she had received complaints from st because of lack of security. 2. Public Housing Tenants Association (PHTA) Joyce Armstrong, President of the PHTA, referenced the Resident Council presentation made at the last commission meeting and clarified that a previous meeting hosted by the PHTA, where an individual was not permitted admittance, was not a public meeting. Further, Ms. Armstrong requested quarterly meetings to begin with the Secretary. Item 6: Regular Business A. Consent Items Minutes o Minutes of regular Board meeting held on November 30, 2011 & January 12, 2012 Motion: Commissioner Hunnicutt moved to accept minutes Commissioner Safai seconded the motion Vote: All approved B. Action Items 1. [Informational Presentation on Public Housing and Housing Choice Voucher Waitlist process of the San Francisco Housing Authority.] Presented by: Nicole McCray Dickerson, Acting Director Ms. McCray-Dickerson presented to the Commission the number of people currently on the SFHA s waitlists, the waitlist process, and how individuals are taken off of the waitlist. Commissioner Saez asked why it takes over 80 applicants to get to one? Ms. Dickerson responded that the applicants can choose not to go to the available unit. Commissioner Saez asked if a Housing Choice Voucher can be used in the Conventional Public Housing program. The Secretary responded that a Housing Choice Voucher cannot be used in an ACC attached Public Housing unit. Commissioner Hunnicutt asked for the status on the Annual Plan Process. Linda Martin-Mason, Ombudsman, responded that the process will begin in March. Commissioner Schwartz asked if it would simplify the process by applying one set of preferences to both programs and, if so, would the SFHA recommend it? 25

26 Nicole McCray-Dickerson responded that it is recommended and would be helpful. Commissioner Schwartz asked if there is a standard process for pre-applications older than a particular amount of months. Commissioner Schwartz recommended annual status updates. The Secretary stated that an automatic online waitlist has been tested which would eliminate some of the paper work. The Secretary also asked the Board to entertain the idea of a site-based waitlist. Commissioner Schwartz stated that a site-based waitlist would be unfair to anyone with mobility issues. Commissioner Schwartz encouraged staff to find a way that allows potential residents to apply at any site to whichever site they desire. Public Comment Item 7: Commissioners Comments Commissioner Smith asked for the status of on-line rent payment. Commissioner Schwartz requested an update on the potential of revitalization of senior homes and Hope SF sites. Item 8: Closed Session None Item 9: Adjournment by consensus 18:15 26

The presentation will cover the following topics: I. The Brown Act California Government Code et seq. contains the provisions of the Ralph M. Brown Act ( Brown Act ). The Brown Act is an act of the California State Legislature that provides the following with respect to public comment: [Continued on Page 2] Attachments: None. 28 Brown Act and Time Limitation re Public Comment February 9, 2012 Page 2 Every agenda for regular meetings shall provide an opportunity for members of the public to directly address the legislative body on any item of interest to the public, before or during the legislative body's consideration of the item, that is within the subject matter jurisdiction of the legislative body, provided that no action shall be taken on any item not appearing on the agenda unless the action is otherwise authorized by subdivision (b) of Section However, the agenda need not provide an opportunity for members of the public to address the legislative body on any item that has already been considered by a committee, composed exclusively of members of the legislative body, at a public meeting wherein all interested members of the public were afforded the opportunity to address the committee on the item, before or during the committee's consideration of the item, unless the item has been substantially changed since the committee heard the item, as determined by the legislative body. Every notice for a special meeting shall provide an opportunity for members of the public to directly address the legislative body concerning any item that has been described in the notice for the meeting before or during consideration of that item. California Government Code (a) The following provision of the Brown Act discusses time regulations of public comment: The legislative body of a local agency may adopt reasonable regulations to ensure that the intent of subdivision (a) is carried out, including, but not limited to, regulations limiting the total amount of time allocated for public testimony on particular issues and for each individual speaker (emphasis added). California Government Code (b) Because the San Francisco Housing Authority Board of Commissioners ( SFHA Board of Commissioners ) is a legislative body in the State of California, the Brown Act governs the public meetings of the Board of Commissioners. Thus, pursuant to the Brown Act, the Board of Commissioners may adopt reasonable regulations limiting the time allocated for public comment at meetings. II. The Sunshine Ordinance The San Francisco Board of Supervisors enforces the San Francisco Sunshine Ordinance ( Sunshine Ordinance ), a local ordinance that requires City boards and commissions to adopt regulations. The Sunshine Ordinance provides the following under the Public Testimony section of the ordinance: A policy body may adopt reasonable regulations to ensure that the intent of [the public testimony requirements] are carried out, including, but not limited to, regulations limiting the total amount of time allocated for public testimony on 28

Each policy body shall adopt a rule providing that each person wishing to speak on an item before the body at a regular or special meeting shall be permitted to be heard once for up to three minutes. Time limits shall be applied uniformly to members of the public wishing to testify (emphasis added). San Francisco Administrative Code 67.15(c) The Sunshine Ordinance applies to all agencies and boards and commissions created by the City Charter or by Ordinance or Resolution passed by the San Francisco Board of Supervisors. According to the Sunshine Ordinance Task Force, it is a procedural question whether a member of the public is permitted to yield or give his/her time for public comment to another member of the public. According to the task force, it is a rare occurrence for the chair of a board/commission to allow a member of the public to yield his/her time to another member of the public. According to the task force, it is not recommended and unfavorable for a board/commission to allow this practice, because the practice would violate the ordinance provision that time limits be applied uniformly to members of the public wishing to participate in public comment. III. Practices of San Francisco City and County Boards and Commissions The SFHA Office of the General Counsel inquired with four (4) City and County entities, subject to both the Brown Act and the Sunshine Ordinance, about their procedures for time limitations of public comment. The four (4) entities include the San Francisco Board of Supervisors, the San Francisco Board of Education, the San Francisco Building Inspections Commission, and the San Francisco Fire Commission. According to board/commission staff for all four (4) entities, it is not the practice of the board/commission to allow a member of the public to yield or give his/her time to another member of the public. The SFHA Office of General Counsel also inquired with the San Francisco Municipal Transportation Agency (SFMTA) Board of Directors about the SFMTA s practices pursuant to the Brown Act and public comment. According to SFTMA Board staff, it is not the practice of the SFMTA Board to allow a member of the public to yield or give his/her time to another member of the public. IV. San Francisco Housing Authority Board of Commissioners Public Comment Procedures Resolution 4854, as amended December 9, 1999, are the Bylaws of the SFHA Board of Commissioners. Article III includes provisions for Meetings. Section VI of Article III lists the Order of Business for regular meetings. The Order of Business includes Item 9 for Public Comment on Items 29

30 Brown Act and Time Limitation re Public Comment February 9, 2012 Page 4 on the Agenda and Item 12 for Public Comment on Items Not on the Agenda. The Bylaws are silent as to time allocations for public comment. The SFHA Board of Commissioners Meeting Notice and Agenda provide for public comment procedures at SFHA Board of Commissioners meetings. Item 7 on the San Francisco Housing Authority Board of Commissioners Meeting Notice and Agenda provides the following: Requests for public comment may be heard on items not on the agenda as well as after staff presentation on any Regular Agenda Item. The language of the Brown Act is silent as to the exact amount of time a legislative body must allocate to each participant for public comment, giving the legislative body the discretion to allocate time so long as the time limitation is reasonable. The SFHA Board of Commissioners meeting procedures allocate two (2) to four (4) minutes, depending on the use of an interpreter, for public comment, which is a time allocation that is reasonable pursuant to the language of the Brown Act. Further, the Sunshine Ordinance explicitly states that each participant may comment once up to three minutes, requiring legislative bodies in the City and County of San Francisco subject to the Sunshine Ordinance to allocate a maximum of three minutes per participant in public comment. The SFHA Board of Commissioners meeting procedures allocating two (2) to four (4) minutes are reasonable in comparison to the practices of other legislative bodies in the City and County. In addition, because the Brown Act gives a legislative body the discretion to adopt reasonable regulations to ensure that the intent of public comment provisions are carried out, the SFHA Board of Commissioners meeting procedures giving the President or the Board the discretion to limit total testimony are permissible and appropriate. In sum, the President and the Board have the discretion to establish and impose time limitations on each participant of public comment at SFHA Board of Commissioners meetings. 30

31 AGENDA SAN FRANCISCO HOUSING AUTHORITY BOARD OF COMMISSIONERS Agenda Category: Agenda Title: Presented By: Report: Executive Office Reorganization of Public Housing Operations Roger Crawford, Special Assistant to the Executive Director. SUMMARY: As staff reported to the commission on September 22, 2011, the Department of Housing and Urban Development (HUD) reduced the Authority s subsidy payments by $5.145M. These reductions affected our Public Housing Program, among other departments, for fiscal year A consequence of this subsidy reduction is that the Authority was required to reduce staffing levels in public housing in order to maintain a balanced budget. A result of these staffing reductions is that work assignments and allocation of staff need to be reconsidered to maintain productivity and serve our residents. Therefore, management decided to separate its public housing operations into two divisions: Family Communities and Senior Communities. Each community will have its own director and management team. 32 Reorganization of Public Housing Operations February 3, 2012 Page 2 Staff believes that by spreading out the oversight of our public housing operations between two management teams, tenant concerns and issues can be addressed more quickly and efficiently. Also, each worker will have the resources and the capacity necessary to perform their respective duty and be able to better assist one another. As shown in the attachment, the Family Communities division will have a director (Florence Cheng is currently filling this role in an acting capacity) and two area managers. Each area manager will report to the director and be responsible for approximately 1350 units. The Senior Communities will be directed by Anthony Ihejeto. He will supervise two area managers. One area manager will be responsible for 1452 units, and the other will be responsible for 2530 units (1192 public housing units, and 1338 Hope VI units). Although the area manager of the Hope VI sites will have more units, Hope VI units require less management and oversight as they are controlled by outside management companies. With respect to each public housing development, management will address the staffing allocation and work assignments at each development by working with SEIU and listening to the workers to best determine how to divide the labor among the properties. These discussions will take place at the Joint Labor Management Committee scheduled for this month. 32
