1 August 8, 2016 The Board of Ellis County Commissioners met in regular session at 5:04 p.m., Monday, August 8, 2016, in the Commission Chambers, at the Administration Center, 718 Main Street, Hays, Kansas. The meeting opened with everyone standing and saying the Pledge of Allegiance. Commissioners present: Vice-Chair Barbara K. Wasinger and Commissioner Martha L. McClelland. Chair Dean F. Haselhorst was absent. It was noted that a quorum was present. Also present were County Counselor Bill Jeter, County Administrator Phillip Smith-Hanes, and County Clerk Donna J. Maskus. ORDER OF BUSINESS No changes were given to the Order of Business. APPROVAL OF PRIOR MINUTES No minutes were presented. CONSENT AGENDA To approve the Consent Agenda A-F, as presented, including the following: Voucher Claims Voucher Claims dated August 3, 2016 of $2,899, wire transfer to the Public Building Commission (PBC) account. Voucher Claims dated August 3, 2016 of $490,850 wire transfer for the GO Bond payment. A Voucher Claim dated August 4, 2016 of $218.20, reissued payments. Payroll Claims Payroll Claims for deductions dated August 5, 2016 for $155, Payroll Claim dated August 5, 2016 for $378, ISSUES FROM PERSONS NOT ON THE ORDER OF BUSINESS No comments were given from persons not on the Order of Business. CANVASS THE AUGUST 2, 2016 PRIMARY ELECTION To appoint Phil Smith-Hanes as a member of the 2016 Primary Election Canvass Board. Ellis County Commissioners Wasinger and McClelland along with Smith-Hanes served as the Canvass Board to review the August 2, 2016 Primary Election.

2 Chair Wasinger opened the Canvass of Votes for the August 2, 2016 Primary Election. County Election Officer Donna J. Maskus presented results from the August 2, 2016 Primary Election with a percent turnout of the 17,615 qualified voters. Per Kansas Statutes, the Precinct Committeeman and Precinct Committeewoman Offices must have at least five or more votes to be elected if no candidates had filed for this office. No write-in candidates had enough votes to be elected as Precinct Committeeman or Precinct Committeewoman Office. The Kansas Statutes states that the Township Treasurer and Trustee write-in candidates must have three or more write-in votes to be nominated to run in the November 8, 2016 General Election. One write-in candidate, Holly Rupp, received three write-in votes on the Herzog Township Democratic Ballot; therefore Rupp will be on the General Election ballot for this township office. Thirty-five provisional ballots were presented with four ballots that could not be opened due to not being registered, moved from another Kansas County and one that did not show their qualifying voter identification before the Canvass. Maskus stated that Ellis County did not have any voters that had registered to vote at a Kansas Driver License Agency or a Federal Voter Registration and had not shown their proof of U.S. Citizenship. The Kansas Secretary of State had given direction that these individuals would vote a Provisional Ballot, and the vote would be tabulated with all other Provisional Ballots. The Board of Canvassers had no questions and the County Clerk s Office will now process the Election Abstract of all votes from the 2016 Primary Election which will be presented to the Commission to sign at the August 15, 2016 meeting. The Canvass of votes from the August 2, 2016 Primary Election closed. COUNTY ATTORNEY FILLING POSITION County Attorney Tom Drees announced that one of his legal assistants resigned her position to take a job in the private sector. Drees asked to refill his legal assistant position since it is included in the 2016 and 2017 Budgets. Drees also asked for clarification for all County offices in what procedure does the Commission wish departments to follow when a resignation happens. Drees asked if they wish for the departments to discuss the resignations with County Administrator Smith-Hanes, or to meet with the Commission. Commissioners asked that County Administrator Smith-Hanes review current job positions if they become vacant, and if necessary to bring concerns to the Commission. KANSAS ASSOICATION OF COUNTIES (KAC) LEGISLATIVE REQUEST

3 Appraiser Lisa Ree discussed a legislative matter that she would like to see Kansas Association of counties (KAC) pursue in their legislative platform which will be discussed and decided during the KAC Convention in November. The tax lid bill has shortened the deadline day in processing oil and gas values for County Appraisers and requires values to be certified to the County Clerk by June 1 st. Appraiser Ree stated that she has 1500 leases to put taxable values on and several leases require extra time through the evaluation process; this leaves little time to hold and make informed decisions on oil and gas protest hearings before the June 1 st deadline. Appraiser Ree sees that this could mean that values could be overstated in the certification to the County Clerk because of the deadline timing. Appraiser Ree has visited with other County Appraisers and she has their support on this matter. Commissioners supported Appraiser Ree s concern with the tax process in being able to have sufficient time to work oil values during the tax process. Appraiser Ree will be sending this information to KAC for the legislative platform. APPOINTMENT OF EMERGENCY MANAGER Director of Fire Darin Myers addressed rescinding Resolution Number to consolidate the functions of the disaster agency with the County Fire Department. To rescind Resolution and approve Resolution to appoint Darin Myers as Director of Fire and Emergency Management. RESOLUTION RESOLUTION OF THE BOARD OF ELLIS COUNTY COMMISSIONERS WHEREAS, pursuant to K.S.A , Ellis County has the responsibility to establish and maintain a disaster agency responsible for emergency management and coordination of response to disasters, and WHEREAS, the Board of County Commissioners by Resolution No appointed Mr. William Ring as County Emergency, and WHEREAS, the Board of County Commissioners desires to consolidate the functions of the disaster agency with the County Fire Department, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF ELLIS COUNTY, KANSAS, as follows: 1. Resolution No is hereby rescinded; 2. Darin Myers, Director of Fire and Emergency Management, is designated to coordinate county planning for and response to disasters; 3. Mr. Myers may be contacted at 1105 E. 22 nd Street, Hays, KS 67601, via telephone at (785) , or via electronic mail at ecfd@ellisco.net. This resolution will take effect immediately upon publication in the official county newspaper.

Director of Fire and Emergency Management Myers discussed his goals for emergency management including finishing the emergency operations center and upgrades to the radio system. Myers will work to complete his training for Emergency Management. COUNTY COUNSELOR BILL JETER REPORT County Counselor Bill Jeter did not have anything to report on at this time. COUNTY ADMINISTRATOR REPORT County Administrator Smith-Hanes had no report. COUNTY COMMISSIONER REPORTS No Commission reports were given. EXECUTIVE SESSION To go into Executive Session for 15 minutes to discuss attorney-client matters with County Counselor Jeter, County Administrator Smith-Hanes, County Attorney Tom Drees and Commissioners. The Executive Session started at 5:42 p.m. At 5:57 p.m., the Open Meeting resumed with no action taken.
