The purpose is to remove and place fill material and site grade within the floodplain and regulated area in order to facilitate renovations of fairways, greens, bunkers, tee decks and cart paths associated with holes 4, 5 and 6. Also proposed is the construction of a new irrigation reservoir and water intake structure

2 TO: Chair and Members of the Executive Committee Item EX8.5 Meeting #5/09, July 10, 2009 FROM: Brian Denney, Chief Administrative Officer RE: ROUGE PARK ALLIANCE GOVERNANCE, ORGANIZATION AND FINANCE REVIEW Consultant Selection KEY ISSUE Award of contract for consulting services related to a governance, organization and finance review of the Rouge Park Alliance. RECOMMENDATION THAT the contract for consulting services related to a governance, organization and finance review of the Rouge Park Alliance be awarded to the consortium of StrategyCorp Inc./Hemson Consulting Ltd. at a total cost not to exceed $120,000, including applicable taxes. BACKGROUND At Rouge Park Alliance Meeting #5/08, the following resolution was approved: THAT the Rouge Park Alliance approve the outline for the governance and financial review discussed in this report, and request each of the Partners (Federal Government, Toronto and Region Conservation Authority, City of Toronto, Region of York, Town of Markham, Region of Durham, and Waterfront Regeneration Trust Corporation) included in the Steering Committee to appoint its member to the Committee. Terms of References (TOR) for the review were subsequently developed by the steering committee with the assistance of Mr. Robb Ogilvie. In 1988 the Government of Canada announced that it would provide $10 million for a wilderness reserve or heritage park to protect the Rouge River Valley System. In January 1990, the Honourable Pauline Browes introduced a private members bill in the House of Commons that the government should consider the advisability of entering into negotiations with the government of Ontario to establish a wilderness reserve or heritage park to protect the environmental uniqueness and importance of the Rouge River Valley System in Scarborough. Although the bill was passed unanimously, negotiations between the federal and provincial governments never took place. In June 1990, the Province of Ontario appointed a multi-stakeholder Rouge Park Advisory Committee to develop a recommended park plan. This committee carried out a four phase planning process that included extensive public, agency and interest group consultation and forwarded its recommendations to the Province in July In 1994, the Province of Ontario released a Rouge Park Management Plan. 157

3 In 1995, a number of key events occurred: the Honorable David Crombie of the Waterfront Regeneration Trust was asked by the Province of Ontario to recommend a management structure and funding framework for the park. the federal government deposited $10 million, for the Rouge Park, with the Waterfront Regeneration Trust because the Rouge Park was not a legal entity that could receive monies on its own. the Rouge Park Alliance was established by the Province as a voluntary, partnership organization to oversee the implementation of the Rouge Park Management Plan. The Rouge Park Alliance's mandate is to oversee and coordinate the implementation of the Rouge Park management plans and to be an advocate for the protection, enhancement and restoration of the Rouge watershed. The Rouge Park Alliance, in consultation with partners, is responsible for: preparing resource plans, strategic plans, organization plans and workplans; overseeing and coordinating the implementation of the plans; ensuring a solid financial plan; monitoring success, amending and updating plans; remaining a strong, informed and reasoned leader and advocate for the health, biodiversity and the integrity of the Rouge Park; and ensuring that an ecosystem perspective is maintained. The founders established the Alliance as a start-up mechanism to forge the partnerships during the tenuous initial years. It was never envisioned as the final organizational form or model. However, this start-up mechanism was never succeeded or replaced by a formal/legal entity. As a result, Toronto and Region Conservation Authority (TRCA) and other members voluntarily stepped in and helped the park operate under a wide variety of creative interim approaches. In 1997, the Rouge Park Alliance retained the services of the LURA Consulting Group to review and recommend a new organizational and financing model, however very little was done with the review. TRCA took some steps to provide administrative and real estate support but the funding issues were not resolved. In 2001, the Rouge Park Alliance released the Rouge North Management Plan. The development of the Rouge North Management Plan fulfilled the directions set out in the Rouge Park Management Plan (1994) and provided guidelines for the protection, enhancement and restoration of the Rouge Park and watershed. In 2004 and again in 2007 the Province of Ontario committed substantial areas of land to the park in Toronto and in Markham, including the lands to create Bob Hunter Memorial Park. In March 2008, the Town of Markham established the Rouge Park Implementation Task Force to undertake a review of its relationship with the Rouge Park. The November 2008 final report made a number of recommendations regarding boundaries, uses, protection, governance and funding. The latest recommendation was presented at the April 3, 2009 meeting of the Alliance and proposed the creation of a 16,000-hectare national park. 158

4 RATIONALE The park has continued to evolve and grow as additional lands have been added/acquired. At the same time, new communities are developing around the park. The challenge is to recommend ways to reconcile the addition of new lands and changing use/leisure patterns with the vision/goal and objectives of the Rouge Park. Funding commitments for both development and operation of the park need to be confirmed. As a result, a Request for Proposals (RFP) was developed and circulated on May 29, 2009 to the following 13 consulting firms: Barrett and Associates; Blackstone Partners; Deloitte & Touche LLP; Urban Strategies Inc.; KPMG; The Randolph Group; Berkeley Consulting Group; StrategyCorp Inc.; Hemson Consulting Ltd.; Mollenhauer Consulting; Oliver Wyman Delta Organization and Leadership; Consulting Matrix; Wood-Sloan Inc.. The RFP closed at TRCA Head Office at 4:00 p.m. on June 19, Proposals received from the following three firms were opened by TRCA staff (Brian Denney and Kathy Stranks) on June 22, Deloitte & Touche LLP; StrategyCorp Inc.; Oliver Wyman Delta Organization and Leadership; While the overall project management of the governance, organization and finance strategy will be the responsibility of the Rouge Park Alliance, a project steering committee has been established to oversee the project and work with the successful consultants. The project Steering Committee consists of the Rouge Park Alliance Chair, along with the following representatives from the following Alliance member organizations: Government of Canada; Province of Ontario; Waterfront Regeneration Trust; City of Toronto; Region of York; Region of Durham; Town of Markham; TRCA. The Steering Committee is supported by the General Manager and the other staff of the Rouge Park Alliance. 159

5 The Steering Committee received presentations from the 3 RFP respondents meeting the mandatory criteria on July 7, The steering committee assessed the proposals against the following criteria: Qualifications and Experience Quality of Proposal Project Management Financial Presentation/Interview Based on review of the proposals submitted and the July 7, 2009 presentation and interview, the steering committee was unanimous in recommending that the contract be awarded to StrategyCorp/Hemson, as they are the proponent best meeting the requirements of the RFP. FINANCIAL DETAILS The budget for the project is not to exceed $120,000, including GST. The complex nature of the undertaking combined with the large number of stakeholders in the Rouge Park, necessitated that the budget be fixed for the study. All consulting teams were advised of this amount. StrategyCorp/Hemson is able to complete the project deliverables within this budget limit. A detailed work plan will be formulated as part of the formal contract for consulting services. Funds are available from the following sources: $40,000 federal government; $40,000 provincial government; $40,000 Rouge Park Alliance. DETAILS OF WORK TO BE DONE The role of the steering committee will be to provide overall project direction to the consultants, act as liaison with the Alliance members and generally ensure that the project achieves the deliverables described in the RFP on time and on budget. The steering committee is supported by the General Manager and the other staff of the Rouge Park Alliance. The consultants are expected to work closely with the steering committee on five key deliverables: a set of feasible governance options, including the National Park option; funding strategy; management and organization structure to plan, operate and manage the park; reconciling the addition of new lands and changing use/leisure patterns with the vision/goal and objectives of the Rouge Park; developing and implementing an effective strategy for engaging the broader membership of the Alliance (and their sponsoring/host organizations) in the discussions of the first four deliverables listed above. 12 CITY OF TORONTO (ETOBICOKE YORK COMMUNITY COUNCIL AREA) EX10.72 LAMBTON GOLF AND COUNTRY CLUB To site grade and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Lot 6-8, 26-27, 27A, Plan 789, 2424, (100 Scarlett Road), in the City of Toronto (Etobicoke York Community Council Area), Humber River Watershed as located on the property owned by Lambton Golf and Country Club. The purpose is to remove and place fill material and site grade within the floodplain and regulated area in order to facilitate renovations of fairways, greens, bunkers, tee decks and cart paths associated with holes 4, 5 and 6. Also proposed is the construction of a new irrigation reservoir and water intake structure. The permit will be issued for the period of July 10, 2009 to July 9, 2011 in accordance with the following documents and plans which form part of this permit: Letter of Undertaking, prepared by Lambton Golf and Country Club, dated July 8, 2009, received July 8, RATIONALE The application was reviewed by staff on the basis of the following information: 167

13 Proposal: The Lambton Golf Club is proposing renovations to all of its 27 hole golf course. The works will commence in the summer of 2009 with the first phase including the construction of a new irrigation pond and water intake structure and renovations to holes 4, 5 and 6 which are adjacent to the Humber River. The second phase will involve renovations to the remaining holes on the course and the replacement of two existing bridges which span the concrete lined Black Creek. The bridge replacement work involves placing new concrete abutments beyond the existing channel and the placing of new bridge decks. The existing bridge decks and abutments will be removed. The second phase of the works is expected to occur towards the end of the 2009 summer season. Control of Flooding: A portion of the grading/cutting and filing works will take place in the flood plain portion of the property. TRCA has requested the applicant undertake floodplain analysis of the Humber River in order to assess the impacts of the proposed works upon the floodplain. TRCA staff are in agreement with the conclusions of the floodplain analysis which reveal that there will be no significant impacts to the upstream and downstream storage or conveyance of flood waters. Pollution: A silt fence will be secured around all construction areas to prevent the migration of construction generated sediment into the watercourse. Dynamic Beaches: Not applicable Erosion: There are no geotechnical issues with the proposed works. Conservation of Land: The proposed works will be executed well beyond the margin (top of bank) of the watercourse, thereby mitigating direct impacts on the existing river bank. All filled and disturbed areas will be stabilized and re-vegetated following construction. No significant resource features will be impacted by the proposed works. Plantings Approximately 500 trees will be removed over two phases to accommodate the golf course renovations. The City of Toronto, Urban Forestry Department have required the planting of replacement trees in the ratio of 3:1 to offset the immediate loss natural cover and to provide for an overall net gain in natural cover. New shrubs and ground cover is also required as part of the restoration plan for the site. Policy Guidelines: The proposal is consistent with Section (H) Existing Resource-Based Uses -of the Authorities Valley and Stream Corridor Management Program.
