Call to Order: President, Travis Longcore, called the meeting to order at 7:05 p.m. 2. Roll Call: Board Secretary, Robin Greenberg, called the roll with 17 present initially and a quorum met. Three other Board members came in within minutes, with 20 members present. 3. Pledge of Allegiance: CD-5 Councilmember, Paul Koretz, led the Pledge of Allegiance. 4. Adoption of the February 24, 2016 Agenda: The agenda was adopted by unanimous consent. 5. Approval of the January 27, 2015 Minutes: Copies of the January 27, 2015 Minutes (Attachment A) had been circulated with the draft agenda. Nickie Miner asked to include on page 9, that the letter from BCA was received after the Planning & Land Use meeting. The minutes were unanimously adopted as amended. 6. Public Comment Aaron Green from the Afria Consulting Group related that there is new information about Angelo View Drive, including 300 pages of new studies and responses to comments from the MND. 3 Board took position that the applicant do an EIR, which he promised to do. A hearing is scheduled for haul route and MND March 1 st 9:00 at the Department of Building & Safety for public comment. Gary Plotkin & Robert Schlesinger asked CM Koretz about Shawn Bayliss s suggestion that haul routes for the two Angelo View projects need to be planned as one project. Noah said it was incorrect. Reports of Officers 7. President s Report Travis Longcore: Travis announced that there will be Officer Elections next month, and he will not be a candidate for President. a. Representatives of Elected Officials and Agencies (Updates & Discussions) i. City Councilmember Paul Koretz, Council District 5: Paul Koretz related that Nickie Miner will be his choice for this year s Pioneer Woman of the Year because of her fine work at Benedict Canyon Association and in the community. He also commended Tony Tucci for his work on CLAW, Let s Buy a Mountain, and on banning rodenticides. He related some efforts of his office, including but not limited to the following: His office put the 6,000 cubic yards maximum into the ICO. They are looking to reduce this to 3,300 cubic yards. They have found contractors violating the requirements. They are tracking the amount of travel on virtually all haul routes and are asking for one truck at a time, before another moves in. An inspector goes daily to most major sites. One developer was found to be violating every requirement and is being prosecuted. They are looking the Public Records Act process. They are battling getting to the Ridgeline ordinance, of which he stated that he was told yearly, would be a million dollar process, but stated that he met with the new Planning Director to have it go forward this year. On short-term rentals, he noted difficulty catching landlords who are evicting tenants, some using the Ellis Act (to be vacant five years). Tenants have taken legal action. City Attorney has said they can t go after people unless a City Employee has witnessed the transaction. Paul Koretz related that he created the ACE program (Administrative Citation Enforcement) to make it easier to enforce against party houses. He would be happy to see airbnb eliminated but thinks that won t happen; people will be allowed to rent in their home while there; homeowners will be able to rent their house while on vacation. As to damaging infrastructure with development, he d support a proposal for developers to pay for the damage from trucks or he will help craft one. He described a signage & billboards scam with construction-site gray walling wrapped around properties to advertise movies and rock albums; allowing ground-level billboards with virtually no cost for permitting. Signage is becoming more valuable than businesses. Board questions and comments included but were not limited to: Dan Love applauded the Paul Koretz for work done. He asked about timing between ICO and permanent ordinance release. CM Koretz expects there will be plenty of time and if not, he will find a way to extend it. He said he has helped get Planning Dept. staffing for ICOs & HPOZs. Bob Schlesinger asked who has jurisdiction over the Department of Building & Safety. Paul Koretz replied the General Manager but the Mayor really has control. He can fire the General Manager. The City Attorney tells them what is legal. 3

4 Gary Plotkin asked if they could reinstitute meetings with department heads monthly. CM Koretz replied not on a regular basis but could try to set up another meeting. He has spoken with new Planning Director about meeting with a large area of neighborhood councils, which we can coordinate with him and Department of B&S. Mike Kemp thanked the CM and his staff for help with Planning & Land usage. As to the CM s motion on LLCs, he asked if we can have more transparency to know who owns some of the projects. CM Koretz replied that there are many hidden owners and bad actors and they are looking at not permitting those bad actors. Jamie Hall thanked CM Koretz for supporting Let s Buy a Mountain, He asked for status of the Wildlife Corridor Ordinance. Noah is working on getting it scheduled. Jamie stressed that this is a priority, and needs to be taken into account with every project. Nickie Miner related that the project at Angelo View will destroy wildlife. She asked about using Sunset to 405 for haul routes. Noah stated that they have had difficulty reaching the City of Beverly Hills. Bob Schlesinger and Nickie have found a route that does not touch Beverly Hills: Sunset to Carolwood to Brooklawn to Angelo View. Noah added that other than the haul route, this project is pretty much by right. He has not gone to the site. Matt Friedman asked about the City's RFP (Request for Proposals) to build a fiber community broadband network. Three vendors applied to build and run the City's network, and Matt wanted to know if the City will retain control over internet pricing and policies (such as data caps, usage based pricing, and net neutrality) so it does not become the nation's first Community Broadband to be controlled by a corporate interest, with the high prices and customer-unfriendly policies that generally come with corporate control of broadband. The Councilmember said he will look into this and speak to Bob Blumenfield. Don Loze thanked CM Koretz for raising the Ridgeline Ordinance issue and coming to BCA and discussing it again. He asked for more transparency. CM Koretz noted difficulty in the Planning Dept. He needs to speak with the new General Manager about getting community input. When getting to the budget process he will tell him we need to make it more. Travis Longcore commented as to short-term rentals, they are not consistent with the history of the City, and the Compact between the City and the residents that is implicit in the zoning of residential districts; hotels are limited to certain zones and not allowed in residential districts; they involve a turnover of people every two or three days. ii. Janet Turner, Field Rep. for Congressman Ted W. Lieu, CA 33 Update: WLA VA Draft Master Plan legislation will be heard tomorrow at the Congressional Veteran s Committee. The Purple Line was put on the Draft Master Plan and they ll have a parking lot for vets & community. They ll form a Community Veteran Engagement Board. UCLA signed their agreement with WLA VA; Brentwood School is in negotiation. Brentwood Village parking will likely stay. There ll be a 501c3 to train vets in entrepreneurial skills & in 5-10 years hope to put a building for a center for entrepreneurs. The soccer field is usable until needed for something else. There will be a proposal for the dog-park & the City of L.A. iii. Adam Miller or Catherine Landers, Deputies for Councilmember David Ryu, of CD-4 Adam Miller noted that the Bureau of Engineering is starting to work on the bulkhead of Laurel Canyon s Appian Way (following DWP pipe burst & street collapse). 4

5 Cathy Wayne asked Adam to speak to CM Ryu about the ground-level signage and about Waze, which is causing accidents. Adam noted that Council is looking at this problem. iv. Noah Muhlstein, Planning Deputy for Councilmember Paul Koretz, of CD-5 spoke during CM Koretz s presentation above. v. Chris Ragsdale, Senior Lead Officer, West Los Angeles Police Station -- Chris related that crime has leveled off especially for Benedict and Coldwater in the hillside areas. André Stojka noted an increase in burglaries in Bel Air Ridge, Bottlebrush area. Chris noted they assess crime on a 24-hour basis to determine use of limited resources. Surveillance cameras show what is going on, especially auto-related crimes/thefts, in the overnight hours & burglaries during the day or early evening. Complacency is our largest threat; we need to look at our homes & vehicles; consider use of wifi-based systems. Alarms do not elicit a priority response. Chris stated that he is working to resolve party houses. Currently, he has two with evictions, others owner-occupied. him or contact him for chronic situations. Vice President s Report Nickie Miner Nickie asked Robert Ringler, Past President of BABCNC, and C-PAB Co-Chair, to give a report on the C-PAB Summit. Robert explained that the Community-Police Advisory Board meets monthly. This year s summit was for the Operations West Bureau. Michael Downing, Assistant Chief on Counter-Terrorism, Special Operations Bureau, discussed terrorism and homeland security. Robert invited participation in C-PAB, by becoming a qualified member. Nickie would like it if the BABCNC could support refreshments for one of their monthly meetings and inquired about this. 9. Secretary s Report Robin Greenberg Robin reported that Board member, Jason Spradlin, is still out, recovering from his motorcycle accident and passed around a get-well card to send to him. 10. Treasurer s Report Dan Love a. Update from Treasurer Reports of Committees Consideration of December 2015 & January 2016 Monthly Expenditure Reports (MERs) and bank statements (Attachments B & C) (Discussion & Action) Moved by Dan Love; seconded by Larry Leisten. 6 a. Consider approval of the 2016 Election Outreach Plan. (Attachment D) Greenberg - Robin introduced the most recent outreach plan to be submitted to DONE. There will be a Meet & Greet in April, for which we will need to order food from AJU. - Robin handed out election mailers for distribution. She thanked Maureen Levinson and Larry Leisten for their work on the mailers, and thanks Maureen Smith, John Amato & Gary Plotkin for all of their work on this committee. Motion: To approve the 2016 Election Outreach Plan. (Attachment D) Moved by Jamie; seconded by Larry; vote was taken and the plan was unanimously approved. b. Consider approval of an increase in the Elections Budget of $2,500 (from $6,000 to some $8,500) (Attachment E) Moved by Dan Love; seconded by Larry Leisten. Discussion ensued. Motion to table until after other items on the agenda were completed. Moved by Jamie and seconded by Cathy. Vote was unanimous in favor of waiting. Motion: To approve an increase in the Elections Budget of $2,500 (from $6,000 to some $8,500) (Attachment E). Following discussion, a roll call vote was taken with 15 yeas, 2 nays, 2 abstentions, 0 ineligible, and 5 absences (president not voting except to break a tie), and the motion to approve a $2,500 increase passed. Additional Updates from Larry Leisten & Robin Greenberg, Committee Chairs - Larry gave update. Dan Love tried to register as a candidate and the City Clerk s candidate registration system was not functioning. Our website is up-dated as to elections. - Maureen Smith related that she worked hard on making use of Nation Builder but ran into problems with it; it s now on hold pending further word from Stephen Box at DONE. - Robin noted that we are in the final stages of design on banners and will put them in the same places we put them previously for outreach, (e.g., Sunset in Bel Air, Laurel Canyon & Mulholland). 13. Public Safety/Disaster Preparedness Committee Chuck Maginnis, Chair Absent a. Update from the Chair (There was no EP meeting in February.) 14. Planning & Land Use Committee Michael Kemp, Chair a. Update on February 9, 2016 PLUC Meeting (Update, Discussion & Action) Mike Kemp reminded people to feel free to attend the meetings Charter Oak Lane: ZA ZAD A new Single Family Dwelling on a sub-standard street. The BABCNC PLU Committee voted at its February meeting to rescind its original recommendation to support this project with conditions, and voted with 6 yeas, 1 nay, and 1 abstain to recommend the following motion: Motion: The BABCNC recommends to the Los Angeles City Planning Department that the case so noted, ZA (ZAD), located at Charter Oak Lane, due to its location on a sub-standard street, be denied. 6

7 Moved by Mike Kemp. Mike gave background, stating that they voted at the February meeting to rescind their original approval and then made a motion to deny, which passed. Public Comment: Mr. Vianney Boutry, Architect, re-introduced himself and his client, Mr. Stephane Lecam, to the Board. He gave a very brief update that he has met with the neighbors, has heard their concerns, and returned to the PLU meeting with a list of mitigations to these concerns. At the PLU meeting, he asked for a continuance, which was denied. He has returned today with more answers. Mr. Jeff Sie expressed opposition, stating it is on a dangerous narrow steep slope. Tom Demko expressed opposition. He lives across the street from construction. He referred to the street having a 30% incline; says he cannot see how trucks can carry dirt; thinks they will bottom out; doubts that they could make a turn or could do so without disrupting residents. Valerie Edwards is opposed to the project due to safety issues, noting a substandard street that is a footpath. She has witnessed cars losing control. Ira Moretzki is opposed; he referred to the prior denial 17 years ago for project across the street. Paul Boorstin expressed opposition. He has lived on Westwanda for 40 years; he feels that this is a life or death matter, mentioning an ambulance not able to get up to a house there. Jill Demko expressed opposition. She lives at top of Charter Oak, across the street from project. She stated if building were allowed to happen, they would be landlocked during construction. She asked where the trucks will go when building the road. She would lose rental income. Bradley Friedman opposes the project. He stated he represents 150 members on the petition and demands the City not approve permits to enable the project. He provided excerpts of the petition. Yoav Getzler a 50-year resident opposes the project; referred to prior ZA findings; says building on this paper street sets a bad precedent; doesn t want to hear construction, wants to hear the birds. Bettany Moretski filled out a speaker card opposing to the project but did not wish to speak. Board Questions: Larry Leisten asked about the available facts when first heard and subsequently. Michael Kemp responded when first heard at the PLU Committee, they felt the request was reasonable. They had a meeting at the site; there is a 28% gradient. The applicant brought a list of mitigating measures, including resurfacing the street. Nickie Miner responded it is a path and not workable in any way. Jamie Hall commented that it is important that we do not say it is the road alone for the denial. He did not feel that the applicant sufficiently mitigated traffic impacts. John Amato asked if this was a paper street, and the answer was it is a paved road to the last house, and a paper street to the lot. Mike Kemp noted that the applicant tried very hard to address the concerns; provided two pages of mitigations, and he is disappointed that the committee did not continue the item so that the architect could work with the neighbors. Don Loze noted the issue before us is a variance and opines that there are no findings for a variance, referencing fire code. Mr. Boutry replied that with regard to fire, the house will have no issue. They have offered to repave the road and change the slope at the beginning to help create easier access for trucks and ambulance, and provide a turnaround at the top of the road. Workers will be shuttled. 7

8 Cathy Wayne asked about trucks parking and cement trucks. Mr. Boutry is considering use of small pickup trucks to remove dirt, and, either making concrete on site or bringing it in a small pickup. Motion To Substitute: Jamie moved; 1 opposed (Mike Kemp); and the motion carried. Substitute Motion: To recommend that the City deny the project on the basis that there are significant unmitigated impacts associated with the development of the proposed project, which is located on the steep substandard hillside road. These unmitigated impacts include, but are not limited to, traffic, fire danger, and public safety. Moved by Jamie Hall. The BABCNC PLU Committee voted at its February 9, 2016 meeting, unanimously (7 yeas, 0 nays, 0 abstain) to recommend the following position: Motion: The BABCNC recommends to the Los Angeles City Planning Department that the case so noted, ZA (CUB) located at 2922 Beverly Glen Circle be approved with the following conditions: 1) That the seating of the restaurant not exceed 80 seats, and 2) That a farmer s market is not a part of this application. Moved by Michael Kemp. Michael explained the history: that the applicant came to the BABCNC in the fall of 2013 for a beer & wine license. It has now been brought to our attention that that license was never completed, and the Glen Center is now pursuing completing the license, the only change being that the final license will be for a full liquor license. Mike clarified that the final license will run with the property. c Franklin Avenue ZA ZAD: ZAD to permit the improvement of Franklin Way with a roadway of 12 in lieu of 20 required. The BABCNC PLU Committee voted at its February 9, 2016 meeting, unanimously (7 yeas, 0 nays, 0 abstain) to recommend the following position: Motion: The BABCNC recommends to the Los Angeles City Planning Department that the case so noted, ZA (ZAD), located at 8517 Franklin Avenue, approve the case with the following conditions: 1) That the applicant reach out to the surrounding neighbors for their input, and 2) Pending the position by CD-4 on the project. Ms. Kimberlina Whettan presented the project with mounted photos and projections. She related that they have received verbal support from immediate neighbors and written support from some, four letters of which she provided for the record. She was accompanied by Mr. Matt Dzurec, Land Use Attorney with Armbruster, Goldsmith & Delvac, LLC. Moved by Mike Kemp. Mike noted that this is an unusual project. Discussion was held. Vote was taken and was unanimous in support of the PLU Committee s motion. d Antelo Place: DIR DRB-SPP-MSP Remodel of an existing 10,945 s.f. SFD. Including an addition of 650 s.f. addition, 326 s.f. basement area, 1,180 s.f. detached garage, and 1,748 s.f. of covered porch and patio area. The BABCNC PLU Committee voted at its February 9, 2016 meeting, unanimously (7 yeas, 0 nays, 0 abstain) to recommend the following position: Motion: The BABCNC recommends to the Los Angeles City Planning Department s Mulholland Scenic Parkway Design Review Board that they approve the case, DIR DRB-SPP-MSP, as submitted. Moved by Mike Kemp (Ms. Kimberly Whetton, who was still present, and happened to have worked on this project, related that this was already approved). The Board voted unanimously to support. 8

Update on February 17, 2016 meeting with CD-5 and LADBS Mike Kemp A meeting was held at City Hall s CD-5 office, regarding a proposed new ordinance outlining additional regulations for haul routes and construction activity in the hillside areas. They are working on a new ordinance. 15. Ad Hoc Committee on Mansionization Gary Plotkin, Chair (Update, Discussion & Possible Action) a. Report by Ad hoc Committee on Mansionization Chair, Gary Plotkin -- No report b. Update on pending BHO & BMO Code Amendments Mike Kemp March 10, 2016: Public Hearing City Planning Commission on new BHO/BMO regulations. Reports of Representatives 16. Budget Representatives Report Nickie Miner & André Stojka a. Report from Budget Representatives (Update & Discussion) No report 17. DWP Committee Update Don Loze a. Report on DWP Rate Increases Don gave update, stating that they will accept the recommendation of DWP. There is no action item. 18. Department of Public Works Representative Dan Love a. Report (Update & Discussion) No report due to time constraints 19. West Los Angeles Regional Alliance of Councils (WRAC) - Greenberg (Update, Discussion & Action) a. Update on the February 17, 2016 WRAC Meeting, at which the following motions were recommended. b. City Authority Over Conditional Use Beverage (CUB) Permits for Alcohol (Full Motion Attachment F) & (Background Information Attachment G) Motion: Now, therefore, be it resolved, that the BABCNC calls upon the City Council to adopt a policy to: 1) Authorize the imposition of land use conditions that protect public health, safety and welfare by mitigating potential adverse impacts from the sale or service of alcohol, consistent with the practice of other jurisdictions statewide, as well as the City s decades-long practice prior to 2012; 2) Maintain and enforce previously-imposed CUB conditions on the sale or service of alcohol; and 3) Prohibit the removal of previously-imposed conditions outside the public processes mandated under the City Charter and Zoning Code. (BABCNC authorizes submission of a Request of Elected Officials letter or Community Impact Statement (CIS) to this effect if and whenever appropriate.) (Passed by Brentwood CC, Mar Vista CC, Westside NC, Westwood CC, Westwood NC.) Moved by Gary Plotkin; seconded by Nickie Miner. Motion passed by 17 yeas, 0 nays, 1 abstention by Mike Kemp. c. LADWP Ballot Measure (Gomes/LANCC) (Attachment H) Council File # Motion: WRAC supports the DWP Oversight Committee calls on the City Council to follow the recommendation in the IEA Survey to form a committee to examine governance reforms for the Department with the explicit task of reporting its findings and recommending a measure for the 2017 ballot. This Governance Committee should be involved in drafting any memorandums and other information from the beginning and include at least two members from the Neighborhood Councils who are familiar with the operations and finances of DWP. The DWP Oversight Committee recommends that there be a robust and transparent discussion and debate before any measure is placed on the ballot for voter approval or rejection. (BABCNC authorizes submission of 9

10 20. New Business: a Community Impact Statement to this effect if and whenever appropriate to Council File ). Moved by Gary Plotkin; seconded by André Stojka.
