TERRY OWEN, GENERAL ORDER NO. 187,32(REOPENED) IN THE MATTER OF Rules Governing E91 1 Fees, 150 C.S. R. Series 3 1, to provide further guidance regarding E9 1 1 fee requirements. GENERAL ORDER NO IN THE MATTER OF Rules Governing Emergency Telephone Service, 150 C.S.R. Series25, torevisethe rules relating to E911 fees for prepaid cellular service. On July 18, 2008, the Public Service Commission of West Virginia (Commission) entered an Order in the above-styled cases proposing the repeal of Series 31, Rules Governing E911 Fees. Those Rules had been promulgated by the Commission by Order entered on June 30,2006. Corresponding E91 1 fee rules had been in effect since March 6, 1998 for landline and wireless telecommunications services. See Rules and Regulations Governing Emergency Telephone Service, 150 C.S. R. Series 25. The Commission proposes repealing Series 31 and revising Series 25 to explicitly include prepaid wireless telecommunications service subscribers and providers. Those revisions have been proposed to facilitate the enactment of a general consumer sales tax for E9 1 1 fees for prepaid wireless (cellular) telephone service, which was imposed by the West Virginia Legislature through the enactment of statutory revisions during the 2008 Session. The Legal Division has reviewed the proposed repeal of Series 3 1 and the associated revision of Series 25 and finds them to administratively and concisely implement the recent legislation. The Utilities Division continues to review the rulemaking changes. While not filing initial comments, the right to file reply comments to the initial comments of other interested parties has been reserved. There appear to be no jurisdictional issues in this proceeding, The Staff anticipates that the Commission will retain jurisdiction in this proceeding because of its nature. Series 25 due to the Legislation enacted in Senate Bill 552, which as a result rendered 150 C.S.R. Series 31 invalid.
