1 File #TBOCT Page 1 of 6 The Town of Fenton Town Board held its regular meeting on Wednesday, October 3, 2018, at 7:00 PM, at the Fenton Town Hall, 44 Park Street, Port Crane, New York. PRESENT: Town Board Members David Hamlin, Supervisor Michael Husar, Councilman (arrived at 7:08 PM) Thomas Moss, Councilman Richard Pray, Councilman Highway Superintendent Randy Ritter Town Attorney Albert Millus, Jr. (arrived at 7:14 PM) Town Clerk Melodie Bowersox Deputy Town Clerk Sheryl Seymour ABSENT: Town Board Member Gary Holcomb, Deputy Supervisor OTHERS PRESENT: CAC Member Pam Klesse, Planning Board Member John Eldred, Town Historian Cheryl Mammano, ZBA Member Cindy Cook and approximately 26 Members of the General Public. Also present were Broome County Legislator Cindy O Brien and Arena/Forum Manager Chris Marion. Chris Marion led in the Pledge of Allegiance. Broome County Budget Summary Chris Marion represented County Executive Jason Garner with an overview of the Broome County Proposed Budget that was presented to the County Legislature. This year s Budget Address was held at the new Dick s Sporting Goods facility at the Corporate Park. Tax Reduction This is the first time in 14 years that the proposed Budget begins with a reduction in the Property Tax rate from the previous year. This would be a little less than ½%. Reserve Account The County has slowly been building up their Reserve Account in the event of any emergencies. There have been six emergencies since 2017 which included flooding, snow and a train derailment. Public Safety The County is looking to create a new position, Emergency Management Coordinator, to create Action Plans and train First Responders to deal with emergencies. The County is also looking at adding more Dispatchers and Assistant District Attorneys as well as personnel in the Sheriff s Office to help with centralized bookings. Small Communities Grant Fund This fund gives small Communities a chance to work together to apply for funds to enhance their Communities. The application goes through the County Legislature. Heroin Epidemic There is grant money in the Budget to help assist with battling the heroin epidemic. Workforce Development The Workforce Development Program works with the District Attorney s Office, Department of Social Services and the Chamber of Commerce to attract people inside and outside the Community to fill positions that are currently unfilled. Next Steps The County Legislature s Committees will review all the Department s Budgets before adopting the final Budget.

RESIDENTS TIME (7:17 PM) Depot Hill Road Venue Resident John Hussar expressed concerns regarding the Depot Hill Road venue, which included events in excess of the four the Town approved, the creation of a parking lot with signage and lights, use of pyrotechnics on one occasion, pedestrian and driver safety on the road, and hours of noise from a shooting range. Mr. Hamlin said he was aware numerous cars have been using his driveway to turn around. Atty. Millus said issues have come up recently and the Board is working on it. Lawn Mowing at 203 Ballyhack Road Resident Thomas Ralston addressed the Board on behalf of his neighbor Velma Casterlin, who received a summons for her lawn. Velma has two days left to take care of her lawn and Thomas asked for an extension as he has located someone to mow the lawn this week. Mr. Hamlin said that would be acceptable to the Board and Mr. Moss will notify Code Enforcement Officer John Broughton. Boy Scout Eagle Project Resident Ryan Spence, a member of Boy Scout Troop 199, approached the Board regarding a proposed Eagle Scout project. He would like to install an adaptive swing in either the Port Crane Park or the Hillcrest Park with protective matting underneath. He is looking into raising the funds and the regulations involved. An unidentified Resident asked why the lights were out at the Depot. Mr. Hamlin said someone shot out the transformer for the second time. It costs $3,000 to get it up and running each time. The Sheriff s Department is involved. 3 File #TBOCT Page 3 of 6 CDBG 34 $5, SUPERVISOR S REPORT The Tentative Budget has been filed with the Town Clerk s Office. The Final Budget will be presented to the Public on November 7 th. TOWN ATTORNEY S REPORT 1001 Chenango Street All the utilities are disconnected and it is ready to come down. Gorick Construction will be starting sometime between tomorrow and October 19 th Chenango Street The property went into foreclosure and a Realtor purchased it. Atty. Millus received a call from the purchaser and told the new owner what needed to be done regarding open citations. 14 Franklin Avenue There is a tarp on the back of the roof and John Broughton has sent them to Justice Court. The wife called Atty. Millus and told him they cannot afford to fix it and that it is in foreclosure. Outdoor Recreation This was discussed at the Work Session last week and is pending. Local Laws #4, #5 and #6 Atty. Millus distributed updated drafts of Local Law #4 (Special Use Permits), Local Law #5 (Restricted Commercial District), and Local Law #6 (to rezone the Carrier Services Group portion of the Depot Property to the new Restricted Commercial Zone). Introduction of Three Local Laws Mr. Moss made a motion to introduce the three Local Laws, seconded by Mr. Pray. Motion carried. ROLL CALL VOTE: Councilman Mr. Holcomb absent Councilman Mr. Husar aye Councilman Mr. Moss aye Councilman Mr. Pray aye Supervisor Mr. Hamlin aye Prior to the vote, Atty. Millus explained it is a technical requirement to introduce Local Laws prior to a Public Hearing being scheduled. Mr. Pray asked for clarification regarding the addition of Outdoor Entertainment Uses to the Special Use Permit. Atty. Millus said that would be part of the pending Outdoor Recreation Law. The Outdoor Recreation Law would state the Outdoor Recreation Uses would be subject to the Special Use Permit. Resident Jennifer O Hare asked why the Special Use Permit is now being discussed for Outdoor Recreation Uses when it was originally discussed at the various Board Meetings and the last Public Hearing that the Special Use Permit would be applicable to the proposed Restricted Commercial District only. Mr. Husar said that initially there was no intent to use the Special Use Permit for any other area other than Restricted Commercial District. However, a later consideration was that if there were parts of the Outdoor Recreation Law that would benefit from the Special Use Permit, it would be a prime tool for adding more protection. TOWN CLERK S REPORT
4 File #TBOCT Page 4 of 6 Monthly Report was read by Melodie Bowersox. Total Local Shares for September 2018 were $ 5, TOWN ENGINEER S REPORT Report was read by Mr. Husar. COMMITTEE REPORTS Building and Grounds Mr. Moss reported the following projects have been completed: Bryant has the wall mounted AC units in the Crime Lab that were not cooling now up and running. Pending projects: Sergeant Nichols and Mike Pipher are working on the vault door and the hardware replacement for the current doors in the Crime Lab. There is some leaking through some of the fan vents in the Crime Lab. Assistant Town Engineer Rick Armstrong took a look and believes it has something to do with condensation of the air conditioning units rather than a leak in the roof. Bryant is looking into this. The completion of the generator maintenance contract is anticipated by November. Discussions regarding updates to the Town Hall security system are pending. Mr. Moss has been trying to set up a meeting with NYSEG regarding the process for light replacement, etc., and has been unable to get a return call. Mr. Hamlin will provide another point of contact. There was a server issue at the Town Hall these last few days. The server is now up and running but needs to be replaced. A complaint was received last week regarding excessive weeds growing outside of the fencing near the tunnel on both ends. Mr. Moss was told by the Highway Department that the State changed the configuration of the fencing which has made it difficult for them to get behind the fence to keep it trimmed. However, they have trimmed it since receiving the complaint and will do their best to maintain it. John W. Danforth Consultant, a consulting firm that works with Municipalities on energy efficiencies, has reached out regarding the lighting upgrade project for the Town Hall and tunnel. Mr. Moss will be meeting with the CAC in November to give them an update on the project. Zoning Enforcement Report was read by Mr. Moss. Additionally, Mr. Moss will look into 310 Ballyhack Road. Water and Sewer Report was read by Mr. Pray. Dog Control Report was read by Mr. Pray. Building Inspector Report was read by Mr. Hamlin.
5 File #TBOCT Page 5 of 6 Highway and Solid Waste Highway Superintendent Randy Ritter reported solid waste pickup will continue for another month. Repairs continue from the storm damage. The drainage project in Port Crane is at the halfway point. Assessor There was no Assessor Report. Justice Court Report was read by Mr. Husar. Also noted was that there is still no Court Clerk. There have been two interviews with a third to be scheduled. Additionally, James Dadamio, Broome County Security Director, is proposing the County Security become involved in court security for Town and Village Courts. Towns and Villages can contract with County Security to be present during court proceedings. Historical Advisory Committee (HAC) Committee Chair Cheryl Mammano reported the Committee members visited the Whitney Point Shakespearian Club to give a talk on the CCC and the building of Chenango Valley State Park. The Committee is in the process of digitalizing all the office files. Conservation Advisory Committee (CAC) Committee Member Pam Klesse distributed a Notice of Intent (NOI) draft for the cutting of logs and timber for the Board to review which was put together by the Committee. On behalf of the CAC, Pam thanked Randy Ritter and his crew for doing such a good job on the Towpath Road. The vegetation can be cut in the late Fall. Mr. Pray made a motion to approve all Committee Reports as submitted, seconded by Mr. Husar. Motion carried. VOTE: Ayes 4 Hamlin, Husar, Moss, Pray Nays 0 Absent 1 Holcomb MINUTES Mr. Pray made a motion to approve the Minutes from the August 22 nd, 2018 Work Session and the September 5 th, 2018 Town Board Meeting, seconded by Mr. Husar. Motion carried. VOTE: Ayes 4 Hamlin, Husar, Moss, Pray Nays 0 Absent 1 Holcomb OLD BUSINESS Limited Commercial Zoning (Public Hearing 11/7) The Public Hearing for the Restricted Commercial District will be held at the regular Town Board Meeting on November 7 th. Outdoor Woodburning Furnances (OWBF) Mr. Husar said a Public Hearing would need to be scheduled regarding changes in penalty violations for OWBF. Currently, the first violation has a penalty of $25, the second violation a penalty of $50, and the third and subsequent violations a penalty of $100. Mr. Husar proposed a $100 penalty for the first violation, a minimum of $150 and a maximum of $250 for a second violation, and a minimum of $250 and a maximum of $500 for the third and subsequent violations. Mr.
6 File #TBOCT Page 6 of 6 Husar also proposed that the injunctive relief include specifically the shutdown or removal of the OWBF. Work on New Franklin Avenue Extension After doing some research on past correspondences and negotiations with the Railroad, Mr. Husar suggested the Railroad be contacted again to determine whether insurance issues can be resolved and an agreement be reached. Winter Parking Mr. Husar reminded the Board Winter Parking needs to be discussed. NEW BUSINESS Work Session for October is 10/24/18 Mr. Hamlin reminded everyone that the October Work Session is October 24 th. Flood Damage Report Randy Ritter is working on this. A design for the Monkey Run Road area is pending. It is hoped that we will receive FEMA reimbursement. Mr. Hamlin will contact Broome County Emergency Services Director Mike Ponticello to see whether we should still collect information on damages of private property.
