The remains of our falling hero s, we have talked about over the last two years. The date is Saturday 19 May 2012 The time is 9:am The place is the Long Island National Cemetery in Farmingdale I HAVE BEEN AWAY AND THERE IS NOTHING NEW TO REPORT AT THIS TIME. KEEP AFTER YOUR MEMBERSHIP RENEWALS AND BE SURE TO SEND IN YOUR DELEGATES LIST TO THE COUNTY ADJUTANT. SECOND DIVISION REPORT WITH ALL THE CAUCUSES BEING OVER WE CAN GET BACK TO PICKING UP THOSE MEMBERSHIP STRAGGLERS. IT CAN BE DONE... OTHER POSTS HAVE PROOVED IT. All we are asking at this time is to let us know if you will be attending with your post and will you be bringing your post colors? The funeral homes from both county s will be meeting at exit 49 of the long island expressway. They must leave there by 8:15 a.m. to be on time at the cemetery. For all who plan to go straight to the cemetery, please listen to the staff at the cemetery as parking is not the best. Completing this task will not come easy as things will change from time to time. When all is said and done all will be notified. Our main goal is to make sure that the Veterans who will be interred will be with the highest of honor. Next week the funeral homes will put the names of the decease veterans in the newspapers in hope that if there are any family members that may not know. All are hoping that all family will not be over looked. Soon as everything comes together every one will be notified If any one needs any info please call me. LET S PUT A LITTLE EFFORT INTO PICK- ING UP THE LAST OF THE RENEWALS. MANNY RODREGUEZ THIRD DIVISION REPORT The Third Division Caucus was held last evening, Thursday, April 26. Fred Neilson answered the call to step up and was nominated to assume the position of Third Division Commander for the Legion year. Congratulations Fred and THANK YOU. When some needs help the call has always been send in the Marines. Semper Fi Fred and I look forward to working with you. Also, Angelo Grande was nominated to assume the high and exalted position of County Adjutant for the Legion year. Congratulations and best wishes Angelo. All Post Commander are reminded that your Consolidated Post Report and Children & Youth Report are due in the adjutant s hand no late than May 15. The Charles A Fowler Post Annual POW/MIA Remembrance is THIS Sunday, 29 April during the 1000 Catholic Mass. The reservation only brunch will be held immediately following the mass at

2 the Firefighter s Benevolent Hall on Steamboat Road. There are a few seats still available. See Jim Barton or me after the caucus if you would like to attend. This year there will be a jewelry demonstration and sale mother s day, birthdays, graduations, weddings all are coming up. All Third Division Posts are AGAIN reminded that your list of delegates and alternate delegates for the County Convention are due to the Adjutant by the end of the month in order that your post may vote at the Convention. For God, Country and the American Legion Louise McCann, 3d Division Commander CHILDREN and YOUTH REPORT This year s Party for the children of SCO family of service of Sea Cliff, New York was held at St. Patrick R. C. Church on Saturday, April 21, This is a very special day for the children of SCO. All bus outings and all other programs were canceled, allowing us the opportunity to give a little joy and happiness to the Children of SCO. The menu was a hot buffet with plenty of food, ice cream, cake, and soda for dessert and a DJ for there dancing pleasure. There were about one hundred and twenty five people including staff Legionnaires and Auxiliary members. We thank Mary Sterger, County President and all members of the Auxiliary for supplying the Desserts. We also thank County Commander Andy Booth and all other Legionnaires and Auxiliary members for being there, the outstanding job that they did, contributed highly to the success of the program. All of the above could not have taken place without the support of the Posts and Units that contributed funds. Special thanks to Deacon Michael Devenney, (Parish Business Manager) for allowing us the use of the facility. At this time I would like to this opportunity to thank the Posts that contributed funds during the month of April and they are: Glen Cove Post 76, Glenwood Landing Post 336, Nassau Police Post 1050, and Floral Park 334. I Thank You I also have about seven checks, made out to, the Children & Youth Committee or to that Guy by the name of Willibe Wilson. Now if I didn t call your Post, name, please see me after the meeting. Consolidated Post Reporting It is now time to fill out the Consolidated Post Report. I m asking all Post Commanders and Post Children &Youth Chairmen to take the lead and see that their Post is COUNTED FOR! Respectfully Submitted Fred Nielsen and Willibe Wilson, Jr. Children and Youth Co- Chairmen Law & Order April was a busy month. I finished up with the Law and Order programs at Charles Wagner Post 421 on April 20, I attended another program on April 22, 2012 which was at the Merrick Post 1282 and I closed out the month on April 23, 2012 at the Howard A. Van Wagner Post 962. All the programs went very well and they were well attended. All the Posts ran a great program and in following an American Legion tradition. I would like to thank these Posts for their kind invitations. One of the awards went to several Police Officers and Fireman for their outstanding performance which started out as a normal auto accident. A pickup truck struck a pole. As Fire Fighters arrived to give aid, the first Fireman was shot. The other Fire Fighters used the ambulance to protect him while giving him aid. As Police responded unaware of what was developing, shots again rang out. This could have gone horribly wrong, but with their professional training, the Police were able to apprehend the subject. This is only one of the many stories on what our Police Officers, Fire Fighters and A.M.T.s, come in contact with. I strongly feel we should be doing more of these programs to, honor those men and women out there protecting our families. PCC I Shipped 17 boxes to the troops this month and I have two ready to ship but I need to get the correct APO/FPO address as the one I was given was no good. If you have items to donate, bring them to the County meeting, call me for pick up if you have large amount or drop them off at Ken Cadieux s house.

PROTOCOL COMMITTEE REGINALD BUTT The Protocol Committee was contacted by the Chairwoman of the Convention Committee to check on list of guests to the Installation Dinner. She was supplied with a list that was in the order of priority. She has the option of deleting any guests but must follow the priority listing. No other requests have been received. LEGISLATIVE REPORT REGINALD BUTT 1. I received the following News Release: Mojave Cross Settlement Laued by Legion (April 25, 2012) - A federal district court decision that ended a decade of legal battles over a cross that served as a World War I veterans memorial in the Mojave Desert was praised today by the leader of he nation s largest veterans organization. We are delighted that the court approved a land exchange that will finally enable the Mojave Cross to be restored as the monument to World War I veterans that was first erected on Sunrise Rock in 1934 by a World War I veteran, Riley Bembry, said Fang A. Wong, National Commander of the 2.4 million member American Legion. A federal judge approved the lawsuit settlement Monday, permitting the U.s. Park Service to turn over a remote hilltop area known as Sunrise Rock to a Veteran of Foreign Wars post in Barstow, Calif, and a nearby Veterans home. The park service will give up the acre of land in exchange for five acres of donated property elsewhere in he 1.6 million-acre preserve in Southern California. The American Legion was involved from the beginning, filing friend-of-the-court briefs in support of the memorial, up to and including an appeal to the U.S. Supreme Court on April The Court refused to order removal of the cross and directed a federal judge to look again at the congressional transfer plan. Once the land exchange is complete, the park service will fence the site, leaving entrances for visitors, and post signs noting that it is private land. A plague will be placed on the rock noting that it is a memorial to U.S. War Veterans. We will continue to monitor he progress of this settlement closely until the land exchange anbd the Moja\ve Cross, which was stolen by vandals during litigation, is replaced, as a fitting tribute to our World War 1 Comrades, Wang said. 2. Update on the Flag Amendment Bills: Senate Joint Resolution (S.J. Res) 19 as a total of 29 cosponsors. To date H.J.Res 13 the house companion to the Senate measure as accumulated 64 cosponsors. Contact your representatives and senators offices and ask them to cosponsor the flag amendment in their respective chambers. If they are already cosponsors, be sure to thank them for their support.

4 HOMELAND SECURITY REGINALD BUTT, JR. PCC Each day in read in the papers or hear on the different news media about terrorist acts. Most of these are home grown terrorists, which means we have to be alert and be observant. The Department of Homeland Security is telling everyone to be on the alert as the first anniversary of the captured and killing of Osama Ben Laden is this coming month. If you see something that looks out of place or individuals acting suspicious, report it. Remember, Terrorism has many formal definitions. In most it involves illegal activity, including use of force or violence directed against the civilian population. It is intended to coerce or intimidate a government or civilian populations or noncombatants in furtherance of terrorist political/social objectives. Terrorism can be domestic, international, state-sponsored or loosely affiliated. The bottom line is ALWAYS BE ALERT AND IF YOU SEE SOMETHING, SAY SOMETHING. BOYS STATE PROGRAM REGINALD BUTT, JR. PCC The Boys State applications are slow coming in, so far 22 have been returned with two missing pages. I have 44 boys lined up but that may change. All the applications are due to me by 30 April. I was up to 49 boys but we had a few drop out, it is possible one or two more will also drop out. State runs from Sunday 24 June thru Friday 29 June. There will be an orientation on 6 June 2012 at the Williston Post #144 in Williston Park. I thank all the posts who have sponsored boys for this worthwhile program. The bus will leave Williston Post on Sunday 24 June at 6 A.M., I will start logging in the boys at 5 A.M. NATIONAL COMMNDER FANG WONG THANKS ALL WHO ATTENDED HIS DINNER AT ANTUN S. NASSAU COUNTY HAD SIXTEEN TABLES AT THIS AFFAIR AND WAS WELL REPRESENTED. THANKS TO THREE MEM- BERS OF THE COMMITTEE WHO WORKED HARD: ANGELO GRANDE, JOE REALE AND JOHN HASSETT - GREAT JOB BY ALL THREE. Our County Program will enhance and build on the Post Level and be the basis for the County Level Recognition Program during the annual County Convention in June You must be a past or present Post Level Honoree to be nominated for the County Level Honor. Each Post Commander was asked to appoint a LOTY chairperson to write up their Post selected Honoree so they can be nominated (one per Post) for the County Level Program. With 54 Posts in Nassau County we will be able to elevate this important program to the level it needs to be. This year only 14 Posts had candidates in it. Legionnaire of the Year (LOTY) Joseph P. Slattery, Jr., PCC, Chairman docjoepc@yahoo.com This Recognition Program is a fitting way to honor and recognize our dedicated Legionnaires who work tirelessly and many behind the scenes to keep our Posts and County programs together. They work with our Veterans, Communities and Programs. The County Level Honoree will go onto the District Level Program. The judges this year were asked to judge the 14 that were submitted. They went over each one and were able to make a selection. The selected Nassau County Legionnaire of the Year will be announced on Saturday of our County Convention in June. All past Post and County Legionnaire of the Year Honorees are asked to attend and be recognized before the public announcement of this years Honoree. Start the new Legion year 2013 off by collecting and writing up your Post members contributions so your Post can make a selection during the month of JANUARY The deadline for our County Program is March 1st

5 NASSAU COUNTY AMERICAN LEGION DEPARTMENT OF NEW YORK OFFICIAL CONVENTION CALL Pursuant to the Constitution and By-Laws, I, Andy Booth, Commander of the Nassau County American Legion, Department of New York, do hereby call the 94th Annual Convention of Nassau County to be held in Hicksville, New York, Town of Oyster Bay, at the Levittown Hall, Levittown Parkway, Hicksville, NY 11801, Telephone , commencing Friday, June 1st, 2012 at 8:00 P.M., and ending on Saturday, June 3rd, The Installation Ball to be held at the Edwin Welch, Jr Post in Seaford, N.Y. on Sunday Afternoon, June 4th, 2011 commencing at 1 PM. 1. To elect Officers for the Nassau County Organization for the ensuing year, a Commander, three Vice Commanders of equal rank, an Adjutant, Treasurer and a Membership Officer. 2. To elect Delegates and Alternates to the Convention of the Department of New York, to be held in Rochester, New York, on July 18th, 19th, 20th and 21, 2012 (Wednesday through Saturday inclusive). 3. Nassau County is entitled to four (4) Delegates and Alternates at large and one Delegate and Alternate for each 250 paid-up membership prior to thirty days before the date of said Department Convention. 4; The remaining Delegates and Alternates to which the County is entitled to according to its membership as provided in the Department Constitution and By-Laws shall be elected at the County Convention after nominations by the Divisions at their respective Caucuses held for that purpose at the County Convention. 5. Each Division shall be entitled to a proportionate number of Delegates and Alternates in the same proportion as that Division has contributed to the total membership of the County, such proportions to be divided by the Chairman of the Committee on Credentials. 6. To transact such other business as may come before the Delegates and Alternates assembled and to consider such matters as the County may desire to bring before the Department Convention. 7. Post representation to the County Convention shall be on the basis of one Delegate and one Alternate for the first fifteen members and one additional Delegate and Alternate for each twenty five members or major portion thereof, paid up at the time of the report of the Credentials Committee at the County Convention, and all Past County Commanders and Past State and National elective officers present and in good standing as a member of a Post in Nassau County. 8. Delegates and Alternates to the County Convention shall be elected at a meeting duly called by the Post at least ten (10) days prior to said Convention and each Delegate and Alternate shall be supplied with credentials by the Commander or Vice Commander and Adjutant of their respective Post. No Delegate or Alternate shall be seated without presentation of proper credentials. 9. In order to execute the Unit Rule, fifty percent or better of the Post Delegation must be present at Roll Call. Further, the intent to exercise this privilege must be submitted in writing to the County Adjutant prior to the opening of the Convention, such letter to be over the signature of the Post Commander or Adjutant. 6 The rules of the convention are as follows: THE RULES OF THE CONVENTION 1) With the following modifications, Robert Rules of Order, revised, will be followed and shall govern this Convention in all cases wherein they are applicable and in which they are not inconsistent with the Constitution and ByLaws of The American Legion or special rules of order of this Convention. 2) Only duly accredited Delegates or Alternates shall be given the privilege of the floor during this order of business of this Convention 3) The official reports of the Posts to the Credentials Committee of the names of Delegates and Alternates to Convention shall be binding upon this convention and the names as reported shall be recognized as the official Delegates and Alternates to the Convention. 4) Alternates shall have all the privileges of Delegates, including that of serving on committees, except the privilege of voting on the Convention floor. 5) A Delegate desiring to obtain the floor or make a motion or address the convention shall rise, address the Presiding Officer as Mr. Commander, and give their name and the name of his or her Post before proceeding with his or her subject. 6) The floor shall be permitted but once to an individual Delegate on the same question; also once on an appeal. 7) The decision of the Presiding Officer as to who is entitled to the floor in any instance shall be final and there shall be no appeal from that decision. 8) The decision of the Presiding Officer in ruling any motion out of order shall be final, but an appeal may be made and brought to a vote. 9) Debate shall be limited to 5 minutes for each speaker. No Delegate shall speak for more than 5 minutes on the same question, without the consent of the Convention by two-thirds vote except nominating speeches for County Officers. 10) Debate on any one subject presented to the Convention shall be limited to forty-five (45) minutes except under special rules as the Convention may adopt prior to debate, by two-thirds vote. 11) Voting shall be by acclamation, that is to say a voice vote, except where a roll call is demanded by the chairman of at least three Posts. Election of County Officers shall be by roll call. 12) Nominations shall be made upon a roll call of Posts. A Post may nominate, pass, yield to another Post or second a nomination. The roll call shall be according to divisions beginning with the First Division, then the Second Division, and then the Third Division. In each division Posts are to be called in alphabetical order except that by unanimousconsent that this rule may be abrogated to save time. Nominating speeches are limited to seven minutes, seconding speeches to three minutes. Not more than two seconding speeches shall be made for any candidate. 13) Whenever a ballot by Posts is taken, the vote of each Post shall be equal to the total number of Delegates to which the Post is entitled, as shown by the report of the Credentials Committee, provided that a majority of the Delegates of the Post are present, and vote unanimously. In the event of a divided vote of a Post delegation, or when less than a majority of a Post delegation is present, only the votes of those present and voting shall be counted. 14) Past County Commanders Past State and National elective Officers entitled to vote shall only vote after the roll call of Posts has been completed. 15) The Commander of every Post, the delegation of which has been duly instructed by such Post to vote the Unit Rule at this Convention, shall so verify in writing to the County Adjutant, otherwise, a vote by Unit Rule by the delegation from any Post need not be recognized, where a dispute arises among the delegates of such Posts on any question at this Convention. A Post may vote its entire strength under the Unit Rule, unless there are less than 50 % of the delegates present at the time of voting, in which event only those present and voting shall be counted. 16) Upon any vote taken under a roll call of Posts, the chairman and members of the delegation shall rise, and the chairman shall announce the number of votes his or her Post casts, either in the affirmative or negative, or in favor of a candidate, as the situation requires. If voting under the Unit Rule, the chairman shall so state. 17) A candidate for office shall be deemed elected, if he or she received a majority of the votes cast. In the event no candidate receives a majority, a second vote shall be taken. In the further event that no candidate received a majority after the second vote, all candidates other than the two (2) receiving the highest number of votes on the second ballot shall withdraw, and balloting shall continue. 18) All proposed resolutions shall first be submitted in writing to the Resolutions Committee and no action shall be taken by this Convention upon such proposed resolutions, without a report of the Chairman of the Resolutions Committee upon the resolutions, but the Presiding Officer of the Convention, if he or she feels the occasion or courtesy demands it, may otherwise permit the submission of such resolutions to the Convention. The election of County Officers will take place on Saturday morning June 2, The installation Dinner will be held at the Massapequa Post on Sunday Afternoon from 3:30 to 7:30 PM. Memorial Garden in L. I. National Cemetery gets make over by Plainview Cub Scout Pack 423 as Earth Day Project, 2012 As an Earth Day Service Project for our Veterans, Plainview Cub Scout Pack 423, Chartered to Plainview American Legion Post 1812, did a complete make over of the Memorial Garden by the pulling of weeds, planting of new shrubs, the planting of flowers in the entrance pots, the edging of all of the planting beds, the removal of the stones, the picking up of the fallen leaves, the cleaning up of the small memorial monument in front of the garden and the spreading of the new black mulch. The Memorial Garden was designed by Master Gardner Cheryl Anne Lombardi and built in 2005 with funds donated to the Veterans, at no cost to the Government.. Roseann Santore, LIN Cemetery Director thanked and commended the Cub Scouts, parents and leaders for taking on the Earth Day Project for our Veterans. She presented each one with a beautiful Certificate for their service and hard work. The heavy rains that were predicted held off long enough for the Scouts to complete the project. The garden is now ready for our Unclaimed Remains Service on May 19th and Memorial Day Service on May 27th.
