5 So What is the Problem? The problem is that regardless of whether a state legalizes, decriminalizes, or in some manner tries to legitimize cannabis activity, it remains a prohibited Schedule I narcotic under federal law. Therefore, in the eyes of federal law, virtually ALL state sanctioned cannabis activity is still a crime. In the eyes of federal law the $$ related to state sanctioned cannabis activity is still the proceeds of criminal activity. Therefore banking it is money laundering.. Schedule I Controlled Substances ü Substances in this schedule have no currently accepted medical use in the United States, a lack of accepted safety for use under medical supervision, and a high potential for abuse. 14 Ø As of March 2017, 368 FIs report banking marijuana related businesses (MRBs) Ø 62 of them credit unions Ø 585 different banks/cus have at some point served MRBs (meaning 274 have dropped out at some point) q "If a credit union decides to serve a marijuana business, that's a business decision for that credit union. 19 FinCEN s February 14, 2014 Guidance Bringing the proceeds of state licensed cannabis business into the mainstream financial system allows for monitoring and reduces chances for diversion Its still Schedule I under Federal Law! The obligation to file a SAR is unaffected by state law that legalizes marijuana activity. A FI institution is required to file a SAR if, consistent with FinCEN regulations, the FI knows, suspects, or has reason to suspect that a transaction conducted or attempted by, at, or through the financial institution: (i) involves funds derived from illegal activity or is an attempt to disguise funds derived from illegal activity; (ii) is designed to evade regulations promulgated under the BSA, or (iii) lacks a business or apparent lawful

21 FinCEN Guidance Footnote # 7 q There is a debate as to the meaning and the reach of FN # 7: For some, FN #7 is a greenlight for any ancillary business to be banked w/o worry. For others, FN #7 is a warning that FIs must treat at least some ancillary businesses as high risk and perhaps even as high a risk as the marijuana related business itself. ü ü ü ü Landlord Armored car company FI that is banking an MRB Local market? FinCEN recognizes that a financial institution filing a SAR on a marijuana-related business may not always be wellpositioned to determine whether the business implicates one of the Cole Memo priorities or violates state law, and thus which terms would be most appropriate to include (i.e., Marijuana Limited or Marijuana Priority ). For example, a financial institution could be providing services to another domestic financial institution that, in turn, provides financial services to a marijuana-related business. Similarly, a financial institution could be providing services to a non-financial customer that provides goods or services to a marijuanarelated business (e.g., a commercial landlord that leases property to a marijuana-related business). In such circumstances where services are being provided indirectly, the financial institution may file SARs based on existing regulations and guidance without distinguishing between Marijuana Limited and Marijuana Priority. Whether the financial institution decides to provide indirect services to a marijuana-related business is a risk-based decision that depends on a number of factors specific to that institution and the relevant circumstances. In making this decision, the institution should consider the Cole Memo priorities, to the extent applicable.
