1 Terms of Reference for Core Team members of the EU EOM to the Republic of Nigeria Elections 2015 The present terms of reference offer selection criteria for the Core Team of the European Union Election Observation Mission to the Republic of Nigeria. In addition to the Chief Observer, the Core Team is composed of 9 experts whose individual terms-of-reference are outlined below. Preliminary remarks 1. European Union Election Observation Missions (EU EOMs) are independent in their findings and conclusions, but must, at all times, adhere to the standard EU methodology for election observation in both, political/electoral and implementation/security matters, as outlined in the Handbook for European Union Election Observation. 1 EU EOMs must follow standard guidelines, models and practices as specified by the European Commission. All mission members must follow the EU Code of Conduct for election observation, as well as adhere to the UN Declaration of Principles for International Election Observation and Code of Conduct for International Election Observers The Core Team is an essential component of EU EOMs. The respective roles and responsibilities of all retained experts is a key element of a successful mission. All members of the Core Team must be experienced in election observation or related activities, fluent in the working languages of the mission, and be able to work cooperatively in a team. Experience and training within EU missions and initiatives will be considered an asset. 3. Please note that due to the evolving context of elections, the following Terms of Reference offer a general overview of the requested job profiles that is potentially subject to changes. The final version including the detailed description of the final profiles and responsibilities of each analyst/expert will be provided in the contract. 4. All Core Team members are required to participate in EU EOM briefings and debriefings organised by the Commission. These activities are an integral part of the mission. (1) CHIEF OBSERVER (CO) The CO has the overall responsibility for the EU EOM. S/he is commissioned directly by the EEAS and the European Commission. The CO s duties, tasks and responsibilities are detailed in the annex attached to her/his contract. (2) DEPUTY CHIEF OBSERVER (DCO) 1 n_observation_handbook_en.pdf 2

2 The DCO acts as the principal political and technical advisor to the CO. Under the authority of the CO, the DCO has management responsibility for the political, analytical and methodological aspects of the EU EOM. Under direction of the CO, the DCO is co-responsible for the management of operational and security aspects of the EU EOM, in coordination with the Agency or Service Provider selected for mission implementation. The DCO is also responsible for the co-ordination of all mission member activities, including vis-à-vis staff made available by the Service Provider. Under the authority of the CO, the DCO is responsible for the coordination and editing of final reports to be submitted to Commission services according to the schedule agreed between CO, DCO and relevant EEAS and European Commission services. For the return visit, the DCO will be present in the country for additional 5 days (including traveling time) after the closure of the EOM. S/he will provide EEAS and European Commission services with a mission report on the return visit and roundtable. The DCO will keep the CO and relevant European Commission services regularly informed about all aspects of the mission. S/he will: Manage political and methodological tasks: 1. Ensure that the EU EOM adheres to the EU methodology for election observation, as outlined in the Handbook for European Union Election Observation and accompanying guidelines, as well as to the Declaration of Principles for International Election Observation and Code of Conduct for International Election Observers, commemorated at the United Nations in October In particular, the DCO ensures that the EOM assesses the conduct of the election process in accordance with Nigeria international obligations and commitments for democratic elections. 2. Ensure that the EU EOM adheres to the Memorandum(a) of Understanding or exchange of letters signed by the European Commission with the host state and electoral authorities. 3. Understand the electoral framework and oversee identification of the main electoral and political issues. 4. Ensure inclusion of EOM-relevant political analysis in EU EOM reports. 5. Ensure gender mainstreaming and/or the inclusion of a gender-sensitive, social and cultural analysis in EU EOM reports. 6. Maintain regular co-ordination and communication with domestic and international organisations involved in observing/monitoring the electoral process. 7. Meet regularly with election administration, political party leaders, political contestants, international organisations, government departments, other relevant state institutions and NGOs as well as with EU Member States and the EU Delegation. 8. Co-ordinate the preparation of the EU EOM preliminary statement, based on the standard format/template provided by the COM services, which should be approved by the CO. The EEAS and European Commission must be given an opportunity, in

3 sufficient time (usually 48 hours), to provide comments on the preliminary statement, which should be considered carefully before it is finalised. Final approval lies with the CO. 9. Inform European Commission services on important developments in between reporting cycles. 10. Co-ordinate the preparation of interim reports on the election process and EU EOM activities, based on contributions from the Core Team, using the standard format/template provided by the European Commission services. The EEAS and European Commission services must be given an opportunity, in sufficient time (usually 48 hours), to provide comment on these reports, which should be considered carefully before they are finalised. Final approval lies with the CO. 11. Co-ordinate, draft and edit the EU EOM final report, based on the standard format/template provided by European Commission services. The DCO is responsible for the collection of all CT member contributions and shall provide Commission services with a harmonised and coherent document as final draft, upon pre-agreed deadlines. Particular attention will be paid to follow-up recommendations drafted by the EOM, according to the template provide by Commission services. The EEAS and European Commission services must be given an opportunity (over at least a two week period) to provide comment on the draft final report, which should be considered carefully before it is finalised. Final approval lies with the CO. The date for final report delivery should be agreed during the debriefing of the Mission and should, where possible, be within two months of Core Team departure from the country of observation. 12. Ensure reliability and quality of the translation of the final report into other working languages of the mission. 13. Ensure that all reporting is of highest possible standards, both in terms of content and language, and findings are based on direct observation by EU EOM Core Team members and observers. 14. Maintain highest mission visibility and image; liaise with Commission services in order to deliver highest quality. Manage operational tasks: 1. In the absence of the CO, assume position of Acting CO and lead daily EU EOM activities. 2. Ensure high visibility of the mission, together with members of the core team. 3. Oversee the work of all core team members, in particular: - organise effective coordination and regular team meetings among Core Team members; - oversee preparation and conduct of briefing and training sessions for observers; - ensure that observers are briefed on the EU, the EU foreign policy and in

4 particular, on election support instruments and the European Instrument for Democracy and Human Rights (EIDHR); - oversee preparation of briefing materials and report forms for observers ensuring that observers are briefed on the EU, the EU foreign policy and in particular election support instruments and the European Instrument for Democracy and Human Rights (EIDHR); - oversee the preparation of the deployment plan prepared by the Observer Coordinator(s) and subsequent deployment of observers; ensure that the deployment plan be communicated to the Service Provider sufficiently in advance, in order to allow for all logistical and security measures to be taken in a timely manner; - oversee contiuous media relations and public outreach activities, including website content. In the absence of the CO, act as principal spokesperson for the mission. 4. Determine Core Team rules of procedure, which should include: - rules for core team (meetings and other necessary rules to ensure the effective flow of information among core team members and vis-à-vis observers (enhancing the need to ensure the flow of information is well coordinated); - rules for interfacing with national authorities, election stakeholders (level of contacts, signature responsibilities etc); - internal deadlines for preparing weekly and preliminary reports, taking into account reporting guidelines; - rules for establishing an operational plan for election day, ensuring smooth data flow to and from observers; - rules for archiving main documents (what kind of information received must be recorded or which prepared/received documents must be retained); - rules for daily coordination with the implementing partner or serviceprovider and its staff. 5. Oversee the methodological and operational integration of locally recruited diplomatic STOs, of associated observers from non-eu member states, and of the MEP delegation into the EU EOM workflow. 6. Oversee the work of, and ensure coordination with the Service Provider (SP) - organise effective coordination and regular team meetings between Core Team members and the SP; - ensure daily briefings with SP on logistic and security aspects; - establish proper channels and procedures for communication of emergency situations with the SP; - oversee preparation of logistic aspects by the SP (transport, accommodation, working facilities etc...); - in cooperation with the Observer coordinator, liaise with the SP Operation and Security Expert on deployment plan and movements of the observers; - oversee the preparation of security /behavioural training tasked to the SP by the EC prior to observer deployment; - address to the SP the day-to-day logistic needs for the proper conduct of the mission, and oversee its delivery according to the terms of contract; - address to the SP the day-to-day appropriate security needs and oversee its delivery according to the terms of contract.

5 7. Ensure that all mission members are fully aware of the EU EOM Codes of Conduct and the consequence of failing to abide by them. 8. Oversee the observer evaluation process. Ensure that this is prepared in coordination with all core team members; co-sign the evaluations and certificates for observers together with the Observer Coordinator. Ensure that evaluations follow COM guidelines. Oversee the inclusion of evaluations in the roster by the Coordinator. 9. Provide a final evaluation of the core team in collaboration with the in collaboration with EEAS and COM» 10. Under CO responsibility, ensure that all measures are taken to ensure the security of EU EOM members. Inform European Commission services in a timely manner about all security issues. Decisions related to security must be taken in a timely manner under CO responsibility, in coordination with the Service Provider, in charge of the security and logistical aspects of the mission, and in consultation with the European Commission services. In case of disagreement between the DCO (under the authority of the CO) and the Service Provider, the DCO (under the authority of the CO) and the local representative of the Service Provider shall discuss the matter in order to reach agreement, and in case no agreement can be found, the CO and/or the Service Provider shall refer the matter to the European Commission (FPIS4), who shall contact the Service Provider in order to find a mutual agreement. 11. Ensure a good working relationship within the core team, with the Service Provider and with the locally recruited staff. 12. Provide a briefing on the working of the mission for national staff. 13. Ensure the smooth and timely circulation of information to European Commission and EEAS services. 14. Ensure that any modification requested to the TOR and the budget is notified in due time to the Service Provider and EEAS/European Commission services for final approval by the relevant European Commission services. 15. Ensure, in co-ordination with the core team and the Service Provider, the effective closure of the mission, including the archiving of main documents and donation of equipment in collaboration with the EU Delegation. 16. Coordinate and draft, with the support of the Observer coordinator and with the contribution of other analysts, and based on assessments by the observers, the internal final report, including feedback on individual terms of reference for each analysts and for observers, modus operandi of the mission, lessons learnt and good practices, and suggestions for methodological improvements and information on possible areas of technical assistance. The final internal report should be approved by the CO and submitted to COM and EEAS services prior to the debriefing.

6 17. Perform any other duty required by the CO or COM/EEAS services for the good functioning of the EU EOM. 18. Be available for the return visit and roundtable. (3) LEGAL ANALYST The Legal Analyst is responsible for providing an analysis of the legal framework governing the elections in the Republic of Nigeria in accordance with international and regional commitments and obligations applicable to democratic elections, taking into consideration the country s legislation and regulations related to elections. S/he will analyse processes related to petitions and election offences. This will include looking at the role of the judiciary, the police, and the election administration. S/he will also look at political party registration, political finance regulation and enforcement, and candidate registration. The Legal Analyst will take into consideration Nigeria s international and regional commitments in promoting gender equality. The Legal Analyst should coordinate closely and share information with the Election, Political, and Media Analysts. S/he will support core team colleagues in their use of international law related to elections. S/he will work under the supervision of the CO and DCO. S/he will: 1. Have acquired solid grasp of the legal and regulatory framework for elections, as well as international and regional commitments and obligations applicable to democratic elections. In this context the Compendium of International Standards for Elections is an important background document. 2. Ensure that the Chief Observer and core team members are aware of international and regional commitments and obligations for elections, including those under ICCPR, UNCAC, CEDAW, ICERD, CRPD as well as regional instruments. 3. Comprehensively analyse national legislation, in particular concerning universal, equal and secret suffrage, right to vote and to stand as a candidate, conditions for the exercise of fundamental freedoms of expression/association/assembly/movement, the right to life, the prohibition against torture, the right to a fair and public hearing, constituency delimitation, election administration, voter registration, political party registration and finance, candidate registration, campaign, media (in conjunction with the media analyst), voting, counting and tabulation, complaints and appeals. Assess legislative amendment proposals for consistency with international law, good practice and previous EU EOM recommendations. 4. Assess compliance of national legislation with Nigeria s international and regional commitments and obligations for democratic elections. 5. Assess electoral legislation from a gender perspective, in accordance with applicable international conventions (CEDAW), focusing in particular on the participation of women and socially vulnerable people and special needs groups.

7 Assess whether election legislation is respected in practice, allowing all persons to enjoy internationally guaranteed rights. 6. Contribute to the EU EOM assessment of whether the elections are conducted in accordance with the legal framework as set out in national legislation as well as international and regional commitments and obligations for elections. 7. Assess and analyse legal aspects of the activity of the judiciary/election administration, in particular: - the capability of the judiciary/election administration in implementing the legal framework consistently; - the role of the judiciary/election administration in dispute resolution and election process supervision; - the conduct and effectiveness of complaints and appeals processes. 8. Log, categorise and maintain in a database key election-related petitions and appeals, filed by parties and candidates. 9. In coordination with the political analyst and the media analyst, monitor closely any arrests or detentions impacting fundamental rights underlying elections and the circumstances surrounding such arrest/detentions. 10. Attempt to record, assess and analyse election-related arrests, investigations and prosecutions. This includes looking at the respective roles played by the police, election administration and courts. 11. Meet regularly with judicial and other relevant bodies, and attend court hearings relating to petitions, appeals and electoral offence charges. 12. Gather information on the process of complaints about judges and judicial processes through the National Judicial Council. 13. Liaise with international organizations and agencies as well as with domestic NGOs specialized in legal issues. 14. Analyse legal information collected by LTOs and other core team members. 15. Support the DCO in developing the analytical framework and implementing the EU election observation methodology. 16. Brief mission members on important legal issues. 17. Suggest relevant questions to be included in LTO weekly report templates. 18. Participate in observer briefings, debriefings and team meetings. 19. Contribute to the preparation of interim reports, the preliminary statement and the final report. Contribute to the internal report, including suggestions of methodological improvements and information on possible areas of technical assistance.

8 20. Perform any other duty required for the good functioning of the EU EOM. (4) ELECTION ANALYST The Election Analyst is responsible for assessing the performance of the election administration and other public authorities in the preparation and conduct of the electoral process. S/he will analyse the effectiveness of the relationship between the HEC and other administrative agencies (particularly the Ministry of Interior) and international technical assistance. The Election Analyst should co-ordinate closely and share information with the Observer Coordinator, the Data Analyst, and the Legal, Political and Media Analysts. S/he will work under the supervision of the CO and DCO. S/he will: 1. Become familiar with Nigeria s constitutional, legal and regulatory framework for elections; assess the implementation of national election legislation by the Independent National Electoral Commission (INEC) of the Republic of Nigeria and other governmental bodies responsible for administering elections, concerning, in particular, the delimitation of constituencies and distribution of seats, voter registration polling, counting and results management. 2. Assess the degree of inclusivity and representativeness of Nigeria s electoral practices, including its impact on women participation and representation and participation of minority groups. In particular the participation of Internally Displaced Persons (IDPs) will need to be considered. 3. Assess the performance of the election administration and governmental bodies concerning technical preparations for the election. Special attention should be paid to recruitment procedures for temporary election staff and the measures taken to promote women s participation. 4. If possible, observe sessions of the election commission, follow the issues on its agenda, meet with relevant members of the different state electoral structures that constitute the election management, and provide the EU EOM with information about INEC decisions and complaints brought to the election administration. 5. Assess the performance of the election administration, its effectiveness, its statutory and functional independence, impartiality and transparency of operation, and the degree to which it enjoys confidence of electoral stakeholders. 6. Assess the election administration s capacity in relation to voter education initiatives, training of election officials, and production and distribution of relevant material. 7. In coordination with the voter registration expert, assess the voter list and voter registration issues arising. Assess how equally women, socially vulnerable populations and special needs groups can participate as voters.

9 8. Assess the preparation and conduct of voter education and voter awareness campaigns, and how women, socially vulnerable populations and special needs groups are integrated in global strategies. 9. Maintain regular relations with election analysts of other international observation missions, as well as with international technical assistance provided to the INEC. 10. Meet with election analysts from Civil Society Organizations (domestic and international) and other international organisations involved in the election process. Be the key working level point of contact with CSOs, ensuring they are informed of EU EOM activities and the EU EOM is informed of their work and analysis. 11. Support the DCO in developing the analytical framework and in implementing the EU election observation methodology. 12. Keep LTOs abreast of developments in the electoral process. In consultation with the LTO coordinator, prepare relevant questions for LTO weekly reports and interpret the responses thereto. 13. Prepare the Observers observation forms format and instructions. With the data analyst, and the Observer Coordinator, analyse data from Observers observation forms. 14. With the Observer Coordinator, develop and coordinate a strategy for following up on the collection of election material from the polling stations through higher levels of the election administration. Follow results tabulation. The strategy should include plans on how to systematically collect consistent information on the process and, as far as possible, individual polling stations results. 15. With the Data Analyst, analyse results tabulation data, if it is processed in a manner that allows it. Highlight clearly anomalous results. 16. Brief mission members on important issues regarding their area of responsibility. 17. Participate in observer briefings, debriefings and team meetings. 18. Contribute to the preparation of interim reports, the preliminary statement and the final report. Contribute to the internal report, including suggestions on any methodological improvements and information on possible areas that merit technical assistance. 19. Perform any other duty required for the good functioning of the EU EOM. (5) POLITICAL ANALYST The Political Analyst is responsible for conducting a political assessment of the election process and will provide information concerning the historical, social, cultural and political background on the country as well as on-going developments.

10 S/he will work under the supervision of the CO and DCO. S/he will: 1. Undertake comprehensive political analysis of the electoral process and gain broad understanding of the historical, cultural, social and political context in which the elections are being held, as well as of electoral sociology (overall party system, voting patterns and political affiliations). 2. Meet with political parties, candidates and political analysts in coordination with the DCO on a regular basis throughout the deployment of the mission. 3. Assess the legal, regulatory and administrative framework for conducting political life, including political parties and NGO registration and development. Assess the approach of political parties regarding the participation of women and socially vulnerable groups. 4. Develop statistical and analytical tools for comparative election results analysis. 5. In relation with the Election and Data Analysts, assess the voter list from an electoral sociology perspective. 6. With the Election Analyst, assess the electoral system from an electoral sociology perspective. Assess how equally women and socially vulnerable categories can participate and gain representation or potential obstacles to their representation. 7. With the Observer Coordinator and the Media Analyst, assess the conduct of the electoral campaign and its content; in particular whether fundamental freedoms are being protected by law and upheld by state actors; the existence of a level playing field, and the general security surrounding the campaign. In addition, attention will be paid to the participation of women and potential obstacles affecting women candidates. 8. Liaise with domestic observer groups and other national or international nongovernmental organisations engaged in the election process. 9. Provide assessment, background knowledge and relevant material on a wide range of interlocutors including candidates, political parties, state authorities, military, media groups, journalists, and decision makers in the country. 10. Produce regular reporting on political developments for core team and observers and provide oral briefings as required. Provide written and oral briefings for the CO. 11. With the legal analyst, review the legislative and regulatory framework for campaign finance. Assess implementation in practice. 12. Gather information and review the misuse of state resources and positions, and what measures are being taken to mitigate and overcome such problems. 13. Assess what measures are being taken to prevent electoral violence, and what

11 measures are taken in response to such violence. 14. Attempt to record the extent and type of election-related violence taking place at different stages in the electoral process. Work in conjunction with the Media Analyst to gather information from the media for subsequent analysis. 15. Ensure that LTOs are kept abreast of political developments. In consultation with the LTO coordinator, prepare relevant questions for the LTO weekly reports and process and interpret the responses thereto. 16. Develop a cultural awareness briefing for mission staff, taking into consideration religious custom and practices in relation to the electoral process. In conjunction with the SP operations and security experts, brief mission members about culturally sensitive issues and the appropriate behaviour to be adopted by observers in the course of their activities. 17. Assess the role and participation of women and socially vulnerable groups in the country. 18. Support the DCO in developing the analytical framework and in implementing the EU election observation methodology. 19. Organise meetings for the CO in conjunction with the DCO. 20.Participate in observer briefings, debriefings and team meetings. 21. Contribute to the preparation of weekly reports, to the preliminary statement and to the final report. 22. Contribute to the internal report, including suggestions on any methodological improvements and information on possible areas of technical assistance. 23. Perform any other duty required for the good functioning of the EU EOM (6) MEDIA ANALYST The Media Analyst is responsible for assessing media coverage during the election period, as well as the overall media environment. The Press and Public Outreach Officer is responsible for organising the EU EOM s communication and public outreach strategy, for maintaining relations with the media, and for organising EU EOM press conferences. S/he will work under supervision of the CO and DCO. S/he will: 1. Identify the most important media outlets to be monitored in terms of coverage, audience, ownership, content, bias, and impact, at the central and state levels. This should include monitoring of federal and some state government-owned electronic media outlets. 2. As far as possible, assess private media sector structures and ownership and its

12 potential impact on the availability of pluralistic information. 3. Establish the methodological framework for monitoring the most important media outlets. 4. Set up a central media monitoring unit, including both staff recruitment and training, technical set up and management and procedures for an additional decentralized monitoring. 5. With the Observer Coordinator, liaise with LTOs on implementation of media monitoring in their areas of responsibility. Prepare relevant questions for LTO weekly reports and process and interpret the responses thereto. 6. Monitor the media coverage of the EU EOM. 7. In liaison with the Legal expert, assess whether existing legislation does provide a reasonable framework for the protection of freedom of speech and for a free press; assess whether the media, both public and private, provide balanced coverage of the election campaign in accordance with existing legislation, using both quantitative and qualitative analysis. Assess coverage of women candidates and the manner in which women and socially vulnerable groups are portrayed in the media in relation to the elections. Specific attention should be paid to regional dimensions of the campaign. 8. Verify the freedom of the media to carry pluralistic political commentary. 9. Assess cases or allegations of intimidation or violence against journalists. 10. Assess the tone of the media coverage of the campaign by recording any statements that go beyond acceptable limits or that may be considered hate speech or incitement to violence. Particular attention should be paid to debates and programs involving participation of the public. 11. In liaison with the Election Analyst, assess the quantity and range of official voter information items distributed through the media. 12. Assess the context for producing and broadcasting paid political advertising. 13. Assess legal and institutional mechanisms to adjudicate media related complaints, as well as performance of self-regulation initiatives during the elections. 14. Assess any political party complaints against the media. 15. Collate and analyse all material available on opinion polls. 16. Maintain contact with representatives of the media sector and institutions, domestic or international observers groups engaged in media monitoring, especially in regard to public broadcasters and other state owned media. 17. Prepare (or obtain from another institutions/organisations) a basic daily media digest of political and election related items for the EU EOM.

13 18. Ensure that media monitoring results are regularly communicated to LTOs. 19. Advise the CO and DCO on strategies to achieve maximum visibility for the EU EOM. 20. With the Security Expert, in conjunction with the media expert, prepare a daily briefing on election and political violence as reported in the media. 21. Participate in briefings, debriefings and team meetings. 22. Contribute to the preparation of interim reports, of the preliminary statement and of the final report. Contribute to the internal report, including suggestions on any methodological improvements and information on possible areas of technical assistance. 23. Perform any other duty required for the good functioning of the EU EOM. (7) PRESS AND PUBLIC OUTREACH OFFICER The Press and Public Outreach Officer is responsible for organising the EU EOM s communication and public outreach strategy, for maintaining relations with the media, and for organising EU EOM press conferences S/he will: 1. Advise the CO and DCO on strategies to achieve maximum visibility for the EU EOM in the national and international media. 2. Develop an overall public outreach strategy, making use of networks of nongovernmental organisations, political parties, universities, etc. 3. Establish and maintain contact with the local and international media. 4. Ensure that EU Visibility guidelines for external actions are followed. 5. Coordinate the Public relations room, train and supervise the assistant to the Press Officer. 6. Coordinate the development of the mission website, as well as of mission related audio-visual material, in terms of design and contents, in cooperation with all other mission members and in coordination with the European Commission and the EEAS. 7. Prepare a mission fact-sheet to explain the mandate and objectives of the EU EOM to the general public. 8. Assist the CO and DCO in the preparation of media interviews, press releases

14 and press conferences, as instructed by CO/DCO. 9. Ensure and oversee translation of public information and documents issued by the EU EOM. 10. Ensure that the public outreach strategy is gender sensitive. 11. Prepare a comprehensive press distribution list for both local and international media. 12. Ensure maximum distribution of EU EOM press releases, of the preliminary statement and of the final report both locally and internationally. 13. With the Observer Coordinator, ensure that EU EOM press releases and statements are communicated to observers and that observers are made aware of any potentially sensitive statement before being made public. 14. Participate in briefings, debriefings and core team meetings. 15. If requested by the CO, DCO, EEAS or Commission, prepare first drafts of interim reports, of the preliminary statement, and of the final report ensuring that Commission guidelines are followed and that reporting grammar and style are of the highest standard. 16. Perform any other duty required for the good functioning of the EU EOM. (8) OBSERVER COORDINATOR The Observer Coordinator is responsible for coordinating the activities of observers and for providing the link between the field and the core team. S/he will work under the supervision of the CO and DCO. S/he will: 1. In conjunction with other core team members and the Service Provider (including operation and security experts), ensure high quality of observer briefings and debriefings. Ensure that necessary arrangements are properly prepared: organise meetings, develop session agendas, ensure that observers understand EU observation methodology, identify and select relevant speakers, prepare necessary materials for observer briefing and debriefing sessions, ensuring that observers will be provided with pertinent information on the European Union, its goals, institutions and composition, its foreign policy, particularly the EU election support policy, the European Instrument for Democracy and Human Rights (EIDHR) and the European Commission s role in electoral assistance and election observation. 2. Ensure that observers sign the EU EOM Code of Conduct. 3. Ensure full compliance with EU methodology as outlined in the Handbook for European Union Election Observation. 4. Under guidance of the DCO and in coordination with the SP operation and

15 security experts, plan and organise the deployment and movement of LTOs and LSTOs, ensuring representative observation coverage and taking into account security considerations. 5. Inform observers about the activities of the election authorities and about programmes developed at central level by civil society organisations and instruct observers on their possible impact at local level, as well as the level of co-ordination desirable with these groups; liaise with observers in the field and brief teams on a regular basis (preferably on a daily basis) regarding important issues identified by the core team (including Service Provider operation and security experts) which affect their activities. 6. Coordinate the tasking of observers by the mission. Insure consistency of instructions and information given to observers. Under CO and DCO supervision, the Observer Coordinator will insure that instructions given to observers keep in line with mission priorities. 7. In consultation with other core team members, prepare LTO report templates and report forms, ensuring that the information sought can be effectively processed. Distribute and collect observer reporting templates and forms. 8. Ensure that observer reports adequately address women s and socially vulnerable categories issues, and other human rights issues. 9. Receive, analyse and carefully and rigorously summarise observer reports for the CO and other CT members. Weekly summaries of reports received from observers will be prepared and shared with the other CT members as well as the LTOs. 10. Alert the core team and SP operation and security experts of important or specific issues within their area of responsibility as identified by the observers and ensure that these issues are followed. 11. Coordinate with Legal, Election, Political and Data Analysts the development of a database for Election Day and provide corresponding information and training to observers on statistical data collection. 12. Provide technical assistance to the Election analyst in the conduct of statistical analyses of observer collected data. 13. Provide the Commission with complete LTO evaluations, as well as LTO end of Mission reports, both in line with Commission guidelines. Provide the Commission with a comprehensive synthesis of all evaluations, certificates and End of Mission report before closure of the mission. 14. Ensure that all evaluations are signed by relevant observers, by the Observer Coordinator and by the DCO, so that they can be updated in the EU EOM roster (the Observer Coordinator will sign a letter of confidentiality on the information obtained in the roster). 15. With the DCO, coordinate the integration of locally recruited diplomatic STOs

16 (LSTOs), observers from non EU member states and MEP delegations into the EU EOM. Lead in preparing and managing LSTOs. This includes preparing information on their role and what s required, gathering LSTO individual information, organising their deployment, coordinating their briefings and manging information circulation and reporting. 16. Prepare summaries of the main observer findings for the preparation of EU EOM interim reports, of the preliminary statement and of the final report. 17. Coordinate and draft, under the guidance of the DCO and with the contribution of other analysts, and based on evaluations from observers, the internal final report, including feedback on individual terms of reference for each analyst and for observers, modus operandi of the mission, lessons learnt and good practices, and suggestions for methodological improvements and information on possible areas of technical assistance to the host country. 18. Perform any other duty required for the good functioning of the EU EOM (9) DATA ANALYST Under the guidance of the Chief Observer and in close coordination with the Deputy Chief Observer, the Election Analyst, the Observer Coordinator, the Data analyst will prepare detailed statistical analysis of available demographic, civil and voter registration data. The analysis will integrate regional, social, gender and age structures dimensions. In addition, the data analyst will assist the Election Analyst, the Observer Coordinator and in designing analytical tools for the treatment of key election findings based on observation forms completed by long term and locally recruited short-term observers (LTOs and LSTOs). S/he will work under the supervision of the Election Analyst. S/he will be present in Nigeria for a maximum of 30 days (TBC). S/he will: 1. Under the supervision of the Election Analyst, design and prepare an appropriate database system to facilitate the analysis of the demographic, civil registration and voter registration data collected by the mission, assess representation of woman and socially vulnerable categories on the voter register, including access to personal documentation and civil registration. 2. In coordination with the Election Analyst, ensure that LTOs and STOs are briefed on the structures and statistical characteristics of the voter list and on civil and registration procedures. 3. Under the supervision of the Election Analyst, liaise with the national and international agencies in charge of collecting and producing demographic, civil and voter registration data in order to assess the data collection and treatment procedures and methodology, including but not limited to COMCAS, Ministry of the Interior, Office of the Public Prosecutor, Ministry of Defence, and HEC s sub-committee for the voter register.

17 4. Contribute to the design of an appropriate database to facilitate the analysis of the data collected by observer teams. In coordination with the Election Analyst, contribute to the design and content of EU observer reporting forms, ensuring that the information contained can be processed effectively by the database. 5. In coordination with the Election Analyst provide input on the electronic system of the tabulation of results, on its integrity and on any data available on the tabulation of results from official or mission sources in terms of potential anomalies. 6. Recruit, train and supervise data entry clerk(s) responsible for data entry on E day, if necessary. 7. Attend briefings and debriefings as requested. 8. Perform other duty required for the good functioning of the EU EOM. (10) VOTER REGISTRATION AND DELIMITATION ANALYST Under the guidance of the Chief Observer and in close coordination with the Deputy Chief Observer, the Election Analyst, the Observer Coordinator, and the Political Analyst, the Voter Registration and Delimitation Analyst analyst will prepare detailed analysis of available demographic, civil and voter registration data. The analysis will be responsible for assessing the performance of the election administration and other public authorities in the preparation and conduct of the voters registration process. It will build on the assessment made during a prior Election Expert Mission, adding information on developments from the two election days. Delimitation issues will be assessed. In addition the Voter Registration and Delimitation Analyst will contribute to results analysis and other related election administration issues arising. The Voter Registration and Delimitation Analyst will: 1. Provide updates on the VR process. 2. Undertake an in-depth assessment of the voter registration process looking directly at systems and considering the views of stakeholders. 3. Consider how effective the VR system is in providing for inclusion and safeguards in the electoral process. 4. Assess the effectiveness of the permanent card readers. 5. Consider groups that may be excluded from registration, including internally displaced persons (IDPs) who are registered but in other locations to ones they are living in. 6. Assess the quality of any reports by civil society or others on the voter registration process. 7. Assess the impact of voter registration problems on the election process. 8. Identify issues of concern for improvement and make short -term recommendations.

18 9. Look at future long-term options, including possible synergies with civil registration systems. Look at geographical mapping options that may facilitate voter registration. 10. Assess the delimitation process in place. 11. Analyse any problems with the current constituency markations. 12. Make recommendations for long-term options for an improved delimitation process. 13. Perform any other duty required by the European Commission/EEAS services for the good functioning of the EUEOM
