3 1 Basic ID Rules The voter s ID is one of the acceptable types of ID. Don t forget, the list of acceptable IDs is different for different types of voters: Type of Voter Voter at Registration Table Voter at the Registration Table with the ID special designation on the ATV. If no acceptable photo ID, list of HAVA IDs will be taped to the Help Table. On the curbside privacy shield. 2 The voter s ID meets expiration requirements. Different IDs have expiration requirements. Latest issuance date for the 2016 Primary: 3/15/2008 Must be unexpired or contain no expiration date 3 The name and photo are substantially equivalent. Always view the information in the light most favorable to the voter. Always notify the judges if you have a concern about the similarity of the photo or name. Photo on the ID must reasonably resemble the voter standing in front of you. Name on the ID must be substantially equivalent to the name printed on the ATV. 4 Do not consider the voter s address when viewing the ID. The address on the ID does not have to match the address on the voter s record. Do not look at the address when determining whether an ID is acceptable. 3

4 ID Requirements for Voters at Registration Table Any Wake County voter may present one of the following types of photo IDs that bears a reasonable resemblance to the voter in order to vote on Election Day. A copy of this list is in the Registration Table Quick Guide and will be posted at the Registration Table. A North Carolina Driver License or Identification card including a learner s permit or a provisional license. This form of ID may be expired for up to 4 years before it is presented for voting. If expired, expiration date must be on or after 3/15/2012. Early Voting: See Application Table Quick Guide for a chart of acceptable expiration dates. A United States Passport (unexpired), including a passport book or a passport card, issued by the United States Department of State. A Veterans ID card issued by the United States Department of Veterans Affairs. A Veterans card bearing an expiration date must be unexpired, but Veterans ID cards without an expiration date are also acceptable. A United States Military ID card issued by the United States Department of Defense, including those issued to dependents, retired military personnel, and civilians. A Military ID bearing an expiration date must be unexpired, but Military ID Cards without an expiration date are also acceptable. 4 A tribal enrollment card issued by a federally-recognized tribe. If the card bears an expiration date, it must be unexpired. If it does not bear an expiration date, it must bear a printed issuance date that is not older than eight (8) years before it is presented for voting. The date issued, if voting on Election Day, must be on or after 3/15/2008. A tribal enrollment card issued by a state-recognized tribe, provided that it has been approved by the State Board of Elections. This card must be unexpired. A list of approved state-recognized tribes will be provided as soon as they become available.

5 ID Requirements for Curbside Voters The list of ID types that are acceptable for curbside voters is more extensive than the list for voters at the Registration Table. The full list of acceptable curbside IDs is on the curbside shield. The curbside official should compare the name on the ID to the name on the curbside affidavit, which should match the name on the ATV that they get in a later step. When there is a question about a curbside voter s resemblance to the photo on the ID, the election judges are not required to go to the voter s car together. When there is a question about a curbside voter s resemblance to the photo on the ID, political observers may witness the judges going to the voter s car but may not participate in discussions or look at the voter s ID. If a curbside voter does not have an acceptable ID, complete the Help Referral form and select No Photo ID and No HAVA Document. 5

6 When Expired IDs are Acceptable 1 The voter presents a North Carolina Driver License. This photo ID can be expired for up to 4 years before it is presented for voting. What should I do if a voter shows an expired ID that is not a NC Driver License? 1. Complete the Help Referral form. 2. Select ID Expired as the reason for sending the voter to the Help Table. 3. Give the ATV and the Help Referral form to the voter and send to the Help Table. Expires: Eleanor s ID only expired a couple of days before the election. Her ID meets the expiration requirements for an NC Driver License. 6

7 2 The voter is 70 years of age or older and the photo ID expired after the voter s 70th birthday. If a voter over the age of 70 presents an out-of-state driver license, the voter must have registered to vote within 90 days of Election Day to vote a regular ballot. How do I determine the voter s age? (Voter Search Screen) How do I determine whether the voter was 70 when the ID expired? Subtract the voter s date of birth from the expiration date on the photo ID. 7

8 When Out-of-State Driver Licenses are Acceptable Out-of-State Driver licenses are acceptable only if the license is unexpired and the voter registered to vote within 90 days of the election. How do I determine whether a voter registered within 90 days of the election? The phrase Registered Within 90 Days will be printed on the ATV if a voter registered to vote within 90 days of the election. For every voter, the date of registration is printed on the ATV stub. At early voting, you must click the View Voter button to view the voter s date of registration. What should I do if the voter shows an out-of-state Driver License but did NOT register within 90 days? 1. Complete the Help Referral form. 2. Select No Acceptable ID as the reason for sending the voter to the Help Table. 3. Give the ATV and the Help Referral form to the voter and send to the Help Table. 9 When ID Special Designation is Printed on the ATV At the Registration Table 1. If the voter shows an acceptable photo ID listed on page 4 at the Registration Table, process them normally and send them to the Ballot Table. 2. If the voter DOES NOT show an acceptable photo ID at the Registration Table, send the voter to the Help Table. Check the No Photo ID box on the Help Referral form. At the Help Table 1. Ask the voter to show a HAVA ID from the list at the Help Table. 2. Inform the voter of alternate voting options listed on the Acknowledgment of Notification of Voting Options form. If the voter selects any of the alternative voting options, refer to page 16 for processing. 3. Process them provisionally. The voter should select reason #10 as the reason for voting provisionally. If the voter showed a HAVA ID, write the type in the blue box on the provisional envelope. If the voter DID NOT show a HAVA ID, indicate in the blue box on the provisional envelope that they did not provide an acceptable photo ID or a HAVA ID. 4. Attach the Help Referral form and the ATV to the provisional envelope. ( with Call the Help Line for guidance in processing a voter ID on the ATV who has no acceptable form of ID. 9

10 When the name is NOT Substantially Equivalent The name appearing on the photo identification must be the same or substantially equivalent to the name contained in the registration record. The election official shall make this determination based on the totality of the circumstances, construing all evidence, along with any explanation or documentation volunteered by the person presenting to vote, in the light most favorable to that person. This means the voter can show additional documentation or IDs to demonstrate their name. IDs that are not considered acceptable may be used only as evidence of a name variation or change. The name appearing on the photo identification shall be considered substantially equivalent to the name contained in the registration record if differences are attributable to a reasonable explanation or one or more of the following reasons:» Omission of one or more parts of the name (such as, for illustrative purposes only, Mary Beth Smith versus Beth Smith, or Patrick Todd Jackson, Jr. versus Patrick Todd Jackson, or Maria Guzman-Santana versus Maria Guzman);» Use of a variation or nickname rather than a formal name (such as, for illustrative purposes only, Bill versus William, or Sue versus Susanne);» Use of an initial in place of one or more parts of a given name (such as, for illustrative purposes only, A.B. Sanchez versus Aaron B. Sanchez);» Use of a former name, including maiden names (such as, for illustrative purposes only, Emily Jones versus Emily Gibson), or a variation that includes or omits a hyphenation (such as, for illustrative purposes only, Chantell D. Jacobson-Smith versus Chantell D. Jacobson);» Ordering of names (such as, for illustrative purposes only, Maria Eva Garcia Lopez versus Maria E. Lopez-Garcia);» Variation in spelling or typographical errors (such as, for illustrative purposes only, Dennis McCarthy versus Denis McCarthy, or Aarav Robertson versus Aarav Robertsson). If the voter s registration is different but substantially equivalent to their photo ID, the official may invite the voter to complete a name change, but this is NOT a requirement. 11 Do NOT ask the voter for more information or documentation at U the Registration Table. That will be handled at the Help Table. At the Registration Table 1. Inform the voter that the name on their presented ID does not substantially match the name on their voter registration and will need to go to the Help Table for assistance. Inform the voter that they will still be able to vote, there is just more information needed to determine if the voter is eligible to receive and vote a regular ballot. 2. Complete the Help Referral form using the information on the voter s ATV. If the voter does not have an ATV, ask the voter for their information and complete the gray portion of the Help Referral form. 3. Check the box next to Other and write name is not the same. 4. Complete sections B and C of the Help Referral form. 5. Send the voter with the ATV(if applicable) and the Help Referral form to the Help Table. X Judges: At the Help Table 1. Ask the voter for their Help Referral form and ATV (if they have one). 2. Inform the voter that the election judges will assist the voter to determine if the voter s presented ID meets the North Carolina requirements to vote a regular ballot. 3. Summon the election judges to the Help Table and give them the voter s Help Referral form. Depending on the outcome of the judges determination, you will then complete the ATV and send them to the Ballot Table, or you will process them provisionally., Refer X Justine Bradshaw Justine Bradshaw to page 18 for instructions. 11

12 When the Photo on the ID does not Reasonably Resemble the Voter The photograph appearing on the photo identification must depict the person presenting to vote. The election official shall make this determination based on the totality of the circumstances, construing all evidence, along with any explanation or documentation volunteered by the person presenting to vote, in the light most favorable to that person. Perceived differences of the following features shall not be grounds for the election official to find that the photograph appearing on the photo identification fails to depict the person presenting to vote: Weight Hair features and styling, including changes in length, color, hairline, or use of a wig or other hairpiece Facial hair Complexion or skin tone Cosmetics or tattooing Apparel, including the presence or absence of eyeglasses or contact lenses Characteristics arising from a perceptible medical condition, disability, or aging Photographic lighting conditions or printing quality If the voter is wearing a hat or other accessories that obstruct your ability to make a determination, ask the voter if they would mind removing the accessory. If they DO mind and you are not able to determine a resemblance, send the voter to the Help Table. Please remember to be mindful of voter s religious beliefs and other private matters that may lead the voter needing to wear additional clothing and accessories. N Remember: You are relying on your eyes to make this determination. If YOU do not see a resemblance between the voter and their presented ID, follow the procedures on the next page. 12 C Remember that your determination must be made in a way that is most favorable to the voter.

14 When the Voter Declared a Religious Objection Prior to the Election The North Carolina voter ID law allows voters who have a sincerely-held religious objection to being photographed to be exempt from showing a photo ID to vote. To get this exception, the voter must complete a declaration to that effect on or before 25 days before the election in which they are voting. These voters will have ID Exempt printed on their ATV. At early voting, you must click the View Voter button and look for the Religious Objector check box. You are not required to click the View Voter button for every voter - only those who state that they declared a religious objection prior to the election. These voters should not be asked to present a photo ID. All voters must still state their name, address, and, in partisan primaries only, their party affiliation. 15 When a Voter Declares a Religious Objection on Voting Date If a voter declares that they have a sincerely-held religious objection to being photographed and ID Exempt does not appear on the voter s ATV (or at early voting, Religious Objector check box is not checked): 1. Complete the Help Referral form. 2. Select Religious Objection as the reason for sending the voter to the Help Table. 3. Give the ATV and the Help Referral form to the voter and send to the Help Table. At the Help Table 1. Inform the voter that they will need to vote a provisional ballot and that they will need to complete and sign the Religious Objection Declaration at the Board of Elections office prior to 12:00 p.m. the day before canvass day to validate their provisional vote. 2. Inform the voter that they must also present a form of ID listed below at the Board of Elections office when signing their declaration. 3. Complete the provisional process. The voter should select reason #10 as the reason they are voting provisionally. 4. Attach the Help Referral form to the provisional envelope and place it in the red bag. 5. When giving the provisional instructions to the voter, be sure to tell them: Please take a copy of a HAVA document and your provisional voting instructions to the Board of Elections before 12:00 p.m. on the day before canvass and complete a Religious Objection Declaration. 15

16 When the Voter does not have an Acceptable ID At the Registration Table 1 2 Why does the voter not have an ID? Help Referral Reason No Photo ID No Photo ID - Reasonable Impediment At the Help Table There are three scenarios. Choose the voter s scenario below. A. If the voter forgot their photo ID 1. Complete the provisional process. The voter should select reason #10 as the reason they are voting provisionally. Attach the Help Referral form to the provisional envelope and place it in the red bag. 2. Give the voter a Voter ID Push Card: Please take one of these photo IDs and your provisional voting instructions to the Board of Elections before 12:00 p.m. on the day before canvass. 3. Give the voter a Voter ID Push Card to take with them. B. If the voter has a reasonable impediment 1. Refer to page 17 for instructions. C. If the voter chooses NOT to vote a provisional ballot 1. Inform the voter of the options located on the Acknowledgment of Notification of Voting Options form. 2. If the voter wishes to leave the polling place without choosing one of the options on the form, have the voter print and sign their name on the Acknowledgment of Notification of Voting Options form. 3. Give the voter a Voter ID Push Card to take with them. 4. Complete and give the Acknowledgment of Notification of Voting Options form to the Chief Judge. 16

17 When the Voter has a Reasonable Impediment U This Please note that this process is not for a voter who simply left their ID at home. process is for voters who do not have an acceptable ID at all. If a voter, after being asked for their photo ID, tells you that they have a reasonable impediment or a reason why they do not have an ID to show: 1. Complete the Help Referral form. 2. Select No Photo ID - Reasonable Impediment as the reason for sending the voter to the Help Table. 3. Give the ATV and the Help Referral form to the voter and send to the Help Table. At the Help Table 1. Inform the voter that they will need to vote a provisional ballot. 2. Complete the Reasonable Impediment Declaration with the voter. Complete the provisional process. The voter should select reason #10 as the reason they are voting provisionally. Attach the Reasonable Impediment Declaration to the provisional envelope and place it in the red bag. 5. If the voter did not provide information or a document when voting provisionally, inform the voter that they must present one of those documents at the Board of Elections office no later than 12:00 p.m. on the day before the county canvass. 18 When the Judges must make a Determination When are the judges needed? The election judges are needed whenever a voter is referred to the Help Table due to the Registration (Election Day) or Application (Early Voting) Table officials not being able to determine: 1. That the voter s photo ID reasonably depicts the voter, OR; 2. That the name on their voter s registration is not substantially equivalent to the name on their presented ID. Rules for the Determination The judges must follow the rules for determining resemblance listed on pages 10 and 12 of this manual. No individual judge s determination is more important than the others. The judges must be unanimous in their determination that the voter s presented photo ID does NOT depict the voter, or the voter will vote a regular ballot. The voter may present any additional information or documentation to help explain any variations between their registration or appearance and their presented ID. This is not required. Any information the voter presents can only be used to help make a determination that allows the voter to vote a regular ballot. The judges should disregard any provided information or documentation that could hurt the voter s chance to vote a regular ballot. The judges should not make any inquiries into the voter s privacy to help the determination. The judges may ask: Is there any additional information you can provide that can help explain the difference in your appearance/ name? If the voter says no, the determination must be made using only the information the voter has voluntarily given. 19 Completing the Help Referral form After a determination is made, each judge must complete section C of the Help Referral form. Each judge will select their determination, print their name and sign the signature line. The results of the determination should be selected before giving the form back to the Help Table official. Depending on the results of the determination, the Help Table will when either process the voter normally to receive a regular ballot or begin the provisional voting process. If the voter votes a regular ballot, give the Help Referral form to the Chief Judge (Election Day) or Site Supervisor (Early Voting). If the voter votes provisionally, clip the Help Referral form to the provisional envelope. For early voting, there will only be two (2) assigned election judges. Only the Application Table official and the two judges must complete and sign section C. Ask the voter to select the provisional voting reason #9 in section A of the provisional envelope. Attach the completed Help Referral form to the provisional envelope. Observers During the Determination Process An observer MAY observe the determination process but they may NOT:» Speak during the process or offer assistance in the determination process» Talk to the voter or to the judges during the determination process» Look at the photo ID in question» Challenge the determination of the judges If any Observer tries to impede the determination process in any way, call the Help Line. 19

20 Voter Assistance Not all precincts or early voting sites are sufficiently staffed to have a person that can help voters in line with their questions. However, if you have enough people to properly staff all of the stations and someone is available, an official may be asked to help inform voters of the new requirements. This may not be necessary unless there are a large number of voters in line. Rules for an Election Greeter DO inform a voter what photo IDs are acceptable. You can use a Voter ID Push Card and the Voter ID Posters on the wall to help illustrate to the voter what is acceptable. DO NOT tell a voter that the photo ID they have will not be acceptable. DO NOT tell a voter that they cannot vote because they do not have a photo ID. DO inform voters of the different ways that they can vote without showing a photo ID, including Absentee by Mail (at early voting up until the request deadline has passed), or they may vote provisionally if they declare a reasonable impediment, a sincerelyheld religious objection to being photographed, or they wish to show a photo ID before canvass. DO NOT suggest to the voter that they should leave the polling place to retrieve an ID. The voter must make that determination on their own.»» DO NOT make a reasonable resemblance determination. This can only be made by the Registration Table official. If you are not comfortable answering a photo ID question or you do not know that answer, inform the voter that the Registration Table official will be able to assist them further. 20

21 Conflict Resolution If the voter is unwilling to show a photo ID or is argumentative: U We do not make the law but we must follow the law. 24 Quick Tips! Photo ID Checklist: Acceptable Type of Photo ID Photo on the ID depicts the voter Meets Expiration Requirements Address does NOT need to match! Name on voter s registration is substantially equivalent Acceptable Photo IDs NC Drivers License or ID Card U.S. Passport Military ID Card Veteran s ID Card Tribal Enrollment Card Out-of-State Driver License Unexpired Voter registered within 90 days Curbside Voters May Show Valid Photo ID Utility Bill Bank Statement Government Check Paycheck Other Government Document Voters over 70 years old Acceptable IDs may be expired for any amount of time if the voter was 70 when it expired. Refer to page 7 for further instructions. ID Special Designation 70+ ID Refer to page 9 for acceptable IDs for voters who have ID Required on their record. Expiration Requirements DMV-issued ID may be expired up to 4 years. Tribal Enrollment Card must be unexpired or if no expiration date, issuance date must be fewer than 8 years before the election. All others must be unexpired or have no expiration date. No Photo ID Send the voter to the Help Table. Process provisionally (Reason #10). Voter must show ID day by 12:00 p.m. the day before canvass at Board of Elections office. Give voter an ID Push Card. Reasonable Impediment (Voter doesn t have photo ID at all due to a reasonable impediment) Send the voter to the Help Table. Complete Reasonable Impediment Declaration. Voter must show a document or provide information on Declaration. Process provisionally (Reason #10). ( Remember: When in doubt, call the Help Line. We will help you find the answer every time.
