1 Athens Public Transit Request for Quotation TRANSIT SHELTERS & INSTALLATION per the SFY 2011 STATE OF GOOD REPAIR GRANT Interested Vendors should submit their quotes by 5:00 p.m. on October 28th, 2014, to: Athens Public Transit c/o Transportation Services Manager 1015 E State St Athens, Ohio Lachman@hapcap.org No late quotes will be considered. Vendors should submit detailed quotes including cost clearly marked with the main heading ATHENS PUBLIC TRANSIT SHELTERS and the appropriate subheading of specific subproject. Vendors may submit quotes for any and all subprojects under the grant, alone or in combination. 2 Page 2 of 6 SECTION 1: OVERVIEW Scope of Projects Athens Public Transit Subproject Description Project Max. Subproject 1: Supply four (4) to six (6) Transit Shelters $44,500 Subproject 2: Supply Rear Wall, Existing Main Shelter $4,000 Subproject 4: Supply and Install Replacement Safety Glass, Existing Shelter $1,500 Maximum Project Total: $50,000 General Information Quotes will be accepted for the period Tuesday October 22, 2014, through Tuesday, October 28, The quotes must be submitted prior to 5:00 p.m. Eastern on October 28th, 2014, to Athens Public Transit, 1015 E State Street, or submitted electronically by same deadline to Lachman@hapcap.org. Vendors must be able to furnish satisfactory evidence of their ability to deliver the product specified. Contracts may not be awarded to any person or firm in arrears to Athens Public Transit or the City of Athens from any cause or who may have, in former contracts with Athens Public Transit or the City of Athens, failed to perform satisfactorily. Athens Public Transit reserves the right to accept or reject any or all quotes, to waive any irregularities or informalities in the quotes; and to choose the Vendor who offers the lowest, most responsive, reasonable quote. Any erasures or other changes in the data contained on the quotes must be explained by separate letter, noted over the signature, or initialed by the Vendor. Failure to comply with this could invalidate a quote. Subsequent to the award of the contract and within seven (7) days after the contract forms are received by the successful Vendor for signature, the successful Vendor shall execute and deliver the required number of copies of the contract to Athens Public Transit. The failure of the successful Vendor to execute such contract documents within seven (7) days after the prescribed forms are received for signature, shall constitute default. The Procurement Officer may either award the contract to the next best responsible Vendor or re-advertise for quotes.
3 Page 3 of 6 Vendor should: -include submitted Technical and Cost Quotes; -not include promotional materials; -completely and accurately address the criteria found in this RFQ. Timeline Below is the schedule for accepting and choosing quotes: TASK DATE Request for Quotes Issued 10/21/14 Request for Quotes Due 10/29/14 Notice of Award 11/5/14 Additional Requirements In addition to supplying the technical information for software, the responses must also include detailed information for: Implementation - Timeline for complete project. This timeline should be by week number from project start-up date, and should detail the complete implementation process. References- give names and contact information of past and current customers, within the last 2 years. Selection Criteria Athens Public Transit will facilitate all evaluation activities. They will assess each quote based on the following weighted criteria: Cost Responsiveness to technical specification Qualifications/Project Team Implementation plan and schedule Cost Quotes The cost quotes should provide detailed information on the scenarios and options requested. When your product and services do not match the descriptions provided in this Cost Quotes worksheet, include an explanation or proposed substitution using the format provided. Respondents should add appropriate line item(s) and explanations, as needed. ITEM/Description Base Cost Requested Options Vendor Explanation/Substitution. Subtotal Total Cost
4 Page 4 of 6 Incorporation of Federal Transit Administration (FTA) Terms The preceding provisions include, in part, certain Standard Terms and Conditions required by DOT, whether or not expressly set forth in the preceding contract provisions. All contractual provisions required by DOT, as set forth in FTA Circular E, are hereby incorporated by reference. Anything to the contrary herein notwithstanding, all FTA mandated terms shall be deemed to control in the event of a conflict with other provisions contained in this Agreement. The Contractor shall not perform any act, fail to perform any act, or refuse to comply with any Athens Public Transit requests which would cause Athens Public Transit to be in violation of the FTA terms and conditions. For all required FTA terms and conditions please refer to Master.pdf. No Obligation by the Federal Government. (1) The Purchaser and Contractor acknowledge and agree that, notwithstanding any concurrence by the Federal Government in or approval of the solicitation or award of the underlying contract, absent the express written consent by the Federal Government, the Federal Government is not a party to this contract and shall not be subject to any obligations or liabilities to the Purchaser, Contractor, or any other party (whether or not a party to that contract) pertaining to any matter resulting from the underlying contract. (2) The Contractor agrees to include the above clause in each subcontract financed in whole or in part with Federal assistance provided by FTA. It is further agreed that the clause shall not be modified, except to identify the subcontractor who will be subject to its provisions. Program Fraud and False or Fraudulent Statements or Related Acts. The Contractor acknowledges that the provisions of the Program Fraud Civil Remedies Act of 1986, as amended, 31 U.S.C et seq. and U.S. DOT regulations, "Program Fraud Civil Remedies," 49 C.F.R. Part 31, apply to its actions pertaining to this Project. Upon execution of the underlying contract, the Contractor certifies or affirms the truthfulness and accuracy of any statement it has made, it makes, it may make, or causes to be made, pertaining to the underlying contract or the FTA assisted project for which this contract work is being performed. In addition to other penalties that may be applicable, the Contractor further acknowledges that if it makes, or causes to be made, a false, fictitious, or fraudulent claim, statement, submission, or certification, the Federal Government reserves the right to impose the penalties of the Program Fraud Civil Remedies Act of 1986 on the Contractor to the extent the Federal Government deems appropriate. (2) The Contractor also acknowledges that if it makes, or causes to be made, a false, fictitious, or fraudulent claim, statement, submission, or certification to the Federal Government under a contract connected with a project that is financed in whole or in part with Federal assistance originally awarded by FTA under the authority of 49 U.S.C. 5307, the Government reserves the right to impose the penalties of 18 U.S.C and 49 U.S.C. 5307(n)(1) on the Contractor, to the extent the Federal Government deems appropriate. (3) The Contractor agrees to include the above two clauses in each subcontract financed in whole or in part with Federal assistance provided by FTA. It is further agreed that the clauses shall not be modified, except to identify the subcontractor who will be subject to the provisions. Privacy Act Applicability to Contracts When a grantee maintains files on drug and alcohol enforcement activities for FTA, and those files are organized so that information could be retrieved by personal identifier, the Privacy Act requirements apply to all contracts. Flow Down The Federal Privacy Act requirements flow down to each third party contractor and their contracts at every tier. Model Clause/Language The text of the following clause has not been mandated by statute or specific regulation, but has been developed by FTA.
5 Page 5 of 6 Contracts Involving Federal Privacy Act Requirements - The following requirements apply to the Contractor and its employees that administer any system of records on behalf of the Federal Government under any contract: (1) The Contractor agrees to comply with, and assures the compliance of its employees with, the information restrictions and other applicable requirements of the Privacy Act of 1974, 5 U.S.C. 552a. Among other things, the Contractor agrees to obtain the express consent of the Federal Government before the Contractor or its employees operate a system of records on behalf of the Federal Government. The Contractor understands that the requirements of the Privacy Act, including the civil and criminal penalties for violation of that Act, apply to those individuals involved, and that failure to comply with the terms of the Privacy Act may result in termination of the underlying contract. (2) The Contractor also agrees to include these requirements in each subcontract to administer any system of records on behalf of the Federal Government financed in whole or in part with Federal assistance provided by FTA. SECTION 2: DESCRIPTION OF SUBPROJECTS Subproject 1: Supply four (4) transit shelters. Outside dimensions of shelters may be quoted between 4 x 8 and 5 x 12 ; points will be awarded for larger sizes within stated subproject budget. Frame black tubular aluminum, walls at least ¼ tempered glass without permanent safety markings. Points awarded for additional structural and design elements from Athens Public Transit Functional/Technical Specification and Long Range Site Plans for Transit Shelters, Section 2. Points awarded for adherence to floor plans and wall configurations per Athens Public Transit Functional/Technical Specification and Long Range Site Plans for Transit Shelters, Section 3. Subproject 2: Supply Rear Wall, Existing Main Shelter. Shelter outside dimensions: 5 x 15 Framing: 2.5 square members, anodized aluminum, dark bronze finish Wall Material: ¼ tempered safety glass, grey tint. Rear wall/framing dimensions needed: 75 H x 171 W (approx. 6 x 14 ) At least two (2) wall supports with concrete-tapping bolts required.
