19 Gujarat 2012 Assembly Elections Gujarat Assembly Elections 2012 were held during the month of December, A total of 1666 candidates contested in the Gujarat State Assembly Elections out of which, Gujarat Election Watch (GEW) & Association for Democratic Reforms (ADR) have analyzed the data of 1660 candidates. This report includes the analysis of criminal, financial, and other details of 1660 candidates and 182 MLAs. Also, the analysis of Election Expenses of the 182 newly elected MLAs is presented in this report. This report is based on the analysis of information provided by the contesting candidates in their self-declared affidavits that they submit to the Election Commission of India when they file their nomination-paper for the said elections. Representation of political parties A total of 1666 candidates contested in the Gujarat 2012 Assembly Elections representing 40 political parties. In 2007, 1268 candidates contested, representing 39 parties for the Gujarat Assembly Elections. Executive summary of candidates and MLAs Summary of Candidates Gujarat Election Watch (GEW) has analyzed affidavits of 1660 out of 1666 candidates who contested in the Gujarat 2012 Assembly Elections. Criminal z Candidates with Criminal Cases: Out of these 1660 candidates analyzed for Gujarat Assembly Elections, 287 candidates or 17 % declared criminal cases against them. In 2007 assembly elections for the whole of Gujarat, 23% candidates had declared criminal cases against themselves. z Party wise Candidates with Criminal Cases: Among major parties, INC has 57 out of 176 (32 %), BJP has 49 out of 181 (27 %), GPP had 37 out of 166 (22 %), BSP has 12 out of 162 (7 %), JD(U) had 10 out of 64 (16 %), SP had 9 out of 67 (13 %), and NCP had 7 out of 12 (58 %) candidates with declared criminal cases. z Candidates with Serious Criminal Cases: Out of these 287 candidates with declared criminal cases, 126 (8%) have declared serious criminal cases like murder, attempt to murder, kidnapping, extortion, rape etc. BJP has 25, INC has 22, GPP has 17, JD(U) has 6, SP has 3, NCP has 5 and BSP has 4 such candidates. z Candidates against whom charges have been framed: Out of these 287 candidates with declared criminal cases, charges have been framed against 200 candidates with cases of kidnapping, Murder, dacoity, rape etc. z Candidates with Serious & Violent Crime Cases: The top three candidates from major parties who have declared serious criminal cases of murder, kidnapping and theft against them are: (1) Vasava Chhotubhai Amarsinh (of JD(U) from Jhagadia(ST) constituency) has declared three charges related to murder and 2 charges related to kidnapping.(2)chaudhary Shankarbhai Lagdhirbhai (of BJP from Vav constituency) has declared 3 charges each related to murder and attempt to murder (3) Amit Anilchandra Shah (of BJP contesting from Naranpura constituency) has declared 2 charges related to murder. From INC, Barad Jashubhai Dhanabhai from Talala Constituency has declared 1 charge related to attempt to murder. z 3 candidates have declared charges related to rape against themselves, namely Jethabhai G. Ahir of BJP from Shehra constituency, Vikramsinh Jatubha Parmar of Vishva Hindustani Sangathan Party from Vejalpur constituency and Praful- Gujarat Election Watch

20 chandra Punjabhai Vankar of BSP from Shehra constituency (has declared that he has been acquitted but the case is still declared). z Red Alert Constituencies: There are a total of 38 red alert constituencies (i.e. where 3 or more candidates contesting either on a party ticket or as an independent candidate have declared criminal cases). Financial z Average Assets: The average asset per candidate contesting in the Gujarat 2012 Assembly Elections is approximately Rs 1.73 crores. Among major parties, the average asset per candidate for INC is Rs 7.05 Crores, for BJP is 5.43 Crores, for GPP is 1.22 Crores, for BSP is Lakhs, for JD(U) is Lakhs, for SP is Lakhs, and for NCP is Rs 3.48 Crores. z Crorepati Candidates: A total of 372 candidates out of 1660 analyzed i.e. 22% are crorepatis. In 2007, there were 21% crorepati candidates. z High Asset Candidates: The top three candidates who have declared the highest assets are Balvantsinh Chadansinh Rajput of INC from Sidhpur constituency who has declared the highest assets worth Rs. 268 crores, followed by Indranil Sanjaybhai Rajguru, of INC from Rajkot East constituency with Rs. 122 crores worth of assets and Javaharbhai Pethalajibhai Chavada of INC from Manavadar constituency with assets worth Rs. 82 crores. From BJP, the candidate who has declared the highest assets is D.D. patel from Mansa constituency with assets worth Rs crore. z Low Assets: A total of 16 candidates out of 1660 analyzed have declared that they have zero assets. Another 20 candidates out of 1660 analyzed have declared assets less than Rs. 10 thousand. z INC and BJP candidates with lowest assets: Among candidates from INC, Patel Lalitbhai Thakorbhai from Akota constituency has declared the lowest assets worth Rs 6.17 Lakhs. From candidates contesting on BJP ticket, Rameshbhai Bhurabhai Katara from Fatepura (ST) constituency has lowest declared assets of worth Rs 6 Lakhs. z High Liabilities: A total of 58 candidates out of 1660 analyzed have declared liabilities of Rs. 1 crore or above. z High Liability Candidates: The top three candidates with highest liabilities are Balvantsinh Chandansinh Rajput, an INC candidate from Sidhpur who has declared the highest liabilities worth Rs Crores followed by Indranil Sanjaybhai Rajguru of INC from Rajkot East constituency with liabilities of Rs Crores and Rajendrakumar Dhudalal Joshi of INC from Deesa constituency with liabilities worth Rs crores. From BJP the candidate with highest liability is Jitendrabhai Kantilal Somani from Wankaner constituency with liabilities of Rs Crores. z Undeclared PAN: 480 out of 1660 (29%) candidates analyzed in the Gujarat 2012 Assembly Elections, have not declared their PAN details z Crorepatis with undeclared PAN: 14 Crorepati Candidates have not declared their PAN details. z Undeclared PAN Party Wise: 76 out of 162 candidates of BSP have not declared their PAN, 6 out of 181 of BJP have not declared their PAN, 7 out of 176 of INC have not declared their PAN, 29 out of 166 candidates of GPP have not declared their PAN, 18 out of 64 of JD(U), 2 out of 12 of NCP and 25 out of 67 of SP have not declared PAN details. z High Income Candidates: Solanki Hirabhai Odhavjibhai of BJP from Rajula constituency and Italiya Ghanshyambhai Kanjibhai (GPP) from Katargam constituency both have declared the highest income of Rs Crores in their last Income Tax return. They are followed by Pabubha Virambha Manek of BJP from Dwarka constituency who has declared income of Rs Crores in his last ITR, and Radadiya Jayeshbhai Vithalbhai, of INC from Jetpur constituency who has declared income of Rs crore as per his last filed Income Tax Returns. z No Income-Tax Candidates: A total of 997 candidates (6) out of the 1660 candidates analyzed by the Gujarat Election Watch have declared that they have never filed income tax returns. z No Income-Tax Candidates Party-Wise: Of the 997 candidates analyzed who have declared that they have never filed 2 Gujarat Election Watch 2012

21 income tax returns BJP has 30 (17%) out of 181 candidates, INC has 38 (22%) out of 176 candidates, GPP has 69 (42%) out of 166 candidates, BSP has 132 (81%) out of 162 candidates, and JD(U) has 48(75%) out of 64 candidates who have declared that they have not filed IT Returns. z High Assets but no IT Return: Top 3 candidates with maximum assets but who have declared that they have never filed IT returns are Parmar Rajabhai Parbathbhai of BSP contesting from Somnath constituency with total assets of Rs crores. He is followed by Jadeja Kandhalbhai Sarmanbhai of NCP from Kutiyana with assets of Rs crores and Laxmanbhai Ambalal Baraiya (INC) from Daskroi constituency with assets worth Rs 6.61 crores. From BJP the candidate who falls in this category is Dilipkumar Virajibhai Thakor (contesting from Chanasama constituency with total assets of Rs crores). Other Background Details (Education, Gender, Age) z Women Candidates: Total number of women candidates who contested in the Gujarat Assembly Elections 2012 was a mere 97 compared to 1569 men candidates, i.e. only 6% of the candidates were women. z Graduate Candidates: A total of 423 (25%) candidates (out of 1660 analyzed) are graduate or with higher educational qualification in the Gujarat 2012 Assembly Election. z Age: 141 candidates out of 1660 analyzed have declared their age to be 30 or less. A total of 31 candidates out of the total analyzed are more than 70 years of age Summary of MLAs Gujarat Election Watch (GEW) has analyzed affidavits of all the 182 newly elected MLAs of Gujarat 2012 Assembly Elections. Out of these 182 MLAs, 115 are from BJP, 61 are from INC, 2 from NCP, 2 from GPP, 1 from JD(U) and 1 independent MLA. Criminal z MLAs with Criminal Cases: Out of these 182 MLAs analyzed for Gujarat Assembly Elections, 57 MLAs or 31% have declared criminal cases against them. In 2007 Assembly elections, 47 MLAs or 26% MLAs declared criminal cases against themselves. z Party wise MLAs with Criminal Cases: Amongst major parties, both INC and BJP have MLAs who have declared criminal cases. BJP has 32 out of 115(28%), and INC has 20 out of 61(33%) MLAs who have declared criminal cases against themselves. Other than them, 2 MLAs from NCP, 1 MLA each from GPP and JD(U) and 1 Independent MLA have declared criminal cases against them. z MLAs with serious criminal cases: Out of these 57 MLAs who have declared criminal cases against themselves, 24 MLAs declared serious criminal cases against themselves. z MLAs with Serious and Violent crimes cases: The top three candidates from major parties who have declared serious criminal cases of murder, kidnapping and theft against them are: (1) Vasava Chhotubhai Amarsinh of JD (U) from Jhagadia (ST) constituency who has declared 9 charges related to dacoity, 7 charges related to theft and 3 charges related to murder. (2) Amit Anil Chandra Shah (of BJP from Naranpura constituency) has declared 2 charges related to murder and 2 charges related to kidnapping.(3) Chaudhary Shankarbhai Lagdhirbhai (of BJP from Vav constituency) has declared 3 charges related to murder and 3 charges related to attempt to murder (4) Barad Jashubhai Dhanabhai (of INC from Talala constituency) has declared 1 charge related to attempt to murder. z MLA with rape charges: 1 MLA has declared charges of rape against himself. 22 z MLAs against whom charges have been framed: Out of the 57 MLAs who have declared criminal cases against themselves charges have been framed against 35 MLAs for various crimes. Financial z Average Assets: The average asset per MLA who has been elected to the Gujarat 2012 Assembly is approximately 8.03 Crore. Among major parties, the average asset per MLA for INC is Crore, for BJP is 5.82 Crore, for NCP is crores, for JD (U) is 2.70 Crores and for GPP is 1.52 Crores. z Crorepati MLAs: A total of 134 out of 182 MLAs i.e. 74% are crorepatis. In 2007, there were 31% crorepati MLAs. z High Asset MLAs: The MLAs with maximum assets in 2012 Gujarat Assembly are Balvantsinh Chandansinh Rajput of INC from Sidhpur constituency who has declared the highest assets worth Rs 268 Crore, followed by Rajguru Indranil Sanjaybhai of INC from Rajkot East who has declared assets worth Rs 122 Crore and Chavada Javaharbhai Pethalajibhai of INC from Manavadar constituency with assets worth Rs Crore. z 3 MLAs have declared assets of less than Rs 10 lakh. z Lowest Assets MLAs: Rameshbhai Bhurabhai Katara of BJP from Fatepura (SC) constituency has declared the lowest assets of Rs. 6 Lakhs, Vakil Manisha Rajivbhai of BJP from Vadodra City(SC) constituency has declared assets of Rs Lakhs and Rathod Pravinbhai Jinabhai of INC from Palitana constituency has declared assets worth Rs Lakhs. z High Liabilities: A total of 28 (15%) MLAs out of 182 analyzed declared liabilities of Rs. 1 crore or above. z High Liability MLAs: The top three MLAs who have declared the highest liabilities are- Balvantsinh Chandansinh Rajput of INC from Sidhpur who has declared liabilities worth Rs Crores followed by Rajguru Indranil Sanjaybhai of INC from Rajkot East constituency with liabilities worth Rs Crores and Manibhai J. Vaghela an INC MLA from Vadgam (SC) constituency with liabilities worth Rs Crores. Among BJP MLAs, the highest liabilities have been declared by Patel Dineshbhai Balubhai from Padra constituency with liabilities worth Rs crores z Undeclared PAN: 4 out of 182 MLAs have not declared their PAN details in the 2012 Gujarat Assembly Elections. In 2007 Assembly elections 54 MLAs had not declared their PAN details. z MLAs who have declared Highest Income in ITR: Solanki Hirabhai Odhavjibhai of BJP from Rajula constituency has declared an income of Rs 3.41 Crore, followed by Pabubha Virambha Manek of BJP from Dwarka constituency with an income of Rs 3.25 Crore and Radadia Jayeshbhai Vithalbhai of INC from Jetpur constituency with an income of 2.53 Crore. z No Income-Tax MLAs: Out of 182 MLAs, 31 MLAs (17%) have not filed ITR z High Assets no ITR: Among them, Kandhalbhai Sarmanbhai Jadeja of NCP has the highest assets of approximately Rs crores, followed by Vitthalbhai Hansrajbhai Radadia of INC from Dhoraji constituency who has declared assets worth Rs 5.62 Crore and Dilipkumar Virajibhai Thakor of BJP from Charasma constituency who has declared assets worth Rs 4.73 Crore. Other Background Details (Education, Gender, Age) z Educational Background of MLAs: 44% MLAs (80 of 182 analyzed) have a graduate or a higher qualification in the Gujarat Legislative Assembly of z Women Representation: Out of 182 newly elected MLAs in Gujarat Assembly Elections 2012, only 16 (9%) MLAs are women. In 2007 Assembly Elections also there were 16(9%) women MLAs. z Age of MLAs: 3 MLAs have declared their age to be less than 30 years. 23 Analysis based on declared criminal cases Candidates A total of 1660 affidavits have been analyzed by Gujarat Election Watch (GEW) for both the phases of Gujarat 2012 Assembly Elections. Out of these 1660 analyzed candidates, 287(17%) declared that they have criminal cases against them. Out of these 287 candidates with declared criminal cases, 126 have declared serious criminal cases like murder, theft, kidnapping, attempt to murder, rape etc. against them. Party-wise break up of candidates with declared criminal cases A total of 287 candidates contesting in the Gujarat State Assembly Elections 2012 have declared criminal cases against them. INC has 57 out of 176 (32 %), BJP has 49 out of 181 (27 %), GPP had 37 out of 166 (22 %), BSP has 12 out of 162 (7 %), JD(U) has 10 out of 64 (16 %), SP has 9 out of 67 (13 %), and NCP has 7 out of 12 (58 %) candidates with declared criminal cases.
