Shamsheer Khan for his continuous presence through out the 5 days of inspection. The massive task to speaking to the over 2000 inmates, lodged in Beur Central Prison and Correctional Home, would not have been possible without the support of the prison writers. About CCTV Cameras: 34 cameras were installed. But they are not functioning from Now new setup is taking place. Video-conferencing is taking place. About Drainage: Water logging takes place inside prison. Since the prison floor/jail ground is lower than the surrounding areas. Thus incase of a heavy shower water stagnates inside prison ground and takes over 72 hrs to naturally dry up. The area behind the Juvenile/ Young Offenders Ward was extremely dirty. There was an overwhelming odour from rotting garbage that was staked behind the ward. About Legal Aid Clinic: No clinic operates here. Even Lok Adalat hasn t happened for a long time. No legal Aid lawyer comes to meet prisoners. Legal aid Lawyer is empanelled after long time of application.
2 Sarju Khand Ward 11/3 The Gandhi Maidan blast accused: 1. Faqruddin 2. Umar Siddique 3. Md. Mojibullah Ansari 4. Md. Firoz Asllam 5. Azharuddin Qureshi 6. Haider Ali No access to charge-sheet: They are all in prison since December None of them were allowed to keep a copy of the charge sheet. Apparently the charge-sheet is over a 1000 pages long so lawyer asked for a huge amount of money to get each their certified copy. One certified copy of charge-sheet was obtained but then pages were missing from the charge sheet. It is the principle right of the accused to have a free copy of the charge-sheet. However, the accused persons informed that they were not aware if the court had restricted them from having a copy of the charge-sheet but it is the prison administration that was not allowing them the copy of the charge-sheet. It was informed that the police SP had forbidden them from having, any document, pen, pencil, paper, as their case is under the NIA, so extreme measures are taken and prison administration is on high alert. No access to lawyer: They can t raise the matter in the court as their lawyer is also not very co-operative. They suffer the burden of the terrorist tag, thus the lawyer is not very keen to defend terror accused. Again, accused persons not only suffer the burden of the terror tag but they also have to suffer the consequences of being extremely poor at the same time. The dual burden of being terror accused and being poor are proving lethal. The lawyer has lost interest in the case and does not attempt meeting them in the court. More over in the court they are so heavily covered by security that lawyer will have to go through special procedure every time he has to meet them. Considering the meagre amount of fees lawyer receives from his client, he clearly lacks inclination to meet client. Neither can the accused persons afford to request lawyer to meet them in prison. No access to medical treatment: Haider Ali, needs special treatment. He is suffering from a slip disk. He cannot move around, bed ridden. He was taken to PMCH but his treatment is not continuing. 3 1. Rajesh Kumar, in prison for 1 month, u/s of Arms Act. No lawyer. Needs Legal Aid High Security Ward: Bindu Singh, in prison for 13 yrs, UTP, plenty of cases. List of cases in lower courts: -Jehanabad- 18 cases, all the charges are from between the years None of the cases are disposed. -Bokaro- 13 cases in total. 7 acquittal and 6 pending. -Patna-84 cases in total. Of which acquitted in 48 cases. -Dhanbad-7 cases. He complained that his production warrant from other state or district doesn t come regularly. Even when the warrant comes there is very less time for prison administration to arrange for his travel to the respective court. Eg: there are instances if hearing is on Wednesdayproduction warrant came from court to prison on Monday evening. Again if production warrant reaches prison on time then due to non-availability of guards he is not sent to the respective courts. He wants to run all his cases concurrently since they are old cases and he has been in prison for nearly 10 yrs now as an UTP. He wants speedy disposal of all the cases. Nishant in prison for 6 yrs. He has been convicted, given life sentence in 1 case of abduction and he has filed an appeal in Patna HC. However, claims appeal pending past 5 yrs. But his complain was of another case of Arms Act, which was charged 6 yrs ago yet not a single witness has passed. Case in Patna Civil court, he has no idea what is happening in the case at moment. Condemned prisoners: Amin Manjhi, condemned prisoner (Capital Punishment) by Hilsa Lower Court, 1 yr ago. He needs lawyer to file appeal in HC, since he has never seen his private lawyer and thus not sure if he has a lawyer. His family hasn t visited him in months. Md. Shamsher Alam, condemned prisoner (Capital Punishment). He is charged for serious rioting. He came to prison in 2003, he remained in prison as UTP for 11 yrs then he was convicted in His case is on appeal in the HC. Kundan Kumar, in prison for months. Not aware of charge said he is accused of theft. He has no family visitor and has no lawyer. Needs Legal Aid He was kept in high Security ward because he got into a fist fight with other prisoners.
4 Anees Rupesh, he is in prison for the past 3 ½ yrs, case was charged 2 ½ yrs ago, but case is on stand still and not a single witness has passed. He is imprisoned under sections of dacoity and 302 IPC. Anil Sharma, in prison for 18 yrs, thus his name should now go to remission board for consideration. However, the problem with his remission calculation is he was in Jharkhand prison from 1997 till IG Prison of Bihar cannot calculate remission of prisoner in other state. 9 accused persons were in the High Security cell who had been transferred from Suarat prison. They were in Beur prison past 10 days. They didn t want to be kept in High Security prison and also wanted to know ground of keeping them in High Security Prison. They were all charged u/s 379/461/66D IPC. They also informed that one among them namely, Shambhu Karan Singh might be suffering from malaria thus needed immediate medical treatment. They didn t have lawyers till date of inspection. However, they claimed that they were expecting their family members to visit them soon and then they can keep lawyers. Bhairo Singh, convicted under NDPS Act, Application has gone for Legal Aid Lawyer for HC appeal over a year ago yet Lawyer has not been empanelled. Needs Legal Aid Lawyer for HC appeal. Cuha, NDPS, in prison for 8 months. No lawyer. Needs Legal Aid He was in High Security prison because he was caught smoking ganja inside prison. Manish Kumar, in prison for 3 yrs, u/s 302 IPC. No No visitor. Needs Legal Aid Ranjesh Kumar@ Mantu Shaw, in prison for 3 yrs, motorcycle theft. He needs Legal Aid Fantoos, in prison for 5 months, u/s NDPS. No Needs Legal Aid Kamal Rai, Kamal Rai, convicted in 1 case (302IPC), appealed in High Court then granted bail in the same case. He has 3 u/s 307 and 395 IPC which are under trial for 13 yrs, in Hajipur Court. He was sent to Beur on Administrative grounds 4 monts ago but he wasn t produced in court in the past 4 months. He requests the case be let to continue in Hajipur court and he be produced there. Bhagdeo Rai, he is in prison from 2006, has several charges on him. 302 IPC, 120B. He has one lawyer who looks after all cases and he knows not much about the cases. He complained that he has a case in Hajipur court but he hasn t gone for production for past 11 months to Hajipur Court.
5 Md. Zaffar Alam, convicted in Abduction case in Appeal in Jharhand HC, but he couldn t go for hearing since he is in Patna. Also he has a case pending in Patna Court from 2007, his case has been chare-sheeted, but the case is still not charged. Woman Ward Ward 3 20 inmates and 10 fans Nusrat Parveen, in prison for theft of Rs. 8000/-, Has a 2 yrs old child with her in prison. Munna Devi, in prison for 3 yrs, convicted 4 months ago in 498A case. Aged appears to be above 80yrs. She needs sarees has no clothes to wear. She has no visitors. He son is in jail too yet no one comes to meet her. Other inmates informed that her case has gone for appeal but she has no information regarding the same. Jyoti Kumari, in prison for 9 months, accused of abduction. Needs Legal Aid She is from Punjab. Sobha Kumari (In prison for 3 months) and mother Meena Kumari (in prison for 1 month), u/s of dacoity. No visitor. No lawyer. Needs Legal Aid Pyari Devi, very old and infirm, aged around 70 yrs. In prison for 4 months. Cannot hear and is not aware of what is happening around her. She is not aware of charge. Claims that her elder son put her behind bars as she did not give a share of property. Younger son comes to visit her. If sone has kept a lawyer then she has a lawyer or else she doesn t have a lawyer. Other inmates too could not inform if she has a lawyer. Her son comes from Bettiah. Needs Legal Aid Urmila Tanti and Kusum Tanti, in prison for 2 yrs. NDPS case. Bail granted 2 yrs ago, requires family bailer. But No family. They have no one at home. The mother and the daughter are daily waged labourers. Once they were allotted a job of carrying goods to another place for which they would be paid 2000/- they were not aware what was in the bag. Only after they were caught did they find out that they were made to carry ganja. They need legal aid lawyer. Meena Sharma, 14 yrs in prison, u/s 302 IPC. Convicted in Appeal Pending in HC.
