3 PAT I: THE PEAMBLE THE TITLE This amendment, being an amendment to the Official Plan of the Town of Milton shall be known as: Amendment No. XX To the Official Plan of the Town of Milton 6096 & 6110 egional oad 25 (Framgard Node), (Part of Lot 6, oncession 2 (NS Trafalgar)) Part 2, ; Parts 2& ; Part 4, ; and Part 19, (Town of Milton) (LOPA-XX/18) PUPOSE OF THE AMENDMENT The purpose of this amendment is to add a Specific Policy Area to the subject lands to increase the maximum retail and service commercial area to 2,787 square metres for purpose-designed stand-alone buildings. LOATION OF THE AMENDMENT The subject lands are located on the west side of egional oad 25 and north of Britannia oad (egional oad No. 6). The lands are municipally identified as 6096 and 6110 egional oad 25 and are legally described as Part of Lot 6, oncession 2 (NS Trafalgar), Town of Milton. The location of the property is illustrated in Figure 1. BASIS OF THE AMENDMENT The subject lands are located within the Boyne Survey Secondary Plan and are designated Major Node Area, with applicable policies found in Section The Town of Milton approved an Official Plan Amendment (OPA 48, By-law ) on May 28, 2018 amending the Boyne Survey Secondary Plan policies for esidential High Density, Secondary Mixed-Use Nodes, and Major Node designations. Through OPA 48, Section e was amended to restrict retail and service commercial uses for purpose designed buildings to 1,860 square metres, while the maximum commercial area remains unchanged at 2,787 square metres if located on the ground floor of a multi-storey building. This resulted in the proposed commercial building exceeding the new maximum for purpose designed buildings. The proposed amendment will permit the development of 2,787 square metres of retail and service commercial area within a stand alone two-storey building, with retail uses on ground floor and office/service commercial uses on the second floor.
4 PAT II: THE AMENDMENT All of this document, entitled Part II: THE AMENDMENT consisting of the following text constitutes Amendment No. XX to the Town of Milton Official Plan and the Boyne Survey Secondary Plan. DETAILS OF THE AMENDMENT The Town of Milton Official Plan and Boyne Survey Secondary Plan is hereby amended by Official Plan Amendment No. XX, pursuant to Sections 17 and 21, and 22 of the Planning Act, as amended, as follows: 1.0 SHEDULE HANGE 1.1 Amending Schedule I1 Urban Area Specific Policy Areas by adding Special Policy Area No. XX to the lands at 6096 & 6110 egional oad 25 (known legally as Part of Lot 6, oncession 2 (NS Trafalgar)). 2.0 TEXT HANGE 2.1 Adding the following text to Section 4.11 Specific Policy Area : XX Notwithstanding Section e) as amended, the land identified as Specific Policy Area No. XX on Schedule I1 of this Plan, being the lands at 6096 & 6110 egional oad 25, may be developed to provide retail and service commercial uses in purpose designed building(s) to a maximum gross floor area of 2,787 square meters. 3.0 IMPLEMENTATION AND INTEPETATION This Official Plan Amendment shall be implemented and interpreted in accordance with the implementation and interpretation provisions set out in the Amendment and the relevant sections of the Official Plan.

Pursuant to Subsection 17(27) of the Planning Act,.S.O. 1990, c. P. 13, as amended, this Official Plan Amendment comes into effect the day after the last day for filing a notice of appeal, if no appeal is filed pursuant to Subsections 17 (24) and (25). Where one or more appeals have been filed under Subsection 17 (24) or (25) of the said Act, as amended, this Official Plan Amendment comes into effect when all such appeals have been withdrawn or finally disposed of in accordance with the direction of the Ontario Municipal Board. 3. In the event that the egional Municipality of Halton, being the Approval Authority, has declared this Official Plan Amendment to not be exempt, the lerk is hereby authorized and directed to make application to the Approval Authority for approval of the aforementioned Amendment Number XX to the Official Plan of the Town of Milton.
