No website : OFFERS INVITED FOR RATES OF COUNTRY LIQUOR Sealed Offers are invited from reputed running distilleries/ bottling plants located anywhere in India for manufacture and supply of Plain (A Grade Rectified Spirit/ ENA based) country Liquor of 40 UP in sealed glass Nips (180ml) on F.O.R. basis at Depots of Rajasthan State Ganganagar Sugar Mills Limited in Rajasthan for a period from June, 2011 to 31 st March, The maximum quantity required cases per day. The quantity may be reduced as per the requirement of RSGSM. The Offerer should be a distiller/ Bottlers holding valid licence for distillery Bottling Plant from the competent authority and the distillery should have a distillation plant to manufacture Rectified Spirit/ ENA. The F.O.R. rate (per case) must be quoted districtwise given in the offer document for supply of 40 UP Plain (Rectified Spirit / ENA based) Country Liquor in sealed Nips (180ml). Offered rates must be quoted separately for Nips in Rectified Spirit/ ENA category. Details are available in tender document and on website also. Prescribed offer form will be sold till PM on on payment of Rs. 500/- (by post Rs. 550/-) and filled up offers shall be accepted till 2.30 PM and opened on the same date at 3.00 PM alongwith Demand Draft of E.M.D. Rs lacs in the name of Rajasthan State Ganganagar Sugar Mills Ltd., payable at Jaipur. The rates should be submitted online. 2. The process, username and password for accessing the web portal will be provided along with receipt of tender fees by RSGSM. 3. Please read carefully the steps of submitting offer form online. 4. The printed copy of rates should be attached duly signed with offer form. 5.. The following annexure of rates is for demonstration only. Please use printed hard copy generated from RSGSM web portal only. 6. Handwritten rates would not be accepted with offer form. 7. In case any rate difference found between online rates and attached copy of offer form, the rates shall be considered on the basis of attached copy duly signed with offer form. 8. Please call on for any assistance. The rates must be offered F.O.R. at RSGSM Depots for supply of Country Liquor 40UP duly packed & sealed as per specification of RSGSM in Glass bottles. The offer rates for 40UP should not exceed Rs for R.S. based and Rs for ENA based Country Liquor because the selling rate for R.S. based C.L. is Rs. 330/- per case and for E.N.A. based C.L. is Rs. 349/- per case Above rates as fixed by the Government vide its order dated and margin profit allowed for RSGSM is 20% on offered price. No addition and/or alteration should be made in the offered rates. No overwriting should be done. Corrections, if any, should be done clearly and should be initialed. 8 TERMS & CONDITIONS OF OFFER As per the Rajasthan State Excise Policy the entire supply of Country Liquor (i.e. 100%) has been assigned to RSGSM. Therefore RSGSM has to purchase Country Liquor from running private distilleries/ bottlers, to procure proper quality of Country Liquor for supply. The following terms & conditions are determined for the offer:- 01. The Director Incharge, RSGSM shall finalise the offer of various distillers/ bottlers received for supply of Country Liquor. 02. (a) There shall be no case under Excise Act or any other criminal law registered or challaned any where, against the offerer/ supplier firm or any of the shareholder. The supplier shall submit an affidavit that no case is pending to this effect. (b) The supplier firm should have an Excise license valid upto minimum 31 st March, 2012 & distillery/ bottling plant must be continue to produce Country Liquor (A certified copy of such licence or related such substantial documents shall be submitted with the offer). (c) The supplier firm will mention the production & bottling capacity of their Distillery/ bottling plant on per day and per month basis. Capacity available/ offered for RSGSM should be mentioned clearly. (d) The country Liquor produced and supplied should meet the following specifications:- (i) Rectified Spirit & ENA used for manufacture of Country Liquor should be of A Grade as per IS Specification. (ii) The strength of plain Country Liquor manufactured & supplied to RSGSM shall be of 40 UP in Glass Nips (180ml) (iii) As per Excise Policy of Rajasthan State 40 UP Country Liquor shall be supplied in Glass bottles (Nips 180ml) only, if any changes occur or Government allows full or part filling of 40 UP Country Liquor in PET containers (Nips 180ml), in future, the same may be allowed to the supplier. (iv) The Country Liquor in Glass bottles(nips) shall be supplied to our Depots with in 7 days of the placing of supply order / supply schedule. (v) Packing material of good quality shall be used. If there is any loss due to inferior quality packing material the supplier shall bear such losses. (vi) The Country Liquor should be supplied in Nips (Glass) bearing hologram on it. Presently the fixing of Holograms is discontinued but as and when it will resume, the supplier will have to affix it. (vii) No transit wastage/ Breakages shall be allowed. Filled Nips of Country Liquor shall be supplied with proper seal, label & hologram as per design and specification approved by Excise Department duly packed in carton boxes. (viii) Rates should be quoted district wise on F.O.R. basis at various depot of RSGSM Ltd., situated in Rajasthan for a period from June, 2011 to 31 st 7

9 March, The rates shall remain FIRM for the year upto 31st March, 2012, as per tender. However, rates may be reviewed after six month only at the level of State Government of Rajasthan, if there is unnatural rise/ fall in cost of Rectified Spirit on submitting of proof. (ix) The manufacturer shall abide by all the provisions of Excise Act and Rules there under for manufacturer and supply of Country Liquor at our Depots. (x) Supplier's name should be mentioned on every corrugated boxes of Country Liquor. (xi) "For sale in Rajasthan only" must be printed on each Label & Corrugated Box. 03. RSGSM shall retain the right to allocate the quantity of Country Liquor and destinations as per its requirement. 04. In case of any dispute arising in contract, the matter will be referred to Sole Arbitrator appointed by Director Incharge, RSGSM, whose decision shall be final and binding on both the parties. 05. Inspection : The RSGSM Ltd. is at liberty to carry out sudden inspection of the factory/ works of the Supplier before or during the supply contract without prior intimation. 06. Cancellation: In case RSGSM do not require part or entire ordered quantity due to any reason, it may cancel the part or entire order during the period of contract and/ or any extended period, for which no claim whatsoever of the supplier shall be entertained. 07. Testing: The random sample for testing of supplied Country Liquor shall be taken and necessary testing shall be done at Laboratory of RSGSM or Excise Department, as stipulated by R.S.G.S.M. time to time. 08. In the event of any breach of conditions of the contract at any time on the part of the supplier, the contract may be terminated summarily by the Director Incharge with such conditions as may be deemed fit. 09. All legal proceedings, arising out of this contract shall be subject to the jurisdiction of the courts situated at Jaipur City only. 10. If the supplier fail to execute the order/ contract within the specified period and if such failure to deliver the goods or/ complete in prescribed time as aforesaid, have arisen from and unforeseen cause such as strike, fire, accident, act of GOD, Natural Calamity resulting in stoppage of work in the factory, of the manufacturer or similar reason which the Director Incharge may find valid for an extension of the time, he may extend the period without charging any agreed liquidated damages. His decision shall be final regarding the sufficiency or otherwise of the grounds for extension of time. 11. Distilleries/ Bottling Plant have to provide Brand Name of Liquor. 12. FORCE MAJEURE: If Government imposes any restriction on the supply, matter shall be considered under Force Majeure Clause. 13. LIQUIDATED DAMAGES :- 8

10 (a) If the supplier fails to execute the order/ contract within the period specified in the tender form, the Director Incharge may at his discretion allow extension of time subject to recovery from supplier as liquidated damages and not by way of penalty, a sum equal to the following percentage of the value of goods which the supplier has failed to supply for the period of delay as stated below :- Delay upto one forth period of the prescribed delivery period 2.5%. Delay exceeding one fourth but not exceeding half of prescribed delivery period 5%. Delay exceeding half but not exceeding three fourth of the prescribed delivery period 7.5% Delay exceeding three fourth but not exceeding the period equal to the prescribed delivery period 10% (b) Should the supplier fail to execute or complete the order/ contract within the period specified in the tender form and if such failure to deliver/ complete the order in prescribed time as aforesaid have arisen from, any unforeseen cause such as strike, fire, accident, act of GOD resulting in stoppage of work in the factory of the tenderer if similar reasons which the Director Incharge may find valid for an extension of the time he may extend the period without charging any agreed liquidated damages. His decision shall be final regarding the sufficiency or otherwise of ground for extension of time. Notes :- Fraction of day in reckoning the period of delay in supplies shall be eliminated if it is less than half a day. The maximum amount of liquidated damages shall be 10%. 14. The quality of Country Liquor to be supplied by Distillers/ Bottlers should conform to specifications prescribed by RSGSM and Excise Department of Rajasthan. If the Country Liqour supplied is found to be spurious/ not fit for human consumption, the supplier shall be responsible for all damages that might accrue directly or indirectly to the consumer/ RSGSM, if any. 15. Quantity & supply schedule:- The supply of Country Liquor shall be made by Private distillers/ bottlers as per supply schedule to be given separately from time to time. The ordered quantity can be increased/ decreased at the discretion of RSGSM & the supplier shall have no claim whatsoever on this account. 16. Supply period :- Supply shall be started within seven days from the date of issue of order by RSGSM & as per supply schedule to be given from time to time. 17. Specification :- The Country Liquor to be supplied should conform to specification prescribed by RSGSM and Excise Deptt. It should be fit for potable use and the strength of Country Liquor shall be 40 0 UP. Certificate issued by concerned Excise Office of exporting unit regarding its fitness for human consumption shall be furnished with each consignment. In case said certificate(s) are not sent alongwith each consignment, the consignment shall not be accepted by RSGSM. If the Country Liquor so supplied by the supplier is found at any stage, to be spurious/or not fit for human consumption, the entire consignment shall be rejected at the risk and cost of the supplier and the supplier shall be responsible for legal/ criminal proceedings arising there from and also damages that might accrue directly or indirectly to the consumer/ RSGSM, if any. 9

11 18. Risk & Cost :- In case of your inability to supply the ordered quantity in full/part, which may cause loss to us in procurement of the Country Liquor from other sources, it will be done at your cost and risk without prior notice. 19. Payment :-100% payment shall be released weekly by cheque from Head Office after receipt of verified bills from respective Depot & District Depots on sale of consignment of Country Liquor to licensees. Remittance charges on payment made to Supplier except through cheque will be borne by the Supplier unless specifically agreed to by the RSGSM Liability on account of excess wastage etc. :- All excise rules and regulations and other regulations of the exporting State / Rajasthan Government that are in force at the time of manufacture and delivery of the goods or may be in force at the time of actual supply, shall be applicable on the supplier. If any liability arises on RSGSM on account of excess wastage, loose strength until the completion of the contract of Country Liquor or on account of any violation of Excise regulation and/ or any other Government regulation, the same will be borne by the Supplier and it shall be the responsibility of the supplier to indemnify RSGSM by those amounts or otherwise get it waived off from the appropriate authorities of concerning state. 21. Insurance :- Insurance of material in transit shall be arranged by the supplier at his own cost. 22. Tax deduction at source :- Income tax and service tax deduction will be made at source at the rates notified by the Central Government from time to time if applicable on the supply contract. 23. EMD/ Security Deposit :- supplier shall have to deposit EMD Rs Lac by DD/ Bankers Cheque in the name of Rajasthan State Ganganagar Sugar Mills Ltd./, payable at Jaipur. Without EMD tender shall not be accepted. Successful Tenderer shall have to deposit a sum of Rs lac as Security deposit. This shall be returned after successful completion of the contract. In case of non fulfilment of the contract, the security amount deposited can be forfeited in full or in part. Decision of the Director In-Charge in the regard shall be final. No interest shall be paid on such deposit. No adjustment of any previous balance against security will be allowed. 24. Any duty, Tax etc, paid at the time of purchase shall be refundable to RSGSM if the same is found not to be payable afterwards. 25. A bottler who owned a bottling plant with an investment of more than Rs lac and having Semi automatic/automatic Bottling plant shall be eligible to participate in the tender. The proof of technology and investment must be submitted with the tender. Tender without documentary proof will not be entertained. 26. No Counter condition shall be accepted. Conditional tender would be rejected outrightly. 27. A supply time schedule shall be prescribed and successful tender has to comply with the schedule of supply as per destination. 28. The penalty by way of Liquidated Damages (LD) shall be charged from such successful tenderer who fails to supply Country Liquor as per schedule of supply 10

12 issued by the Purchaser. The rates of LD has been prescribed at condition No.13 of this document. 29. In case Import duty is made applicable by the Excise Department of the state of Rajasthan, same shall be payable by the purchaser i.e. RSGSM. 30. The Label registration of 40 UP Country Liquor shall be executed by the successful tenderer and registration Rs.25000/- per label registration and other requisite charges as prescribed by Excise Department of Rajasthan shall be paid by the successful tenderer for their respective brand. 31. Supplies will be made underbond by the successful tenderer on receipt of order for supply/schedule of supply issued by the purchaser i.e. RSGSML. Import Permit shall be issued by the District Excise Officer, Jaipur city on receipt of requisite/prescribed duties and charges if any. In case of such consignment/quantity of Country Liquor so supplied is found sub standard/rejected/not sold/transit breakages etc shall be liability of the supplier/successful tenderer of Country Liquor. 32. The successful tender will get the export permit from the respective state from where such Country Liquor is being exported to the State of Rajasthan. Export duties and all other charges relating to supplies to Rajasthan shall be liability of the successful tender/manufacturer. 33. The competent Excise Authority of the exporting unit shall issue legal and valid Transport Permit from the manufacturing places to the destination depot of RSGSML. All responsibility, legal liabilities, liability on imposition of duties, penalties etc. on account of any violation shall be sole responsibility of the manufacturer/ successful tenderer. RSGSML or Excise Department of the State of Rajasthan shall, in no circumstances, can be assigned responsibility of any negligence/erosion/ mistake for/ any wrongful act on the part of supplier/successful Tenderer. 34. Consent of the Excise Commissioner of the State where distillery/bottling plant is situated for supply of country liquor from that State to Rajasthan in which the capacity of the distillery/bottling plant should be clearly mentioned. 35. A statement indicating the maximum quantity of country liquor that can be supplied to Rajasthan by the tenderer from each of its units, must be attached with the tender offer. 36. The tenderer will give complete addresses of its sister concerns alongwith name of partners with their complete addresses and extent of share. 37. The approved distiller/bottler shall have to use glass bottles with freedom to use old bottles. (Seal & Signature of Offerer) 11
