2 Resolution No Adopted June 19, 1985 Overland park made a commitment to the communities of Morse and Stanley that when annexed, the city would recognize and preserve the character and historical significance of these communities as future development occurs.

3 Minutes from October 1, 2007 City Council Meeting: Rezoning Proposal Opposed Comments from city council members regarding their opposition to rezoning this property at the council meeting on 10/1/07. Councilman Spears - In terms of the traffic issues and safety concerns, he would prefer to see the lowest impact in this area. Did not support rezoning to CP-0 Mayor Gerlach - He would like the least intensive use on this property and the best type of development for the neighborhood. Did not support rezoning to CP-0 Mr. Lyons - He concurred that other alternatives need to be considered for this property as currently zoned. Did not support rezoning to CP-0 The motion to deny rezoning passed by a roll-call vote of

Introducing commercial zoning into a neighborhood within our two communities which has never been planned to have commercial and where substantial vacant commercial properties exist elsewhere in close proximity For these reasons, we would strongly recommend against approving the proposed commercial rezoing.

14 From the Executive Airport Comprehensive Compatibility Plan: Chapter III, Section 4, Land Use Restrictions state: Furthermore, single land uses which attract crowds in excess of 500 persons at any one time (such as hospitals, schools, theaters, arenas, stadiums, and the like), or concentrate persons who are unable to respond to emergency situations (such as children, elderly, or handicapped, such as day care establishments, nursing homes, and elderly care or special care facilities) should be evaluated carefully due to the large concentration of persons at such facilities. Such uses may be found to be appropriate within the Airport Interest Area based upon a thorough evaluation of the scope of the proposed development at the proposed location with regard to airport compatibility issues.
