2 Govt. of India ALL INDIA INSTITUTE OF MEDICAL SCIENCES, PATNA (An Autonomous body under MoHFW, Govt. of India) No. AIIMS/Pat/Tender/Almirah/2014 Dated Notice Inviting Tender for Supply of Almirah All India Institute of Medical Sciences, Patna (AIIMS Patna) invites bids for Supply of Steel Almirah & Glass Door Almirah form reputed companies/firms/individuals/societies etc. those are in the business for the last three years. Accordingly, sealed tenders are invited latest by up to 14:00 hrs. 2. The interested Companies/Firms/Agencies may send their bid complete in all respect along with Tender Fee of Rs. 1,000/- and Earnest Money Deposit (EMD) of Rs. 1,97,500/- (Rupees one lacs ninety seven thousand five hundred only) in the form of Demand Draft issued in favour of AIIMS, Patna, drawn on any scheduled bank payable at Patna and other requisite documents to the undersigned duly superscripted Bid for Tender No AIIMS/Pat/Tender/Almirah/2014 before 1400 hrs on 23 rd May, The bids received after this deadline shall not be entertained under any circumstances whatsoever. NOTE: The EMD and Tender Fee draft should be put in the envelope containing Technical Bid failing which the tender shall be rejected forthwith. 4. The sealed envelopes are to be deposited in the tender box placed at the office of Medical Superintendent, AIIMS, Patna or may be sent through registered/speed post addressed to The Medical Superintendent, All India Institute of Medical Sciences, Phulwarisharif, Patna Bids sent by COURIER will not be entertained. 5. Bids will be opened on at hrs in the presence of bidders or their authorized representatives who wish to participate in the bidding process with authorization letter. If the opening date happens to be a closed day/holiday, the tender will be opened on the next working day. 6. Any future clarification(s) and / or corrigendum(s) shall be communicated by the Medical Superintendent through the website 7. Director, AIIMS, Patna reserves the right to amend or withdraw any of the terms and conditions contained in the Tender Document or to reject any or all tenders without giving any notice or assigning any reason. 3 GENERAL INSTRUCTIONS TO THE TENDER 1. The tender is Two Bid document. The technical bid should contain all the relevant information and desired enclosures in the prescribed format along with Earnest Money Deposit (EMD) and Tender fee. The financial bid should contain only commercial. In case, any bidder encloses the financial bid within technical bid, the same shall be rejected summarily. 2. The tender Document can be downloaded from the website of AIIMS Patna i.e The Tenders should be typewritten or handwritten but there should not be any overwriting or cutting. Correction, if any, shall be made by neatly crossing out, initialing, dating and rewriting. The name and signature of bidder s authorized person should appear on each page of the tender. All pages of the tender document shall be numbered and submitted as a package along with forwarding letter on agency s letter head. 4. The Contracts concluded as a result of this Tender Inquiry shall be governed by the Terms & Conditions and other relevant instructions as contained in this Tender Document. 5. The prices/rates quoted should be indicated in words as well as in figures. 6. Bidders are requested to quote their prices on a firm & fixed basis for the entire period of the Contract. Bids of the firms received with prices quoted on variable basis shall be rejected straightaway. 7. Quotations qualified by such vague and indefinite expressions such as subject to prior confirmation, subject to immediate acceptance etc. will be treated as vague offers and rejected accordingly. 8. Bidders are requested to enclose a copy of their valid certificate of PAN No., TAN No, Sale Tax/VAT No./Service Tax No. or any other document as requested by the Institute with their tender. 9. Tenders received without Tender Fee and EMD amount by way of demand draft in favour of AIIMS, Patna will not be considered at all. 10. Refund of Earnest Money Deposit: The EMD submitted by unsuccessful bidders shall be returned to them without any interest whatsoever, within 15 to 90 days after conclusion of the contract with successful bidder. The EMD submitted by successful bidders shall be returned to them after the successful bidder deposits the performance security according to conditions stipulated in the bid document. 11. Bidders may note that if the date of tender opening given in this Tender Document is declared to be a gazetted holiday, the tender shall be opened on the next working day at the same timing. In such an event the closing hours for receipt of tenders in AIIMS will stand automatically extended up to hours of the next working day in the Government offices. 12. Late/delayed tenders received in AIIMS due to any reason whatsoever will not be accepted under any circumstances. 13. At any time prior to date of submission of tender, Tender Inviting Authority may, for any reason, or decision, modify the terms & conditions of the tender document by a corrigendum displayed on the website of AIIMS Patna ( In order to provide reasonable Page 3

4 time to take the amendment into account in preparing their bid, Tender Inviting Authority may or may not, at his discretion, extend the date and time for submission of tenders. 14. Tendering firms are at liberty to be present or authorize a representative to be present at the opening of the tender at the time and date as specified in the Schedule. The name and address of the representative authorized to attend the opening of the tender on behalf of a tendering firm should be indicated in the tender. The representative so deputed should also bring with him a letter of authority from the firm for having been authorized to be present at the time of opening of tender. Only one representative per firm shall be permitted to attend the opening of the tender. The name and address of permanent representative of the firm, if any, should also be indicated in the tender. Representatives of firms who have not submitted the tender or representatives not possessing authority letter from the bidders or outsiders shall not be allowed to attend the tender opening process. 15. DOCUMENTS COMPRISING THE BID: 16. The bids prepared by the bidder shall comprise of (1) The Technical Bid and (2) Financial Bid: TECHNICAL BID: - To qualify in the Technical bid the firm should have the minimum eligibility criteria; the firm in this regard should submit the following documents (a) Duly filled format of Technical Bid as per Annexure 1. (b) Copy of constitution or legal status of the sole proprietorship/ firm/company etc. (c) The technical bid should be accompanied by Demand drafts for bid security of the amount equal to sum of EMD amount as mentioned in the NIT (refundable). (d) Copy of Income Tax Return Filed Acknowledgements for last Three years. (e) Copy of PAN Card. (f) Copy of Sales tax/vat registration certificate. (g) The bidder should have adequate experience for supply/execution of similar work in Govt. offices/psus and other similar organizations. Necessary supporting documents like work orders for last three years to this effect must be submitted along with the offer. (h) Authorization letter/certificate from original manufacturer (if any) of the product. (i) Broachers, original technical catalogue with detailed specification and picture of the product offered. FINANCIAL BID: - The financial bid shall contain: Price Bid Form [as per Annexure 2] Prices must be quoted as per format specified, failing which tender shall be summarily rejected. Page 4

5 17. SUBMISSION OF BIDS 17.1 SEALING AND MARKING OF BIDS: The bidder shall wax seal the Technical and Financial Bids in separate envelopes and keep them in a bigger wax sealed envelope. The Technical Bid shall bear the name TECHNICAL BID OF Tender No. AIIMS/Pat/Tender/Almirah/ 2014 on the envelope, while the Financial Bid shall bear the name FINANCIAL BID of Tender No. AIIMS/Pat/Tender/Almirah/2014 on the envelope for avoiding any mismatch The bigger envelope containing technical and financial bids in separate envelopes shall be: (a) Addressed at the following address: Medical Superintendent, All India Institute of Medical Sciences, Medical College Building, Phulwarisharif, Patna (b) All the envelopes shall bear the Tender name, the tender number and the words DO NOT OPEN BEFORE (due date & time). (c) The envelopes shall indicate the name and address of the bidders to enable the bid to be returned unopened in case it is declared late or rejected. (d) Bids shall be delivered in person and shall be dropped in the tender box placed in the office of the Medical Superintendent, AIIMS Patna or shall be sent by Registered/Speed Post. Bids sent by COURIER will not be entertained. The Purchaser shall not be responsible if the bids are delivered elsewhere. (e) Venue of Tender Opening: Tender will be opened in the office of the Administrative Officer, AIIMS Patna at specified time on the due date. If due to administrative reason, the venue/ time of bid opening is changed, it will be displayed prominently on the notice board of the Institute as well as in the office of the Administrative Officer, AIIMS Patna. 18. BID PRICES: 18.1 The bidder shall give the total composite price inclusive of all levies and taxes (inclusive of VAT). The basic unit price and all other components of the price need to be individually indicated against the goods it proposed to supply under the contract as per price schedule given in Annexure-3. The offer shall be firm in Indian Rupees only. No foreign exchange will be made available by the purchaser Prices indicated on the Price Schedule shall be entered in the following manner: (i) The price of the goods shall be quoted in total (inclusive of all taxes and levies) for each item. (ii) The bidder shall quote only one price for each item and if more than one price is quoted under different options the rate quoted by him in the first option only will be valid and will be taken for evaluation for all the items given in schedule of requirement The prices quoted by the bidder shall remain fixed during the entire period of contract and shall not be subject to variation on any account. A bid submitted with an adjustable price quotation is likely to be treated as non-responsive and rejected. Page 5

6 18.4 The unit price quoted by the bidder shall be in sufficient detail to enable the purchaser to arrive at prices of the items offered DISCOUNT, if any, offered by the bidders shall not be considered unless they are specifically indicated in the price schedule. Bidders desiring to offer discount shall therefore modify their offers, suitably while quoting and shall quote clearly net price taking all such factors like Discount, free supply, etc. into account The price approved by the Administrative Officer for procurement will be inclusive of levies and taxes, packing, forwarding, freight and insurance as mentioned in para 13.1 above. Break up in various heads like Custom duty, Excise duty, Sales Tax, Insurance freight and other taxes paid/payable as per clause 13.2 is for the information of the purchaser and any changes in the taxes shall have no effect on the price during the scheduled delivery period. 19. TECHNICAL EVALUATION: 19.1 Purchaser shall evaluate the technical bids to determine whether they are complete, whether required sureties have been furnished, whether the documents have been properly signed and whether the bids are generally in order Prior to the financial evaluation, the Purchaser will determine the substantial responsiveness of each bid to the Bid document. For purposes of these clauses, a substantially responsive bid is one, which conforms, to all the terms and conditions of the Bid Documents without material deviations. The Purchaser's determination of bid's responsiveness is to be based on the contents of the bid itself without recourse to extrinsic evidence A bid determined as substantially non-responsive will be rejected by the Purchaser and shall not subsequent to the bid opening be made responsive by the bidder by correction of the nonconformity Demonstration of Samples: Samples of product offered by the bidders must be submitted at the time of opening of technical bid before the technical bid evaluation committee. Financial bids of only those bidders will be opened samples of which are found fit for use. 20. FINANCIAL EVALUATIONS AND COMPARISON OF SUBSTANTIALLY TECHNICAL RESPONSIVE BIDS: 20.1 The purchaser shall shortlist those who are eligible and have submitted substantially technical responsive bid for opening of financial bid. Successful Bidders would be called to attend opening of financial bids. The Financial Bids of unsuccessful bidders would not be opened and destroyed Arithmetical errors shall be rectified on the following basis. If there is a discrepancy between the unit price and total price that is obtained by multiplying the unit price and quantity, the unit price shall prevail and the total price shall be corrected by the Purchaser. If there is a discrepancy between words and figures, the amount in words shall prevail. If the Supplier does not accept the correction of the errors, his bid shall be rejected The evaluation and comparison of responsive bids shall be done on the price of the goods offered inclusive of Levies & Taxes i.e., Sales Tax, VAT & Excise Duty, packing, forwarding, freight Page 6

7 and insurance etc. as indicated in the Price Schedule in annexure- 2 of the Bid Document but exclusive of octroi/entry tax which will be paid extra as per actual, wherever applicable The Purchaser may waive any minor infirmity or non-conformity or irregularity in a bid which does not constitute a material deviation, provided such waiver does not prejudice or affect the relative ranking of any bidder. 21. AWARD OF CONTRACT: PLACEMENT OF ORDER The Purchaser shall consider placement of orders for commercial supplies on those bidders whose offers have been found technically, commercially and financially acceptable and whose goods type have been approved/validated by the purchaser. The Purchaser reserves the right to counter offer price(s) against price(s) quoted by any bidder. 22. PERFORMANCE BANK GUARANTEE & EXECUTION OF CONTRACT: 22.1 Firm whose offer is accepted will have to furnish Performance Bank Guarantee of an amount equal to 10% of the value of contract, in favour of AIIMS Patna issued by any scheduled bank The performance Bank Guarantee submitted should be valid for 06 months The Performance Bank Guarantee shall be refunded within 15 to 90 days after completion of the contract as per order, or after the expiry of contract on satisfactory completion of the same whichever is later No interest will be paid on Performance Bank Guarantee/Earnest Money Deposit In case of breach of any terms and conditions of the contract or on unsatisfactory performance, the amount of security deposit shall be liable forfeited by Medical Superintendent, AIIMS Patna and his decision shall be final The expenses of completing and stamping the agreement shall be paid by the bidder. 8 GENERAL TERMS AND CONDITIONS 1. Parties: The parties to the Contract are the supplier (the tenderer to whom the work has been awarded) and the AIIMS, Patna. 2. Address: For all purposes of the contract including arbitration there under, the address of the supplier mentioned in the tender shall be the final unless the supplier notifies a change of address by a separate letter sent by registered post with acknowledgement due to the AIIMS, Patna. The supplier shall be solely responsible for the consequences of any omission or error to notify change of address in the aforesaid manner. 3. Bid Security: 3.1 The successful tenderer has to deposit a security equivalent to 5% of the tender amount in the shape of bank draft payable in favour of Director, AIIMS, Patna Bank guarantee pledged to in favour of Director, AIIMS, Patna within 7 days of acceptance of the tender. 3.2 No request for transfer of any previous deposit of Bid or Performance Securities or payment of any pending bill held by the AIIMS, Patna in respect of any previous work will be entertained. 3.3 Tenderer shall not be permitted to withdraw his offer or modify the terms and conditions thereof. In case tenderer fails to observe and to comply with any stipulations made herein or backs out after quoting the rates, the aforesaid amount of Bid Security will be forfeited to the Government. 3.4 The tenders without Bid Security Deposit will be summarily rejected. 3.5 No claim shall lie against the Government /AIIMS, Patna in respect of erosion in the value or interest on the amount of earnest money deposit or security deposit. 4. Preparation and submission of Tender: The tender should be submitted along with EMD. The envelope should be superscripted with "Tender Number" and subject of Tender. 5. Signing of Tender : Individual signing the tender or other documents connected with contract must specify whether he signs as: (a) a 'sole proprietor' of the concern or constituted attorney of such sole proprietor, (b) a partner of the firm, if it be a partnership firm, in which case he must have authority to execute contracts on behalf of the firm and to refer to arbitration disputes concerning the business of the partnership cither by virtue of the partnership agreement or by a power of attorney duty executed by the partners of the firm. (c) Director or a principal officer duly authorized by the Board of Directors of the company, if it is a Company Note below: a) In case of partnership firms, a copy of the partnership agreement, or general power of attorney duly attested by a Notary Public, should be furnished on stamped paper duly sworn or affirmed by the partners admitting execution of the partnership agreement or the general power of attorney. The attested copy of the certificate of registration of firm should also be Page 8

9 enclosed along with the tender. b) In the case of partnership firms, where no authority to refer disputes concerning the business of partnership firm has been conferred on any partner, the tender and all other related documents must be signed by all partners of the firm. c) A person signing the tender form or any documents, forming part of the tender, on behalf of another person should have an authority to bind such other person and if, on enquiry it appears that the persons so signing has no authority to do so, the Director, AIIMS, Patna may without prejudice, cancel the contract and hold the signatory liable for all costs, consequences and damages under the civil and criminal remedies available. d) The tenderer should sign and affix his/her firm stamp on each page of the tender and all its Annexure as the acceptance of the offer made by the tenderer same will be deemed as a contract and no separate formal contract will be drawn. e) NO PAGE SHOULD BE REMOVED/DETACHED FROM THIS NOTICE INVITING TENDER. (This subclause will not be applicable in cases where signing of a separate agreement is considered by the AIIMS, Patna as necessary.) 6. Price Bid: a) The Price Bid should be submitted in form given in Annexure lll. b) A consolidated price including taxes should be quoted. The price quoted shall be firm and final and nothing extra is payable. c) Taxes, if any, to be paid need to be duly indicated in the bid otherwise no extra payment would be made for this purpose. d) Terms of payment as stated in the Tender Document shall be final. e) At the time of payment of bills, the income tax, if any, shall be deducted at source as per Government rules and guidelines as may be prevailing at the time of such payment. 7. Validity of the bids : The bids shall be valid for a period of six month from the date of opening of the tenders and can be extended by competent authority on month to month basis.this has to be so specified by the tenderer in the price bid. 8. Opening of Tender : The tenderer is at liberty either himself or authorize not more than one representative to be present at the time of opening of the tender. The representative attending the opening of the tender on behalf of the tenderer should bring with him a letter of authority from the tenderer and proof of identification. On the date and time indicated in the "Schedule of Tender", price bids will be opened and read out in the presence of tenderers' representatives. 9. Criterion for Evaluation of Tenders: The evaluation of the tenders will be made first on the basis of technical information furnished in Page 9

10 tender and then on the basis of price information furnished in form given in Annexure-III. The price bid (Annexure III) of such firms found valid based on technical parameters. It must be kept in view that no decision will be given by the Tender Evaluation Committee or any inferences drawn during the meeting of this committee by the tenderers or their representatives will be their own view and the AIIMS, Patna will not be responsible to abide by the same. The reasons for selection or rejection of a particular tender will not be disclosed. The award of work will be further subject to any specific terms and conditions of the contract given in part II of Annexure II of this Notice. 10 Right of Acceptance: a) The Director, AIIMS, Patna reserves all right to reject any tender including of those tenderers who fail to comply with the instructions without assigning any reason, whatsoever and does not bind itself to accept the lowest or any specific tender. The decision of Director, AIIMS, Patna in this regard will be final and binding. b) Any failure on the part of the Supplier to observe the prescribed procedure and any attempt to canvas for the work will prejudice the Supplier's quotation. 11. Communication of Acceptance: Successful Tender will be informed of the acceptance of his tender. Necessary Instructions regarding the amount and time provided for Security Deposit will be communicated. 12. Time Schedule of completing of work: The work must be completed within a period of 45 days or time specified in the work order from the date of award of work as per schedule mentioned in Part-II of Annexure II. 13. Penalty: In the event of the Supplier failing to : (i) Observe or perform any of the conditions of the work as set out herein,or (ii) Execute the work in good and workmen-like manner and to the satisfaction of and by the time fixed by the AIIMS, Patna; (a) It shall be lawful for the AIIMS, Patna in its discretion in the former event to remove or withhold any part of the work until such times as he may be satisfied that Supplier is able to do and will duly observe the said conditions and in the latter even to reject or remove, as the case may require any work executed otherwise than in a good and workman like manner to the satisfaction of and by the time fixed by the AIIMS, Patna and in both or either of the events aforesaid to make such arrangements as he may think fit for the reproduction of the work so removed or work in lieu of that so rejected or removed as aforesaid on account and at the risk of the Supplier. (b) Provided further that if in either event any excess cost be incurred by reason of the difference between the prices paid and the accepted rates, AIIMS, Patna may charge the amount of such excess cost to the Supplier and the same may at any time thereafter be deducted from any amount that may become due to the Supplier under this or any other contract or from the security deposit or may be demanded of him to be paid within seven days to the credit of the AIIMS, Patna. (c) In the event of discovery of any error or defect due to the fault of the supplier at any time after the completion of work ordered, the supplier shall be bound, if called upon to do so, rectify such Page 10

11 error or defect at his own cost to the satisfaction of and within the time fixed by the AIIMS, Patna. In the event of the delivery of any defective work, which owing to urgency or for any other reason cannot be wholly rejected the AIIMS, Patna shall have the power to deduct from any payment due to the Supplier such sum as he may deem expedient. (d) In the event of a work being wholly rejected, the AIIMS, Patna may at its discretion either: (i) Permit the Supplier to re-do the same within such time as he may specify at Suppliers own cost which shall include the costs of all sorts i.e. materials, labour, overheads, transportation etc, or (ii) Arrange to get the additional work done elsewhere and by any other person or from any other source than the supplier in which case the amount of extra cost, if any, shall be recovered from the Supplier in the manner provided in sub-clause (b) of this clause. (e) The powers of the AIIMS, Patna under this condition shall in no way affect or prejudice the powers in certain events to terminate the contract, vested in him as herein provided nor forfeiture nor forfeiture of deposit mentioned under clause above. (f) Since the work being awarded to the supplier is of important nature the time schedule given in clause must be adhered to failing which a penalty at the rate of Rs 500/ per day per item of delay will be imposed which will be recovered in the manner stated in sub-clause (b) of this clause subject to maximum of 10% of total tender value. 16. Natural Calamity, Strike etc:2 In case of strike, combination of workmen or natural calamity of any kind, fire accidents or circumstances beyond the control of the firm causing stoppage of his work, whereby the delivery or completion of work may be suspended resulting in undue delay without penalty, AIIMS, Patna shall have the power during such stoppage to get the work done elsewhere without charging the supplier. No obligation will rest on AIIMS, Patna to pay for any portion of the work undertaken before such a stoppage. The supplier shall provide every facility for removal and use of materials as may be necessary for timely completion of the work. 17. Insolvency etc : In the event of the firm being adjudged insolvent or having a receiver appointed for it by a court or any other order under the Insolvency Act made against them or in the case of a company the passing any resolution or making of any order for winding up, whether voluntary or otherwise, or in the event of the firm failing to comply with any of the conditions herein specified the Director, AIIMS, Patna shall have the power to terminate the contract without previous notice. 18 Breach of Terms and Conditions : In case of breach of any of terms and conditions mentioned above, the Competent Authority will have the right to cancel the work order without assigning any reason there for and nothing will be payable by this AIIMS, Patna in that event and the security deposit shall also stand forfeited. 19 Subletting of Work: The firm shall not assign or sublet the work or any part of it to any other person or party without having first obtained permission in writing of the Director, AllMS, Patna, which he will be at liberty to refuse if he so thinks fit. 12 20 Right to Call upon Information Regarding Status of Work: The AIIMS, Patna will have the right to call upon information regarding status of work at any point of time. 21 Precautionary Measures: a) While observing the economy in his costs in his own interest the Supplier must be careful that quality and cleanliness of the work is maintained as well as time schedule prescribed etc. should not be disturbed. b) The Supplier must take every care to see that the work or any portion of thereof does not fall into unauthorized hands. Care should be taken to execute the work under proper security conditions and no spare item of work/copies should be retained/sold or otherwise made over by the Supplier or any of his staff member to any person/other than the person(s) authorized by the AIIMS, Patna. 22 Samples: a) The following should be kept in view while supplying samples of work done in the past or material proposed to be used have been sought for in Part-I of Annexure-II. Samples of work done in the past, if any sought for should be equivalent to the quality mentioned in the specifications provided in Part I of Annexure II, in sufficient quantity required for test as asked for and submitted along with the Price Bid only. b) The tenderer should furnish a certificate on a separate paper certifying that the sample enclosed with is in accordance with specifications given in the Part-I of Annexure-II to the tender and he will be responsible for rejection/cancellation of contract if the sample is not found up to the mark or for civil/criminal proceedings if the material supplied is found substandard or not accordance with the sample furnished along with the tender at a future date. c) Samples should be supplied free of charge and they will be returned after award of work order to the successful bidder. Tenders without samples are liable to be rejected d) The supplier must confirm that the stores/materials offered will conform to the specification in all respects. The mere fact that the competent authority has approved the samples (just by seeing it in a non-expertise way) will in no way absolve the supplier from supplying stores/materials of the different specifications. Where the stores/materials offered are not to the required specification the extent of deviation may be clearly indicated. 23. Attested photocopies of latest Income Tax Return should be enclosed. 24. The tender is not transferable. Only one tender shall be submitted by one tenderer. 25. Terms of payment: a) No payment shall be made in advance nor shall any loan from any bank or financial institution be recommended on the basis of the order of award of work. b) The supplier shall submit the bill at each stage/in the first week of following month in respect of previous month (in case of monthly payments) for sanction of the amount of bill and passing the bill for payment. 13 c) All payments shall be made by cheque or RTGS only. d) The AIIMS, Patna shall be at liberty to withhold any of the payments in full or in part subject to recovery of penalties mentioned in proceeding para. e) The term "payment" mentioned in this para includes all types of payment due to the Supplier arising on account of this contract excluding Earnest Money and Security Deposit governed by the separate clauses of the contract. 26. Arbitration: If any difference arises concerning this Agreement, its interpretation on the payment to be made there under, the same shall be settled by mutual consultations and negotiations. If attempts for conciliation do not yield any results with in a period of 30 days, either of the parties may make a request to the other party for submission of the dispute for decision by an arbitrate tribunal consisting of a Sole Arbitrator to be appointed by the Director, AIIMS, Patna. Such request shall be accompanied with a panel of names of three persons to act as the sole arbitrator. In case of such arbitrator refusing, unwilling or becoming incapable to act or as mandate having been terminated under law, another arbitrator shall be appointed in the same manner from among the panel of three persons to be submitted by the claimant. The arbitration proceedings shall take place at and shall be conducted in English.
