Detailed information about the items and their specifications are available in tender document, which can be downloaded from the University website 2. Two bids system of tender will be adopted. (i) The bid containing technical documents, EMD, Tender Fee and eligibility documents. (ii) Bid containing financial offer. Technical and financial bids should be submitted in separate covers. These two envelops shall be sealed in a common cover and addressed to The Registrar, Gautam Buddha University, Greater Noida, Gautam Budh Nagar (U.P.) superscribing Tender against Notification Advt. GBU/002/Admn./Canteen/2016, Name of Work Running a Canteen (SOM), 07 Kiosk/Tuck Shops on Contract & on the Basis of Monthly License Fee so as to reach us on or before last date of bid submission. 3. The Technical Bid and Financial Bid should be duly filled-up. 4. These bids will be opened in two stages. The bid containing technical documents, EMD, TF and eligibility documents will be opened at first stage and if same is found according to requirement, the bid containing financial offer shall be opened in second stage. 5. The Technical Bid shall contain all documents in support of work, EMD, Tender Fee, terms & conditions and eligibility criteria along with the page number. 6. The Financial Bid shall contain amount schedule only. The amount and units shall not be overwritten in the price schedule. The amount shall be both in words and figures. 7. Eligibility Criteria: All the participating firms should meet the following qualifying criteria. The firm should be a registered firm. Following documents are required to be submitted with Technical Bid, to qualify eligibility criteria: Page 6 of 17

7 a) PAN/TIN registration certificate (self attested). b) Service Tax/Sales Tax/VAT registration certificate (self attested). c) Food License (self attested) d) Earnest Money Deposit (EMD) in form of FDR/Bank Guarantee in favour of Gautam Buddha University alongwith the Technical Bid. If service/work will not be as per norms EMD would be forfeited. e) Tender Fee in form of DD/Pay Order in favour of Gautam Buddha University alongwith the Technical Bid. f) Authorized signatory should sign and stamped on all pages. Bids without authorized signature & stamped will be rejected. g) The vendor shall submit an affidavit (Rs.10/- non-judicial stamp paper) to the effect that the firm has never been blacklisted by any organization. 8. Offer should be sent in a sealed envelope, submitted either in person or by post on which name and address of the supplier/firm shall be written. Tenders received through E- mails or FAX will not be considered. 9. The technical bids will be opened on scheduled date and time. Bidders/authorized representatives of the bidders intending to attend the tender opening should intimate in advance. 10. The cost of the tender is Rs.1050/- (Rupees One Thousand Fifty Only) inclusive of taxes (Nonrefundable) and it shall be paid separately in the form of DD/Pay Order drawn in favour of Gautam Buddha University payable at Delhi and should be attached with technical bid envelope. 11. The Licensee shall furnish a security deposit amounting to an amount equal to six times of monthly license fee in the form of FDR issued from a nationalised Bank drawn in favour of Gautam Buddha University, Greater Noida. The FDR shall only be accepted if it is valid for 60 days over and above the period of contract to begin with and shall be extended along with the period of extension of contract, if any. 12. The licensee shall provide valid labour licence prior to start the contract. 13. The security Deposit shall only be released after three months of close of contract and submission of No Dues/Clearance from all concerned Authorities of GBU. 14. The Licensee shall sign a formal Agreement on a non-judicial stamp paper worth Rs. 100/- (at his cost) within fifteen days from award of the work. 15. The tenderer should go through the complete tender document before tendering considering all terms & conditions and rates of various food items already fixed by the University. Page 7 of 17

8 16. The Contract shall remain in force initially for two year which, may be renewed for such further period as may be decided by the University, depending upon the Firm s/contractor s performance and appraisal report provided however, the University shall have the right to terminate the contract forthwith and to forfeit the Security Deposit/Bank Guarantee, if the work is found unsatisfactory at any time or for violation of any clause of the contract. 17. The Licensee shall be absolutely a bare license and anything contained therein shall not be deemed to give any right in law in respect of the said premises fittings, fixture and other University belongings to the Licensee in any manner. 18. The University shall initially equip the Canteen with electricity and water connections, electric bulbs/tube lights, fans, etc. as deemed appropriate by University. Any replacement later and repair during the course of operation shall be made by the Licensee at his own cost. The Licensee shall maintain the area properly at his own cost and shall handover back to the University all equipments provided by the University in good working condition. As soon as the term of agreement expires or the agreement is otherwise terminated. The Licensee shall, however, pay for the consumption of water and electricity to the University. In case of any shortage, breakage Licencee shall get it repaired to the satisfaction of University authorities other-wise the loss thereof shall be recovered from the Licensee. 19. The Licensee shall equip the Canteen with decent crockery sufficient for the use of 100 persons at a time to the satisfaction of the University. Similarly, good stainless steel utensils will be used for serving break-fast, tea, snacks and lunch and etc. 20. The LPG cylinders shall be arranged by the Licensee at his own cost. The gas lines shall be maintained by the agency and repairs if required shall be got done by the Licensee at his own cost with superior quality materials under prior intimation to the University. 21. The Licensee shall pay License fee for the occupation of said premises on quarterly basis (for three months) in advance before the 7th day of the month requisite. Electricity charges will be payable monthly by the licensee as per monthly consumption on actual bill for Canteen only and Rs.750/- (seven hundred fifty only) per kiosk/tuck shop. In the event of license being revoked or terminated, the licensee shall pay a proportionate part of the license fee at the rate in force including proportionate charges for the fraction of the current month upto the date such revocation termination. In case the Licensee fails to deposit the license fee, electricity charges etc. within the specified period, an 12% per annum shall be charged for the same from the Licensee. However, it shall be the responsibility of the Licensee to get the electricity dues clearance from the appropriate authority before handing over the vacant charge of the premises otherwise same will be recovered by the University. 9 22. In case the Licensee fails to pay the monthly license fee as prescribed above, in time or commit breach of any of the terms and conditions, the University will notify the Licensee about the said arrears of breach, as the case may be and in the event of the Licensee failing or omitting to remedy the breach or payment of the arrears with 15 days of the notice served in writing to the Licensee, the University can terminate license and thereafter the University shall have the absolute right to enter upon the premises and take possession of the premises. 23. That the University shall have the lien on all the belongings of the property of the Licensee for the time being in or upon the premises of the University and if the Licensee does not pay the arrears of license fee, electricity charges or other dues payable to the University, even after the termination of the license, the University will have the right to realize the amount due to the University from EMD & Security Deposit and if the due amount is still more, than by putting the belongings of Licensee in public auction after notifying the said auction to the Licensee. 24. Where any belongings of the Licensee are sold, the sale proceeds thereof shall, after deduction of the expenses incurred by the University in disposing of the belongings and after deducting the amount, if any due to the University on account of arrears of rent including incidentals or damages or cost or any other charges be paid to him or a person or persons as may appear to the University to be entitled to the same. 25. The Licensee shall not carry out any permanent addition or alteration to the said premises and any construction thereon and electrical or sanitary installations in the said premises without prior permission of the University. If any temporary additions or alterations are required by the Licensee, a request to this effect may be made in writing to the University who may consider the same on such terms and conditions as may be deemed appropriate. 26. The Licensee shall make good any damage caused to the said premises except normal wear and tear. The decision of the University on the question whether any damage is caused to the premises and what amount of compensation would make good such damage, shall be final and binding on the parties thereto. The Licensee shall not sublet/ permit the said premises or any part thereof to be used by any other person for any other purpose whatsoever without the pervious consent in writing of the University and in default thereof shall be liable for cancellation of license. The Licensee shall not introduce any partner nor shall transfer possession of the premises or part thereof or otherwise carry on the business in the premises with any other person or assign, transfer, charges or other alienate his interest in the premises shall not change the business for which the said premises are licensed to him. 11 28. The Licensee shall not allow any other person/s to use the premises with or without consideration. He shall not use the premises or any other space in the Campus for residence of himself & his employees or for the purpose other than that provided in this license deed. He shall not make or permit to make, any structural additions and alterations to the premises, without the previous written sanction of the University. Page 11 of 17

12 29. The Licensee shall on revocation or termination of this license, hand over the possession of the said premises to the University in as good a condition as they were on the date of occupation of the License, except normal wear and tear. 30. The Licensee shall abide by the law in force including the Municipal By-Laws relating to the sale of food, drinks, hygienic conditions etc. he/she shall himself obtain the required necessary license from the competent authority i.e. Government Organization. The Licensee shall comply with the instructions issued from time to time the University or by an Officer/Committee nominated by the University on this behalf. 31. The cooking medium shall be an ISI Mark/standard company in such vegetable refined oil/butter/ ghee. 32. The food, sweets, snacks etc. served by the Licensee shall be obtained by him from the approved sources and shall be fresh, wholesome of good quality of their respective kind and of reasonable quantity. The University shall have the right to stop the sale or even destroy those articles which are not considered of the requisite standard or are found unfit for human consumption. The Officer/Officers of the University designated by the University including the Medical Person of the University shall on demand, be supplied free of cost with a sample or any eatable kept for use for inspection analysis. If on examination, it is proved to the satisfaction of the University whose decision shall be final and article kept are exposed to dust, flies, that food stuff or that the service rendered by the Licensee is defective, the license shall be revoked, and the Licensee shall be even prosecuted under the provision of Prevention of Food Adulteration Act and shall also be liable to pay a fine deemed to be suitable by the University Authorities and may also face prosecution under relevant Acts/ Laws of land. 33. No non-vegetarian food shall be brought, cooked or served in the canteen except eggs. Any violation of this is liable to termination of the contract. 34. The Licensee shall keep a Complaint Cum-Suggestion Book at a conspicuous place in the said premises in which suggestions may be recorded by the customers and which shall be opened to inspection by an Officer duly authorized by the University. The Licensee shall implement these suggestions within a period of one week and where it is not possible to do so, he shall bring the matter to the notice of the University. The Licensee shall also put up a signboard reading Suggestion Book available at the counter within a fortnight from the date of allotment of the premises. The University may also prescribe, if need be, the number of employees to be engaged by the Licensee keeping in view of the size of his business. They shall be properly and neatly dressed. The Licensee shall also furnish to the University information about the servants engaged by him within a fortnight of the date of allotment of the premises (along with two pass-port size photographs of each servant). Similarly, Page 12 of 17

13 information/photograph shall be supplied subsequently as and when changes are made by the Licensee in this respect. 35. The Licensee shall ensure that persons not below a particular age, and as may be permissible under the relevant law, are employed and shall also maintain an Attendance Register for his employees. 36. The dealings of the Licensee and his servants with the Staff & the students shall be polite and courteous. 37. If any person employed by the Licensee in connection with the purpose of this license deed is found guilty of breach of rules/discipline/terms of this deed, the Delhi Technological University shall have the right to require the Licensee to terminate the services of such an employee who shall not afterwards be permitted by the Licensee to come to the premises/campus without the previous written permission of the University. 38. The Licensee shall not be permitted to exhibit in the said premises any printed or written notice, advertisement, posters etc. of any kind and any company whatsoever. 39. The University or its Officer shall not be held responsible for any loss or damage occurring to any goods, stores or articles intended for sake that might be kept in the said premises, kitchen cellars or other offices. 40. The Licensee shall make good any damage caused to the said premises. The normal wear and tear, if any shall also be brought to the notice of the University in writing at the end of each month, failing which any damage noticed later shall have to be made good by the Licensee. Further the decision of the University on the question whether any damage is caused to the premises and what amount of compensation is payable shall be binding on the Licensee. 41. The Licensee shall not without the permission in writing of the University close the premises or otherwise suspend the licensed business for even a day. The Licensee shall be available at the premises daily during school time and can absent only if permitted by the University for short period on account of some unavoidable circumstances beyond the control of the Licensee and such reasons shall have to be to the satisfaction of the University. 42. If the period for which the premises have been licensed has expired and has not been formally extended and the premises are not required to be vacated, then the Licensee may continue on the same terms & conditions till the license is renewed on mutual agreement. 43. The Licensee shall not do anything in or outside the premises, which may be nuisance or a cause of annoyance to the neighbours. 44. On the expiry or earlier termination of this license, deed, the premises shall be vacated peacefully by the Licensee and he shall clear all dues before vacating them. It shall be the Page 13 of 17

14 responsibility of the Licensee to hand over the possession personally to the University in the same condition in which he had occupied then However, if he fails to do so, the action stipulated in this license deed and any other action deemed appropriate by the University shall be taken. 45. The Licensee shall make use of the said premises for his business purpose only shall keep the adequate area around the said premises clean and in hygienic condition, and he shall not cause any obstruction or encroachment whatsoever under any circumstances. 46. If at any time it comes to the notice of the University that the area around the said premises are being used by unauthorized persons with the connivance of the Licensee or that the Licensee has put up any hoardings, show- case etc. stacked any goods in such areas or is carrying on any activities which obstruct normal movement of public, University personnel or other Licensee or which cause nuisance to other licensees, or that the Licensee is using the said premises for any purpose other than specified in the Agreement, then, notwithstanding anything contained in the Agreement, the University shall be entitled forth with to terminate the License without assigning any reason and without service of notice to the Licensee and to claim damages at such rate as may be decided by the University alongwith minimum penalty of Rs. 5000/- (Rupees Five Thousand only). 47. Any notice to be given to the Licensee under the terms of this license shall be considered to be duly served & the same shall have been affixed on outer door any other conspicuous part of the said premises. 48. All payments to the University shall be made by a Bank Draft or Cash. No cheques will be accepted. 49. The Licensee shall strictly follow the Labour laws and all statutory obligations as applicable and shall indemnify University against any loss or damage, which University may suffer as a consequence of non compliance of these Laws by the Licensee. 50. The Licensee shall ensure proper cleaning in and around canteen, kiosk/tuck and shop. The Kitchen waste shall be disposed off through covered containers in the dustbin situated in the nearby area. 51. Financial shall be opened only for those agencies who qualify and finally the tenders shall be decided on the basis of the highest monthly license fee offered in the financial bid. 52. Checking as and when required or desired by the GBU will be made by an officer authorized by the University. The contractor shall obtain valid license as applicable for running Canteen after award of work. 53. Failure to comply with all the terms and conditions mentioned herein would result in the tender being summarily rejected. 54. Conditional tenders will not be accepted. Page 14 of 17
