TO THE HONORABLE MARVIN ISGUR, UNITED STATES BANKRUPTCY JUDGE: Rodney D. Tow, the Chapter 7 Trustee (the Trustee ) of ATP Oil & Gas Corporation ( Debtor ) in the above-captioned Chapter 7 case (the Bankruptcy Case ), hereby requests, pursuant to 105(d)(1) of title 11 of the United States Code, 11 U.S.C (as amended, the Bankruptcy Code ), that this Court schedule and conduct a status conference relating to the claims the Chapter 7 estate has against BP Exploration & Production, Inc. and certain other parties (the BP Claims ) as set forth in the case styled ATP Oil & Gas Corp. v. BP 1

2 Case Document 3300 Filed in TXSB on 09/05/14 Page 2 of 5 Exploration & Production, Inc., et al., Case No. 2:13-cv CJB-SS, pending before the United States District Court for the Eastern District of Louisiana (the BP Litigation ). In support of the Motion, the Trustee respectfully states as follows: JURISDICTION AND VENUE 1. This Court has jurisdiction over this matter pursuant to 28 U.S.C. 157 and 1334 and the Standing Order of Reference of the United States Bankruptcy Court for the Southern District of Texas. This is a core proceeding pursuant to 28 U.S.C. 157(b)(2)(A). Venue is proper in this district pursuant to 28 U.S.C and The statutory basis for the relief requested is 105(d) of the Bankruptcy Code. BACKGROUND 2. On August 17, 2012 (the Petition Date ), the Debtor filed a voluntary petition for relief under chapter 11 of the Bankruptcy Code with the United States Bankruptcy Court, Southern District of Texas, Houston Division (the Court ). 3. On April 4, 2013, an Order [Dkt. No. 1682] was entered approving the Debtor s employment and retention of the law firm Motley Rice, LLC ( Motley Rice ), who served as special counsel to the Debtor in the BP Litigation. 4. On April 20, 2013, by and through its special counsel, Motley Rice, the Debtor filed the complaint ( Complaint ) that forms the basis of the BP Litigation in the United States District Court for the Eastern District of Louisiana (the Louisiana District Court ). 5. On May 20, 2013, the Louisiana District Court ordered that all responsive pleading deadlines, motion practice, discovery proceedings, and other deadlines in the [BP Litigation] are SUSPENDED until further order pending the consolidation [with the] multidistrict litigation. Order Regarding New Related Cases Pending Consolidation, May 20, 2013, Case No. 2:10-md CJB-SS (E.D. La., commenced August 10, 2010) [Dkt. No. 2

To date, no responsive pleading to the Complaint has been filed in the BP Litigation by any of the named defendants thereto. 6. On June 26, 2014 (the Conversion Date ), the Court entered an Order [Dkt No. 3163] converting the Bankruptcy case to a case under chapter 7 of the Bankruptcy Code, and the United States Trustee appointed Rodney D. Tow as the interim Chapter 7 trustee. The Trustee is currently winding down the operations of ATP and administering its various assets. 7. The Trustee intends to seek the employment and retention of Motley Rice by the Chapter 7 estate, so as to further pursue the BP Claims in the BP Litigation. RELIEF REQUESTED 8. The Trustee seeks that a status conference be scheduled and held before the Court with regard to the BP Claims. The Trustee believes that a status conference is warranted to provide the Trustee and BP Exploration & Production, Inc. an opportunity to schedule mediation to try to resolve the BP Claims. Resolution of the BP Claims is necessary for the resolution of the Debtor s bankruptcy case. BASIS FOR RELIEF 9. Under 105(d)(1) of the Bankruptcy Code, the Court shall hold such status conferences as are necessary to further the expeditious and economical resolution of the case upon the request of a party in interest. 11 U.S.C. 105(d)(1). Moreover, the Court may issue an order at any such conference prescribing such limitations and conditions as the court deems appropriate to ensure that the case is handled expeditiously and economically. 11 U.S.C. 105(d)(2). 10. The Trustee believes the BP Claims to be the largest remaining asset of the Debtor s estate. The Trustee would like to schedule a conference with BP Exploration & Production, Inc. to establish a mutually agreeable mediation to possibly resolve the BP Claims in 3

A status conference before this Court will assist the Trustee and BP Exploration & Production, Inc. to determine what information should be exchanged prior to mediation in order to achieve an expeditious, economical, and appropriate resolution in the administration of the BP Claims. WHEREFORE, the Trustee respectfully requests that the Court enter an order, substantially in the form attached hereto (a) scheduling a status conference related to the BP Claims, and (b) granting such further relief as is just and proper.
