1 STANDARD SUMMARY PROJECT FICHE 1. Basic Information 1.1 CRIS Number: 2003/ Title: Development of the National Operation Control System (NOCS) of the Hungarian Border Guard 1.3 Sector: Justice and Home Affairs 1.4 Location: Hungary, Budapest and selected premises of the Hungarian Border Guard throughout Hungary 2. Objectives 2.1 Overall Objective To fight more effectively against illegal immigration and cross border illegal activities 2.2 Project purpose To further develop the National Operational Control System of the Hungarian Border Guard the CheckNet and ensure that the Check Net program is ready to function in the most efficient manner. 2.3 Accession Partnership and NPAA priority Priorities determined by the Accession Partnership and the NPAA The project is in line with the Accession Partnership (AP) priorities concerning all the project objectives. According to section 4 of the AP it should be recalled that incorporation of the acquis into legislation is not in itself sufficient; it will also be necessary to ensure that it is actually applied to the same standards as those which apply within the Union. In all of the areas listed below there is a need for credible and effective implementation and enforcement of the acquis. Section JHA of the AP specifically refers to the need to continue to strengthen border management, paying special attention to the Unions future external borders, to ensure due implementation of the Schengen Action Plan and to strengthen the fight against organised crime. As for the National Plan for the Adoption of the Acquis (NPAA) the Hungarian Government undertook the task of adapting the Acquis Communautaire including the Schengen acquis -, moreover that Hungary will be ready for its implementation as well by the accession. It is also laid down in the NPAA that the Government according to the Schengen Action Plan ensures the necessary EU conform personal and technical background by carrying out infrastructural developments by the time of accession, - and by the time of Schengen membership to be defined at a later time from Hungarian budget and with the assistance of PHARE support Priorities determined by other relevant documents Action Plan, Chapter JHA, Implementing the Schengen Agreement, Crossing Internal Borders (Article 2), according to which: Organisation of mobile units to carry out in-depth checks (joint mobile units including the 1

Peer Review conclusions (June 2002), which says, that CheckNet meets the expected additional compensatory measures so that a possible abolishment of border control at the internal border will not result in a security deficit for all other partners. 2.4 Contribution to National Development Plan - Not applicable. 2.5 Cross Border Impact - Not applicable. 3. Description 3.1. Background and Justification The project is part of a long-term programme initiated by the Ministry of Interior and laid down in the NPAA, which aims at reaching the best practice of the Member States of the EU in the field of Justice and Home Affairs. For the present PF, the focus is on better effectiveness of in-depth checks and on the more efficient prevention and fight against illegal immigration and cross-border organised crime. For this, the capacity of Hungarian law enforcement authorities to co-operate with each other and partner organisations in the EU Member States must be improved, as it is laid down - above the NPAA - in the Schengen Action Plan, and the development concepts of the relevant authorities. Therefore, the results and activities of the present Project Fiche are fully in line with the mid-, and long-term development concepts of the Ministry of Interior and its law enforcement organisations, and the development of this Project Fiche was also done on the basis of these strategies and plans. Namely, Development Concept of the Ministry of Interior of the Republic of Hungary , in more specific the Medium-term Strategy Concept of the Hungarian Border Guard Extract from the Medium-term Strategy Concept of the Hungarian Border Guard is presented in Annex 8. 2

3 According to the concept of the CheckNet, in order to meet the requirements of Schengen, effective measures have to be implemented in order to fight illegal immigration, which can only be achieved with a systematic approach, with the close co-operation of all the relevant organisations. Therefore, a strategy has been developed and approved by the Ministries concerned to development and operation of the network controlling illegal immigration. With the abolishment of border traffic control on the future internal borders of Hungary a system of in depth checks, a filter system is developed, the goal of which is three-fold: 1. to assure the free movement of people; 2. to promote the detection and apprehension of persons illegally entering, staying and working in Hungary and of persons representing a threat for the security of the Hungarian Republic as well as for the Member States of the European Union; 3. to realise this goal in the most effective and most cost-efficient manner. The measures shall be implemented avoiding total control, therefore and at the same time in a thorough, but selective and differentiated manner, within the scope of the general policing activities, and with fully exploiting the available forces and equipment. The concept introduces a full co-operation of the activities of the authorities participating in the network, with respect to the place, the time and the methodology of the actions. The authorities involved are the Hungarian Border Guard, the Hungarian Police, the Office of Immigration and Nationality, the Customs and Finance Guards and the National Works Safety and Work Authority. The Hungarian CheckNet is to be connected to the network controlling illegal immigration or other authorities of the neighbouring countries. The CheckNet reaches through the borders. The network itself basically means that the relevant authorities continue carrying out their lawenforcement activities, yet in one, strictly coherent system presence in place and time and applied techniques, co-ordinated by one single body, the Hungarian Border Guard. The development of the NOCS is the implementation of backbone of the CheckNet. 3.2 Linked activities The modernisation of the Hungarian Border Guard has also been assisted by a number of PHARE supports. Details on the previous Phare projects are presented in Annex 5. In the framework of the NPP 98 and NPP 99 realised throughout of the whole territory of Hungary, IT and telecommunication network developments took place to establish the basis of the Hungarian Border Guard subsystem of Hungarian N-SIS. The establishment of a GPS based vehicle tracking and dispatcher system on the future external borders in the framework of the NPP 99 and NPP 2000 has been partly realised and is under development. Because (1) the HBG has the leading role in the co-ordination of the Network for the Fight Against Illegal Immigration (CheckNet) 1, and (2) the existing IT infrastructural background of the HBG is suitable for becoming the backbone of a National Operational Control System (NOCS), 1 The ministries concerned (Minister of Interior, Minister of Finance, Minister of Social Affairs) have issued a joint resolution in order to create the co-ordination of the relevant bodies with a view to carry out in-depth checks. 4 which provides an adequate data processing and forwarding for the members of the CheckNet 2, the HBG started an improvement project on its own efforts. The first phase of the improvement of the NOCS will be carried out until 31 st July of 2003 covering the National Headquarters; the Budapest Regional Directorate (its local offices and the Ferihegy International Airport); the Orosháza Regional Directorate and its Local Offices. Details on the investment places involved by the first phase are presented in Annex 6. The IT system plan and the integration software-development needs will also be carried out in the first phase to establish the integrated data processing and forwarding system, which will also be used for implementation of the second phase implemented with PHARE support. The present likewise the previous - PHARE programmes are planned according to the above longterms Hungarian plans and strategies and the EU requirements. Responding to the new requirements, the present PF includes new items, as well as familiar elements, which are the next phase of the already started developments. Naturally, nor the activities of the previous PHARE programmes, nor the elements of the present, ongoing or planned programmes are overlapping with each other or the present PF. Above all, these developments are also fully in line with the developments financed from purely own, Hungarian resources. 3.3 Results The necessary integrated IT telecommunication system is established on adequate infrastructural background. On the infrastructure basis of the NOCS, the CheckNet provides as part of compensatory measures the most efficient green border surveillance on borders under illegal immigration pressure and alien policing controls to be carried out in the depth of the whole country, in order to fight against illegal entry, stay and employment, being in line with the statements of the quoted documents in section 2.3 presented above. 3.4 Activities The objective of the present PF is the second phase of the improvement of NOCS covering the Nyírbátor Regional Directorate and its Local Offices on the Ukrainian and Romanian border sections, the Kiskunhalas Regional Directorate and its Local Offices on the Yugoslavian border section and the Pécs Regional Directorate and its Local Offices on Croatian border section, as future external borders. Beyond all, the second phase shall cover the Szombathely Regional Directorate and its Local Offices on the Austrian and Slovenian border section and the Local Offices of Budapest Regional Directorate on the Slovakian border section, as future internal borders. Details on the investment places involved by the second phase are presented in Annex 7. Establishment of Operational Control Sub-systems with reconstruction works, hardware development and IT and telecommunication network integration at the following places: 1. at the Nyírbátor Regional Directorate (RD) and its Local Offices (LOs), 2. at the Kiskunhalas RD and its LOs, 2 The basic objective of this system, that is to be co-ordinated among the Hungarian Border Guard, the Hungarian Police, the Office of Immigration and Nationality, the Customs and Finance Guards and the National Works Safety and Work Authority in time, location and method in a command centre at the Border Guard is an obstacle-free-movement; to act as a deterrent and thus prohibit ongoing illegal migration; to combat black labour in all its possibilities; to harmonise the existing systems at their best and not develop a new system. 5 3. at the Pécs RD and its LOs, 4. at the Szombathely RD and its LOs, 5. at the LOs of Budapest RD Technical Assistance activities The task of the Technical Assistant is to survey the HBG premises and activities to be performed, and at the same time, the preparation of the necessary tender documentation. The Technical Assistant shall be selected in co-operation with the CFCU, according to the Hungarian public procurement regulations. The management cost of the Technical Assistance shall be covered from Hungarian budget Works activities In general, the rooms for persons on duty at the actual facilities used by HBG at present have been designed for one person. The present average basic area is m 2. The existing duty rooms have a low level of comfort and with a limited possibility of placing IT and telecommunication devices. In line with the tasks of joining the EU the duties and personal number of the organisations are gradually increasing. During the planning of the new type dispatcher rooms were calculated for two persons on duty providing adequate work conditions and for the space needed for also storing operational control devices and equipment (altogether m 2 per dispatcher rooms at Local Office in average). In case of the Regional Directorates, during the planning of the new type dispatcher rooms were calculated for four persons on duty (altogether 40 m 2 per dispatcher rooms at Regional Directorates in average). The work activities include the extensions of the basic area of the dispatcher rooms and the adequate transformation necessary for the separation and the security of the IT equipment. It means that the basic area of the present dispatcher rooms must be enlarged to m 2 at the Local Offices and to 40 m 2 at the Regional Directorates on average. In addition, the development of the appropriate working conditions and the fire prevention also has to be developed. The reconstruction and renovation activities are different on each investment place. In the second phase 48 premises of the HBG (5 Regional Directorates, 43 Border Policing Local Office) are planned for reconstruction. 3 The planned main works in case of the working place: Internal wall replacement for enlargement Technical reconstruction (heating, air exchange, main power network, lighting) Internal covering Development of mechanical safety conditions Preparation of the in-built furniture and setting The planned main works in case of technical place: Development of mechanical safety conditions Technical reconstruction (air exchange, main power network, lighting) Placement of fire protection conditions Equipment supply activities 3 The remaining 22 s of the HBG subordinated by the Ministry of Interior are in common building with the Customs and Finance Guards at the border crossing points. These buildings belong to the Customs and Finance Guards subordinated by the Ministry of Finance. 5

6 On the basis of the IT system plan developed during the first phase, the IT equipment improvement includes purchase of servers and PC workstations in adequate number. According to the preliminary estimation it means that each investment place of the second phase shall be provided with one server and 2-6 PC workstations depending on the functionality of the given Local Office. Altogether, it is planned to supply 70 offices of the HBG in this project (5 Regional Directorates and 65 Local Offices). It is planned to purchase 70 servers (1 for each investment place) and 246 PC workstations (6 per Regional Directorate, 4 per Border Policing Local Office, 2 per Border Traffic Local Office) Service activities The integration of the present radio, GPS and other relevant sub-systems into the present IT and telecommunication system in the investment places of the second phase will also be carried out applying the IT system plan and the integration software, developed in the first phase. 4.The task of the Service supplier of the second phase is to carry out the system integration with using the already available plan and software. The aim of the system integration, with the application of integration software developed in the first phase, is to (1) establish the continuos two directional data communication (including GPS, SMS and digitalised voice data) among the HQ of HBG and the Regional Directorates and the patrols via the Local Offices. Furthermore the aim of the system integration is to (2) provide fast connection from the end-users to the central data records of activities and also to (3) ensure protected storing of records on hierarchically higher servers at the Regional Directorates and the HQ of HBG. The significance of the system integration is that it will on one hand (1) assist the functioning of the system applications 5 used during the operation control, and on the other hand (2) it will synchronise and harmonise the software(s) already used in in-depth control. By this, the systems previously purchased and used as individual systems (e.g. remote ground sensor systems, vehicles equipped heat sensing camera systems) now can be inter-linked, which creates a complex overview increasing the efficiency of the whole system. In the second phase 70 premises of the HBG (5 Regional Directorates, 65 Local Offices) shall be included in the system integration. 7 For IT development projects, the time frame, the project preparation (until commitment) should be shortened and managed within one year of the signing of the FM. This recommendation has been taken into account as in the Implementation Schedule 8 months are planned from the date of tendering to contracting. 4. Institutional Framework The Ministry of Interior will be responsible for the implementation of the project as employer. Where applicable, the technical assistant and the technical quality controller for the project will be appointed before tendering the main (supply, works and service) projects. The supplier(s) for the main projects will be appointed within the frame open tender processes. Owner will be the Hungarian State. Trustee of the property will be the Ministry of Interior and the Hungarian Border Guard. The Ministry of Interior will ensure the full co-ordination. Specialists of the Ministry of Interior and the Hungarian Border Guard will carry out and finalise the technical specifications in close co-operation with the technical assistant. They will also co-ordinate and also supervise the implementation of the whole project. 5. The ratio between the PHARE and national amount is binding and has to be applied to the final contract price. 6. The Ministry has nominated Dr. Krisztina Berta, Deputy State Secretary, as Senior Programme Officer. The CFCU will manage the administrative and financial implementation of the project under the responsibility of the Programme Authorising Officer. 7

The technical assistance will be selected in co-operation with the CFCU under Hungarian procurement rules. Naturally, the number of tenders and contracts will be finalised during the development of the tender documentation with the co-operation of the approved technical assistance. Investment Criteria 11.1 Catalytic effect: The project will finance activities that will crucially contribute to the operation of a Schengen compatible border management and fight against organised crime. Without PHARE support, some of the development items could only take place well beyond Accession Co-financing: The local co-finance contribution is earmarked in the long-term development plan of the Ministry of Interior. The co-financing has been confirmed by the leadership of the Ministry of the Interior and by the Ministry of Finance Additionality: No other financiers will be displaced by the Phare intervention. In the case of reconstruction are fully planned, however, without the financial support of PHARE, it will actually not be realised with this time schedule, even not in detail. It can be realised only with serious delay, despite of the fact that HBG already has the increased number of staff Project readiness and size: Launching of the tender and the contract process can be carried out according to the timing as all necessary documents and licences for planned projects will be owned by the Beneficiaries by the time of the start of the tenders. Preparation for Phare tendering and contracting can commence immediately Sustainability: Relevant government policies ensure sustainability. All beneficiary institutions are in a position to operate the project and the relevant buildings and sites effectively in the long run. The program was successfully implemented. The HU NPP for Strengthening Border Management was based on the NPAA, but also follows up the results of the previous PHARE assistance. The provided financial funds of the NPP 98 was utilised for institution building and investment in the field of the fight against organised crime, and harmonisation of regulations and procedures in handling asylum seekers and refugees as well as purchase of IT and equipment for the modernisation of the border management system in preparation for the accession of Hungary into the EU. The program was successfully implemented. The HU NPP was indirectly related to several previous PHARE Programs implemented by the Hungarian Border Guard and the Hungarian Customs and Finance Guard for the reconstruction of 16

17 different border crossing points, but also follows up the results of the previous PHARE assistance. The program was successfully implemented. 17

EXTRACT FROM THE MEDIUM-TERM STRATEGY CONCEPT OF THE HUNGARIAN BORDER GUARD The mid-term strategy of the Hungarian Border Guard in point 1.1 states, the following: The operation-control services attached to both management and executive levels guarantee the continuity of management, the accomplishment of the necessary reactions and priority measures, the management of the subordinate services, the realisation of the reporting tasks, the information and networking with the partner organisations, the continuous availability of data and the completion of the object-security objectives. Data based information processing, registration and data recording has come into prominence. The analysis section set up as a requirement of EU accession has been integrated into the Operation Control organisational unit of the Hungarian Border Guard enhancing the effectiveness of the integration of the functional procedures of the Border Guard. Connecting the local information and information analysis to the central level enables control and application based on complex evaluation. The immediacy and the quantity of information requires a new type of operation-control activity approach, which provokes the dominance of operation-control and requires the realisation of Operation-Control Centres. Instead of indirect flow of information the direct possibility of query has become conspicuous which changes the nature of the activity as well as its operativity and the efficiency. The security of the premises is closely linked to the operation-control activity, which comes into existence with a minimal technical background, mostly based on living-power and regimemeasures but since the complex establishment of necessary security has not been guaranteed and individual security units do not form a coherent security system, it needs to be modernised and organised on a new basis. (What needs) to be considered: Intensification of the IT "background-dependency" of the activity of operation-control, introduction of new system and methods in data processing; Previous surveillance activity overcomes the simple registration- transformation methods, requires widespread professional influence; The risk level of the premises increases, more frequent completion of risk-analysis becomes necessary and justified and requires extension to each activity-field; Central realisation of operation-control becomes general, the national and EU-related cooperational level of the analysing activity intensifies, and the need to introduce similar security standards becomes evident. 22

23 Annex 9. DETAILS ON THE SCOPE OF THE SYSTEM INTEGRATION The existing IT and telecommunication background of 65 Local Offices is presented in the Annex 9/a and 9/b. The server computer planned to be purchased in the second phase will hold and process the personnel and equipment records of the given Local Office (for example: patrol vehicles, thermal cameras, step detectors), the recorded information of voice and data exchange and the data of the digital maps. In addition to this, the Management Support (decision preparation) System which will be developed in the first phase on the HBG s own efforts is planned to be held and processed by the server computers. The server of the Local Office will continuously forward the data toward the server of the Regional Directorate designed for the same purpose. The PC workstations of the persons responsible for operation control will be able to (1) follow and control the activities of the patrols based on GPS data appearing on the digital map and (2) to co-ordinate the patrols with the help of SMS and voice communication connection. The existing IT and telecommunication background at the 5 Regional Directorates is same as at the local offices, the difference is that the capacity of devices is higher. The function of the IT devices at the Regional Directorates is the same as the IT devices of the Local Offices. The Management Support (decision preparation) System, developed in the first phase, enables to (1) control actions covering the operation area of more Local Offices, but under its scope of authority and to (2) exchange data with co-operating authorities during aliens policing assignment. The servers and PC workstations will be connected to the present national IT and telecommunication system of HBG (run under IP-Internet Protocol) via local Ethernet type networks of the Regional Directorates and Local Offices. The radio base stations at the Local Offices connect to the telephone exchange sub-central, but their are not connected directly to data exchange network. The processing of GPS data and the handling software of digital maps are done by the control computer of the radio base stations. These control computers are planned to be connected to the Ethernet network. Through this, data forwarding to the server of the Local Offices via the existing radio network will be realised. Consequently, data (including digitalised voice, SMS and GPS data) will be transmitted via the existing radio and IT network to and among the dispatcher centres at the Local Offices and Regional Directorates. 23
