1 STANDARD TWINNING LIGHT PROJECT FICHE 1. Basic Information 1.1 Programme: IPA Twinning Number: HR/2011/IB/JH/02 TWL 1.3 Title: Strengthening capacities of the Ministry of Interior for using IMSI Catcher (CRO IMSI) 1.4 Sector: Justice, Freedom and Security 1.5 Beneficiary country: Republic of Croatia 2. Objectives 2.1 Overall Objective: To improve the level of criminal police investigation in the Republic of Croatia in line with the best practices of the EU Member States. 2.2 Project purpose: To strengthen administrative capacities of the Ministry of Interior for using International Mobile Subscriber Identity (IMSI) Catcher in future criminal investigations. 2.3 Contribution to Accession Treaty / Relevant National Documents: Following the signature of the Accession Treaty on 9 December 2011 and its ratification procedure in the Member States, Croatia joined the European Union on 1 July In the Annex VII among Specific commitments undertaken by the Republic of Croatia in the accession negotiations it is stated: To continue to ensure a sustained track record of substantial results based on efficient, effective and unbiased investigation, prosecution and court rulings in organised crime and corruption cases at all levels including high level corruption, and in vulnerable sectors such as public procurement. Strategic plan for the Ministry of Interior and other institutions involved in protection and rescue for the period inter alia states the following goals: to reduce the risk of criminal behaviour, improve prevention of criminal behaviour and to improve crime prevention. Criminal offences are classified into several categories: organized crime and corruption, economic crime, drug abuse, criminality of special safety significance; crime of violence, property crime, and all other offenses not covered by the mentioned categories. In the Republic of Croatia, the police registers approximately criminal offenses per year. Of the total number of detected offenses police in Croatia manages to resolve, on an annual basis, about 60 percent of the crime. Without neglecting the less harmful crimes, in the next period, greater attention should be paid to the most difficult criminal cases.
2 Among methods of achieving the abovementioned goals are: improving the work of the criminal police, improving the effectiveness of combating corruption and organized crime and strengthening cooperation between the police and the judiciary. This Twinning light project will increase efficiency in pursuing and arresting fugitives and offenders of serious crimes through developing innovative solutions in criminal investigations in the area of mobile communications and improving level of technical education of police officers. This will further contribute to improvement of criminal police investigation in the Republic of Croatia which is related to achieving objectives indicated in the above mentioned documents. 3. Description 3.1 Background and justification: Main responsibilities of the Ministry of Interior (MoI) of the Republic of Croatia are to ensure safety of citizens as well as of democratic institutions of the State and the constitutional system, to fight against and prevent all forms of crime and enhance the system of national security. Furthermore, the Ministry of Interior is in charge of administrative affairs, such as citizenship, identity and travel documents, documents in the field of road traffic, possession of weapons, affairs connected with entry, stay and work of aliens, asylum and other forms of international protection. It is also responsible for inspections in connection with safety of persons, facilities and environment. Treaty of Lisbon, considers the fight against crime as one of the most important tasks of the European Union: The Union shall offer its citizens an area of freedom, security and justice without internal frontiers, in which the free movement of persons is ensured in conjunction with appropriate measures with respect to external border controls, asylum, immigration and the prevention and combating of crime (Article 3, paragraph 2). Accordingly, the Internal Security Strategy, adopted by the European Council in February 2010, considers organised crime as one of the main threats for the internal security of the EU. The Communication from the Commission The EU Internal Security Strategy in Action: Five steps towards a more secure Europe of 22 November 2010, COM (2010) 673 final, includes the task to fight serious and organised crime and terrorism as one of the five strategic objectives. Prevention of crime as well as detection and fight against crime are also among the most important goals to be pursued within the strategic documents of the Republic of Croatia. Thus, Strategic Plan of the Ministry of Interior provides strategic basis for suppression of organised crime and corruption in the Republic of Croatia. Furthermore, National Anti-Corruption Strategy and Action Plan of the Ministry of Interior stipulate anti-corruption measures in order to increase the number of reported criminal offenses with elements of corruption and to intensify prevention of corruption. 2
3 The said measures also envisage training of police officers in terms of the Code of Police and implementation of self-assessment process with the purpose of improving the integrity of the Ministry and preventing of internal corruption. The National Police Office for Suppression of Corruption and Organized Crime (NPOSCOC) was established in September 2009 in order to tackle organised crime and corruption in the most efficient way. Fight against crime also requires the use of sophisticated equipment taking into consideration the new crime trends. For this reason criminal police purchased special equipment for micro locating cell phones and collecting mobile phone numbers - International Mobile Subscriber Identity (IMSI) Catcher as one of the necessary tools to search for perpetrators of serious crimes and to fight against corruption and organized crime. The use of IMSI Catcher has by now proved to be of great help to police officers in conducting criminal investigations. However, the knowledge of police officers to operate IMSI Catcher was acquired exclusively through work on the system itself without any additional training. Taking into consideration that the work with highly advanced equipment requires technically trained police officers, the need for specialized trainings in this area has been determined. Following the above, this Twinning light project will strengthen capacities of Croatian police officers operating IMSI Catcher through transposition of knowledge and experience of police officers from EU Member State. This will greatly contribute to the efficiency of Croatian police officers who will be in position to learn from more experienced colleagues who also work with IMSI Catcher. Standard Operating Procedures and functional specifications for development of database for storing and cross analysing data of all criminal investigations that involve IMSI Catcher are also envisaged to be developed through this Twinning light project. At this moment there are four police officers in charge of IMSI Catcher, however specific subgroup/unit within Fugitive Unit is not formally established. Therefore, it is necessary to perform analysis of the present situation and modus operandi of the Fugitive Unit and provide recommendations on future establishment of the specific IMSI Catcher subgroup/unit within Fugitive Unit (when it will be possible) and technical equipment needed for quality work performance in criminal investigations connected to the area of mobile communications. The application of outputs developed through this Twinning light project will result in further improvement of efficiency of criminal police investigations, interagency and cross-border cooperation in fight against organized crime and corruption. 3
4 3.2 Linked activities: IPA 2011 Strengthening capacities of the Ministry of Interior to combat cybercrime (Twinning project no. HR/2011/IB/JH/01, MS Twinning partners: Spain and Hungary) The purpose of this Twinning project is to strengthen capacities of Forensic Science Centre for forensic investigation of cybercrime and to strengthen capacities of the Criminal Police Directorate for fighting cybercrime at the national, regional, European and international level. Through this project Standard Operating Procedures for collection, examination, analysis and reporting on electronic evidence according to ISO standard and ENFSI procedures will be developed. Training programme and training manual, including training of trainers programme and corresponding materials, on forensic cybercrime investigation for forensic science experts will be prepared. Capacity of the Criminal Police Directorate for fighting cybercrime and capacity of the Police Academy to provide training on fighting cybercrime will be enhanced. It is expected that the implementation of activities will start in 2Q 2014 with the implementation period of 15 months. IPA 2009 Capacity Building in the Field of Fight against Sexual Exploitation and Sexual Abuse of Children and on Police Assistance to Vulnerable crime Victims (Twinning project no. HR/2009/IB/JH/03, MS Twinning partner: United Kingdom) The purpose of this project was further strengthening of the institutional capacity in the field of prevention and fight against sexual exploitation and sexual abuse of children, as well in the area of police assistance to vulnerable crime victims, especially children and their families. The overall project included Twinning and supply component. Implementation of the Twinning project started in September 2011 and finished in April Through this project public awareness of sexual abuse of children as a social problem was raised, handling in cases of investigations in this area standardized, police and judicial officers trained (including trainings on forensic hardware and software investigations) and cooperation among relevant institutions improved. Through the supply component official premises were equipped with adequate furniture; equipment for conducting interviews with children, victims of sexual exploitation and sexual abuse will be purchased during IPA 2007 Strengthening Capacities of Ministry of the Interior to combat Narcotic Drugs Trafficking and Drug Abuse (Twinning project no. HR/2007/IB/JH/03, MS Twinning partner: Austria) The project started in February 2010 and finished in July Its objective was to strengthen the ability of Ministry of Interior in fight against organized crime in the field of suppression of organized production and resale of drugs. The overall project included Twinning and supply component. MPAP 2008 Reorganisation of the Criminal Police - Phase 2 This technical assistance was provided by the Department of International Police Information (IPOL) and the Regional Police Force of Utrecht. The project started in April 2009 and ended in November The purpose of the project was to provide 4
5 further support to the reorganisation of the Criminal Police, including strengthening of the National Police Office for Suppression of Corruption and Organised Crime. CARDS 2004 Combating Trafficking in Firearms, Ammunition and Explosives (Twinning project no. HR/2004/IB/JH/03, MS Twinning partner: Netherlands) The overall project comprised Twinning and supply component. Implementation of the Twinning project started in June 2007 and finished in November The aim was to enhance the ability to prevent, combat and eradicate the illicit manufacturing of and trafficking in firearms, ammunition and explosives. MATRA Flex Reorganisation of the Criminal Police The project finished in April It was implemented in cooperation with the partners from the Netherlands. The purpose of the project was assistance to the reorganisation of the Croatian Criminal Police. NPOSCOC was established in line with the model developed through this MATRA Flex project. CARDS 2003 Criminal Intelligence System Phase II (Twinning project no. HR/2003/IB/JH/07, MS Twinning partner: United Kingdom) This project was continuation of the Phase I project. The overall project included Twinning, technical assistance and supply component. Project started in June 2006 and finished in March CARDS 2002 Criminal Intelligence System Phase I (Twinning project no. HR/2002/IB/JH/01, MS Twinning partner: United Kingdom) The overall project included Twinning, technical assistance and supply component. The project started in May 2005 and finished in July The aim of the project was designing of missing CIS components and implementing developed CIS components building upon the currently existing CIS and general concept designed by CAD to fight against transnational organised crime, illegal migration, money laundering, trafficking in human beings, weapons and drugs. In addition to the above mentioned projects, linked activities also include bilateral cooperation with Germany. During 2009 and 2010 several study visits were organised to German Criminal Police with the purpose of acquiring knowledge in tactics and technics in police work regarding IMSI Catcher. Since there is a constant need for improvement of skills and knowledge of police officers in this highly specialised and technical area of criminal investigations, specific capacity building activities envisaged under this Twinning light project are necessary and there is no overlapping with the above mentioned linked activities. 5
6 3.3 Results: Result 1. Recommendations for improvement of Fugitive Unit work regarding IMSI Catcher usage in criminal investigations in terms of internal organization, human capacities, work processes and technical equipment prepared. Result 2. Standard Operating Procedures for the process of requesting, preparing and implementing IMSI Catcher operations prepared. Result 3. Functional specifications for development of database for Fugitive Unit developed. Result 4. Capacity of police officers for using IMSI Catcher in criminal investigations strengthened through practical on-the-job trainings. 3.4 Activities: Activities related to Result 1: 1.1. Conducting analysis of the functioning of the Fugitive Unit regarding IMSI Catcher usage in criminal investigations in order to identify shortcomings and deficiencies in terms of human and technical capacities and work processes and preparing analysis report with recommendations for improvement in line with the best EU practices in the following areas: - internal organization (proposal on possible reorganization through establishment of IMSI Catcher subgroup/unit within Fugitive Unit) - human capacities (proposal on the needed number of employees) - work processes - technical equipment Activities related to Result 2: 2.1. Preparing Standard Operating Procedures for the process of requesting, preparing and implementing IMSI Catcher operations. Standard Operating Procedures should include templates which should comprise at least: template for demand for IMSI Catcher operation, template for approval of the operation and templates for all the other relevant information. Activities related to Result 3: 3.1. Collecting all technical and operative information relevant for preparation of functional specifications for development of database for Fugitive Unit and preparing corresponding report. 6
7 3.2. Preparing functional specifications for development of database for storing and cross analysing data acquired through criminal investigations that involve IMSI Catcher. Activities related to Result 4: 4.1. Conducting training needs analysis (TNA) for police officers in Fugitive Unit regarding usage of IMSI Catcher and preparing TNA report that will identify specific skills and competences of police officers which need to be further improved and will serve as basis for Activity 4.2 and Conducting two study visits to EU Member State in duration of 10 working days each with the purpose of obtaining practical on-the-job experience through field work with IMSI Catcher (e.g. police officers participating in the actual operations involving IMSI Catcher). In total 4 police officers will participate in the above mentioned study visits and each police officer will prepare individual report for further dissemination of the gained knowledge and ensuring its sustainability Conducting on-the-job training for 4 police officers through at least 4 regional field visits in different parts of Croatia related to IMSI Catcher operations with the purpose of practical implementation of the learned techniques in the BC under supervision of MS experts. Institutional Framework The beneficiary of the project is Ministry of Interior (MoI) of the Republic of Croatia. More specifically, the project beneficiary is National Police Office for Suppression of Corruption and Organized Crime (NPOSCOC) as a separate organizational unit within the MoI Criminal Police Directorate. Main tasks of NPOSCOC are suppression of the most complex crimes, particularly crimes of corruption and organized crime. NPOSCOC headquarters consists of 6 departments: Organised Crime Department, Drugs Crime Department, Economic Crime and Corruption Department, Criminal Intelligence Analytics Department, Criminal Intelligence Affairs Department and Special Criminal Affairs Department. Fugitive Unit was established in 2008 within Special Criminal Affairs Department of NPOSCOC. Fugitive Unit consists of six police officers, out of which four police officers are in charge of IMSI Catcher. Tasks of the Fugitive Unit include: - Pursuit of fugitives and offenders of serious crimes, - Helping the extradition and rendition proceedings for fugitives arrested locally and in other jurisdictions, - Cooperation with other relevant governmental, public and private bodies and institutions. This Twinning light project may lead to changes of institutional framework in relation to internal organization of the Fugitive Unit. 10
11 Two Steering Committee meetings will be held for the purpose of reviewing the progress made under the project as well as to discuss results achieved and/or problems occurred. The first Steering Committee meeting will be held during the third month of project activities implementation in order to discuss and comment the draft start-up report. The second Steering Committee meeting will be organised during the last month of the implementation period of the Action to discuss the draft final report. It should be noted that the participation of the Member State Project Leader in Steering Committees meetings has to be combined with expert missions in case the Member State Project Leader is also a short-term expert in the twinning light project. If the Member State Project Leader is not short-term expert in the twinning light project then his visits to Croatia, (one visit every three months) as part of his overall task to ensure coordination and political steering of the project, should be organised at the same time as the two Steering Committee meetings of the project. The exact participants of the Steering Committee meetings will be defined during the implementation of the project, but will at least include the following members: BC Project Leader MS Project Leader CFCA Project Manager EC Croatia Transition Office Programme officer Ministry of Regional Development and EU Funds Sector Manager The beneficiary is committed to provide all necessary infrastructures such as office space and computers with internet connection for experts, and to ensure the necessary local staff/experts inputs. 5. Budget Strengthening capacities of the Ministry of Interior for using IMSI Catcher (CRO IMSI) Twinning light contract IPA Community Contribution ,00 EUR 90% National Co-financing ,00 EUR 10% TOTAL ,00 EUR The total amounts of the IPA Community Contribution and National Co-financing stipulated in the above table represent the total maximum amounts and therefore, they may be reduced at the level of the Twinning light contract, while the relevant ratio (percentages) should be maintained as fixed. The co-financing requirement foreseen under IPA will be considered fulfilled according to the provision of the relevant Financing Agreement. Interpretation costs will be reimbursed from the budget only for the purpose of workshops and seminars, up to 7% of the Contract amount can be used for translation and interpretation purposes. Provisions for visibility costs and expenditure verification costs should be included in the budget. 11

13 6.4 Reporting: The Start-up Report will cover first two months of the contract and will be submitted during the third month. The Start-up report should: - Clearly define the aims and purpose of the aid provided by the project, - Give detailed description of the content of particular parts of the project, - Work out in detail the activities carried out and the results achieved, - Work out in detail all modifications agreed with the beneficiary institution, - Review difficulties met during the implementation of the project and measures that were undertaken for their removal, - Provide all findings obtained in the meanwhile and preliminary conclusions, and - Contain a general plan of activities for the implementation of the remained duration of the project. The Final Report shall be submitted within three months upon the completion of the project activities and in any case within the legal duration of the project, and it should contain the following: - Complete review of all activities carried out by MS experts during the implementation of the project, - Achieved progress concerning each activity, - Summary of all project results, with particular emphasis on mandatory results, - Estimation of the project impact compared with the project aims and measures of the achieved progress, - Identification of all important problems met during the implementation of the contract and solutions that have been applied, - Lessons drawn from the project, and - Recommendations for further steps in future projects The reports must be endorsed and countersigned by the beneficiary, who may make additional comments. Reports shall be submitted to the Ministry of Interior, the Central Finance and Contracting Agency, the Ministry of Regional Development and EU Funds and the concerned service of the European Commission in a form of 4 hard copies and an electronic version. All reports should be written in English. 6.5 Language: Working language of the project will be English. 7. Implementation Schedule (indicative) 7.1 Launching of the call for proposals: 2Q Start of project activities: 3Q Project completion: 1Q Duration of the execution period (number of months): 9 months; the execution period will end 3 months after the implementation period of the Action (work plan) which will take 6 months. 13
14 8. Sustainability This Twinning light project will strengthen capacities of Croatian police officers operating IMSI Catcher and thus enhance efficiency of criminal police investigations. Trained police officers will further disseminate the obtained knowledge once the project is finished, thus ensuring sustainability of the project results. Standard Operating Procedures will be developed and used after the implementation of project. Functional specifications prepared through the project will be used for development of database for Fugitive Unit. 9. Crosscutting issues Based on the fundamental principles of promoting equality and combating discrimination, as provided in Croatia s legislation and practice, participation in the project will be guaranteed on the basis of equal access regardless of sex, racial or ethnic origin, religion or belief, disability, age or sexual orientation. 10. 18 Catcher Conducting training needs analysis (TNA) for police officers in Fugitive Unit regarding usage of IMSI Catcher and preparing TNA report that will identify specific skills and competences of police officers which need to be further improved and will serve as basis for Activity 4.2 and Conducting two study visits to EU Member State in duration of 10 working days each with the purpose of obtaining practical on-the-job experience through field work with IMSI Catcher (e.g. police officers participating in the actual operations involving IMSI Catcher). In total 4 police officers will participate in the above mentioned study visits and each police officer will prepare individual report for further dissemination of the gained knowledge and ensuring its sustainability Conducting on-the-job training for 4 police officers through at least 4 regional field visits in different parts of Croatia related to IMSI Catcher operations with the purpose of practical implementation of the learned techniques in the BC under supervision of MS experts.
