1 Embassy of Estonia Oslo NOTE VERBALE The Royal Norwegian Ministry of Foreign Affairs presents its compliments to the Embassy of Estonia in Oslo and, with regard to Regulation (EC) No 810/2009 of the European Parliament and of the Council of 13 July 2009 establishing a Community Code on Visas (Visa Code), which entered into force on April 5th, 2010, has the honour to propose the following new Agreement between the Republic of Estonia and the Kingdom of Norway on Schengen Visa Representation in accordance with Article 8 of the Visa Code. This Agreement shall replace the previous Representation Agreement between the Kingdom of Norway and the Republic of Estonia that entered into force on 15th July Extent of the representation Norway represents Estonia at the following location(s): Manila 2. Scope of the representation The representation shall include: - Information to the public where appropriate - The collection of applications and, if necessary, of biometric data in accordance with - The examination of visa applications and the issuing of visas in accordance with - Refusal of visas after examination of the application in accordance with Article 8.4. (d), cf. art. 32, of the Visa Code. - Appeals being conducted in conformity with Article 32.3 of the Visa Code No visa with limited territorial validity (VLTV) shall be issued without authorization from the represented country s authorities. However, this does not apply, if the limitation is solely due to the fact that not all Schengen Member States recognize the travel document; cf. the Visa Code, unless it is the represented country that does not recognize the travel document. 3. Conditions of the representation Fees for the visa applications shall be charged in accordance with the Visa Code. The representing country is entitled to all visa fees. Besides from that the represented country shall not give any financial compensation to the representing country for handling the visa applications. The representing country shall be authorized to affix visas to all travel documents recognized by both Estonian and Norwegian authorities. Supporting documents for the visa application, if necessary, should be translated into one of the working languages used by the issuing mission. Costs of the translation shall be covered
2 by the visa applicants. In the event of questions, in particular related to the inviting party or sponsor, the representing country s Mission may contact the central and/ or local contact point of the represented country. A list of contact points are set down in Article 4 of this Agreement. If the Mission is in doubt whether or not a visa should be issued, the application shall be submitted to the Norwegian Directorate of Immigration for them to take the final decision on the application within the time limits set by article 23 of the Visa Code For nationalities for which consultation is required, the consultation shall be executed by the represented country. In line with the general practice of the Foreign Mission and on equal terms as the practice toward parties in its own similar category, the Foreign mission shall consider if applicants are eligible to benefit from facilitated procedure. Facilitation may relate to the provision of access for submission of applications, the duration of a decision, leniency concerning supporting documents (in accordance with the approved lists in the framework of the Local Schengen co-operation) and the issuance of multiple entry visa with a period of validity ranging from six months to five years. Norway and Estonia may co-operate with an external service providers in the representing locations. Statistics concerning visas issued in representation shall be sent on a yearly basis and, for the past year, should be provided in February the following year. Further practical conditions of implementation of this agreement may be agreed upon informally. 4. The Ministry of Foreign Affairs of the Republic of Estonia and the Royal Norwegian Ministry of Foreign Affairs may agree upon the modification of Articles 1 and 4 of this Agreement containing the list of representing diplomatic missions or consular posts and the list of contacts of the Norwegian and Estonian authorities, by exchange of verbal notes. If the foregoing is acceptable for the Estonian authorities, the Ministry of Foreign Affairs has the honor to suggest, that the present verbal note and reply from the Ministry for Foreign Affairs of Estonia shall constitute an Agreement between the Republic of Estonia and the Kingdom of Norway. The Royal Norwegian Ministry of Foreign Affairs avails itself of the opportunity to renew to the Ministry for Foreign Affairs the assurances of its highest consideration.
