The Section is grateful for the contributions and support from the luncheon sponsors listed on page 9. 2:00 pm 3:30 pm CLE Anatomy of a Debarment Action The panelists will discuss a hypothetical debarment action from beginning to end, offering perspectives and best practices from a variety of viewpoints, to include those of a suspension and debarment official, agency counsel, counsel for a corporate respondent, and counsel for an individual respondent. Among other issues, the panel will explore: How to address the due process and fairness concerns of adverse individual and corporate Respondents; The obligation of the SDO to investigate and consider available information reasonably; Limitations that may be placed on individual owners/managers accused of wrongdoing as a condition for a company s continued eligibility; The proper scope of an administrative agreement and independent monitor responsibilities; and The viability of administrative agreements or alternative resolutions for individual respondents. 4 PROGRAM SCHEDULE 3:45 pm 5:15 pm CLE The False Claims Act A Change in Direction? The past year has seen significant change in the law and practice involving the False Claims Act. For government contractors, the impact of the Supreme Court s Escobar decision continues to be felt particularly with respect to the materiality standard. Courts are examining claims closely for materiality with the result that some cases are not proceeding. There have been some rather dramatic decisions in the Harmon v. Trinity Industries and Ruckh v. Salus Rehabilitation cases. DOJ has filed Statements of Interest in many pending cases affected by Escobar. In addition, DOJ has issued the Brand memo affecting use of agency guidance in civil cases and the Granston memo addressing dismissal of meritless qui tam cases. However, data shows that recoveries in non-intervened qui tam cases also have increased. This panel of practitioners will examine these issues and others, involving the latest developments. As background, the panel will rely upon and update the key issues addressed in the Section s new publication, The False Claims Act and Government Contracts: The Intersection of Federal Government Contracts, Administrative Law, and Civil Fraud.
