LEADING IMMIGRATION & EXTRADITION LAWYERS IN LONDON Founded by Roger Gherson in 1988, the firm now boasts a large team of lawyers dedicated to offering advice on all immigration and nationality matters. As a specialist immigration law firm we represent private individuals, international business executives and private and public companies on the broadest range of immigration matters and related complex and contentious issues. Clients seek our help and expertise from all over the world. As an independent practice we do no government work, so unlike a large number of our competitors, we never shy away from taking on difficult cases. We have a well earned reputation for our outstanding service and for achieving the desired results. We have developed a reputation for making applications outside of the immigration rules and succeeding in politically motivated defences. We are committed to offering our clients: In-depth legal expertise Effective and responsive legal advice Absolute discretion Services tailored to the individual 1
4 PRIVATE CLIENT IMMIGRATION In the constantly changing arena of immigration law, our private client team provide individuals and families with the very best advice on their particular circumstances and ensure that the strongest possible immigration applications are made on their behalf. We act for all types of private individuals including students, entrepreneurs, high net worth individuals, skilled migrants and their families. We employ passionate people who are fully committed to achieving the best outcomes for their clients. Our reputation is testament to our expertise and client service. Applications may be urgent or require an innovative approach, however challenging the situation, we offer to support our clients through every step of the process. Furthermore, we can assist individuals who have had their application refused and may be able to appeal or judicially review the decision. Our private client immigration work covers: Visitors Students Nationality British Passport Applications Sole Representatives Right of Abode Application UK Ancestry Visas Entry Clearance and Visa Applications Limited Leave to Remain and Indefinite Leave to Remain (permanent residence) European Free Movement Applications Domestic workers Dependent family members including spouses, civil partners, unmarried partners, children and other dependents Exceptional applications outside of the Immigration rules 2
5 The firm continues to strengthen it s reputation for achieving a successful outcome for it s clients even in the most difficult and challenging of circumstances. CHAMBERS & PARTNERS CORPORATE IMMIGRATION Corporate immigration in the UK has become extremely complex with the legal, policy and regulatory framework constantly shifting, and an ever increasing emphasis on self-regulation. We provide owners, managers and human resource specialists with the best advice on how to employ and retain employees from outside of the European Union. We will advise your organisation on the various options open to managers and employees whilst mitigating the risks imposed by the ever changing business immigration regulatory minefield. We currently act for over 140 companies and pride ourselves on the fact that the majority of our clients have been with the firm for many years. Whilst we deal with the full range of business immigration work we are often regarded by our clients as the go to firm for any appeals and/or applications that are of a more complex and challenging nature, and in particular, those that fall outside of the rules. At Gherson we make sure we offer our clients added value through our training and development programmes, strategic planning, due diligence and recruitment advice. We are able to assist HR departments to: Obtain the necessary Home Office allocations Undertake preliminary work eligibility assessments Comply with rules surrounding labour market testing Minimise the risk of negative press and reputational damage Reduce the likelihood of employment proceedings Avoid criminal and civil penalties ROGER GHERSON AND HIS TEAM HAVE A REPUTATION FOR TENACITY THAT IS REFLECTED IN THE FIRM S BREADTH OF EXPERIENCE. 3
6 Gherson attracts praise for its unparalleled experience in immigration and extradition cases. LEGAL 500 APPEALS AND JUDICIAL REVIEW We are often approached by individuals who have had their application refused or delayed, and there may be an opportunity to take that refusal on appeal or judicially review the actions of the Secretary of State. The scope for unsuccessful applicants to challenge unfavourable decisions of the Home Office was dramatically curtailed by the Immigration Act Rights of appeal only remain in respect of: The refusal of a human rights or protection claim and renovation of protection status. In some circumstances refusal of entry clearance and refusal to vary leave to remain. Refusal to issue and EEA family permit and certain other EEA decisions. Deprivation of citizenship. Where there is no right of appeal an individual may be able to apply to the Home Office for an administrative review of that decision. This review takes place on the papers and there is no opportunity for a hearing. If there is no alternative remedy available to an unsuccessful applicant they may able to apply for judicial review of the Home Office decision. immigration status for applicants outside of the normal Immigration Rules and where they would otherwise have been refused. However, there is no doubt that challenging decisions of the Home Office has become more difficult as a result of these changes. It is crucial that any application to the Home Office is carefully prepared with a view to securing an appeal right if the application is refused. Gherson s history of involvement in complex immigration appeals and ground-breaking public law challenges to Home Office decisions and policies makes it ideally placed to advise on how to maximise an application s chances of succeeding. BUSINESSES We have also successfully acted on behalf of businesses who have had their sponsor licence revoked, suspended, or downgraded. This is a complicated process requiring an in depth knowledge of the Home Office s policy guidance, rules and regulations. It is essential that the initial sponsor licence application is successful, as if it is refused, the Home Office may impose a six month cooling off period within which the business may not make a further sponsor licence application. Gherson are known for successfully handling complex immigration appeals and judicial reviews. The firm has often succeeded in securing 4
