2 Overview o Review the basic components of the Succession Plan. o Explain criteria and process for selecting Successor Officers. o Present next steps.
3 Succession Plan Components o Defines Emergency and Unavailable for clarity as to when Plan is activated. o Provides criteria and process for appointing Standby Officers. o States the duties of Standby Officers. o Includes flexible process for determining Regular Officer Unavailability and seating Standby Officers. o Provides details on the term of service and dismissal of Standby Officers.
4 Next Steps: Standby Officer Selection o Each Board Member shall provide Secretary with list of three Standby Officers selected based on: o Location. o Age (must be at least 18). o Lack of conflict of interest. o Location of Standby Officers: o All must be lawful residents of California. o Two must be from within the Regular Officer s ward, and the third must be from outside the Regular Officer s ward.
5 Next Steps: Standby Officer Selection Standby Officers shall not: o Be an employee of the District; o Be a member of the Regular Officer s immediate family; o Have a financial interest in a company or agency that has a contract with the District or is reasonably possible to have a contract with the District; or o Serve as an officer or employee of a public entity that has a competing interest with the District.
6 Next Steps: Standby Officer Appointment o Proposed Standby Officers shall provide resumes to Secretary, who shall carefully investigate the qualifications of each. o Following vetting by the Office of Secretary, Director of Operations & Maintenance shall approve list of Standby Officers. o The Board shall appoint Standby Officers through a Resolution. o Standby Officers shall arrange to take the Oath of Office.
7 Next Steps: Standby Officer Appointment o The list of Standby Officers shall be reviewed annually by each Board Member, and Standby Officers shall be reappointed annually. o Standby Officers will be required to complete annual Form 700s. o Standby Officers shall be required to remain informed of Board Member duties and District affairs, and shall remain ready to report for duty following an emergency.

9 Amendment to EBMUD Retirement System Ordinance (No. 40) - Section 21 Second Reading Board of Directors May 23, 2017
10 Updates to Ordinance No. 40 Section 21 provides for an optional modification of a member s retirement allowance to provide an actuarially equivalent allowance for a surviving beneficiary. Actuarial rate of return and mortality tables are used to calculate: optional beneficiary allowance in Section 21, cash-outs of retirement contributions, and posting of interest to employee accounts 2
11 Updates to Ordinance No. 40 Plan Actuary recommended a change to actuarial rate of return from 7.5% to 7.25% as part of their 2016 Annual Actuarial Valuation. Plan Actuary also recommended changes to the mortality tables. The Retirement Board adopted the proposed rate change and updated mortality tables Adopted January 19, 2017 To be effective July 1,
12 Updates to Ordinance No. 40 The Ordinance requires that the actuarial assumptions used to determine optional forms of benefits be specified. The proposed update to the Retirement Ordinance (Section 21) ensures language is consistent with the changes adopted by the Retirement Board. 4
13 Updates to Ordinance No. 40 Steps to finalize adoption of Ordinance amendment First reading was held, 5/9/17 Second reading and vote to adopt, 5/23/17 The Ordinance amendment must be placed in newspaper for 2 successive weeks Adoption of Ordinance amendment will take effect 30 days after the vote to adopt, 6/22/17 Staff will publish and distribute copies of the revised Ordinance by 7/14/17 5
