For more information, please contact Deborah Neels, Senior Director Government Affairs or Barbara Klein, Associate Vice President of Government and Community Affairs at Introduction This report summarizes the unofficial results from the November 2, 2010, General Election results from the Statewide, Congressional District, County Executive, and State Legislative races for public office in Maryland. These results will be certified by the Board of State Canvassers on December 12, Statewide Races Exhibit 1 Office of Governor - Martin O Malley, Democrat, won the Gubernatorial election over challenger Robert Ehrlich, Jr., Republican. The Maryland Constitution states that the term of the Governor shall commence on the third Wednesday of January next ensuing his election for a four year term of office. The Constitution permits the Governor to reorganize the Executive Branch of State Government through Executive Orders submitted to the General Assembly within the first ten days of a regular session. The Executive Orders become effective on the date designated in the Orders, unless the majority of all members of either Chamber specifically concurs in a resolution of disapproval within fifty days after the orders are submitted. Comptroller of Maryland - Peter Franchot, Democrat from Montgomery County, won his bid to retain the office of Maryland Comptroller defeating Republican, William Campbell. The Comptroller is elected by popular vote to serve a four year term of office. The term begins on the third Monday in January following the election. By law, the Comptroller of Maryland serves on the Board of Public Works; the Board of Revenue Estimates; and on other designated bodies. Attorney General - Attorney Douglas F. Gansler, Democrat, was uncontested. The Attorney General is elected by the voters to a four-year term. The number of consecutive terms which an Attorney General may serve is not limited. Though not specified by law, the Attorney General by custom takes office on December 20, following the election. 3 Treasurer - Nancy K. Kopp currently serves as the State Treasurer. Under the Maryland Constitution, the State Treasurer is to be appointed on joint ballot by the two Houses of the Legislature at each regular session in which begins the term of the Governor. The State Treasurer serves a four-year term coinciding with that of the Governor. Congressional Races Exhibit 1 U. S. Senator Barbara Mikulski, Democrat, was elected to the Senate over Eric Wargotz, Republican. In the United States Senate, each state is equally represented by two members. Senators serve for six-year terms that are staggered so elections are held for approximately one-third of the seats every second year. The number of consecutive terms a Senator may serve is not limited. Representatives in Congress - Of the eight U. S. Representatives in Congress who ran to retain their seat, seven were re-elected. Frank Kratovil, Jr, Democrat, was defeated by Andrew Harris, Republican, in the 1 st Congressional District. Seats in the U. S. House of Representatives are apportioned among the states on the basis of population, as determined by the census conducted every ten years. Currently, Maryland has 8 members in the United States House of Representatives. Each Representative serves a two-year term and may be re-elected an unlimited number of times. County Executive Races Exhibit 1 The six most populous counties and Baltimore City operate under a charter form of government. Anne Arundel County voters re-elected John Leopold (Republican); Baltimore County elected a new executive Kevin Kamenetz (Democrat); Harford County elected the incumbent, David R. Craig (Republican); Howard County voters re-elected Kenneth Ulman (Democrat); Montgomery County re-elected Isiah Leggett (Democrat); Rushern L. Baker (Democrat), former state delegate was elected in Prince George s County. County Executives serve a four-year term. The Baltimore City Mayoral Primary election is scheduled for September 13, Maryland General Assembly Exhibit 2 As the legislative body directly representing the electorate, the Maryland General Assembly passes public general and public local laws, raises revenues and appropriates funds to pay for State government services, and oversees the operation of State executive agencies. The Maryland Constitution requires the General Assembly to convene on the second Wednesday of January for 90 consecutive days. During this period the legislature normally considers over 2,300 pieces of legislation including the State s annual operating budget. The 428th Session begins January 12, 2011 and adjourns April 11, The Maryland General Assembly consists of 188 members, with 47 members in the Senate of Maryland and 141 members in the House of Delegates. A detailed analysis of the election results follows. 2

4 Below is a pre-election and post-election comparison of the Maryland General Assembly. Senate of Maryland: Of the 47 members of the State Senate: the party affiliation changed from 70% Democrat/ 30% Republican to 74% Democrat / 26% Republican (the Democrats picked up 2 members with the Republicans losing 2 members); the gender composition remains unchanged at 77% Male/ 23% Female. 10 or 21% are newly elected freshmen members, of which: o 7 currently are members of the House of Delegates (Exhibit 2- Table A), and o 3 do not currently hold a seat in the Maryland General Assembly (Exhibit 2- Table A); and 37 or 79% are returning members (i.e. current incumbents). There are 10 incumbent Senators who either lost the election or chose not to run for the State Senate (Exhibit 2- Table B). House of Delegates: Of the 141 members of the House of Delegates: the party affiliation changed from 73% Democrat/ 27% Republican to 70% Democrat/ 30% Republican (the Republicans picked up 5 members, with Democrats losing 5); the gender composition changed from 64% Male/ 36% Female to 67% Male/ 33% Female (4 less Females, but 4 more Males). 30 or 21% are newly elected freshmen members (Exhibit 2- Table C); and 111 or 79% are returning members. There are 30 incumbent Delegates who either lost the election or chose not to run for the House of Delegates see Exhibit 2- Table D. 3

5 Maryland General Assembly District Level Outcome - Appendix I Appendix I shows a district-by-district list of outcomes in the General Election in the races for the State Senate of Maryland and the House of Delegates. It also reflects those incumbents who will not return denoted by Strikeout. Statewide Ballot Issues in General Election Appendix II There were 3 Constitutional Amendments and 1 controversial Local Ballot Referendum relating to Video Lottery Facilities. 26 Maryland General Assembly Unofficial Results of November 2, 2010 General Election Constitutional Amendments and Select Ballot Questions Maryland Constitutional Question - Should a constitutional convention be called for the purpose of changing the Maryland Constitution? Under Article XIV, Section 2 of the Maryland Constitution the General Assembly is required to ask the voters every 20 years whether a constitutional convention should be called for the purpose of altering the Maryland Constitution. Maryland Constitutional Amendment Trial by Jury - Authorizing the enactment of legislation to limit the right to a jury trial in a civil proceeding to those proceedings in which the amount in controversy exceeds $15,000. (Amending Maryland Declaration of Rights Articles 5(a) and 23) Under Articles 5 and 23 of the Maryland Declaration of Rights, a party in a civil proceeding has a right to a jury trial where the amount in controversy exceeds $10,000. In cases where the amount in controversy does not exceed this threshold amount, a judge, rather than a jury, determines the verdict. The constitutional amendment would increase the amount-in-controversy limitation by providing that a party may not demand a jury trial in a civil proceeding unless the amount in controversy exceeds $15,000, excluding attorney s fees if attorney s fees are recoverable in the proceeding. Qualifications for Baltimore City Orphans Court Judges - Requires judges of the Orphans Court in Baltimore City to be members in good standing of the Maryland Bar who are admitted to practice law in Maryland. (Amending Article IV, Section 40 of the Maryland Constitution) Under the Maryland Constitution, the voters of each county and Baltimore City elect three judges to the Orphans Court of their respective jurisdictions, with the exception of Montgomery and Harford counties, where circuit court judges sit as the Orphans Court. The judges must be citizens of the State and residents, for the preceding 12 months, in the city or county in which they are elected. The constitutional amendment would add an additional eligibility requirement for judges of the Orphans Court in Baltimore City, requiring them to be members in good standing of the Maryland Bar who are admitted to practice law in Maryland. Anne Arundel Local Referendum by Petition - Zoning, Video Lottery Facilities - Video Lottery Facilities are not permitted anywhere in Anne Arundel County under current zoning law. Bill No is a zoning bill and was enacted for the purpose of allowing a Video Lottery Facility as a conditional use in a W-1 Industrial Park zoning district or at a Regional Commercial Complex.
