Kate Patterson-Murphy, San Francisco Arts Commission COMPLAINT Complainant Ann Treboux ("Complainant") alleges that Kate Patterson-Murphy ("Ms. Patterson") of the San Francisco Arts Commission ("the Commission") violated provisions of the Sunshine Ordinance by failing to timely respond to her October 14, 2016 Immediate isclosure Request ("IR"). COMPLAINANT FILES THIS COMPLAINT On October 18, 2016, Complainant filed this complainant with the Task Force regarding the Commission's alleged failure to timely respond to Complainant's IR.. JURISICTION The Commission is a department under the Ordinance. The Task Force therefore generally has jurisdiction to hear a complaint of a violation of the Ordinance against the Commission. The Commission has not contested jurisdiction. APPLICABLE STATUTORY SECTION(S) Section 67 of the San Francisco Administrative Code: Section governs immediacy of response. Section 6250 et seq. of the Cal. Gov't Code ("CPRA") Section 6253 governs the release of public records and the timing ofresponses. Kate Patterson-Murphy, San Francisco Arts Commission Request all documents regarding Barbara Sklar- Oath of Office; dates of swaring in and letters of confirmation from the SF Mayors Office and the SF Board of Supervisors. I am making this request pursuant to the Sunshine Ordinance. On October 18, 2016, Complainant filed this complaint with the Task Force. On October 25, 2016, in response to the filing of this Complaint, Ms. Patterson wrote a letter to the Task Force which reads in part as follows: The Arts Commission accepts full culpability for failing to respond to Ms. Treboux's Immediate isclosure Request. As the attached demonstrates, I communicated with my colleagues, both verbally and via , in advance of my scheduled vacation to ensure that requests would receive timely responses. Unfortunately, my colleagues did not execute the delegated responsibility. We did respond fully to Ms. Treboux's request for "... all documents regarding Barbara Sklar-Oath of Office; dates of swariilg in and letters of confirmation from the SF Mayors Office and the SF Board of Supervisors." A copy of our response was provided by the Task Force Administrator. I deeply regret that this has happened and will take extra measures to guarantee that this will not happen again. Kate Patterson-Murphy, San Francisco Arts Commission * * * CHAPTER 67, SAN FRANCISCO AMINISTRATIVE COE (SUNSHINE ORINANCE) SEC IMMEIACY OF RESPONSE (a) Notwithstanding the 10-day period for response to a request permitted in Government Code Section 6256 and in this Article, a written request/or information described in any category of non-exempt public information shall be satisfied no later than the close of business on the day following the day of the request. This deadline shall apply only if the words "Immediate isclosure Request" are placed across the top of the request and on the envelope, subject line, or cover sheet in which the request is transmitted. Maximum deadlines provided in this article are appropriate for more extensive or demanding requests, but shall not be used to delay fulfilling a simple, routine or otherwise readily answerable request. (b) If the voluminous nature of the information requested, its location in a remote storage facility or the need to consult with another interested department warrants an extension of 10 days as provided in Government Code Section , the requester shall be notified as required by the close of business on the business day following the request. ( c) The person seeking the information need not state his or her reason for making the request or the use to which the information will be put, and requesters shall not be routinely asked to make such a disclosure. Where a record being requested contains information most of which is exempt from disclosure under the California Public Records Act and this article, however, the City Attorney or custodian of the record may inform the requester of the nature and extent of the nonexempt information and inquire as to the requester's purpose for seeking it, in order to suggest alternative sources for the information which may involve less redaction or to otherwise prepare a response to the request. ( d) Notwithstanding any provisions of California Law or this ordinance, in response to a request for information describing any category of non-exempt public information, when so requested, the City and County shall produce any and all responsive public records as soon as reasonably possible on an incremental or "rolling" basis such that responsive records are produced as soon as possible by the end of the same business day that they are reviewed and collected. This section is intended to prohibit the withholding of public records that are responsive to a records request until all potentially responsive documents have been reviewed and collected. Failure to comply with this provision is a violation of this Article. CAL. PUBLIC RECORS ACT (GOVT. COE 6250, ET SEQ.) SEC (c) Each agency, upon a request for a copy ofrecords, shall, within 10 days from receipt of the request, determine whether the request, in whole or in part, seeks copies of disclosable public records in the possession of the agency and shall promptly notify the person making the request of the determination and the reasons therefor. Kate Patterson-Murphy, San Francisco Arts Commission prescribed in this section may be extended by written notice by the head of the agency or his or her designee to the person making the request, setting forth the reasons for the extension and the date on which a determination is expected to be dispatched. No notice shall specify a date that would result in an extension for more than 14 days. When the agency dispatches the determination, and if the agency determines that the request seeks disclosable public records, the agency shall state the estimated date and time when the records will be made available. As used in this section, "unusual circumstances" means the following, but only to the extent reasonably necessary to the proper processing of the particular request: (1) The need to search for and collect the requested records from field facilities or other establishments that are separate from the office processing the request.. (2) The need to search for, collect, and appropriately examine a voluminous amount of separate and distinct records that are demanded in a single request. (3) The need for consultation, which shall be conducted with all practicable speed, with another agency having substantial interest in the determination of the request or among two or more components of the agency having substantial subject matter interest therein. 11 SUNSHINE TASK FORCE FILE# ANN TREBOUX v KATE PATIERSON- SF ARTS COMMISSION Summary: The Sunshine violations are: 67.21(c) for failure to identify public records that were withheld; for failure to justify the reason for withholding certain records; 67.25(a} forthe late response and Government Code section 6253(c) for failing to respond to the October 14, 2016 IR in a timely and/or complete manner. Backround: The initial IR was sent to their generic on October 14, October 14, Page Ritchie said, "we will respond to your request by the end of business on Monday". October I have not received a response and contact SOFT. October 18, Patterson doesn't identify which documents she has and states, "certificates of appointment" and "the Board of Supervisors motion approving her appointment to the Arts Commission." At the Board of Permits and Appeals (Lolli v SFAC}, Sklar claimed to have, "served under five Mayors". In my IR I asked for, "all documents regarding Sklar". I don't know why the SFAc has not identified all the documents they have and which have been withheld. October 18, I em'ail Patterson asking if she has additional documents. She doesn't respond but refers me to an employee at the SF Mayor's Office who no longer works there. The person she referred me to was not the custodian of records. A/TONAL INFORMATION October 19, Patterson states, "Sklar has served on the Arts Commission for many years over two different periods." She MAY invoke an extension. October 19, I restate: "ALL THE YEARS". Once again, Patterson has not identified which documents she has and doesn't seem to know which years Sklar served on the commission. October 20, I Patterson asking her to, "identify the years Sklar was a commissioner" and "a list of all documents for the years she was a commissioner" and "an inventory of the original documents". October 20, Patterson wants" an enumerated list". She doesn't state anymore than that. When I ask what she means, I don't get a response. 1 P275

ISCUSSION Response time to Public Records Requests Administrative Code 67.21{A) requires SFAC to produce responsive documents by the end of business the following day. Administrative Code 67.25{b) allows the department to invoke an extension.
