Interpretation 2. Objects 1.1 The name of the Association shall be the Canterbury and Western Suburbs Cricket Association Incorporated, hereafter referred to as "the Association". 1.2 In these rules, except in so far as the context of subject-matter otherwise indicates or requires - "secretary" means the person holding office under these rules as secretary of the Association, or where no such person holds that office, the public officer of the Association ; "special general meeting" means a general meeting of the Association other than the annual general meeting ; "the Act" means the Associations Incorporation Act, 1984 ; "the Regulation" means the Associations Incorporation Regulation, 1985 "mode of competition" means the conditions applying to the conduct of the Association's cricket competitions ; 1.3 In these rules a reference to a function includes a reference to a power, authority and duty ; and a reference to the exercise of a function includes, where the function is a duty, a reference to the performance of the duty. The objects of the Association shall be the management and promotion of the interests of cricket in general ; 2.2 to arrange and manage cricket competitions between affiliated member clubs and teams in accordance with the rules of the Association, the mode of competition and the prevailing rules and conditions of cricket and of its governing bodies including the N.S.W. Districts Cricket Association (hereafter called "The N.S.W.D.C.A."); 2.3 to adjudicate on all disputes or difficulties among affiliated members of the Association ; 2.4 to affiliate with and where appropriate appoint delegates to the N.S.W.D.C.A. or its successor and any other appropriate governing bodies of cricket. PART II MEMBERSHIP 3. Membership Qualifications The Association shall be composed of all Clubs, Associations and Leagues affiliated with the Association for the current season and individual persons meeting the following qualifications : 3.1 the person is a life member of the Association as provided by Rule 8 ; or 3.2 the person is an office bearer of the Association ; and 3.3 the person is not disqualified from membership as provided by rule 12 ; and. 3.4 the person is not in default to any other association affiliated with the N.S.W.D.C.A., or with the New South Wales Cricket Association, or their successors 4

5 4. Application for membership 4.1 An application by cricket clubs, associations and leagues for affiliation with and membership of the Association shall be made each season in writing on the Associations form, and shall be lodged with the Secretary of the Association, and shall be subject to acceptance by the Executive Committee of the Association. 4.2 Applications for affiliation for each new season shall close at the commencement of that season or at a time determined by the executive committee. 4.3 Where applications are rejected by the executive committee, the secretary shall, within fourteen (14) days after that determination notify the applicant of the committee's determination. 4.4 All club secretaries and delegates must be registered members of the Association and their names and addresses shall be in the hands of the secretary at the closing of entries each season. 4.5 In the event of any change in club secretary or delegates or club secretary or delegates address, the club secretary or incoming club secretary shall notify the Association secretary of such change within 14 days. 5. Cessation of Membership A club, association, league or person ceases to be a member of the Association if that member is expelled from the Association ; 5.2 resigns that membership ; 5.3 fails to renew membership by the start of a new season ; or 5.4 fails to pay any due fees as set out in these rules. 6. Membership Entitlements not Transferable A right or obligation which a club, association, league or person has by reason of being a member of the Association : 6.1 is not capable of being transferred or transmitted to another club, association, league or person ; and 6.2 terminates upon cessation of the club's, association's, league's or person's membership. 7. Resignation of Membership A member body of the Association who has paid all amounts payable by the member body to the Association may resign from membership of the Association by giving notice in writing to the secretary on receipt of which the member ceases to be a member and no moneys will be refunded to the member body. 8. Life Members 8.1 The Association may at an annual general meeting elect life members upon the recommendation of the executive committee. 8.2 Life members may take part in any meeting of the Association except executive committee meetings and vote on any matter brought forward. 9. Affiliated Clubs 9.1 Member clubs, associations and leagues may enter one or more teams in the competitions conducted by the Association provided that such teams conform with these rules and include only players registered with the Association. 5

6 9.2 Such clubs shall nominate one person to act as secretary and all dealings with the Association, in respect to the competitions conducted by the Association shall be between the secretary of the Association and the secretary of the club. 9.3 The name adopted by a member club shall be subject to approval by the executive committee. 10. Fees, Subscriptions etc Affiliation fees, ground fees, registration and insurance fees shall be determined by the executive committee. The treasurer will issue one (1) invoice at the start of the season for these above fees. This invoice shall be payable in full to the Association by 31 st October in each year, or clubs will be rendered as in default and will not receive any points. A final invoice will be issued on the 31 st January listing all fines incurred, this invoice must be paid within 31 days of date of invoice A team affiliation fee shall be paid along with nominating a team. Team nominations will not be taken if not accompanied by such payment 10.3 Fees are to be paid by cheque or straight into the Associations bank account only. 11. Members Liabilities The liability of an affiliated member body of the Association to contribute towards the payment of the debts and liabilities of the Association or the costs, charges and expenses of the winding up of the Association is limited to the amounts, if any, unpaid by the member body as required by rule 10 and rule Disciplining of Members 12.1 Any member body or registered player thereof not complying with the rules and conditions of the Association shall be liable to such penalty as the executive committee shall impose The executive committee may call upon any registered member of an affiliated body to attend any meeting of that committee and to reply to such questions as may be put and if any such person so called fails to appear, or refuses to answer questions satisfactorily, they shall, in the discretion of that committee unless they give reasonable excuse, be disqualified from playing in any match under the jurisdiction of the Association and that person shall be debarred from holding office in the Association until such time as the executive committee decides otherwise Where the executive committee is of the opinion that a member, registered player or group of registered players of a member body of the Association within the Association's competitions has or have refused or neglected to comply with a provision of these rules ; or persistently or wilfully acted in a manner prejudicial to the interests of the Association ; or refused or neglected to comply with the provisions of the Association's mode of competition rules. the committee may, by resolution expel the member or players from the Association ; or suspend the member or player from the Association ; or fine the member, affiliated club, team, player or group of players an amount as determined by the committee ; and deduct competition points from the team or teams concerned advise any appropriate governing body or bodies of its action Where the executive committee requires further information before taking action as set out in rules 12.1 and 12.3 it may by resolution require the secretary, as soon as practicable, to cause a notice in writing to be served on a registered player of a member body, or the secretary of a member body detailing the name or names of any player or official and specific details of charges to be heard ; stating the date, place and time of that meeting ; stating that the player, players or officials named are required to appear before the executive committee or a duly appointed sub-committee at a meeting to be held promptly, fairly and as soon as practicable after service of the notice ; 6

7 stating the date, place and time of that meeting ; informing the player, players or officials named that if they wish to be legally represented at the hearing, notice to this effect in writing, together with a non refundable fee of $200 must be received by the secretary of the Association at least three (3) days prior to the date of the meeting informing the player, players or officials named that non attendance at the hearing may result in the hearing proceeding in their absence Notices can be served by , post or whatever means the Secretary deems the most efficient and effective The rules governing defaulters as set down by the N.S.W.D.C.A. or its successor shall be accepted and adopted by the Association which shall endorse any disqualifications imposed by the N.S.W.D.C.A. or its successor on any person or persons All affiliated member bodies shall notify the secretary of all defaulters and/or disqualifications not later than 30th April each year after the member body has gone through the proper procedure of the notification of the defaulter. The secretary shall thereupon furnish the N.S.W.D.C.A. with a list of all such defaulters after also going through the proper procedure of notification of the defaulter in accordance with the rules of the N.S.W.D.C.A Any affiliated member body may nominate any player or players to the secretary of the Association of that player or players unfinancial status after the member body has gone through the proper procedure of notification of the unfinancial player so as to prevent those players from registering with any other member body affiliated with the Association until that debt is cleared Where the executive committee or sub-committee takes action under rules 12.1, 12.3 or 12.5, the secretary shall within seven (7) days of that decision, by notice in writing, inform the player, players or secretary of the member body of the decision Any affiliated member club playing a defaulting player of any affiliated club, as defined in rules 12.6 and 12.7, shall lose all points gained in the match or matches in which such player played Any club playing competition matches whilst in default to the Association shall not be credited with any points scored When a player or Club is alleged to have breached the Code of Conduct the procedure shall be: An umpire or Club reporting the breach must advise the player or Club at the end of play that a report is to be submitted and the nature of the alleged breach The umpire or Club will report the alleged breach to the honorary secretary without delay The honorary secretary shall arrange without delay a meeting to hear the reported allegations Matters arising on the first day of a two day match shall be heard prior to the next round of matches if possible Matters arising on the final day of a match shall be heard prior to the second following round of matches if possible The honorary secretary shall refer any report to the first Executive Committee meeting following the match involved Notice of the hearing shall be given as per Rule giving seven (7) days notice The executive committee may place a good behaviour bond on a Club after two instances of breaches of the Code of Conduct by that Club or a member of that Club have been proven and the bond shall be forfeited upon any subsequent breach of the Code of Conduct by that Club or a member of that Club is proven. The amount of the bond shall be determined by the executive committee from time to time. 13. Right of appeal of disciplined member Body or player 13.1 Any decision of the executive committee, except those regarding the grading of teams through the Permits and Gradings Committee as per rule 41.3 and those on appeal against the refusal of a permit to play, may be appealed against to the general committee of the Association. Notice of appeal in writing shall be in the hands of the secretary within seven 7

8 (7) days of the decision being made together with an appeal fee which shall be determined from time to time by the general committee and recorded in the minutes. The notice of appeal shall include the motion to be put to the General Committee hearing the appeal and only one motion from the appellant, his representative or his Club shall be voted upon. The decision of the executive committee appealed against shall stand until the appeal is heard and determined by the general committee. The appeal fee shall be refunded only in the event of the appeal being upheld If an appellant wishes to be legally represented at an appeal, notice to this effect in writing, together with a non refundable fee of $200 must be received by the secretary of the Association at least seven (7) days prior to the date of the appeal Any decision of the general committee may be appealed against to the N.S.W.D.C.A. or its successor. Notice of appeal in writing shall be in the hands of the C&WSCA secretary within fourteen(14) days of the decision being made together with the appeal fee required by the N.S.W.D.C.A The executive committee shall recognise and put into effect any resolution of the N.S.W.D.C.A. or other appropriate body on appeals made under rule The executive committee may by resolution re-instate a player at any time. PART III 14. Powers etc, of executive committee THE EXECUTIVE COMMITTEE 14.1 The executive committee shall be called the committee of management of the Association and, subject to the Act, the Regulation and these rules and to any resolution passed by the Association in annual or special general meeting shall control and manage the affairs of the Association ; may exercise all such functions as may be exercised by the Association other than those functions that are required by these rules to be exercised by a general meeting of members of the Association or by a delegates meeting ; has power to perform all such acts and do all such things as appear to the committee to be necessary and desirable for the proper management of the affairs of the Association and the conduct of its competitions ; may organise and conduct such cricket competitions as appear to the committee to be necessary or desirable ; shall set fees and charges for the conduct and administration of its competitions as it deems necessary ; has power to accept or reject applications by clubs, teams or individual players to enter its competitions and to grade any club admitted to its competitions or any player wishing to take part in its competitions shall, if so requested, act as arbiter in any dispute that may arise between any affiliated member bodies. 15. Constitution and membership 15.1 The executive committee shall consist of the president, vice president, secretary, assistant secretary and treasurer of the Association, and Junior Competition Secretary not more than four (4) other members of the general committee The office-bearers of the Association and the executive committee shall be elected at the annual general meeting pursuant to Rule The office-bearers of the Association shall be the patron the president ; the vice president ; the honorary secretary ; the honorary assistant secretary ; 8

9 the honorary treasurer ; the senior registrar ; the representative convenor ; the junior competition secretary; the girl s co-ordinator Each office-bearer and executive committee person shall, subject to these rules, hold office until the conclusion of the annual general meeting following the date of the member's election, but is eligible for re-election In the event of the office of president, honorary secretary or honorary treasurer becoming vacant in the interval between annual general meetings the general committee shall appoint some person to fill the vacant position, subject to these rules In the event of a casual vacancy of any other office occurring the executive committee may appoint some person to fill the vacant position, subject to these rules Any person appointed, pursuant to rule 15.5 or 15.6, to an office of the Association shall hold office, subject to these rules, until the conclusion of the annual general meeting next following the date of the appointment. 16. Election of Office Bearers and ordinary executive committee members 16.1 Nominations of candidates for election as office-bearers and ordinary members of the executive committee of the Association shall be made in writing on the Association form and signed by the nominee and a seconder, being a member of the Association or an affiliated body shall be delivered to the secretary of the Association not less than fourteen (14) days before the date fixed for the holding of the annual general meeting at which the election is to take place If insufficient nominations are received to fill all positions, the candidates nominated shall be deemed to be elected and further nominations to fill the remaining vacant positions shall be received from the floor at the annual general meeting If insufficient further nominations are received, any vacant positions remaining shall be deemed to be casual vacancies If the number of nominations received is equal to the number of vacancies to be filled, the persons nominated shall be deemed to be elected If the number of nominations received exceeds the number of vacancies to be filled, a ballot shall be held The ballot for the election of office-bearers shall be conducted at the annual general meeting in such usual and proper manner as the committee may direct No more than one (1) member of an affiliated club other than office-bearers may be elected as ordinary members of the executive committee. 17. Secretary 17.1 The secretary of the Association shall, as soon as practicable after being appointed as secretary, lodge notice with the Association of his or her address It is the duty of the secretary to handle and deal with all correspondence and contact with members bodies of the Association, suppliers to the Association and all other persons and organisations with whom the association may deal from time to time ; and submit all incoming and all copies of outgoing correspondence to each general committee meeting ; and keep a record of all affiliated bodies and registered members. 9

10 18. Treasurer It is the duty of the treasurer to receive all fees and other payments ; and 18.2 bank all moneys received within fourteen (14) days of receipt thereof ; and 18.3 produce a statement of account at each general committee meeting and when called upon so to do by the executive committee ; and 18.4 ensure that correct books and accounts are kept showing the financial affairs of the Association including full details of all receipts and expenditure connected with the activities of the Association. 19. Assistant Secretary 19.1 It is the duty of the assistant secretary to keep minutes of all appointments of office-bearers and members of the executive committee ; the attendance at all meetings of the Association ; proceedings at all meetings of the Association These minutes shall be kept in the minutes book and such minutes shall be verified as a true copy by the chairperson of the meeting or by the chairperson of the next succeeding meeting. 20. Casual vacancies For the purpose of these rules, a casual vacancy in the office of an ordinary member of the executive committee or an office-bearer of the Association occurs if the member dies ; 20.2 becomes an insolvent under administration within the meaning of the Companies (New South Wales) Code ; 20.3 resigns office by notice in writing given to the secretary ; 20.4 is removed from office under rule 21 ; 20.5 becomes of unsound mind or a person whose person or estate is liable to be dealt with in any way under the law relating to mental health ; or 20.6 is absent without the consent of the executive committee from three (3) consecutive meetings of the general committee or five (5) consecutive meetings of the executive and/or general committee whereupon the provisions of rules 15.5 and 15.6 shall apply. 21. Removal of office bearer 21.1 The executive committee shall have the power to suspend from office any official of the Association and such official shall, on demand by the president or any approved member of the executive committee, hand over all minutes, cash receipts, bank or other books, papers and documents and other property in his possession or custody belonging to or relating to the Association Any official so suspended shall have the right of appeal to the general committee, but such right shall be forfeited in the event of non-compliance with the requirements of rule Meetings and quorum 22.1 The executive committee shall meet at least once per month during the cricket playing season and as required Oral or written notice of a meeting of the executive committee shall be given by the secretary to each member of the executive committee at least forty-eight (48) hours (or such other period as may be unanimously agreed upon by the members of the executive committee) before the time appointed for the holding of the meeting. 10

11 22.3 Notice of a meeting given under rule 22.2 shall specify the general nature of the business to be transacted at the meeting and no business other than that business shall be transacted at the meeting, except business which the committee members present at the meeting unanimously agree to treat as urgent business At any meeting of the executive committee any five (5) members of the committee shall constitute a quorum for the transaction of the business of the meeting No business shall be transacted by the executive committee unless a quorum is present and if within half an hour of the time appointed for the meeting a quorum is not present the meeting stands adjourned to the same place and at the same hour of the same day in the following week If at the adjourned meeting a quorum is not present within half an hour of the time appointed for the meeting, the meeting shall be dissolved The president shall preside as chairperson at all meetings of the association If the president is absent from a meeting or unwilling to act the vice president shall preside as chairperson If both the president and vice president are absent from a meeting or are unwilling to act the members present shall elect one of their number to preside as chairperson at the meeting. 23. Delegation by committee to sub-committee 23.1 The executive committee may, by resolution, delegate to one or more sub-committees (consisting of such representatives from member bodies of the Association as the executive committee thinks fit) the exercise of such of the functions of the committee as are specified in the resolution, other than this power of delegation ; and a function which is a duty imposed on the executive committee by the Act or by any other law A function the exercise of which has been delegated to a sub-committee under this rule may, while the delegation remains unrevoked, be exercised from time to time by the subcommittee in accordance with the terms of the delegation A delegation under this section may be made subject to such conditions or limitations as to the exercise of any function the subject thereof, or as to time or circumstances, as may be specified in the resolution Notwithstanding any delegation under this rule, the committee may continue to exercise any function delegated Any act or thing done or suffered by a sub-committee acting in the exercise of a delegation under this rule has the same force and effect as it would have if it had been done or suffered by the executive committee The executive committee may, by resolution, revoke wholly or in part any delegation under this rule A sub-committee may meet and adjourn as it thinks proper. 24. Voting and decisions 24.1 Questions arising at a meeting of the executive committee or of any sub-committee shall be determined by a majority of the votes of members of the committee or sub-committee present at the meeting Each member present at a meeting of the executive committee or of any sub-committee appointed by the executive committee except the person presiding at the meeting is entitled to one vote. 11

12 24.3 Subject to rule 22.4, the executive committee may act notwithstanding any vacancy on the committee Any act or thing done or suffered, or purporting to have been done or suffered, by the executive committee or by a sub-committee appointed by the executive committee, is valid and effectual notwithstanding any defect that may afterwards be discovered in the appointment or qualification of any member of the executive committee or sub-committee The vice president, secretary, assistant secretary and treasurer shall have a seat and a vote at all meetings of the Association. The president (and in his absence the chairman) shall have only a casting vote at all meetings of the Association. Other office bearers shall only have a vote at the annual general meeting and any special general meeting. PART IV THE GENERAL COMMITTEE 25. Powers etc, of general committee The general committee shall deal with all matters of concern to the Association. 26. Meetings and quorum 26.1 The general committee shall meet on a regular basis throughout the season on a night to be determined from time to time by the general committee, following the completion of each senior game unless decided otherwise At any general committee meeting four (4) members of the executive committee and ten (10) delegates from affiliated bodies entitled to vote shall constitute a quorum. 27. Constitution and membership 27.1 The general committee shall consist of all members of the executive committee ; and one (1) delegate from each member body 27.2 All delegates of the general committee shall be registered members of the Association ; and represent one (1) affiliated member body only retain their power from one annual general meeting until the next inclusive, except as otherwise provided in these rules, or until the secretary be notified in writing by the affiliated member body which the delegate represents, that another delegate has been appointed Delegates from any affiliated member body being in default to the Association or to any other affiliated body shall be debarred from voting at any general meeting of the Association until such default is removed. 28. Voting and decisions 28.1 Questions arising at a meeting of the general committee shall be determined by a majority of the votes of members of the committee or sub-committee present at the meeting Each member present at a meeting of the general committee except the person presiding at the meeting is entitled to one vote. PART V ANNUAL AND SPECIAL GENERAL MEETINGS 29. Presentation of annual reports and trophies The presentation of the annual reports of the secretary and treasurer and the presentation of trophies shall be held no later than the last Saturday of July in each year. Such reports shall be printed and 12

13 distributed at least seven (7) days prior to such presentation night, and shall also give notice of the date of the annual general meeting and the time and place of such meeting. 30. Annual general meetings - holding of The Association shall convene an annual general meeting of its members within two (2) weeks after the annual presentation night. 31. Annual general meetings - calling of and business at 31.1 The annual general meeting of the Association shall, subject to the Act and to rule 29 and rule 30, be convened on such date and at such place and time as the executive committee thinks fit In addition to any other business which may be transacted at an annual general meeting, the business of the annual general meeting shall be to confirm the minutes of the last preceding annual general meeting and of any special general meeting held since that meeting ; to receive from the executive committee reports upon the activities of the Association during the last preceding financial year ; to elect the office-bearers of the Association ; the executive committee ; the permits and gradings committee ; one (1) auditor ; two (2) delegates and one (1) alternate delegate to the N.S.W.D.C.A. ; one (1) delegate to the Canterbury & District umpires Association delegates to the various district grade associations to receive and consider the statement which is required to be submitted to members pursuant to section 26(6) of the Act ; 31.3 An annual general meeting shall be specified as such in the notice convening it. 32. Special general meetings - calling of 32.1 The executive committee may, whenever it thinks fit, convene a special general meeting of the Association The secretary or president shall, on the requisition in writing signed by the honorary secretary of five (5) member bodies, convene a special general meeting of the Association within fourteen (14) days of the requisition being lodged with the secretary A requisition of member bodies for a special general meeting shall state the purpose or purposes of the meeting ; shall be signed by the secretaries of the member bodies making the requisition ; shall be lodged with the secretary ; and may consist of several documents in a similar form, each signed by one or more of the secretaries of the member bodies making the requisition If the committee fails to convene a special general meeting within the time specified in rule 32.2, any one or more of the secretaries of the member bodies who made the requisition may convene a special general meeting to be held not later than three (3) months after the date A special general meeting convened by a member body or bodies as referred to in rule 32.4 shall be convened as nearly as is practicable in the same manner as general meetings are 13

14 convened by the executive committee and any member body who thereby incurs expense is entitled to be reimbursed by the Association for any expense so incurred. 33. Special general meeting to determine the mode of competition 33.1 A special general meeting to determine the mode of competition shall be held prior to the commencement of each season Notice of the mode of competition special general meeting shall be made by the secretary as per rule The delegates at a mode of competition special general meeting shall have the authority to adopt any by-law, conditions and/or rules for the guidance of the competitions, provided that such be consistent with these rules Proposed changes to the mode of competition must be submitted to the secretary in sufficient time for the proposals to be included in the notice of business for the mode of competition special general meeting as per rule Playing dates for the forthcoming season to be determined at the special general meeting to determine the mode of competition for senior and junior formats The secretary shall present at this meeting possible alternative game formats from 40 over, All day games and two day game options for consideration by members 34. Notice 34.1 The secretary shall, at least fourteen (14) days before the date fixed for the holding of an annual or special general meeting, cause to be sent by notifying in writing to the secretary of each member body a notice specifying the place, date and time of the meeting and the nature of the business proposed to be transacted at the meeting including notice of any special resolutions proposed to be considered No business other than that specified in the notice convening an annual or special general meeting shall be transacted at the meeting except, in the case of an annual general meeting, business which may be transacted pursuant to rule A member or member body desiring to bring any business before an annual or special general meeting may give notice in writing of that business to the secretary who shall include that business in the next notice of calling an annual or special general meeting given after receipt of the notice from the member. 35. Procedure and quorum 35.1 No item of business shall be transacted at an annual or special general meeting unless a quorum of members entitled under these rules to vote is present during the time the meeting is considering that item Delegates from one half of the affiliated member bodies (being representatives of member bodies entitled under these rules to vote at a general meeting) constitute a quorum for the transaction of the business of an annual or special general meeting If within half an hour after the appointed time for the commencement of an annual or special general meeting a quorum is not present, the meeting if convened upon the requisition of members shall be dissolved and in any other case shall stand adjourned to the same day in the following week at the same time and (unless another place is specified at the time of the adjournment by the person presiding at the meeting) at the same place. 36. Adjournment 36.1 The chairperson of an annual or special general meeting at which a quorum is present may, with the consent of the majority of members present at the meeting, adjourn the meeting from time to time and place to place, but no business shall be transacted at an adjourned meeting other than the business left unfinished at the meeting at which the adjournment took place Where an annual or special general meeting is adjourned for fourteen (14) days or more, the secretary shall give written or oral notice of the adjourned meeting to each member of the 14

15 Association, or each secretary of a member body, stating the place, date and time of the meeting and the nature of the business to be transacted at the meeting Except as provided in rules 36.1 and 36.2, notice of an adjournment of an annual or special general meeting or of the business to be transacted at an adjourned meeting is not required to be given. 37. Making of decisions 38. Voting 37.1 A question arising at an annual or special general meeting of the Association shall be determined on a show of hands and, unless before or on the declaration of the show of hands a poll is demanded, a declaration by the chairperson that a resolution has, on a show of hands, been carried or carried unanimously or carried by a particular majority or lost, or an entry to that effect in the minute book of the Association, is evidence of the fact without proof of the number or proportion of the votes recorded in favour of or against that resolution At an annual or special general meeting of the Association, a secret ballot may be demanded in respect of any matter At the annual general meeting and any special general meeting any affiliated member body shall be entitled to be represented by two (2) delegates each of whom shall be entitled to vote Any affiliated member body being in default to the Association or to any other member club shall be debarred from voting at any meeting of the Association until such default is removed. PART VI GENERAL 39. Entering competitions 39.1 Team nominations by affiliated clubs must be made in writing on the official Association forms and must be signed by the secretary of the affiliated club and lodged with the Association secretary by a date determined by the executive committee as the closi ng of entries In the event of an affiliated club nominating a team or teams for entry to the competition and withdrawing such team or teams after having been allocated a wicket, the club concerned shall be responsible for the payment of fees due or applicable for such wicket and for affiliation fees Prior to the start of the season a representative from each senior team entered in the competition (preferably the captain/vice-captain) and Secretary of all junior clubs shall appear before a meeting of the Executive Committee and representatives of the Umpires Association, regarding the mode of competition, rules regarding the code of conduct and what the association expects of its affiliated clubs and teams. Any team not represented at this meeting will not be eligible to score any points in their respective grades until they have appeared before the afore said committee Registration to play 40.1 All players shall be registered in writing upon the Association's official form before becoming eligible to play. Teams playing an ineligible player shall lose all points in the match or matches in which such player participates and the club concerned shall be subject to such penalty or penalties as the executive committee may impose. No player shall be registered when directed by the executive committee under rule The club secretary may register all players from the previous season, provided no permit is needed, in a spreadsheet format with the following details- players name, address, phone, grade and date of birth The spreadsheet must be in the hands of the registrar prior to playing. It may be ed, on a disc or printed. 15

16 If players are registered in this format the club secretary must retain the original association forms signed by their players in case of dispute A new player can be registered at any time through the season. Players will still be required to be graded and still required to play 4 games to play semi-finals, or 3 games with ten rounds or fewer Senior players shall be registered with one club only. Juvenile players shall be registered with one club only. Players participating in both competitions must be separately registered in each competition. For the purpose of this rule a juvenile player shall be entitled to register with a different club in each competition No player shall be eligible to participate in either the semi final or final matches unless such player has participated in a minimum of four (4) competition matches, or three (3) matches with ten rounds or fewer, during the current season or has approval from the Executive Committee Any Competition match completely called off (without a ball being bowled) will not be counted as a competition match All registrations must supply 2 passport photos with registration form. One form will be kept by the club secretary and the other to be stamped and laminated and be used for player identification on game day if required Players will qualify to play senior cricket if they have turned 13 on or before August 31 st of the year in which the season starts. 41. Permits and gradings committee 41.1 The permits and gradings committee, herein called the "PGC" shall consist of the registration recorder and four (4) members from affiliated member bodies, with no more than one member from any one affiliated body The PGC shall meet prior to each general committee meeting or as directed by the executive committee. A quorum shall consist of any three (3) members. In the event of a quorum not being available the attending members may co-opt such other member or members of the executive committee as are needed to form a quorum The PGC shall grade all teams in their respective grades after the closing of entries. As far as practicable the competition shall be conducted in grades or divisions of eight (8) teams ; the winning club in the lower grade to take the place of the lowest club in the higher grade. Decisions of the PGC shall be final in any matter relating to the grading of teams The PGC shall consider all applications for permits from players wishing to compete in a grade in which they were previously ineligible. No permit shall be granted by the PGC after the 31st January for the current season All applications for permit shall be in writing on the Association's printed form, signed by the applicant or his club secretary, and shall give a detailed statement of the players averages during the last season in which he played, endorsed by his club secretary or the Association secretary. The PGC may request such additional information as it cons iders necessary. 42. Permits 41.6 An applicant for a permit may appeal against any decision of the PGC to the executive committee. Such appeal shall be in writing and accompanied by an appeal fee as determined from time to time by the general committee which shall be forfeited if the appeal is lost The PGC shall not consider a permit from a player when directed by the executive committee under rule The following players shall apply to the Association for a permit to play : players who did not play in the C.& W.S.C.A. in the previous season ; members of a previous season's premiership winning team wishing to play in the 16

17 same grade (other than the highest grade of the Association) ; 17

18 players wishing to play in a grade lower than the lowest grade in which they were eligible to play in the previous season ; players who last played with any other Association affiliated with the N.S.W.D.C.A. or Grade or Shire (any grade) under the N.S.W.Cricket Association or any other Association Any permit obtained by any player on wilfully false information shall be deemed to be void A player once having obtained a permit to play in the same or lower division or grade cannot then re-apply for a permit during the current season. After receiving a permit in a season, a player playing one subsequent game in a higher grade will be regraded to that higher grade Any player over the age of 50 (at 1 st September) to be allowed to play in any grade without completing a permit application. 43. Regressions / transfers 44. Wickets 43.1 In the same club, a player may be promoted to a higher grade and return to the grade in which he was previously eligible without the necessity of applying for a permit providing that such player does not play more than three (3) matches in the higher grade in one season excepting whereupon the provisions of Rule 43.7 applies Any club with two or more teams within the same grade wishing to transfer a player from one team to another shall apply in writing to the PGC No transfer will be allowed pursuant to rules 43.2 after the 31st January in each season Players wishing to transfer from one club to another during a season must furnish a clearance from the club from which he is transferring, obtain the permission of the executive committee In the same season, a player, wishing to transfer from another Association or Distract Club to this Association, must furnish a clearance from the Association or District Club in which he was last registered, and such clearance must be signed by the Secretary of that Association or District Club Teams in 1st and 2nd Division may promote and regress players between the two Divisions using an unlimited interchange system. To qualify for semi finals in either grade a player must play the last four (4) games in that particular grade or division No player can be placed on more than one (1) senior declared team sheet on any given day. Players can though participate as sub fielders in games other than those they are participating in The Association shall be responsible for the hire of the wickets for all matches under the auspices of the Association and shall charge clubs playing in the competitions for the use of the wickets provided that such charges shall not be in excess of those imposed by the local council In allocating wickets to affiliated clubs the executive committee shall give preference to clubs using the wickets in the previous season The executive committee shall have the power to select wickets for the competition and all games as ordered shall be played thereon The team drawn as the home side shall provide four (4) bails, a minimum of six (6) stumps and sufficient boundary markers as approved in the mode of competition rules (e.g. flags, witches hats, plastic domes). 45. Team sheets 46. Score sheets / results The captain of each team can declare twelve (12) players on the team sheet, which is to be exchanged 10 minutes before the match is scheduled to commence and prior to the tossing of the coin. The twelve (12) nominated players can be used in any way in an innings during the match, with only (11) eleven allowed to bay bowl or field in each innings of the match. Under this rule each innings is regarded as separate so a different eleven (11) can bat and bowl in the second innings as opposed to the first. Sides may nominate 12 players for all games. 18

19 46.1 Scorebooks must be signed by the official umpire if present or by the opposing captain in his absence Match results along with full details of batting and bowling are to be recorded on MYcricket website., by 9pm on the Tuesday after each match. The results are to be checked by both teams and confirmed. Any disputed ganes are to be referred to the Executive committee no later than 9pm the day after the game. Failure to lodge a result on time will result in a fine ALL Clubs are required to phone results to the secretary or his appointee no later than 9.00 pm on the day of the completion of the match. Failure to phone / / SMS results will incur a fine as determined from time to time by the executive committee. 47. Season averages / trophies 47.1 All team averages will be compiled from the results entered into mycricket (per rule 46.2) for the executive committee's perusal at their meeting held no later than the last day of April each year. Individual trophy winners will be determined by the executive committee and announced at that meeting Any club failing to adhere to rule 46.2 may deem all relevant team members to forfeit their rights to Association trophies All Association perpetual trophies must be returned to the secretary not later than 1st May in each year. Clubs failing to comply with this rule shall incur a fine as determined from time to time by the executive committee To win a senior Association trophy a player must play in at least seven matches in the relevant grade and division and also comply with the following requirements : Batting A player must bat in at least seven (7) matches in the relevant grade and division and achieve an aggregate of not less than 250 runs. 48. Forfeits Bowling A player must bowl in at least seven (7) matches in the relevant grade and division and secure not less than 30 wickets. Trophies will be awarded in each division for lowest bowling average and highest batting average subject to the above conditions All non competitive competition players will receive a medal of participation Any team forfeiting a match must give twenty four (24) hours notice in writing of such intention to : - the secretary of the Association ; and - the secretary of the club receiving the forfeit ; and - the secretary of the Umpires Association. Clubs failing to comply with this rule shall be held responsible for all expenses incurred by the forfeit Play shall not commence unless opposing teams have six (6) declared players in attendance at the scheduled starting time on each day. Any team having less than six declared players in attendance shall be deemed to have forfeited the match Absence of a team on any day of the match shall be deemed to be a forfeit by such team with allocation of points to be determined by the executive committee The toss will be conducted 10 minutes before the scheduled commencement of play. A team with fewer than 6 players in attendance OR no completed team sheet at that time will forfeit the toss A fine be levied against a team forfeiting without 24 hours notice. (1) First offence- $20 fine (2) Second offence- $50 fine and an appearance in front of the Executive Committee to explain why they should remain in competition. (3) Third offence automatic expulsion from competition. (4) Teams aggrieved by forfeits to receive maximum number of points scored in that round by any team in that same division up to 10 points, where a team is leading on the first innings after day one and the opposition forfeits on day two, the aggrieved team will automatically receive maximum outright points including bonus points being thirteen(13). 19
