PUBLIC HEARING (This agenda item includes development proposals presented to the Planning & Zoning Commission for discussion and recommendation to the Village Board for final action) Continued Applications A Telser Road Termax Expansion - Flex Construction (PZC #2): The matter was continued at the June 15, 2016 Public Hearing by the Planning & Zoning Commission. The Applicant has been continuing to work with Village Staff to complete the required submission documents. At this time the Applicant is requesting that the Public Hearing be further continued to the August 17, 2016 Planning & Zoning Commission Meeting/Public Hearing. Since Staff of the Community Development Department has not yet received the additional information, we are requesting that this matter be continued to the August 17, 2016 Planning & Zoning Commission Meeting/Public Hearing. 3 Unapproved VILLAGE OF LAKE ZURICH PLANNING & ZONING COMMISSION MINUTES JUNE 15, 2016 The meeting was called to order by Chairman Stratman at 7:01 p.m. ROLL CALL: Present Chairman Stratman, Commissioners Castillo, Dannegger, McCormack, Riley, Schultz, and Tomsovic. Excused: Commissioner Baumann. Also present: Assistant Village Administrator Roy Witherow, Building Services Supervisor Mary Meyer, Community Development Director Sarosh Saher, and Interim Village Planner Al Maiden. Chairman Stratman noted a quorum was present and said Commissioner Dannegger would be serving as a regular member this evening. CONSIDERATION OF MINUTES: APPROVAL OF THE MAY 18, 2016 MEETING MINUTES OF THE PLANNING & ZONING COMMISSION: Commissioner Castillo said he was incorrectly listed as voting when he had not been present at the meeting and asked the minutes to reflect this. MOTION was made by Commissioner Riley, seconded by Commissioner Tomsovic, to approve the May 18, 2016 minutes of the Planning and Zoning Commission as with the corrections requested by Commissioner Castillo. Upon roll call vote: AYES: 6 Chairman Stratman, Commissioners Dannegger, McCormack, Riley, Schultz, and Tomsovic. NAYS: 0 MOTION CARRIED Chairman Stratman said he would swear in anyone wishing to testify or ask any questions regarding any of the four Applications that are on the Agenda tonight. He swore in all those wishing to testify on any agenda item. A Telser Road - Flex Construction (PZC #2): Continuation from the April 20, 2016 and the May 18, 2016 Continued Public Hearing where the Planning & Zoning Commission approved a Motion to continue the Public Hearing to this June 15, 2016 date. Part of the subject property is in the I Industrial District and part of the property is currently in the R-1/2 Single-Family Residential Zoning District, and the Public Hearing is first to consider approval to rezone that portion of the property that is in the R-1/2 District to the I Industrial District and then to consider a Preliminary Plan and Final Plan of Subdivision, and to consider the Exterior Appearance Review at the Subject Property located at 120 and 200 Telser Road. Since this matter was continued from the May 18, 2016 Public Hearing by the Planning & Zoning Commission the Applicant has been continuing to work with Village Staff to try to complete their submission documents. At this time the Applicant is again requesting that the Public Hearing be continued to the July 20, 2016 Planning & Zoning Commission Meeting/Public Hearing and Village Staff supports this request. 5 Planning & Zoning Commission Meeting Minutes, June 15, MOTION CARRIED John Sfire, Deerpath Commons Retail center LLC, presented the petition for his tenant, the State of Illinois Department of Motor Vehicles (DMV) to operate a motor vehicle licensing and inspection office at 951 S. Rand Road in the Deerpath Commons Retail Center. They would occupy approximately 9,700 square feet. Mr. Sfire reviewed the issues raised by staff. He said there will not be any parking spaces behind the building, no CDL license testing, and the parking is adequate. He discussed the motorcycle license testing, which will require the loss of five parking spaces for a six-month period. He distributed a tentative site plan showing parking and the location for motorcycle testing, which will be cordoned off. Mr. Sfire anticipates small motorcycles or scooters will be used for the testing because the area is too small for full-sized motorcycles. He does not anticipate noise to be an issue. Discussion followed on what routes will be used for road tests for vehicles. Mr. Sfire said they will use main roads only and not residential streets. He had suggested using Route 12 to Cuba when he met with representatives of the DMV although no decisions had been made yet. He said the final approval of the route would be determined the police department. Jeremy Lindberg, 567 Chesterfield, Barrington, had concerns about the route going past the school and the safety of the school children. MOTION was made by Commissioner McCormack, seconded by Commissioner Tomsovic, to close the public hearing on Application PZC #3 at 7:29 p.m. Upon roll call vote: AYES: 7 Chairman Stratman, Commissioners Castillo, Dannegger, McCormack, Riley, Schultz, and Tomsovic. NAYS: 0 MOTION CARRIED Discussion followed on the route for road testing, possible conflict with school children, and safety concerns regarding inexperienced drivers. It was agreed upon that Police Department approval of the route would be a condition of approval. MOTION was made by Commissioner Tomsovic, seconded by Commissioner McCormack to receive into the public record the staff review of compliance of this Application with the zoning standards as presented by staff this evening, and to make these standards a part of the official record for the Application. Rand Road for the Illinois Department of Motor Vehicle Licensing and Testing Facility subject to the following condition: a safety review of the testing route be conducted by the police department after the DMV decides what route they will use. Rand Road - Wagly Pet Care Services (PZC #4): This is a continuation from the May 18, 2016 Public Hearing where the Planning & Zoning Commission approved a Motion to continue the Public Hearing to this June 15, 2016 date. The Public Hearing is to consider Request for a Special Use approval for this use in the existing B-3 Business District at the Subject Location. The Applicant is requesting that this matter be withdrawn, and the applicant may consider submitting a new Application regarding this matter in the future. Property owner John Sfire, Fidelity Group, said there must have been a misunderstanding between the Village Staff and Wagly Pet Services. Mr. Sfire understood that Wagly did want to pursue the business and asked that this item be continued and not withdrawn. MOTION was made by Commissioner Tomsovic, seconded by Commissioner Reilly, to continue the public hearing on Application PZC #4 for 832 S. 7 Planning & Zoning Commission Meeting Minutes, June 15, D. 300 E. Route 22 - U-Haul (PZC #5): This is a continuation from the May 18, 2016 Public Hearing where the Planning & Zoning Commission approved a Motion to continue the Public Hearing to this June 15, 2016 date. The Public Hearing is to consider the request for a Special Use Approval, Site Plan Approval and Exterior Appearance Approval for this use in the existing I Industrial District at the subject location. The request for the Special Use approval had previously been reviewed by the Planning & Zoning Commission in 2015 but a Site plan was not included in the submissions to the Planning & Zoning Commission at that time and the Village Board Tabled the consideration of the Planning & Zoning Commission s recommendation. The Applicants have now submitted additional documents including a Site Plan and other documents, and the Applicant is continuing to work with Village Staff to resolve pending issues that include some additional submissions, including a Landscape Plan and additional sign information. Since the Village Staff has not yet received these additional submittals, Village Staff is requesting that this matter be continued to the July 20, 2016 Planning & Zoning Commission Meeting/Public Hearing. MOTION was made by Commissioner McCormack, seconded by Commissioner Tomsovic, to continue the public hearing on Application PZC #5 for 300 E. Route 22, U-Haul, until the next regularly scheduled Planning and Zoning Commission meeting on July 20, 2016 at 7:00 p.m. Upon roll call vote: AYES: 7 Chairman Stratman, Commissioners Castillo, Dannegger, McCormack, Riley, Schultz, and Tomsovic. NAYS: 0 MOTION CARRIED Chirag Patel, 747 Hanley Court, Lake Zurich, asked if he could speak about the DMV agenda item. Chairman Stratman said the public hearing was closed and the PZC already made their recommendations. Mr. Patel objected to the small size of the zoning sign and thought residents should be notified by about zoning issues that might affect them. Mr. Patel was informed of the various methods the Village uses to inform residents and encouraged to sign up for Bench Mark weekly notifications. Director of Innovation Duebner gave Mr. Patel his business card and encouraged him to contact him so he could receive communications from the Village. He was also encouraged to write a letter to the Village Board or attend the Board meeting and make his comments. 9 COMMUNITY DEVELOPMENT DEPARTMENT Building and Zoning Division 505 Telser Road Lake Zurich, Illinois Phone (847) Fax (847) LakeZurich.org APPLICATION PZC #1 AGENDA ITEM 3.D STAFF REPORT To: From: CC: Date: July 12, 2016 Re: Chairperson Stratman and Members of the Planning & Zoning Commission Sarosh Saher, Community Development Director Katie Williams, Associate Planner Mary Meyer, Building Services Supervisor PZC #1 Zoning Application for H&L Auto Repair, 527 Telser Road Summary: Harry Mergenthaler (the Applicant ), of H&L Auto Repair, is the Applicant for the proposed automobile repair facility to be located at 527 Telser Road and legally described in Exhibit A attached hereto (the Subject Property ). The Applicant filed an application with the Village of Lake Zurich received May 27, 2016 (the Application ) seeking: A Special Use Permit to allow an automotive repair shop (SIC #753). The Subject Property is located within the Village s I Industrial Zoning District. Pursuant to public notice published on June 30, 2016, in the Lake Zurich Courier, a public hearing has been scheduled with the Lake Zurich Planning & Zoning Commission for July 20, 2016, to consider the Application. On June 21, 2016, the Village posted a public hearing sign on the Subject Property (Exhibit B). Preliminary Findings: H&L Auto Repair currently operates an automobile and repair facility at 225 Oakwood Road in the village, and has applied for zoning approval to authorize a similar facility on Telser Road in Lake Zurich. The applicant intends to terminate its operations at its current location and relocate such operations to 527 Telser Road. Auto Repair uses are typical within the industrial park and the Village has approved several Special Use Permits over the last decade to allow these uses. Staff has determined that at least seven (7) auto repair Special Use Permits have been issued over the last 11 years. As it relates to Automotive Repair Shops, there are three primary areas where these uses can potentially create nuisances to surrounding property owners: 1. Adjacency to residential areas: If overhead doors are left open, the noise associated with auto repair can be disruptive to surrounding residential uses 2. Outdoor storage of automobiles: If the user begins to store automobiles awaiting repair for long periods of time outdoors, it can become unsightly to surrounding property owners.

10 3. Parking on Village streets: If there is a large que of cars awaiting repair, the cars of employees, customers, and/or cars awaiting repairs could result in their being parked on the street for periods beyond 2 hours, which would violate the parking restrictions on Telser Road. The vehicles are subject to citations or towing during inclement winter weather conditions, or other actions deemed appropriate by the police department. Further, businesses are to provide adequate offstreet parking for their use. However, staff notes that the Subject Property is not adjacent to any residential areas, rather it is surrounded by industrial uses. Staff also recommends that the Applicant clarify how overnight car dropoffs will be coordinated. Please recall that a Special Use Permit was issued to Hawthorn Woods Auto Services, an automobile and truck repair business, in 2015 within the same building unit addressed at 511 Telser Road, but located behind H&L s proposed location. Staff is not aware of any issues that were caused by that particular use at this location that would negatively impact surrounding property. Staff has analyzed the Application relative to its conformance to the required Standards for Special Use Permits as outlined in Section of the Zoning Code. This analysis is contained within Exhibit C. Staff believes that all standards of approval have been met. In addition to the staff analysis, the Applicant has also provided responses to the standards of approval for consideration by the Planning & Zoning Commission. Detailed staff reviews from Building and Zoning, Public Works, and the Fire Department, are also attached. Recommendation: Staff recommends approval of the requested special use, subject to H&L Auto Repair adhering to the 5 parking spaces allotted to him by the building owner. To relieve any parking congestion that may arise in the future, staff encourages the building owner to consider reducing the size of the existing trash enclosures (see Exhibit D.4 Figure 8), or install parking designation signs, similar to ones already in use by R Professional Group, Inc., a tenant operating in the same building (see Exhibit D.6 Figure 11). The Planning & Zoning Commissions recommendation should be based on the standards included in Section Standards for Special Use Permits. Please refer to Exhibit C for Staff s responses to these zoning standards. The Zoning Code requires that a recommendation of approval should be made only after all of the required standards of approval have been met. Based on staff s review, all of the standards for approval for this special use have been met. Therefore, staff recommends that the Planning & Zoning Commission make a motion to the Board of Trustees to recommend approval of this Application, subject to the following condition: Condition of Special Use Permit Approval: 1. All activities associated with automotive repair in connection with the proposed Special Use will be conducted entirely within the enclosed tenant space at 527 Telser Road. 13 STAFF REPORT EXHIBIT C REVIEW OF COMPLIANCE WITH ZONING STANDARDS FOR 527 TELSER ROAD STANDARDS FOR SPECIAL USE PERMITS A. General Standards. No special use permit shall be recommended or granted pursuant to this Chapter unless the applicant shall establish that: 1. Code and Plan Purposes. The proposed use and development will be in harmony with the general and specific purposes for which this Code was enacted and for which the regulations of the district in question were established and with the general purpose and intent of the official Comprehensive Plan. Staff Response: Standard met. One of the purposes of the Zoning Code is to encourage the compatibility between different land uses. As there are existing auto repair uses within the I District, including one within the same building, the proposed use is not only compatible with its neighbors, but consistent with similar uses within the I district. 2. No Undue Adverse Impact. The proposed use and development will not have a substantial or undue adverse effect upon adjacent property, the character of the area, or the public health, safety, and general welfare. Staff Response: Standard met. The proposed use will not create a substantial or undue adverse effect upon adjacent property. Given the existing auto repair uses within the industrial park, the proposed use will be consistent with the character of the area. 3. No Interference with Surrounding Development. The proposed use and development will be constructed, arranged, and operated so as not to dominate the immediate vicinity or to interfere with the use and development of neighboring property in accordance with the applicable district regulations. Staff Response: Standard met. The proposed auto repair use is consistent and compatible with the uses in the immediate vicinity and within the I district and industrial park. Compliance with parking regulations will ensure that the operation of the use will not interfere with adjacent uses. The Applicant will occupy an existing building and is proposing no exterior changes to that building, which building does not currently dominate the immediate vicinity. 4. Adequate Public Facilities. The proposed use and development will be served adequately by essential public facilities and services such as streets, public utilities, drainage structures, police and fire protection, refuse disposal, parks, libraries, and schools, or the applicant will provide adequately for such services. Staff Response: Standard met. The Subject Property is served by Telser Road, which can accommodate the expected increase in vehicular traffic caused by this use. Drainage, police and fire protection, and refuse disposal are adequately Page 5

14 provided at this location. Parks, libraries, and schools should not be impacted by the proposed Special Use Permit. 5. No Traffic Congestion. The proposed use and development will not cause undue traffic congestion nor draw significant amounts of traffic through the surrounding streets. Staff Response: Standard met. The existing street network surrounding the Subject Property is capable of handling the expected increase in traffic and the use will therefore not cause undue traffic congestion or draw significant amounts of traffic through the surrounding streets. 6. No Destruction of Significant Features. The proposed use and development will not result in the destruction, loss, or damage of any natural, scenic, or historic feature of significant importance. Staff Response: Standard met. There will be no change to existing natural, scenic, or historic features on the Subject Property from the proposed use. The use will occupy an existing building with no proposed site changes. 7. Compliance with Standards. The proposed use and development complies with all additional standards imposed on it by the particular provision of this Code authorizing such use. Staff Response: Standard met. Staff has not identified any additional standards for auto repair uses that are imposed by the Code. 8. Positive Effect. The proposed special use creating a positive effect for the zoning district, its purpose, and adjacent properties shall be placed before the benefits of the petitioner. Staff Response: Standard met. The proposed use is compatible with the surrounding properties and industrial uses within the I district. B. Special Standards for Specified Special Uses. When the district regulations authorizing any special use in a particular district impose special standards to be met by such use in such district, a permit for such use in such district shall not be recommended or granted unless the applicant shall establish compliance with such special standards. Staff Response: Standard met. Staff has not identified any additional special standards required for the proposed Special Uses. C. Considerations. In determining whether the applicant's evidence establishes that the foregoing standards have been met, the Plan Commission and the Board of Trustees shall consider: 1. Benefit. Whether and to what extent the proposed use and development at the particular location requested is necessary or desirable to provide a service or a facility that is in the interest of the public convenience or that will contribute to the general welfare of the neighborhood or community. 15 Staff Response: Standard met. Auto repair services are a necessary service within the suburban Lake Zurich community. 2. Alternative Locations. Whether the purposes of the zoning code can be met by the location of the proposed use and development in some other area or zoning district that may be more appropriate than the proposed site. Staff Response: Standard met. The proposed use is appropriate within the I District and the proposed location is suitable for the proposed use. No evidence has been submitted that justifies an alternative location as more appropriate than the proposed location. 3. Mitigation of Adverse Impacts. Whether all steps possible have been taken to minimize any substantial or undue adverse effects of the proposed use and development on the immediate vicinity through building design, site design, landscaping, and screening. Staff Response: Standard met. The applicant will utilize off-site parking on the Subject Property, and reduce trash enclosures or add unit parking identification signs if necessary.
