Announcements 3. New Business - Main Motions 2010 EC 1 PASSED Guidelines for reviewing nomination forms: 1. In order for a nomination form to be confirmed, at least 50 percent of a candidate s required nominations must be valid. Valid shall be defined as having all spaces on a given row filled in. 2. Each nomination form shall be reviewed by at least 2 Elections Commissioners. If the validity of a nomination form is questioned it shall be reviewed by the entire Elections Commission and shall be voted on. 3. If a nomination form shall be is suspected to be forged, for example if multiple nominations appear to have the same hand writing, the Elections Commission reserves the right to investigate the nominations further to confirm or deny their validity. 4. The Elections Commission shall strive to act inclusively to verify the candidacy of all nomination forms possible. If possible, the Elections Commission shall try to contact any candidate that has turned in nomination forms, but can not be confirmed retrieve the information required to get them confirmed EC 2 PASSED Guidelines and clarifications for candidate conduct for SGA elections: 1. No SGA resources (anything that is the property of the SGA or a subsidiary governing body) including but not limited to office space, mailing lists, websites, computers, copiers and printers, may be used for the purpose of campaigning for the election of one candidate over another. 2. Funds may not be transferred between individuals, but as in past elections, candidates campaigning for separate offices or seats within a given district, may choose to become running mates and co-sponsor campaign materials as long as it is equally sponsored EC 3 PASSED The Elections Commission shall allow all students to cast one vote for each open position within their district EC 4 FAILED Motion to confirm the nomination of Brad DeFlumeri Justification: The nomination of Brad DeFlumeri was called into question because most of the nomination signatures had strikingly similar handwriting. As previously discussed in the meeting

2 as 2010 EC 1, section 3, the Elections Commission suspected the nomination to be forged. Using the most accurate method available at the moment, Peoplefinder, the Elections Commission looked up the names from the nomination form to confirm that they were infact UMass students. The Elections Commission determined that since so many of the nomination signatures could not be validated, the nomination form would have to be denied EC 5 FAILED Motion to confirm the nomination of Sarah Schultz Justification: The nomination of Sarah Schultz was called into question because none of her nomination signatures were completely filled in and the Elections Commission had attempted to contact 7 people listed on her nomination form. Of these 7, 5 did not answer, 1 was a wrong number and 1 confirmed that she did nominate Sarah. As previously discussed in the meeting as 2010 EC 1, section 1, the Elections Commission was unable to validate at least 50 percent of Sarah Schultz nomination signatures, so we had to deny her nomination form EC 6 FAILED Motion to confirm the nomination of Jon Menzin Justification: The nomination of Jon Menzin was called into question because only 2 of his nomination signatures were completely filled in and the Elections Commission had attempted to access contact information for all persons on his nomination form that did not have a phone number listed through peoplefinder. The Elections Commission was only able to find and 2 phone numbers not listed on the form. Since these 2 additional phone numbers would not give Mr. Menzin at least 50% of his required signatures, his nomination was denied EC 7 FAILED Motion to confirm the nomination of Andrew Dawson Justification: The nomination of Andrew Dawson was called into question because only 10 of his nomination signatures could be validated. The Elections Commission attempted to look up phone numbers of individuals, using Peoplefinder, that had not completed their nomination signature. The Elections Commission attempted to contact those students that were listed in Peoplefinder, but were unable to verify the validity of enough nomination signatures for the nomination to be confirmed. Announcements 3. New Business - Main Motions 2010 EC 13 NO ACTION Formal complaint submitted by Derek Khanna, Commuter Senate Candidate, against Brad DeFlumeri, Sylvan Senate Candidate. Khanna submitted s sent by DeFlumeri for the purpose of campaigning. The campaign material was not registered with the Chancellor of Elections, and as such was against the Candidate Code of Conduct. The complaint was heard prior to initiating the counting of the ballots on September 29, Two key pieces of information in the were incorrect, the date of the elections and the number of senate seats in the Sylvan area in addition to the campaign material not having been registered prior to release. The s stated that the elections would be held October 28 & 29 and that there would be 3 elected Senate positions in Sylvan. DeFlumeri claimed that the incorrect information was done in error and was not meant to confuse voters. Having finished the election, the Elections Commission would only have been able to Invalidate DeFlumeri's candidacy or Nullify the elections. The Elections Commission felt that although the complaints were valid, they were not severe enough to Invalidate DeFlumeri or Nullify the elections. The Elections Commission voted that no action would be taken against DeFlumeri. See attached documents concerning complaint.

6 Elections Commission October 13, 2009, 7pm SGA Office (420 Student Union) I. Call to Order II. Attendance: Christopher Faulkner, Jeidy Fernandez, Charles Flowers III, Maria Robles, Sarah Eldredge, Amanda Willis, Mark Borenstein, Jitesh Khushalani, Candace Johnson III. New Business - Main Motions 2010 EC 14 Motion to consider the following allegation brought against Referendum 2 of the Fall 2009 General Election. Allegation #1: Title VIII, Chapter 12, Section 3 was violated by the Elections Commission by approving of a petition for referendum, where the candidate, defined therein is no longer a student of the University of Massachusetts Amherst. Notes: Sean McNair is the the first name on the petition. He gave Derek Khanna the signatures, which were then used to submit the referendum. Sean McNair has stated that he did not want the referendum to be accompanied by by-law changes other than the McNair Amendments presented to the Senate in the Spring of Title VIII, Chapter 12, Section 3 For the purpose of Title VIII of the By-laws of the SGA, the first name listed on a petition for a referendum shall be defined as candidate EC 15 Motion to consider the following allegation brought against Referendum 2 of the Fall 2009 General Election. Allegation #2: The wording of the referendum is inconsistent with the wording of the petition. Notes: Derek Khanna submitted a referendum wording different than that appearing on the top of the petition collected in the Spring of Question 2 as it appeared on the ballot: Do you support changing the antiquated Election bylaws to allow for modern technology to enfranchise a broader campus population and have direct accountability by allowing for direct districts with an online voting system as explained in the addendum documents and as endorsed by the SGA in the Spring of 2009? Petition wording collected in Spring of 2009: We, the undersigned Student Government Association members demand that the Legislative and Executive branches of the Student Government Association amend Title VIII of the Bylaws of the SGA to provide for online elections which are accessible remotely through a secure platform developed by the Office of Information Technologies.

7 Furthermore, we demand that the current electoral districts be revised to provide for more direct and accountable representation through the assignment of specific constituent territory to each individual Senator. Finally, we require the leaders of the Student Government Association to cooperate with the Office of Student Affairs in fulfilling our demands before the end of the Senate Regular Period, ensuring that these revisions are in place for the next General Election. The petition included the Signature, Printed name and student address as a means to verify each petition signature. Allegation #1 Reasoning: 7 harmless error, 1 absentia The Elections Commission voted that this allegation against Referendum 2 of the Fall 2009 General Election is harmless error for several reasons. First, there was no evidence of Sean McNair's objection to using the petition where he is technically the candidate, nor was there any objection during the prescribed period of time for a candidate to remove his or her name from the ballot. Additionally, Derek Khanna received this petition from Sean McNair for the purpose of submitting it to the Elections Commission, providing consent for its use in this manner. Finally, the mere existence of this amount of signatures of the student body requesting online voting and direct districting was considered to be powerful enough to allow for its use by Derek Khanna even though was not the candidate as defined by the by-laws. Allegation #2 Reasoning: 6 harmless error, 2 absentia While the wording of the petition collected in Spring 2009 was inconsistent with the wording submitted to be placed on the ballot, the Elections Commission believe that there was no error because there were no by-laws requiring the two to be the same and the 2 points presented in both were the same Online Voting and Direct Districting. Suggestions: The Elections Commission suggests that the Senate enact by-law changes to provide procedures by which the Elections Commission should review referendum.
