Hughes Building, 1801 NW 80th Blvd, Gainesville, FL. Members of the Board and staff were present as noted. 2 The Appeals meeting was called to order by President-elect LaRosa, followed by the Pledge of Allegiance to the Flag. ROLL CALL WELCOME AND ANNOUNCEMENTS Executive Director Dearing called the roll and a quorum was present. (President Marsala and Dr. Lori White arrived later. Members Otero, Samuels and Sennett were absent.) President-elect LaRosa welcomed all in attendance and member school personnel were recognized. ADOPTION OF Motion by Mr. Dyal Seconded by Mr. Lamb AGENDA Moved to adopt the agenda as presented. The question was called. Upon Vote: Motion carried 11-0 OVERVIEW OF THE APPELLATE PROCESS ADJOURNMENT The Student-Athlete Case had been withdrawn by Brandon High School. There being no appeals to be considered by the Board, the meeting was adjourned at 3:06 p.m. with a motion by Ms. Moultrie and a second by Mr. Lamb. Upon Vote: Motion carried 13-0 APPROVAL OF Motion by Mr. Prendergast Seconded by Mr. LaRosa MINUTES Motion to approve minutes of the Board of Directors Meetings of November 15-16, 2015, and minutes of the Emergency Hearing January 20, The question was called. Upon Vote: Motion carried 13-0 SPECIAL RECOG- NITION/AWARDS NFHS Section 3 Distinguished Active Officials Award REPORT OF FINANCE COMMITTEE FHSAA Budget Amendment #2 Mr. Robert K. deviere, vice-president of Volleyball Officials Association, was presented the National Federation of State High School Associations (NFHS) Distinguished Active Officials Award from Section Three (which includes the states of Alabama, Georgia, Florida, Louisiana, Mississippi, North Carolina, South Carolina and Tennessee), along with a Certificate of Achievement. Finance Committee Chair Lamb noted the committee met Sunday, January 31, 2016, and reviewed the following action items presented by staff. FHSAA Budget Amendment #2 shows changes in budget needs by function and has neutral impact on overall fund balance. Motion by Mr. Lamb Seconded by Mr. Ochoa Moved to approve FHSAA Budget Amendment #2 as presented. The question was called. Upon Vote: Motion carried 13-0 FHSAA, Inc., Motion by Mr. Lamb Seconded by Ms. Moultrie Financial Statements Moved to approve FHSAA Financial Statements as of December 31, 2015, as presented. 5 The question was called. Upon Vote: Motion carried 13-0 The general business meeting was recessed and the meeting of the FHSAA Land Corporation, Inc. was convened. FHSAA Land Corporation, Inc., Capital Fund Balance Amendment #3 The Land Corporation Capital Fund Balance Amendment #3 shows changes in budget needs by function and has neutral impact on overall fund balance. Motion by Mr. Lamb Seconded by Mr. Prendergast Moved to approve FHSAA Land Corporation, Inc., Capital Fund Balance Amendment #3 as presented. The question was called. Upon Vote: Motion Carried 13-0 FHSAA Land Motion by Mr. Lamb Seconded by Mr. Chiles Corporation, Inc., Financial Statements Moved to approve FHSAA Land Corporation, Inc., Financial Statements as of December 31, 2015, as presented. The question was called. Upon Vote: Motion Carried 13-0 The meeting of the FHSAA Land Corporation, Inc., was adjourned and the general business meeting was reconvened. REPORT OF GOVERNANCE COMMITTEE Church of God Assoc. of Christian Schools (CGACS) Governance Committee Chair Morris noted the committee met Sunday, January 31, 2016, and reviewed the following item(s) presented by staff. The CGACS requested to become an FHSAA approved accrediting agency for CGACS schools to be eligible for membership in FHSAA. Motion by Ms. Morris Seconded by Mr. Ochoa Moved to approve CGACS as an FHSAA approved accrediting agency. The question was called: Upon Vote: Motion carried 13-0 The Governance Committee discussed and suggested March 14, 3:00 p.m., for a workshop via webinar to review proposed policy changes for possible adoption in April. An update on sectional appeals was also presented. Page 5 of 8

6 REPORT OF OPERATIONS COMMITTEE PROPOSED POLICY CHANGES SCHEDULE WORKSHOP PRESENTATION REPORT OF LEGAL COUNSEL Operations Committee Chair Chiles noted the committee met Sunday, January 30, 2016, and there were no action items. Discussion was held on the following presented by staff: Date to schedule a workshop via webinar to review proposed policy changes for possible adoption in April was suggested for March 23, 3 p.m. Legislative session ends on March 8 and Governor has up to10 days to sign into law. Student Parental Consent and Physical Forms member schools using an online program for the EL2 and EL3 forms. Officials status and FHSAA s plan working with evaluations and needs of officials and the member schools. Board Members noted dates they would be available for a workshop on proposed policy changes via webinar at 3 p.m. as follows: March 13 (9); March 20 (10); March 21 (11); and March 23 (9). More members are available for the workshop on March 21 at 3 p.m. Three members were absent and will be polled as to their availability. The Board will be notified of the date to be scheduled. There were no presentations. Counselor Leonard Ireland noted (1) depositions the end of this week in Marathon on the Bruland & Bonilla Case, hoping to get a Motion for Summary Judgement filed; and (2) the Executive Director, on January 26, received a letter from Liberty Institute representing the Cambridge Christian School over FHSAA not allowing the school to hold prayer over the PA system at the state championship 2A games. He feels FHSAA acted appropriately. Once his research of the voluminous references in the letter is complete, he will give his opinion to the Executive Director. The Executive Director noted FHSAA did not refuse to allow the schools to pray before the game, after the game, on the field, in the locker room or wherever, just not over the PA system during the state championship games. Each school held prayer on the field. REPORT OF EXECUTIVE DIRECTOR Executive Director Dearing noted the following: (1) Members were asked to sign up for upcoming state series events; (2) No objections to the waiver request by Montverde to go out of state to participate in a basketball tournament for 3 days in February were received -- will be placed on the agenda in April for formal approval; (3) The Board was informed of new personnel changes Eligibility & Compliance (E&C) Natalie Strappy (Dir. of Compliance) left in August; Jordanne Stark (Exec. Assist.) has been appointed as Assist. Dir. for Compliance; Carlene Flitcraft (Exec. Assist., Admin. Serv.) was appointed the Executive Assistant in E&C. Page 6 of 8

7 Administrative Services Seth Polansky (Membership Specialist) left in January; J.A. Colasanti (Contract Specialist) was moved to Membership Specialist; Will Adams (Assist. Dir., Athletic Services) moved to Contract Specialist, and former intern, Danielle Hogal was appointed as the Executive Assistant; Corey Sobers (Media Specialist) was appointed Assist. Dir., Athletic Services, leaving a vacancy in Administrative Services to be filled in March. (4) Legislative update House Bill All public school students, including those enrolled in public schools of choice, virtual school, home school or affiliated private school, may participate in extra-curricular activity not offered in their home education program and may attend any public school in the district they preside or a public school in another district pursuant to the inter-district open enrollment policy. Notice for request for participation has to come before the first day of that sport--does not mean the school has to put them on the team, but they are eligible if they make the team. There is language that states FHSAA shall allow any school the option of joining the Association as a full-time member or on a per sport basis. There is language on recruiting -- $5,000 fine for first offense, $7,500 for second offense, $10,000 fine for third offense, suspension without pay for 12 months if an employee of school district, could be a violation and have certificate suspended. Appeals--has to be done by 3 rd party within 30 days and held in county where student lives; all expenses paid by association, and student is eligible to participate until decision is made. Senate Bill Eligibility does not allow student to participate at a school they don t attend, but the student can transfer anytime to a school if there is room and become immediately eligible, if qualified otherwise, which takes away home rule no say-so on the transfers. Allows small private schools that are not members to participate at the public school zoned if private school does not offer that particular sport as an interscholastic sport. Allows private schools only the right to join FHSAA by sport or public charter schools may be permitted. Where House bill has fines for recruiting, Senate Bill states, if employee of district, salary is reduced $5,000 or $7,500 and if they have a teaching certificate or non-instructional certificate, it may be suspended for one game first offense, one year on second offense, etc. The Senate Bill is much more palatable for FHSAA. Both bills cause major problems for school districts, boards and superintendents. Page 7 of 8

8 REPORT OF PRESIDENT President Marsala noted he attended swimming and diving championship events, very outstanding, well run and in speaking with the county manager, they are very supportive and would like to keep this event at this venue. Thanked Dr. Dearing for all his efforts during these stressful times with the legislature. BOARD OF DIRECTORS COMMENTS Legislature Concern was expressed with legislature broadening the definition of school choice to include athletics and school attendance--more loss of district and local control; totally support the athletic role in educating our students, concerned when it takes the lead position in decisions that are critical to the future of our students; need to educate our legislators to hopefully spend more time on support of education for all students and not just how to fulfill parents dreams; maintain education as first line of defense; keep focusing on the students; remain positive and try to lead kids in the right direction; in education, it is not about winning, but life lessons we learn; regardless of what legislature passes, it is incumbent upon us as AD s, principals and superintendents to hire and maintain a staff that does not put winning ahead of the moral lessons taught to our children through sports; let our voices be known call our local legislative delegations. State Series Football finals and championships -- was very impressed, well run, treated extremely well; spoke with staff about the point system and possibility of this coming up for discussion later; organization and administration of the games was very professional and top notch; honor and privilege to help hand out the trophies; amazed at all the work that goes into the championships and more amazing is the quality of people working with the student athletes. Swimming championships -- excellent experience. Board and Staff Appreciation was expressed to the Executive Director on his leadership of FHSAA and all he does for all student athletes; thanked all staff for their support, their professionalism; thankful for the opportunity to work with such great people and to serve on this Board.
