At the present time, NSF cannot identify the grower(s) of the allegedly tainted product except upon information and belief. This issue is still being investigated. These Initial Disclosures will be amended to name the grower once the identity of such grower is established. NSF reserves the right to call as witnesses any persons identified in the documents produced by others in this action or identified in plaintiffs or other party s initial disclosures. in this matter: B. DOCUMENTS NSF may use the following categories of documents in support of its defenses and claims 1. Information about NSF s business operations, including policies, procedures and plans regarding the quality of products; 2. Information about NSF s quality control, inspection and audit procedures; 3. Information about regulatory, trade and industry standards NSF utilized in connection with its business operations; 4. Information as to products processed, distributed or packaged in 2005 and 2006; 5. Information produced by any state and/or federal governmental agency related to fresh spinach and the recent E. coli outbreak; and -9-

These documents are in the possession, custody and/or control of plaintiffs, defendants or various municipal, state and/or federal governmental agencies. DAMAGES Computation of any category of damages claimed by the disclosing party, making available under Rule 34 documents not privileged from disclosure on which computation is based: Not applicable to NSF. INSURANCE Inspection and copying of any insurance agreement under which any person carrying on an insurance business may be liable to satisfy, indemnify or reimburse, part or all of any potential judgment: A policy of insurance that may provide coverage to the defendants for the incident complained of will be provided.
