3 PREAMBLE Upper Midwest Local 1-M Union is part of the Graphic Communications Conference International Brotherhood of Teamsters Union (GCC/IBT) and is dedicated to the formation and sovereignty of one union through amalgamation, merger, and organizing in the graphic communication industry. It is the intention of this Union to expand the existing divisions, crafts and branches and to provide new job opportunities through technology, growth and organization within our industry and beyond. ================================================================================ ARTICLE I Name and Objective 1.1 Name. The name of this local union is Upper Midwest Local 1-M of the Graphic Communications Conference International Brotherhood of Teamsters (GCC/IBT). Note: References in this agreement to the masculine and feminine genders are used interchangeably and apply equally to both genders. 1.2 Objects. The objects of Upper Midwest Local 1-M shall include, without limitation, the following: To bring within its membership and to unite within its ranks all workers in the graphic communications who are engaged in its jurisdiction; to advance and extend the economic and other welfare interests of its members, including their job security and job opportunities, by the establishment and implementation of laws and policies designed to accomplish such results and by continued improvements in the terms of collective bargaining agreements and their enforcement in respect to wages, hours, and other terms and conditions of employment. To establish and regulate sound systems of apprenticeship so that high standards of workmanship may be maintained; to act as an agency for the distribution of job opportunities and to establish and support programs to provide full employment for its members. To establish training and educational programs for its members in respect to new, advanced techniques and processes so that they may adapt to changing technologies and maintain and improve their job proficiency. To maintain a registered union label to be issued to employers upon conditions established by the International in order to distinguish the product of the labor of its members and the conformance of employers to established standards. To establish, continue, and improve plans, programs, and special funds covering and relating to the health and welfare, pension and mortuary needs of its members and in cases of unemployment, whether due to strikes, lockouts, or otherwise. To protect, promote and advance the welfare and interests of the Union by such other actions, not inconsistent with the Constitution of the Graphic Communications Conference International Brotherhood of Teamsters or these laws, as may be necessary and appropriate. ARTICLE II Jurisdiction and Powers 2.1 Jurisdiction. Upper Midwest Local 1-M shall have full jurisdiction over all workers in the processes and industries covered by it within limits laid down in the International Charter. 2.2 Powers. The Local shall be self-governing in respect to its local affairs, subject only to these Bylaws and the Constitution and Laws of the International. It shall possess full power to issue membership cards and other credentials, to tax members for its maintenance and operations, including the maintenance and operations of special benefit funds and plans, and to take any and all other actions as it may deem to be necessary or appropriate to accomplish its objectives. It shall be the exclusive representative of each member for purposes of collective bargaining and the execution of collective bargaining agreements and as such representative is irrevocably authorized by each member to initiate, handle, settle, or dismiss any and all grievances, complaints and disputes relating to their employment. 1
4 ARTICLE III Membership 3.1 Spirit. The Union and the membership are synonymous. The Union was created by, for and of the members. This creation grew out of a desire to raise the cultural, economic and civic level of all members. The Union, therefore, must be responsive to the welfare, rights, dignity and integrity of the individual member. In return the members must be responsive to their obligation of membership in order to obtain these objectives. 3.2 Eligibility. Any worker within the jurisdiction of the Local who satisfies the requirements in the Constitution and Laws of the International is eligible to become a member. Any person who is expelled from the International or any Local thereof shall not be eligible for membership without the consent of the Local Executive Board. Status shall be determined by the Executive Board by applying Apprenticeship Standards, Bylaws, Constitution and/or other standards. 3.3 Application. Application shall be on the forms prescribed by the Local and the International Union and submitted together with an initiation fee as may be determined by the Local Executive Board and/or the International Union. Initiation fees shall be as follows: 1. For candidates qualifying as Journey or like status members (Permits), the sums of two (2) days pay (straight time). 2. For candidates qualifying as apprentices, the sum of one and onehalf (1-1/2) days pay (straight time) and another one-half (1/2) days pay when attaining Journey status. 3. For all other candidates, one (1) days pay. When they are upgraded, one additional day pay, half of which at time of upgrading and the second half upon attaining Journey status. 4. Each candidate will also remit $8 to participate in the GCC/IBT International Benevolent Trust Fund. 5. Members of other GCC/IBT International locals will pay a fee of $25 when transferring into Local 1-M. 6. New candidates making application from newly organized shops: a) The Executive Board shall have the power to waive the initiation fee, in whole or in part as it shall determine, in cases in which it shall be in the interest of organizing establishments not under contract with the Local. b) To establish initiation fees applicable to admission to membership by former members expelled from membership for any offense specified in these Bylaws or the Constitution and Laws of the International. Fees applicable to the Local under this Section shall be deposited in the General Fund of the Local. All applicants for membership shall be required to attend orientation sessions, when notified, to acquaint each applicant with the function, laws, and benefits of the Local and International Union. This is a mandatory condition of membership for all in-town applicants. 3.4 Obligation. As a condition of membership, each applicant shall raise their right hand and subscribe to the following obligation: The Oath: I (name) solemnly promise to faithfully discharge the duties and obligations of membership in the Graphic Communications Conference International Brotherhood of Teamsters, and to Upper Midwest Local 1-M to which I am admitted as a member. I will observe and defend the Constitution, Laws, and Bylaws. I will take an affirmative part in the business and activities of my union and accept and discharge my responsibilities during any sanctioned strike or recognized lockout. By my conduct, I will maintain the dignity of my union, support the fundamental principle of union democracy, and work for the improvements of the economic status and welfare of my brother/sister members. 2
5 I will not knowingly engage in any conduct to undermine the wage and work standards established by contract or other requirements of the union. I will exhaust all forms and avenues of appeal, as provided for by the International Constitution and Laws affecting the Local or the International Union before seeking redress from any outside agency. I further promise that I will not wrong a brother or sister member to see them wronged if in my power to prevent. To all of which I pledge my most sacred honor. 3.5 Requirements. (a) Benevolent Trust Fund- All Local 1-M members shall be required to participate in the Benevolent Trust Fund. (b) Inter-Local Pension Fund All members working in shops where the Inter-Local Pension Fund has been established shall participate in the Inter- Local Pension Fund. Newly organized shops or nonparticipating shops shall have the opportunity to participate by a majority vote in the shop. Once participation is instituted, it will become compulsory. The requirements of subsection (b) shall not apply to helpers. Although helpers may participate is instituted the continuance thereof is compulsory. (c) Local 20C Mortuary Benefit Fund- for all former members of Local 20C. 1. The Local Mortuary Benefit Fund was established by the payment of an initial member s fee of $1.25 by all regular and new members in good standing. All members coming in on traveling and withdrawal cards after one year s membership must pay said membership fee of $1.25 and shall thereafter be entitled to the Mortuary Benefit. Pensioned members shall be exempt from the Mortuary Benefit Fee upon death of a member. 2. Upon death of a member who is eligible for Mortuary Benefit, the union shall at once pay to his or her beneficiary the sum of $ Within thirty days after notification of the death of a member in good standing, each member of the union who has been a member one or more years and who has paid the initial membership fee of $1.25 shall be required to pay the sum of $1.25 upon the death of any one member. This amount is payable before the dues, and if a member fails to pay the Mortuary Fee of $1.25 per death within thirty days after such notification, he or she shall be required to pay a fine of $1.25 plus Mortuary fee of $1.25 to again become eligible for Mortuary Benefit. 4. Every member shall be required to fill out a form furnished by the union, stating the name of the beneficiary eligible for the Mortuary Benefit; also change of beneficiary. 5. In the event there is no named beneficiary living, the union shall take charge of the funeral so that the deceased member may have a proper burial. 6. The death benefit fund shall not be abolished as long as seven members in good standing vote to retain it. 7. The President shall appoint a committee of three members in good standing to serve for one year and to be known as the Mortuary Fund Committee. They shall elect their own officers, except that the Recording Secretary-Treasurer of the Local Union shall be Secretary-Treasurer of this fund. The President is to act as a member of this committee only in an advisory capacity. The committee shall have full charge of this fund and deposit all money in the name of the former Minneapolis Graphic Communications International Union No. 20C Mortuary Benefit Fund. All checks must be signed by the Chairman and the Secretary-Treasurer. The Secretary-Treasurer shall be bonded and the funds of the Mortuary Benefit Fund shall be regularly audited every six-month s period. 8. At the next regular meeting of the Union following the death of a member, it shall be the duty of the presiding officer to officially announce the death of the member, after reading and adoption of the minutes of the previous meeting, and the members shall rise and stand in silence for a period of one minute, following which the President will order the Charter of the Union draped for thirty days. 3
6 9. All expenses incurred by the Union in carrying out the duties of a funeral shall be borne by the Mortuary Benefit Fund, including audit of said fund. 10. In the event of a member serving with the Armed Forces of the United States of America, he shall only become eligible for Mortuary Benefits upon having completed one year of membership in good standing immediately prior to date of entrance on active duty. 11. The fund will be maintained at $3,600 with any excess to be transferred to the General Fund. 3.6 Good Standing. A member in good standing shall be defined as one whose financial obligations of dues and/or assessments to the Local are current. Conversely, a member in bad standing shall be defined as one whose arrears in dues and/or assessments exceed one (1) month. Assessments as used herein shall not include non-attendance assessments or fines, which shall automatically place a member in bad standing if such non-attendance assessments or fines are not paid within sixty (60) days from date of billing. Members in bad standing shall not be entitled to any right, privilege, or other benefit of membership or be covered by any plan relating thereto for one (1) month after paying their financial obligation to the Local. 3.7 Expulsion. (a) A member shall be expelled without recourse to trial procedure for nonpayment of dues, assessments, pension contributions and/or other charges in accordance with the International Constitution and Laws. Notice shall be give to said member in writing. In such cases, a member shall be granted the right to hearing limited to the question of financial delinquency. (b) Members may be expelled for reasons other than financial obligations as provided in these Bylaws. 3.8 Withdrawal-Resignation. A member wishing to terminate their membership may withdraw or resign providing they meet the qualifications and circumstances as defined in the International Constitution. 3.9 Status Classification. (a) The classifications of membership shall be Journey, Apprentices, and Assistants in all branches of the Graphic Communications Conference under the jurisdiction of the Local. (b) Non-apprenticeable classifications shall be referred to as Helper or General Worker. (c) The Local Executive Board shall be empowered to establish classifications as they may deem appropriate. ARTICLE IV Membership Meetings 4.1 Regular. The Local shall meet once each month at a time and date as determined by annual resolution, provided the third meeting of each quarter shall be held in the morning and in the evening. 4.2 Special. (a) Special meeting of this Local may be called (for any purpose) by the President, or at the request of the Executive Board, or upon request of a majority of members present at a regular meeting, or by petition of no less than 15% of the total membership, those petitioners being in good standing, stating the reason for such request in writing to the President. No other business but that for which the special meeting has been called shall be transacted. (b) Special meetings shall be called for authorization of bargaining proposals, for consideration of all proposals from employers and ratification of contract and wage agreement terms. All said action shall be by secret ballot. Only members directly affected by said proposals need be notified. 4.3 Notice. The Recording Secretary-Treasurer shall give due notice to every affected member of the Local at least 48 hours before a special meeting is to be held Required Attendance. Except as otherwise provided, all members employed and /or residing in the Twin City area shall be required to attend at least one regular meeting each quarter, and any special meeting called. 4.5 Penalty. Any member failing to meet the requirements of Section 4.4 shall be assessed $5 for each quarter in which a regular meeting is not attended; and $15 for any special meeting which is not attended. 4
7 4.6 Exceptions. The Executive Board may, for good cause, exonerate any member from the assessment described in Section 4.5 provided said member applies in writing no later than sixty (60) days from the date of the meeting for which said member is assessed. The Board may also exonerate members who apply in writing for the following reasons: 1. Health 2. Those holding the position of non-working foremen, superintendents, etc. and 3. Salesmen and the like who are not employed at the trade. 4.7 Exemptions. Any member over 65 years of age who shall apply in writing to the Executive board of the Local for exemption for the non-attendance assessments shall be exempted. Exempt members as defined in the International Constitution and Laws (60 years of age, 20 consecutive years of membership and retired from the industry) shall be exempt from such provisions upon the effective date of said member s exemption. 4.8 Quorum. A quorum for the purpose of transacting any business at a regular or special meeting shall consist of not less than twenty-five (25) members present in person. 4.9 Questions. Unless otherwise provided in these Bylaws or in the Constitution and Laws of the International, all decisions at any membership meeting shall be decided by a majority of the members present and voting Rules. In the absence of any standing rule to apply to questions before the Local, recourse shall be had to Roberts Rules of Order Admittance. No person shall be admitted to the room who is not a member of the Union except by permission of the Union. ARTICLE V Elective Officers and Duties 5.1 Officers. The elective officers of the Local shall be the President, Recording Secretary- Treasurer, and members of the Executive Board. The Sentinel, Inspector, and the Sergeant at Arms shall be determined by appointment. 5.2 Full Time Officers. The President shall devote his/her entire time to the Local and shall not be gainfully employed in any other occupation. 5.3 Executive Board. The Local Executive Board shall consist of the President, Recording Secretary- Treasurer, and six (6) members elected by the general membership; one (1 ) newspaper press, one (1) member at large, two (2) preparatory, and two (2) press. 5.4 Elective Offices. For the terms beginning January 2008 and all future terms, nominations and elections shall be the following: President Recording Secretary-Treasurer Executive Board: One (1) Member at Large One (1) Newspaper Pressman Two (2) Preparatory Two (2) Press 5.5 Duties of the President. The President shall be the Chief Executive Officer of the Local. The President shall attend and preside over all meetings of the Local, and shall have the deciding vote whenever there is an equal division on any question. The President shall execute and enforce the Constitution and Laws of the International and the Bylaws and policy of the Local. He shall supervise and have the authority to hire such staff as is required to operate the office, and shall set salaries for same, subject to the approval of the Executive Board. The President shall delegate authority and responsibility to other officers, members, and staff as necessary to carry on the business of the Local. The President shall appoint all committees except as otherwise provided by these Bylaws, subject to the approval of the Executive Board, and be a member of each committee ex officio. The President shall in conjunction with the Recording Secretary-Treasurer help supervise the funds of the Local. The President shall be the Chief Controller and Secretarial, Financial, and Disbursing Officer of the Local. He shall supervise all funds. The President shall be authorized to countersign all checks, drafts, or other authorizations for the payment of funds. The President may, with the approval of the Executive Board, appoint administrative assistants. He shall retain Certified Public Accountants to audit the Local s books and records on an annual basis. 5
8 The President shall, with the approval of the Executive Board, appoint a Sentinel, an Inspector, and a Sergeant at Arms. These officers are not members of the Executive Board. 5.6 Duties of the Recording Secretary- Treasurer. The Recording Secretary-Treasurer shall keep and maintain an accurate record of all proceedings of the Local; shall certify to the International the names and addresses of all officers and other officials of the Local. Together with the President, shall keep a true and accurate roll of the membership in the form required by the International. He shall be authorized to countersign all checks, drafts, or other authorizations for the payment of funds. 5.7 Duties of the Local Executive Board. In addition to the duties specified in the Constitution and Laws of the International, the Local Executive Board shall investigate and render decisions respecting all applicants and applications for membership, all disputes among members of the Local or between employees represented by the Local and their employers, all disciplinary action against members, and all other matters referred to it by the Local or pursuant to the Bylaws. All acts of any officer shall be subject to review by the Local Executive Board. 5.8 Duties of the Sentinel. The Sentinel is to receive all candidates for obligation at the meeting to escort speakers and other quests to the podium at the request of the presiding officer and generally assist such officer in the conduct of the meeting. For the faithful performance of duties as Sentinel, a salary of $175 per year, paid annually. 5.9 Duties of the Inspector. The Inspector shall examine the membership cards of all members entering a meeting; shall keep a record by registration of all members attending all regular and special membership meetings. For the faithful performance of duties as Inspector, a salary of $175 per year, paid annually Duties of the Sergeant at Arms. The Sergeant at Arms, under the direction of the Sentinel, shall guard the door to all regular and special membership meetings; shall assist the presiding officer in maintaining order and upon request of the presiding officer expel any person or persons disturbing the proper decorum and order of the meeting or any non-members not authorized by the presiding officers or the assembly. For the faithful performance of duties as Sergeant at Arms, a salary of $175 per year, paid annually Bonding. All officers shall be bonded in accordance with Federal Law. ARTICLE VI Nominations and Elections 6.1 Term of Office. The elected officers of the Local shall be nominated and elected for three (3) year terms in accordance with the provisions of the International Constitution and Laws. Term of office shall be from 4 p.m. the last working day of the year of the election and terminate at 3:59 p.m. three years later. 6.2 Eligibility. Members shall be eligible for election as a Local officer if, at a minimum, they have been a member for at least five (5) consecutive years immediately prior to nomination, in good standing and actively engaged or available for work at the trade for at least one (1) year immediately prior to nomination or as an Officer, Representative or employee of the International or Local Union and not in conflict with the International Constitution and Laws guidelines. Effective January 1, 2005 and forward, members shall be eligible for election as a fulltime Local Officer if, at a minimum, they have been a member for at least five (5) consecutive years prior to nomination, in good standing for at least twelve (12) months prior to nomination, attend at least half the monthly meetings during the twelve (12) months prior to the month in which nominations occur, be actively employed in a shop under the jurisdiction of Local 1-M, or be available for work at the trade for at least one (1) year immediately prior to nomination or as an Officer, Representative or Employee of the International or Local Union and not in conflict with the International Constitution and Laws guidelines. Effective January 1, 2005 and forward, members shall be eligible for election as a Local Officer if, at a minimum, they have been a member for at least five (5) consecutive years prior to nomination, in good standing for at least twelve (12) months prior to nomination, be actively employed in a shop under the jurisdiction of Local 1-M, or be available in such shop for work at the trade for at least one (1) year immediately prior to nomination or as an Officer, Representative or Employee of the International or Local Union and not in conflict with the International Constitution and Laws guidelines. 6
9 6.3 Nominations. Nominations of Local officers shall be opened and closed at the regular meeting in September in the year next and prior to the expiration of the three year term of office. Nominations may be made either from the floor or may be made by mail directed to the Recording Secretary-Treasurer of the Local, Posted at a time sufficiently prior to the meeting so that said nominations may be read by the Recording Secretary- Treasurer at the nomination meeting in September. Nomination forms will be sent out in July to be returned on or before the September Regular meeting. Each nomination must be accompanied by a nominating form or written statement from the nominee signifying said nominee s willingness to run and serve. A nominee may not be nominated to more than one (1) office. When there is no contest the Recording Secretary- Treasurer shall cast a white ballot. The order of nomination shall be as follows: (1) President (2) Recording Secretary-Treasurer (3) Executive Board Members 6.4 Elections. The election of offices shall be conducted by sealed referendum ballot. All nonexempt members shall be eligible to vote including unemployed, sick or non-exempt retired members. Ballots are to be mailed to the last known address of all members. The Referendum Ballots shall be mailed during the last week in October and shall be returned to a post office box designated by the Referendum Board and to be picked up and counted and to arrive no later than the Monday prior to Thanksgiving. Results of the election shall be announced by the Referendum Board at the regular December meeting. The candidate/s receiving the largest plurality vote shall be elected to their respective positions. 6.5 Installation. The officers elect shall take the Oath of Office, administered by the Referendum Chair the last working day in December, in the year of the election, at 4 p.m. at the Union Office. They shall assume their office and duties immediately after being sworn in. The Installation Ceremony will take place at the January regular meeting. ARTICLE VII Resignations, Forfeitures Vacancies of Office 7.1 Resignations. Any officer or any member of an elective or appointed position may resign from that office and/or position upon offering a written resignation one month in advance of its effective date. All properties of the Union that may be in their possession must be returned prior to departure from office and/or position. Upon the resignation of the President the books and accounts shall be audited by a Certified Public Accountant. 7.2 Forfeitures. Any full time officers absenting themselves for three consecutive meetings, for reasons not related to their position, without reasonable cause, from Executive Board Meetings, Regular Monthly Meetings, and Special Meetings (whereby the entire membership is involved), shall subject themselves to forfeiture of office, upon recommendation of the Executive Board. Any member holding a part-time elective or appointed position absenting themselves for three consecutive meetings; Executive Board Meetings, Regular Meetings and Special Meetings, for reasons not related to their positions, without reasonable cause, shall subject themselves to forfeiture of office, upon recommendation of the Executive Board. 7.3 Vacancies of Office. Any vacancy, incapacitation or disability (resulting in not being able to perform duties) of any officer shall be filled at the discretion of the Executive Board in accordance with these Bylaws. President: The Recording Secretary-Treasurer shall succeed to that office for the balance of the term. Recording Secretary-Treasurer: The Recording Secretary-Treasurer shall be filled by appointment of the President subject to the approval of the Executive Board, Sentinel, Inspector and Sergeant at Arms. ARTICLE VIII Delegates and Committees 8.1 GCC/IBT Convention. The President and Recording Secretary-Treasurer shall be automatic delegates by virtue of their offices. The President may appoint one (1) Executive Board member as a delegate with Executive Board approval. The remaining delegates and alternate delegates shall be elected in accordance with the International Constitution and Laws. Delegates must attend all meetings and fulfill all duties in order to receive such expense monies as may be voted on by the Union. 7
10 8.2 GCC/IBT Conference. Delegates to the North American Commercial Pressrooms, Newspaper, Midwestern States Conference and other conferences that require delegates shall be appointed by the President. Any remaining delegates and alternate delegates shall be elected in accordance with the International Constitution and Laws. 8.3 Delegations. Delegates to the Minneapolis Central Labor Union Council, Allied Printing Trades Council, St Paul Trades and Labor Assembly, Minnesota State Federation of Labor Convention, and other assemblies that would require delegations, shall be appointed by the President, subject to the approval of the Executive Board. 8.4 Committees. The following committees may be appointed by the President, subject to the approval of the Executive Board. a. Committee on Political Education (COPE) The COPE Committee shall disseminate information with respect to legislation. It shall recommend positions to be taken on labor issues and candidates for public office. It shall conduct fund raising drives as needed. b. Organizing Committee The Organizing Committee shall establish and maintain a current roster of names and addresses and other pertinent information regarding all unorganized graphic communication workers in the jurisdiction of the Local. It shall also establish and maintain a file of all graphic communications establishments not under contract to the GCC/IBT. c. This committee shall strive ceaselessly to organize all graphic communication workers into the Union and to bring all plants under contract to the GCC/IBT. d. Educational Committee The Educational Committee shall gather and disseminate information and other matters of educational value to the membership. e. Special Committees The Local shall have such special committees as may be needed from time to time to be created by the President, subject to the approval of the Local Executive Board. 8.5 Referendum Board. The Referendum Board shall consist of four (4) elected regular members. The Board shall prepare the ballots and supervise the election. They shall hear all election challenges, which they then refer to the Executive Board of the Local. Election for Referendum Committee shall be one (1) year after the officer elections. Nominations will be opened and closed at the September Regular Meeting and voted at the October Regular Meeting. Should any Referendum Committee member wish to run for another office, they must resign from the Referendum Committee position. a. They shall elect from their members a Chairman and a Secretary. b. The Referendum Board shall have the power to appoint additional members to help tally ballots as needed. c. No officers shall serve on the Referendum Board. 8.6 Compensation. The committee members shall be compensated by lost wages or at $10 per meeting. ARTICLE 1X Chapels and Shop Chair 9.1 Chair. In every shop there shall be a union representative designated as a Chair. References to Chair of the Chapel or Shop Chair are to be construed as one and the same. In shops where more than one department or shift exists, there may be an additional chair for each department and/or shift if there is a need Selection. The Chair shall be elected by the members in that shop annually for a one (1) year term commencing in January of each year. Should the members fail to make such selection, the Chair may be appointed by the President. Elections must take place in November and all information must be provided to the Union office in written form no later than the date of the December Regular Meeting. 9.3 Duties, Powers, and Compensation. a) They shall ascertain immediately from any person obtaining employment in their establishment whether they are a member of the Union, whether they hold a membership card, where they were last employed, and such other matters as may be necessary to determine their status. 8
11 b) They shall check all jobs and work entering the shop from an outside source for the Union Label, shop name, or other designation indicating place of manufacture. c) It shall be the duty of the Chair, upon notification from the Union Office, to use all efforts in their power to induce any member to place themselves in good standing. All Chairs shall remain in good standing. Those who become two (2) months or more in arrears shall immediately forfeit their Chair position. d) The Chair shall endeavor to adjust all differences that may arise in the shop between employer and employee or between union members. In case of failure to reach a settlement they shall refer the matter to the Local officers for further action. e) They shall distribute and collect ballots in any referendum, local or international. They shall urge every member to exercise their voting rights. They shall appoint, when necessary, such shop committees as may be necessary to assist them in carrying out their duties. f) When members are not employed fulltime, the Chair shall keep a record of actual time worked by each member and report same to the Union office. g) For the faithful performance of their duties, the Chair shall be compensated in the following manner: For shops with five (5) members or less the Shop Chair compensation will be $60 per year. For shops with six (6) members or more, the Shop Chair compensation shall be at the rate of $12 per member per year. The count that determines the compensation for each shop will be done during the first week of July. Shops with more than 1 Shop Chair must meet in January of each year to determine the number of Chairs and the percentage of compensation for each Chair. The Executive Board must be informed by January 31 of each year as to the number of Chairs and the percentage that each Chair will receive. The Executive Board has final approval for both the number of Chairs and their percentage for each shop. Example A. Shop with 14 members: One (1) Shop Chair14 X $12 = $168 per year. Example B. Shop with 48 members: Two (2) Shop Chairs 48 X $12 = $576 divided by 2 = $288 per Shop Chair per year. Example C. Shop with 180 members: 30 prep would have one (1) Chair and 150 pressmen would have four (4) Chairs. 180 X $12 = $2, X $12 = $ X $12 = $1,800 divided by 4 which equals $450 per Shop Chair per year. ARTICLE X Apprenticeship Laws 10.1 Indenture. All apprentices may be indentured through the state apprenticeship program for their craft and complete training programs as may be required Schooling. Apprentices must attend a designated school for the purpose of supplementary training for the period designated by the appropriate Apprentice Committee and the Local Executive Board. Failure to comply with result in the cancellation of the indenture and possible termination of employment in the occupation to which indentured Employment. An apprentice shall not be allowed to change employers without the consent of the Local Executive Board or an Officer. 9
12 ARTICLE X1 Employment 11.1 Service. The Local shall provide an employment referral service providing information on available job openings Changing Employment. Members desiring a change in employment shall register with the Local Union Office. Members who are referred out shall notify the designated officer of the Local as to the outcome within twenty-four (24) hours Job Openings. Any member who becomes unemployed shall immediately notify the Local Union office Job Openings. Any member who knows of a job opening within the trade shall notify the Local Union office Travel Cards. Members desiring to seek employment outside of this Local s jurisdiction shall apply to this Local Union office for a travel card, in accordance with the GCC/IBT International Constitution and Laws. In order to receive the Travel Card, the member must be in good standing Approval. No member shall at any time accept a position or visit a graphic communications establishment or employment agency on any pretense whatsoever, or solicit work, either in person, by letter or in any other manner including the acquisition or establishment of a graphic communications business before obtaining the consent of a designated officer or representative of the Local. Any member who violates this law shall be subject to Article 12 of these Bylaws Newspaper Pressrooms. The past practice of the Newspaper Pressrooms having the Shop Chair handling the hiring and placement of employees shall continue. Section 11.6 Approval shall not apply. ARTICLE XII Offenses, Trials, and Appeals 12.1 Disciplines and Penalties. Any member, an officer or other official of the Local, may be disciplined or penalized for the commission of any offense specified in this Article. The discipline and penalties which may be imposed shall include censure, fines, temporary suspension, disqualification to hold office or other official positions, the recall there from, expulsion or any combination thereof Offenses. The offenses for which discipline and penalties may be imposed shall be as follows: a) Willful violation of the provisions of the obligation of membership or of the oath of office as defined in these laws and the International Constitution and Laws. b) Strikebreaking during any sanctioned strike or evasion of responsibilities during a recognized lockout or any sanctioned strike. c) Willful failure to comply with the Constitution and Laws of the International or Bylaws of the Local to the detriment of the organization. d) Knowingly undermining wage and work standards established by contract and/or conferring with an employer with respect to altering the contract, work standards, or other requirements of the organization. e) Corruption or financial malpractice with respect to the funds or property of the organization. f) Bringing false charges against a member, officer or other official; improperly superseding a fellow member in the workplace; depriving or attempting to deprive a fellow member of good standing in the Local, or depriving a fellow member of employment. g) Any member who accepts a job under the Local s jurisdiction and neglects their duties by absence or intoxication or who becomes intoxicated while working shall be fined $50 for the first offense, $100 for the second offense, $200 for the third offense, and suspended for the fourth offense for a period to be determined by the Executive Board. If a period of one year has elapsed after any of these offenses, the penalty of the next offense shall revert to the penalty of the first offense. h) Any member who shall during a meeting of the Union use profane language, gross personalities, demean 10
13 him/herself boisterously, violently, appear at the meeting in a state of intoxication, or refuse obedience to the President, shall, in the discretion of the President, be fined $10 and be removed from the meeting Charges, Investigation, Service, Trials, Decisions and Appeals. All action and matters concerning charges, Investigation, Service, Trials, Decisions and Appeals shall be in accordance with Article XIX of the Constitution and Laws of the International Union. ARTICLE XIII Financial Obligation 13.1 Schedule of Dues. Each member shall pay to the Local1.5% of their dayside straight time gross weekly rate x 52 divided by 12. Members working ten (10) days or more in any month shall be obligated to pay full dues. Members working nine (9) days or less in any given month shall pay unemployed dues at the lowest International per capita tax each month. In addition, all active working members will pay all International per capita tax increases since December 31, 1992 and all future increases. Since June 1, 1995 the per capita tax has increased from $2 per month to $5.25 per month Members Employed in Non-Contract Shops. Effective March 1, 2004, each member shall pay $20 per month plus full International per capita tax Members in Sales. Effective March 1, 2004, each member shall pay $20 per month plus full International per capita tax Members Unemployed. Members unemployed, members who are sick and members employed in an unrelated occupation shall pay the lowest International per capita tax per month Newly Organized Members. Members who join the Union through organizing may have their dues adjusted to a lesser amount for up to two (2) years, upon recommendation of the President and approval of the Executive Board Assessments. Whenever in the opinion of the Local Executive Board, it shall be necessary for the Local to raise additional sums of money, the membership shall be notified by shop bulletin that the next regular meeting will include on the agenda the question of levying an assessment, and if the membership at such meeting shall approve by secret ballot, the assessment shall be due and payable by every member. This does not apply to the Defense Fund Exoneration. Members in distress may be exonerated from the payment of dues or assessments at the discretion of the Local Executive Board, but under no circumstances shall the Local Executive Board remit more than three (3) months dues without the approval of a majority of the members in attendance at a regular membership meeting. Exoneration shall not include such amounts as required for the International Pension Plan and the former Local 20C Mortuary Fund Exemptions. Members meeting the requirements for exempt status under the International Constitution and Laws shall be exempt from dues as provided therein Dues. Each member upon paying their dues shall receive a receipt recording the transaction. Dues are payable the first working day of each month; however, they must be paid by the last working day of the month for which they are owed. ARTICLE XIV Finances 14.1 General. Funds of the Local may not be used for any other purpose than to promote or advance the interests of the Union and not for the personal use of any member Bank Deposits. The Local shall not deposit more than the specified maximum covered by the Federal Deposit Insurance Corporation (FDIC) provision in any one savings account, or certificate, unless approved by a two-thirds (⅔) vote of the membership at a Regular Meeting This shall not be construed as prohibiting amounts in excess of the maximum FDIC amount to remain in an account as a result of accrued interest Investments. The Local may invest in Mutual Funds, Bonds or other Securities, which are legal investments, upon authorization of a vote of two-thirds (⅔) of the members at any regular or special membership meeting. At no time shall the Local have more than fifty (50) percent of its monies invested in investments. 11
14 14.4 Checking Accounts. Checking account balances shall be governed by the function of each account for the capital required for that operation consistent with proper business practices Disbursements. Disbursements for routine operating expenses shall be as authorized by the President and Recording Secretary-Treasurer. Disbursements in excess of $1,000 of a non-routine nature shall require the approval of a majority of the membership voting at a regular or special membership meeting General Fund. The General Fund shall be used for general operating expenses. All receipts shall be deposited in the General Funds. Allocations to be as follows: a) Monies paid to other funds from dues collected shall be computed monthly and transfer made as cash. b) 15% of dues receipts exclusive of the amounts payable for International per capita, and the respective International Death Benefit funds shall be deposited monthly to the Local Defense Fund. c) For the purpose of accounting and as discretion dictates, the President and Recording Secretary-Treasurer may establish accounts within the General Fund under titles descriptive of the account s function and purpose. d) International Assessments collected locally, paid or payable shall be transferred to the appropriate International Defense Fund. e) Allocations of receipts, other than dues, such as assessments and special collections shall be transferred to the designated fund Defense Fund Funding. The Defense Fund shall obtain its revenue from dues as outlined in Section 14.6 (above) and special assessments and from sources as may be determined by the Local. a) Whenever the President and Recording Secretary-Treasurer certifies that the fund has declined to $400,000 or less, an assessment shall automatically become operative in an amount fixed by the Executive Board until the balance attains a level of $500,000. b) Retired, unemployed, and members who came in as a newly organized unit with less than two years of membership, may be exempt from assessment under 14.7 (a) above. c) Under-employed members shall be assessed a pro rata of the total monthly amount in ratio to the number of weeks worked during the month i.e. a week s work shall be considered three (3) days or more Defense Fund Expenditures. Payments shall be made for the following purposes. If payments are to members, or for representing a member (such as an arbitration), the member must be in good standing. a) Strike and Sacrifice benefits in an amount determined by the Local Executive Board. Refusal to accept assignments or employment made by the Local, shall disqualify any member for benefits and: 1. A strike must be sanctioned by the International. 2. A strike requires a two-thirds (⅔) majority vote of the bargaining unit employees affected. b) Expenses incurred in negotiations. c) Legal expenses in excess of normal monthly retainer. d) Expenses for organizing. e) Promotional programs and advertising, subject to approval of a majority of members present and voting at a regular or special membership meeting. f) Payments on behalf of the members to the International Union for any International special assessments as may be levied. g) Any member of the Local who is in dire need may apply for assistance from the Fund. The Local Executive Board may 12
15 make payment or distress loan to the applicant in such amount as they shall determine Officers Compensation. All officers (fulltime and part-time) shall have their salaries reviewed every May 1 st by the Executive Board. The Executive Board shall recommend to the general membership at the next regular meeting, adjustments to be made, if any Expenses Fulltime Officers. The fulltime officers shall be furnished an automobile and be reimbursed any out-of-pocket expenses, upon receipt, for duties in line with serving the membership. All receipts are to be handled through the Recording Secretary-Treasurer Local Sick Benefit. A member in good standing who is out of work, suffering loss of income, either through sickness or accident, shall be entitled to receive the sum of $40 per week, upon a regular physician s certification. No benefits shall be paid for less than one week s sickness. Every member shall be entitled to receive ten (10) weeks payment during any twelve (12) consecutive month period. (The Local Sick Benefit has been suspended effective September 1, 2011.) ARTICLE XV Dissolution of the Union 15.1 Dissolution of the Union. The Union shall not have the power to dissolve itself while there are seven (7) dissenting members. ARTICLE XVI Amendments 16.1 Alterations and Amendments. Any article or section contained in these Bylaws may be amended by presentation of proposed amendment in writing to be read at a regular or special membership meeting. Such proposed amendment shall again be read, discussed and then voted upon at the next regular membership meeting, or at the recommendation of the Executive Board at their next scheduled Executive Board Meeting, the proposed amendments may be sent to the entire eligible voting membership by mail referendum. A two-thirds (⅔) affirmative vote of the members voting shall be required for adoption, as addressed in Section
