Lopes for Shawn Burke MEMBERS NOT PRESENT: Vince Dober Norm Blais Max Tracy ADMINISTRATION: Kristin Jones, Taxi Administration Office Isaac Trombley, Taxi Administration Office Kelly Colling, Airport Operations Sheila Edwards, Airport Ambassador STAFF ATTORNEY: OTHERS PRESENT: Gregg Meyer, Assistant City Attorney Don Corbett, New England Taxi Jim Podrasky, Blazer Transportation Marianne Riordan, Recording Secretary 1.0 CALL TO ORDER and AGENDA The meeting was opened at 9:06 AM on February 6, Agenda Jeff Munger, to approve the agenda as presented. 2.0 PUBLIC FORUM Don Corbett, owner of New England Taxi, inquired about the following: Communication of complaints to the Taxi Board. Requirement to pay livable wage when Skinny Pancake was exempted from paying a livable wage and United was pushed to pay a livable wage. Taxi drivers do not make a livable wage. Jim Podrasky with Blazer Transportation made the following comments: The ghost rider program should be in full operation and expanded because it was witnessed that at least one taxi company did not use the meter for passengers picked up on Church Street. Burlington police officers while on the beat should glance into cabs to ensure meters are being used. 3.0 DISCUSSION 3.01 Correspondence from Donald Corbett, New England Taxi Gregg Meyer explained the Taxi Board is briefed on a complaint and receives associated correspondence Transfer of Queue Permit to Different Taxi Company
2 MINUTES OF MEETING February 6, 2013 PAGE 2 Kristin Jones pointed out the number of queue permits will not decrease if transfers are allowed. There was discussion of the maximum number of permits desired (50) and the existing number of permits (over 60). A waiting list has been established for permits. Jeff Munger, to deny the transfer request Temporary Administrative Rule to Allow Retrieval of Driving History from Another State for Applicants Who Just Moved to Vermont Gregg Meyer advised the proposed ordinance changes to be submitted to the Ordinance Committee for approval will be a permanent solution to the matter so there is no need for a temporary rule. The Taxi Administration Office can request a DMV record check from another state if an applicant has just moved to Vermont. Jeff Munger, to table Item 3.03 Temporary Administrative Rule relative to retrieval of driving history from another state Administrative Rule: Convictions on Background Check Beyond a Certain Period of Time Gregg Meyer explained a rule is needed to address infractions that occurred 25 or 30 years ago that are still on record and the individual has had no additional offenses. The rule could say after legal review of infractions older than 30 years the Taxi Administration Office has the discretion to assess the matter with regard to requiring a hearing before the Taxi Appeals Panel. Action: Gregg Meyer will draft language for the ordinance relative to the Taxi Administration Office having discretion to assess the need for a hearing before the Taxi Appeals Panel for offenses that occurred 30 years ago and with no further infractions on record for the applicant Andre Jarvis Request The Board discussed the extension request by Mr. Jarvis for payment of incurred fines. Jeff Munger, to grant the request by Andre Jarvis for an extension on the payment of fines. Raymond Lopes will check to see if Mr. Jarvis is current on payments to the DMV Proposed Language for Ordinance Changes Gregg Meyer summarized proposed changes to the ordinance as follows: Vermont residency of no less than six months is required plus two years of driving experience with no less than six months of driving in Vermont.
3 MINUTES OF MEETING February 6, 2013 PAGE 3 Reference to the Taxi Advisory Committee is deleted. The Taxi Board recommends the number of taxi licenses that will be permitted. The Taxi Administration Office is given discretion with regard to determining if a hearing is needed before the Taxi Appeals Panel for an infraction that occurred 30 years ago and there are no further infractions on record. There was discussion of having the Airport Commission handle taxi licensing rather than the city licensing committee which is overburdened. Jeff Munger stressed a member of the licensing committee/city council should be on the board making the decision to limit the number of taxi licenses issued in the city. Gregg Meyer will discuss with the Ordinance Committee at the next meeting how much involvement city council wants in the taxi licensing process (i.e. direct membership and attending regular meetings or a semi-annual report). Jeff Munger mentioned the scheduled time of the Taxi Panel/Board meeting is in the morning (9AM) to have the least impact on the taxi industry (meetings at the end of the day or early evening would interfere with potential taxi fares from incoming flights). There was discussion of what constitutes a quorum for the Taxi Board. Gregg Meyer explained the Taxi Appeals Panel and Taxi Licensing Board are two different bodies. A quorum for each entity needs to be clarified in the ordinance. It was noted since the update of the ordinance additional inconsistencies have been found that need to be rectified and included in the package of amendments. Nikki Fuller was compiling a list Question re: Vehicle Section 30-43(a)(6): Cleanliness of Passenger Seat Area Sheila Edwards, Airport Ambassador, discussed the matter of the front passenger seat not always being available to customers. Ms. Edwards said her interpretation of the ordinance is that all seats in the vehicle and the trunk are available to the customer. Some drivers occupy the front passenger seat with their personal items. Some drivers feel the rule refers to cleanliness, not items set on the seat. There was testimony from a cab driver (Jim Podrasky) that some of his customers prefer the front seat because they have motion sickness if they ride in the back seat. Ray Lopes urged amending the ordinance to avoid misinterpretation in the future. Jeff Munger, to define clean in so far as it applies to taxicabs to mean available for use by a customer. Action: The Taxi Administration Office will issue a memo regarding the requirement of a clean panel, seat area and trunk.
4 MINUTES OF MEETING February 6, 2013 PAGE Question re: Signatures for Online Application Gregg Meyer stated the first step is to confirm whether the entity doing the background check will accept an online authorization or require a signature. Action: The Taxi Administration Office will further investigate the matter Follow Up re: Fees Imposed for Driver Training Course The issue of fees for the driver training course will be discussed with Vince Dober at the next meeting. Action: The Board voted unanimously on a motion by Jeff Munger, seconded by Bill Keogh, to table action on Item 3.09 relative to fees imposed for the driver training course Questions from Sheila Edwards re: Contract Fares There was discussion of customers being charged less or paying less than the amount on the meter. The goal of the meters is to assure customers are not over charged for rides. If a taxi business chooses to under charge for a fare or sets a price for a fare prior to the service (i.e. contract fare) that is a business decision and not under the jurisdiction of the Taxi Administration Office or Taxi Board. If complaints are received, the Taxi Administration Office has the authority to investigate the matter and seek information (such as the daily log). 4.0 APPROVAL OF MINUTES 4.01 Taxi Licensing Board 1/9/2013 Jeff Munger, to approve the January 9, 2013 minutes as presented. 5.0 OTHER BUSINESS Next Meeting: Tuesday, February 19, 2013 at 10 AM.
