1 RESOLUTION NO Adopted by the Sacramento City Council September 25, 2018 Amending the Citywide Transportation Development Impact Fee Program By Reducing the Fee within the Railyards Plan Area BACKGROUND A. New and improved transportation facilities will be required to support the City of Sacramento s General Plan and accommodate projected development and growth through B. On September 25, 2018, City Council (Council) conducted a noticed public hearing in accordance with Government Code sections and 65453; and received and considered evidence concerning the Railyards Finance Plan, and the Railyards Impact Fee. On conclusion of the public hearing, the Council approved Resolution No C. On February 14, 2017, Council adopted Ordinance No , adopting Article III to Chapter of the Sacramento City Code, Relating to the Citywide Transportation Development Impact Fee ( TDIF Ordinance ). The TDIF Ordinance: (1) created the authority for imposing the development impact fees to provide funding for transportation facilities to benefit new development within the City; (2) created the authority for imposing the TDIF administration fee for the cost of collection, deposit, investment, accounting, remittance and reporting of the TDIF funds; and (3) enabled the City Council by resolution to set forth the specific amount of these fees in reliance on the TDIF Nexus Study and the TDIF Expenditure Plan. D. The TDIF Ordinance further provides that the Council may, by resolution, set forth exemptions, reductions, and specific limitations which will apply to credits, and deferrals in payment of the TDIF and the TDIF administrative fees. E. On February 14, 2017, Council adopted Resolution which established the Citywide Transportation Development Impact Fee Program. F. The TDIF rate established for the Railyards is reduced due to overlapping funding for certain transportation improvements which are also in the Railyards Impact Fee. Resolution September 25, of 5

2 BASED ON THE FACTS SET FORTH IN THE BACKGROUND, THE CITY COUNCIL RESOLVES AS FOLLOWS: Section 1. Findings. The City Council finds and declares as follows: 1. All of the provisions set forth above are true and correct and are hereby incorporated herein by reference as findings. 2. All new development within the City will result in additional growth that will place burdens on transportation facilities within the City. Such development will necessitate the need for construction of new and expanded public facilities to meet the needs of and to address the impacts caused by new development within the City. The development impact fees updated by this Resolution are designed to partially mitigate the transportation impacts caused by new development in the City, and to protect the public s health, safety and general welfare. 3. The Updated Railyards Finance Plan and Railyards Impact Fee will help mitigate the impacts on transportation facilities resulting from additional growth. SECTION 2. Updated Transportation Development Impact Fee The amount of the transportation development impact fee, which was established though adoption of Resolution , is updated in light of the Railyards Finance Plan to reduce the amount of the fee within the Railyards Plan area as follows: Resolution September 25, of 5
