CITY OF BONITA SPRINGS, FLORIDA ORDINANCE NO. 12- AN ORDINANCE OF THE CITY OF BONITA SPRINGS, FLORIDA ADOPTING AMENDMENTS TO ITS COMPREHENSIVE PLAN INCLUDING AMENDMENTS TO THE FUTURE LAND USE MAP, TEXT CHANGES TO THE FUTURE LAND USE ELEMENT; CREATING THE RURAL AGRICULTURE OVERLAY DISTRICT: ADOPTING GOALS, OBJECTIVES AND POLICIES TO ENCOURAGE AND PROMOTE A LOCAL FOOD SYSTEM APPROACH; PROVIDING FOR TRANSMITTAL TO THE STATE LAND PLANNING AGENCY; PROVIDING A CONFLICTS CLAUSE AND SEVERABILITY CLAUSE, PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, the City Council of the City of Bonita Springs, Florida recognizes the need to plan for orderly growth and development; and WHEREAS, Chapter 163, Florida Statutes provide for amendment to adopted Comprehensive Plan; and WHEREAS, the City of Bonita Springs Comprehensive Plan was adopted pursuant to Bonita Springs Ordinance No as amended in accordance with the Local Government Comprehensive Planning Act; and WHEREAS, the City has reviewed proposed amendments to the City s Comprehensive Plan and to the Map Series of the Future Land Use Element of the City s Comprehensive Plan, and said proposed amendments being reviewed by the City s Local Planning Agency at a duly advertised meeting on July 19, 2012, and submitted data and analysis, which determined such applications to be consistent with the Comprehensive Plan and appropriate to the future land uses within the City; and WHEREAS, the City Council has agreed with the recommendations of the Local Planning Agency that the proposed amendment complies with the requirements of Chapter 163, Florida Statutes, Part II, and that the proposed amendment is consistent with the Comprehensive Plan and appropriate to the future land uses within the City; and WHEREAS, City Council held a public hearing for the transmittal of the proposed amendment on August 1, 2012; and WHEREAS, the City has received and responded to the Objections, Recommendations, and Comments Report; and WHEREAS, public hearings were held by the City Council for adoption of this Ordinance on October 3, 2012 and October 17, 2012 DRAFT FOR DISCUSSION PURPOSES Page 1 of 6 DATE PREPARED: October 16, 2012 U:\City Attorney\Ordinances\2012\12-_ comp Plan - SCEWCD Rural - Local food system GOP (2) docx

16 Rural NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Bonita Springs, Florida that: SECTION 1. The City of Bonita Springs, Florida hereby adopts amendments to its current Comprehensive Plan, which amendments consist of the pages which are identified as Exhibit A Text Amendments to the Comprehensive Plan and an overlay Future Land Use Map Amendment and which are incorporated into the current Comprehensive Plan. A copy of the Comprehensive Plan, as amended, is on file at City Hall in Bonita Springs, Florida. SEcTIoN 2. The City Clerk is hereby directed to transmit three (3) copies of the amendments of the current Comprehensive Plan to the State Land Planning Agency, along with one (1) copy to the Southwest Florida Regional Planning Council; Florida Department of Environmental Protection; Florida Department of State, Division of Historic Resources; Florida Department of Transportation; South Florida Water Management District, Lee County Community Development Department, and to any other unit of local government who has filed a written request for a copy, within ten (10) working days after adoption, in accordance with Section (7), Florida Statutes. SECTION 3. That all ordinances or parts of ordinances in conflict are and the same are hereby repealed. SECTION 4. That should any section or provision of this Ordinance or any portion thereof, any paragraph, sentence or work be declared by any court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder of this Ordinance. SECTIoN 5. The effective date for the enactment of this Ordinance shall be the date a Final Order of Compliance is issued by the Department of Economic Opportunity finding this Amendment to be in compliance in accordance with Chapter , Florida Statutes; or the date a Final Order is issued by the Administration Commission finding this Amendment to be in compliance in accordance with Chapter , Florida Statutes, or thirty (30) days from its adoption date, whichever occurs later. No development orders, development permits, or land uses dependent on this Comprehensive Plan Amendment may be issued or commence before it has become effective. 18 EXHIBIT A TEXT AMENDMENTS TO THE COMPREHENSIVE PLAN Future Land Use Element Policy : Rural Agriculture Overlay District: The Rural Agriculture Overlay District lies generally north of Shangri-la Road, east of Old US 41, south of the city s northern boundary, and west of Interstate 75, as depicted on Figure 11. The purpose of the Rural Agriculture Overlay District is to provide for agricultural uses in the identified rural residential areas of the a) This area has an existing land use pattern of larger lots with lower density residential development consisting of single family dwelling units, varying types of ancillary agricultural uses, and vacant residential lands. Densities and intensities in this area are not to exceed the future land use classification designation except for those lots of record being permitted through a minimum use determination. b) Agricultural uses as a principal use are allowed in this overlay district as a permitted use subject to the standards provided in the land development code. 20 Rural Goal 1: A balanced land use pattern that promotes a high quality of life and allows for a variety of land uses, densities and intensities and the preservation and stabilization of existing neighborhoods; encourages mixed use development; promotes an efficient transportation system; preserves the natural environment and economic vitality of the community; and, is consistent with the availability of essential services. Objective 1.16: Policy : Policy : The city shall encourage and promote a local food system approach within the City of Bonita Springs. The City shall support the development of markets and programs that promote the sale of locally produced agricultural goods, including but not limited to, farmers markets, community gardens, farm to institution programs, and agri-tourism opportunities. The City shall partner with local community groups and organizations and other local governments to pursue funding sources for the development of a sustainable local food system when appropriate. Agricultural pursuits shall be encouraged in all land use classifications, provided that there are adequate standards in the LDC for compatibility with adjoining property and to protect the natural environment. Before new agriculture permits are permitted, the land development code shall include standards for agricultural pursuits and related uses, including but not limited to farmers markets, community gardens, laying hens, and other small scale agricultural uses as allowable uses in appropriate areas. Policy : Community gardens are encouraged in the City within all residential FLUCs, the Moderate Density MU/PD, Old 41 Redevelopment Overlay, Recreation, Public/Semi-public, and the DRGR land use classifications as permitted uses subiect to the standards provided in the land development code and applicable state and local permits. Policy : It is not the intent or encouragement of the local food system approach to re-classify property for tax exemptions purposes under Florida Statutes Chapter 196.
