Applicants for land use and zoning related items are advised that the resumes of staff members who prepare applicable staff reports are on file in the City Clerk's Office. The City desires to accommodate persons with disabilities. Accordingly, any physically handicapped person, pursuant to Chapter Florida Statutes, should, at least 48 hours prior to the meeting, submit a written request to the chairperson that the physically handicapped person desires to attend the meeting. 1. Planning and Zoning Commission Appoint three (3) regular members and one (1) alternate member to the Planning and Zoning Commission with terms to expire on January 31, (The appointments were tabled at the regular City Council meeting on January 22, 2019 at 6:30 p.m.) B. Municipal Code Enforcement Board Accept the resignation of regular member Saundra

2 Ozan (Realtor) with a term to expire on October 31, Her resignation was effective on February 1, Appoint one regular member to an unexpired term to expire on October 31, PETITIONS AND REQUESTS FROM THE PUBLIC PRESENT (NON-AGENDA ITEMS) 8. CONSENT AGENDA A. Resolution No Updating the Water Resources Technical Specifications Approve Resolution No and authorize the Mayor to execute the annual update to the Water Resources Technical Specifications and provide for an effective date. B. Contract for Services Related to the Installation of Four Sewer Force Main Control Valves Approve the award of a contract, subject to the resolution of the contract terms by the City Manager and the City Attorney, to EA Tapping Services LLC, of Apopka, Florida in the amount of $34,000 for the purchase and installation of two 8-inch insertion valves, one 12-inch insertion valve, and one 14-inch line stop for in-line control valves on a sewer force main that runs along the Indian River Lagoon (IRL), approve a budget amendment, and authorize the City Manager to execute the contract. C. Flag and Memorial Committee Transfer of Funds Transfer Flag and Memorial Committee funds totaling $6,800 from a restricted account into a non-restricted account in order to make the following purchases: Banner/flags for the Avenue of Flags - $2,000; Plaques/Name Tags/Bricks for Veteran's Park - $1,000; Event Expenses (flyers, programs, advertising, etc.) - $1,000; Fundraising Costs - $1,000; Donations to nonprofit organizations - $1,000; and Miscellaneous supplies, i.e., stamps, paper, toners, envelopes - $ D. Historic Preservation Plan Adoption Adopt the Historic Preservation Plan completed by Environmental Services, Inc. (ESI). E. Resolution No Supporting Temporary Closure of State Roads Adopt Resolution No supporting temporary closure of State Roads for Rotary Chili Cook-Off 5K Run and Mardi Party Downtown Street Party. F. Piggyback Agreement - Professional Building Department Services Approve the award of Agreement for Professional Building Department Services with Joe Payne, Inc., piggybacking its contract with Brevard County Board of County Commissioners expiring on September 30, 2021, with additional one (1) year Page 2 of 414

3 renewals; and authorize the City Manager to execute the piggyback agreement. G. Advisability - Request by Planning and Zoning Commission to Review Ordinance No Creating Height Overlay Approve advisability, as requested by the Planning and Zoning Commission, to review Ordinance No Creating Height Overlay. H. Award Work Order for Rainfall and Water Level Monitoring Network Approve the award of Work Order ECTSW009 to Environmental Consulting & Technology, Inc. (ECT, Inc.) to manufacture and install stations that will monitor rainfall and water levels in five areas of the City in the amount of $32,625, and authorize the City Manager to execute said Work Order. I. Captioning Equipment for Government Television Approve the purchase and installation of ACE-2000 Automated Close Captioning Engine with SCE-492 Closed Captioning Encoder in the amount $44, from Encore Broadcast Solutions of Altamonte Springs as funded in the FY19 budget; and authorize the City Manager to put in place all the instruments necessary for this purchase. 9. ORDINANCES SECOND READING, PUBLIC HEARING AND RELATED ACTION Page 3 of 414 A. Comprehensive Plan Amendment CPA No Brooks Landing (Transmittal) Conduct the public hearing for Comprehensive Plan Amendment No Brooks Landing Subdivision and transmit the amendment to the State Land Planning Agency for review. The Planning and Zoning Commission considered this request on January 6, 2019 and tabled to their meeting scheduled on March 6, 2019, 7-0. B. Comprehensive Plan Amendment (CPA) No Cerrato (Transmittal) Conduct Transmittal Hearings for CPA No to amend the Future Land Use Map from Commercial Low Intensity to High Density Residential and rezone from Hospital Medical (HM) zoning to Multifamily High Density Residential (R-3) zoning. (This item was tabled by the City Council at their meeting on January 22, 2019 at 6:30 p.m.) The Planning and Zoning Commission considered this request at their January 6, 2019 meeting and recommended denial, 7-0. C. Ordinance No Related to Off-Street Parking Consider Ordinance No amending the Code of

4 Ordinances by amending Chapter 28 Zoning, specifically amending Sections Use table and , Off-street parking lots to amend off-street parking lots from a permitted use with limitations to a conditional use in the Urban Mixed Use (UMU) district, allowing off-street parking lots as a conditional use within the Regional Mixed Use (RMU) zoning district specifically the RMU-300 and -400 subdistricts, and amending the standards for conditional uses; providing for severability, repeal of conflicting ordinances, an effective date and incorporation into the code. (This is the first reading and first public hearing. The second reading and final public hearing is scheduled for February 26, 2019 at 6:30 p.m.) approval, 7-0. D. Ordinance No Related to the Wetland and Conservation Area Conduct the first reading and first public hearing of Ordinance No amending Chapter 29 Special Districts and Overlays of the Code of Ordinances; specifically amending Article IV Wetland and Conservation Area (WCA), Sections Intent to clarify the intent of the overlay as related to conservation easements and other preservation mechanisms, amending Sections Permitted zoning districts, Conditional uses and Official map to include Planned Development (PD) as a permitted zoning district and modify conditional uses within the overlay; providing for severability; repeal of conflicting ordinances; for an effective date and for incorporation into the code. (This is the first reading and first public hearing. The second reading and final public hearing is scheduled for February 26, 2019 at 6:30 p.m.) approval, 7-0. Their motion included adding clarification language that reads the Park and Open Space uses as authorized in the Planned Development Division. E. Ordinance No Amending the Future Land Use/Zoning Consistency Matrix Conduct the first reading and first public hearing of Ordinance No amending Chapter 27 General Provisions of the Land Development Regulations; specifically amending Section Comprehensive Plan Future Land Use Categories amending the Future Land Use/Zoning Consistency Matrix to permit Planned Development (PD) zoning within Conservation and Downtown Mixed Use land use districts; providing for severability; repeal of conflicting ordinances; for an effective date and for incorporation into the code.
