Roll Call. The meeting was called to order at 9:07 a.m. Commissioner Little arrived at 1:37 p.m. 2. Determination of Legal Notice. Mr. Hall advised the Commission that all items have been properly noticed. 3. Director s Report and Miscellaneous. Mr. Hall reviewed the written Director s Report submitted into the record. In response to the Caltrans proposal for Daylight-Headlight sections, Commissioner Calvert noted Caltrans should install more turnouts to improve traffic safety. 4. Regular Calendar. 4A. U MCGUIRE/EDGE WIRELESS North of Fort Bragg Request: Use Permit to construct a new telecommunications facility at the existing communications site on Bald Hill. The facility will consist of nine panel antennas and two microwave dishes to be collocated on an existing 150 foot tall lattice tower, an 8 x 14 foot equipment shelter, a standby generator, a propane fuel tank, and a new 6 foot chain link fence. Mr. Hudson reviewed the staff report and correspondence. He also noted that the condition regarding a bond in the event that the carrier abandons the facility was overlooked and should be included in the conditions of approval. Mr. Alan Waters, Edge Wireless, agent for this application, felt that this project meets all of the criteria in the Wireless Communication Guidelines. He noted that the project has had a full CEQA review and all federal requirements have been met.

2 MINUTES PAGE 2 In response to Commissioner Barth, Mr. Waters explained the federal regulations with licenses and how the government mandates wireless communication facilities for homeland security. He indicted that this tower could improve local emergency services. He stated that currently there is no digital service in this area and this tower would be available for wireless data transfer services in the future. In response to Commissioner Lipmanson, Mr. Waters noted that Edge Wireless has been using a test site for about six weeks. Commissioner Lipmanson asked if a digital system has more dangerous emissions than analog. Mr. Waters stated that he was not an expert but noted that the digital signal and wattage is lower than analog. The public hearing was declared open. Ms. Donna Schuler, adjacent property owner, stated that she could see the existing tower from her property. She expressed health and safety concerns. In response to Commissioner Barth, Ms. Schuler noted that she bought the property about two years ago and she was aware of the existing structures. She expressed concerns that this site would continue to expand and grow. She noted that there would be cumulative impacts if more structures were proposed. She also noted concerns with a creek running through the McGuire property. In response to Commissioner Nelson, Mr. Lynch noted that the Schuler property was approximately 1¼ to 1½ miles from the tower. In response to Chairman McCowen, Ms. Schuler noted that she did receive notice of the hearing. Ms. Freida Feen felt that the public in Fort Bragg was poorly noticed. She requested a continuance so the public could be properly noticed and the cumulate impacts be addressed. She spoke in opposition to additional towers on this site. The public hearing was declared closed. Commissioner Barth noted that she supported a previous application at this site in She felt that this would be a good location for a tower because it was not close to a school and it was a good distance from Highway 1. In response to Commissioner Calvert, Mr. Hudson noted that an ice bridge supports cables to the tower. In response to Commissioner Calvert, Ms. Vicky Littlefield, Edge Wireless, stated the digital batteries last about 50 percent longer than analog phone batteries. Ms. Littlefield also discussed the additional features with a digital system like Caller ID and text messaging. In response to Commissioner Lipmanson, Mr. Waters explained the different frequency between analog and digital. Chairman McCowen asked about the condition of the road. Mr. Waters stated that the road is regularly maintained but develops ruts in wet weather. Mr. Waters felt that the road was about 1½ miles long to the site. The Commission discussed different options for road maintenance. Mr. Waters noted that the land was owned and maintained by the McGuire s.

3 MINUTES PAGE 3 Commissioner Calvert felt that this application completely meets all of the wireless communications guidelines. Upon motion by Commissioner Barth, seconded by Commissioner Calvert and carried by the following roll call vote, IT IS ORDERED that the Planning Commission adopts a Negative Declaration and approves #U making the following findings and subject to the following conditions of approval: General Plan Consistency Finding: As discussed under pertinent sections of the staff report, the proposed project is consistent with applicable goals and policies of the General Plan as subject to the conditions being recommended by staff. Environmental Findings: The Planning Commission finds that no significant environmental impacts would result from the proposed project which cannot be adequately mitigated through the conditions of approval, therefore, a Negative Declaration is adopted. Department of Fish and Game Findings: The Planning Commission has evaluated the Initial Study and other information pertinent to the potential environmental impacts of this project and finds that, based upon the existing development on the subject parcel and surrounding parcels, the project will not have any adverse impact upon wildlife or the habitat upon which wildlife depends and, therefore, the Commission has rebutted the presumption set forth in subdivision (d) of Section Project Findings: The Planning Commission approves #U subject to the conditions of approval recommended by staff further finding: 1. That adequate utilities, access roads, drainage and other necessary facilities have been or are being provided. 2. That the proposed use will not constitute a nuisance or be detrimental to the health, safety, peace, morals, comfort or general welfare of persons residing or working in or passing through the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the county. 3. That such use preserves the integrity of the zoning district. CONDITIONS OF APPROVAL: 1. This entitlement does not become effective or operative and no work shall be commenced under this entitlement until the California Department of Fish and Game filing fees required or authorized by Section of the Fish and Game Code are submitted to the Mendocino County Department of Planning and Building Services. Said fee of $25.00 shall be made payable to the Mendocino County Clerk and submitted to the Department of Planning and Building Services prior to November 1, If the project is appealed, the payment will be held by the Department of Planning and Building Services until the appeal is decided. Depending the outcome of the appeal, the payment will either be filed with the County Clerk (if project is approved) or returned to the payer (if project is denied). Failure to pay this fee by the specified deadline shall result in the entitlement becoming null and void. 2. This permit shall become effective after all applicable appeal periods have expired or appeal processes have been exhausted. Failure of the applicant to make use of this permit within 2 years shall result in the automatic expiration of this permit.

4 MINUTES PAGE 4 3. A muffler shall be installed and maintained in good working order on the generator engine exhaust system. 4. Exterior light fixtures shall be designed or located so that only reflected, non-glaring light is visible from beyond the immediate vicinity of the site, and shall be turned off except when in use by facility personnel. No aircraft warning lighting shall be installed. 5. This permit is issued for a period of ten years, and shall expire on October 17, The applicant has the sole responsibility for renewing this permit before the expiration date. The county will not provide a notice prior to the expiration date. 6. By commencing work allowed by this permit, the applicant agrees to negotiate in good faith with third parties requesting shared use of the facility, and to require no more than a reasonable charge for shared use. 7. Prior to the final inspection by the Building Division, an identification sign for each company responsible for operation and maintenance of facilities at the site, not larger than one square foot, shall be posted at a location from which it can be easily read from outside the perimeter of the communications facility, and shall provide the name, address, and emergency telephone number of the responsible companies. The address assigned to the site by the Planning and Building Services Department shall also be posted. 8. The antennas and supporting structure, shall be inspected every five years, and following significant storm or seismic events, by a structural engineer licensed in the State of California to assess their structural integrity, and a report of the engineer s findings shall be submitted to the Planning and Building Services Department. 9. Prior to commencement of operations, all surplus construction materials and debris, including cleared vegetation, shall be removed from the site to a proper disposal facility. Thereafter the site shall be kept free of refuse. 10. That the access road to the site be maintained on a year round basis in order to provide all season access, and to minimize erosion and drainage damage. 10. In conformance with encroachment permit procedures administered by the Mendocino County Department of Transportation, applicant shall construct and maintain a standard private driveway approach onto Bald Hill Road (CR# 421A), with a minimum width of 10 feet, extending 15 feet from the edge of the County road, with surfacing comparable to that on the County road. 11. A minimum of ten trees, five gallon size or larger, shall be planted and maintained in healthy condition in locations that will provide screening of communication equipment and structures on Bald Hill from locations in Fort Bragg, MacKerricher Park, or along Highway 1. Locations for trees shall be chosen that will not interfere with communications facilities operating on the site. Trees selected shall be indigenous to the area. No herbicides shall be used for site maintenance. 12. If use of the proposed facility is discontinued for a period of one year or more, all parts of the facility not in use, above grade, shall be completely removed from the site, and the site shall be restored to a natural condition.

5 MINUTES PAGE In the event that archaeological resources are encountered on the site, further disturbance in the immediate vicinity of the find shall be halted until all requirements of Chapter of the Mendocino County Code relating to archaeological discoveries have been satisfied. 14. The application along with supplemental exhibits and related material shall be considered elements of this entitlement and compliance therewith shall be mandatory, unless a modification has been approved by the Planning Commission. 15. This permit is subject to the securing of all necessary permits for the proposed development and eventual use from County, State and Federal agencies having jurisdiction. Any requirements imposed by an agency having jurisdiction shall be considered a condition of this permit. 16. The use and occupancy of the premises shall be established and maintained in conformance with the provisions of Title 20 of the Mendocino County Code unless modified by conditions of the use permit. 17. This permit shall be subject to revocation or modification by the Planning Commission upon a finding of any one or more of the following: a. That the permit was obtained or extended by fraud. b. That one or more of the conditions upon which the permit was granted have been violated. c. That the use for which the permit was granted is being conducted so as to be detrimental to the public health, welfare or safety or to be a nuisance. d. That a final judgment of a court of competent jurisdiction has declared one or more of the conditions to be void or ineffective, or has enjoined or otherwise prohibited the enforcement or operation of one or more of the conditions. Any revocation shall proceed as specified in Title 20 of the Mendocino County Code. 18. This permit is issued without a legal determination having been made upon the number, size or shape of the parcels encompassed within the permit boundaries. Should, at any time, a legal determination be made that the number, size or shape of parcels within the permit boundaries are different than that which is legally required by this permit, this permit shall become null and void. 19. Prior to issuance of any permits for new communications facilities, the applicant shall provide an irrevocable letter of credit, bond, certificate of deposit, or other reasonable form of security satisfactory to County Counsel, sufficient to fund the removal of the facility and restoration of the site in the event that the carrier abandons operations or fails to comply with requirements for removal of facilities. 6 MINUTES PAGE 6 4B. U MEADOWS/EDGE WIRELESS Southwest of Hopland Request: Use Permit to install facilities for an additional cellular provider at an existing wireless facility site. Facilities to be added will consist of 9 panel antennas and two microwave antennas mounted on the existing monopole, and a new equipment shelter. Mr. Hudson reviewed the staff report and a memorandum dated September 19, He also noted that the condition regarding a bond in the event that the carrier abandons the facility was overlooked and should be included in the conditions of approval. In response to Commissioner Lipmanson, Ms. Littlefield, Edge Wireless, stated that Edge Wireless wants coverage south of Hopland to the County line and east to the Shokawah Indian Reservation. The public hearing was declared open. Ms. Virginia Meadows, daughter of Berman Meadows who owns the property, stated that her father has tried to contact Edge Wireless to request compensation. She explained that the contract is currently with U.S. Cellular regarding road improvements. She noted that they do not have a contract with Edge Wireless. In response to Commissioner Calvert, Ms. Meadows noted that the road is in good condition. Ms. Meadows also stated that the easement goes through two properties and the road is very steep. The public hearing was declared closed. In conformance with encroachment permit procedures administered by the Mendocino County Department of Transportation, applicant shall, provided they have a legal right to do so, construct and maintain a standard private driveway approach onto County Road 110, to a minimum width of the (10) feet, area to be improved fifteen (15) feet from the edge of the County road, to be surfaced with surfacing comparable to that on the County road.

9 MINUTES PAGE No herbicides shall be used for site maintenance. AYES: Nelson, Barth, Berry, Calvert, Lipmanson, McCowen NOES: None ABSENT: Little 4C. Grading Regulations. Ms. Carre Brown handed out a letter from Mr. Peter Bradford, President of the Mendocino County Farm Bureau. Mr. Hall updated the Commission on the progress the Commission has made on the Draft Grading Regulations and correspondence received since the last hearing. At the October 3, 2002 meeting, Commissioner Calvert agreed to provide alternative language for Section (B). She requested that et seq. be removed from Section (B). The Commission decided to discuss the proposed language for Section (B) at a later date. It was the decision of the Commission modify Section Grading Permit Requirements Subsection (B) Exemptions, Subsection (3) Basements and Footings (6-0; Little Absent) as presented in the Draft Grading Regulations to read: (3) Basements and footings. Excavations below finish grade for basements, footings, retaining walls, or other structures authorized by a valid building permit. This exemption shall not apply to any fill made with the excavated material. This exemption shall not apply to any excavation with an unsupported height exceeding five (5) feet after completion of the structure. It was the consensus of the Commission modify Section Grading Permit Requirements Subsection (B) Exemptions, Subsection (4) Building Pads (5-1; Berry Opposed; Little Absent) as presented in the Draft Grading Regulations to read: (4) Building pads. Grading for building pads, provided the grading is integrated into and regulated under a valid building permit and: (a) (b) (c) (d) (e) (f) the building pad does not exceed ten thousand (10,000) square feet; does not move more than five hundred (500) cubic yards; the existing or finish cut or fill does not exceed three (3) units horizontal to one (1) unit vertical (3H:1V) (33% slope) or five (5) feet in height; is not located in stream setback or riparian corridor; does not obstruct a drainage course; and does not occur during the winter season between October 15 and April 15 It was the consensus of the Commission to revisit the definition of winter season at a later date.

10 MINUTES PAGE 10 RECESS: 12:04 1:37 p.m. Chairman McCowen passed the gavel to Vice-chairman Little for the discussion on the Draft Grading Ordinance. Mr. Peter Bradford, President of the Farm Bureau, reviewed his letter regarding the Agricultural Chapter and CEQA. Commissioner Berry noted that the Draft Grading Ordinance is essentially an Agricultural Grading Ordinance. Commissioner Lipmanson stated that there needs to be more regulations for rural subdivision roads. Sec Roads, Driveways and Parking Areas In response to Commissioner Barth s question as to why the Farm Bureau s proposal deleted the word private in Sec Roads, Driveways and Parking Areas, Mr. Hall noted that County roads are exempt. It was the consensus of the Commission to modify Section Roads, Driveways and Parking Areas (7-0) as presented in the Draft Grading Regulations to read: Unless otherwise required by the County pursuant to a land use permit (i.e. Mendocino County Road Standards as applied through project conditions of approval), private roads, driveways and parking areas shall be designed and constructed in accordance with the standards contained within this chapter and this section. Where any standards within this section conflict with other sections, those other sections of this chapter shall prevail. The Commission discussed the differences between Best Management Practices versus the Handbook for Forest and Ranch Roads, by William A. Weaver, Ph.D. Mr. Hall noted that the Handbook was designed to cover only ranch roads not rural subdivision roads. The Commission questioned if a list of references for Best Management Practices could be included in the Draft Grading Regulations. Mr. Ben Kageyama, Department of Transportation, noted that the County is working on developing County Road Standards. Lengthy discussion ensued over California Department of Forestry, local fire department and County Department of Transportation road standards. It was the consensus of the Commission to modify Section Roads, Driveways and Parking Areas, Subsection (A) Residential Roads Compaction Requirements (7-0) as presented in the Draft Grading Regulations to read: (A) Residential Roads Compaction Requirements. Private roads Roads serving residences, driveways, and parking areas shall be designed and constructed to relative compaction of not less than 90%. California Test Method No. 231 or the latest Caltrans test method may be used in lieu of the standards contained in Section (B)(5).

11 MINUTES PAGE 11 It was the consensus of the Commission to discuss Section Roads, Driveways and Parking Areas, Subsection (B) Non-residential Roads (7-0) at a later date. The Commission did discussed that language in Section Roads, Driveways and Parking Areas, Subsection (B) Non-residential Roads to possibly change may to shall and add or equivalent or better BMP. It was the consensus of the Commission to adopt Section Roads, Driveways and Parking Areas, Subsection (C) Fire Safe Regulations (7-0) as presented in the Draft Grading Regulations to read: (C) Fire Safe Regulations. Roads and driveways may be subject to California Department of Forestry and Fire Protection (CDF) Fire Safe Regulations. It was the consensus of the Commission to modify Section Roads, Driveways and Parking Areas, Subsection (D) Preparation of Plans by a Civil Engineer (7-0) as presented in the Draft Grading Regulations to read: (D) Preparation of Plans by a Civil Engineer. In all cases, at the discretion of the Permitting Agency, where design and Where construction of private roads, driveways and parking areas may pose a risk to public health and/or safety, improvement plans prepared by a civil engineer may be required at the discretion of the Permitting Agency. It was the consensus of the Commission to adopt Section Roads, Driveways and Parking Areas, Subsection (E) Stream Crossings (7-0) as presented in the Draft Grading Regulations to read: (E) Stream Crossings. Stream crossings in new road construction shall be minimized. Off site drainage patterns shall be retained and runoff shall be filtered by use of vegetation, rock or other erosion control materials before delivery at non-erosive velocities and volumes into natural watercourses. It was the consensus of the Commission to review the term stream when the Commission reviews the watercourse definitions. The Commission discussed at length if language should be included regarding the 100-year flood event. It was the decision of the Commission to modify Section Roads, Driveways and Parking Areas, Subsection (F) Storm Water Runoff (4-3; Lipmanson, McCowen, and Barth - Opposed) as presented in the Draft Grading Regulations to read: (F) Storm Water Runoff. A natural stream or ditch Ditch relief or stream conduit shall be of sufficient size as determined by a Qualified Professional so that all storm water runoff in its tributary area shall be conveyed with no more than nuisance damage to improvements and with no excessive increased erosion and sedimentation. Flood flows or emergency flows caused by conduit failure should be accommodated by providing additional surface routes (and/or detention ponds, critical dips, rock slope protection, etc.), which deliver runoff at non-erosive velocities into natural watercourses. Chairman McCowen stated that culverts should be designed to accommodate a 100-year flood event unless a Qualified Professional determined that a lesser standard was adequate.

12 MINUTES PAGE 12 Commissioner Berry was excused at 3:16 p.m. RECESS: 3:18 3:31 p.m. Commissioner Lipmanson felt that Maintenance should not be included under exemptions. He felt that any road maintenance should not be exempt. Mr. Hall noted that the County has no right to go on private property and he noted that education is needed to help the general public. Matters from Staff. None. 6. Matters from Commission. Commissioner Barth stated that she donated a video to Planning and Building Services regarding road maintenance. In response to Commissioner Lipmanson, Chairman McCowen noted that the fiber optic cable issue would be discussed at the November 21, 2002 hearing. Chairman McCowen reviewed an article in the Press Democrat regarding the William s Communication Company. Commissioner Calvert expressed interest on placing a discussion regarding Caltrans Daylight Headlight proposal on the next agenda. Mr. Hall noted that he has composed a letter requesting that the number of signs be reduced. He also noted that he would try to have Caltrans attend a Planning Commission meeting to discuss the proposal. 7. Approval of Minutes. None. 8. Matters from Public. No one was present from the public who indicated a desire to address the Commission. 9. Adjournment. Upon motion by Commissioner Calvert, seconded by Commissioner Nelson, and unanimously carried (6-0; Berry Absent), IT IS ORDERED that the Planning Commission hearing adjourned at 4:10 p.m.
