2 296 Hearing State Corporation Commission Notice of Hearing on Proposed Administrative Regulations A public hearing will be conducted at 10 a.m. Tuesday, May 30, in the first floor hearing room of the State Corporation Corporation Commission, 1500 S.W. Arrowhead, Topeka, to consider the adoption of the proposed revision of the Kansas motor carrier regulation K.A.R a. A summary of the regulation and its economic impact follows: K.A.R a. Hours of service. Prior to April 29, 2005, all regulations regarding motor carrier safety were encompassed in K.A.R On April 29, 2005, K.A.R was amended and the various safety regulations contained in K.A.R were separated into 13 new regulations, K.A.R a K.A.R m. The Federal Motor Carrier Safety Administration (FMCSA) has recently determined that the state is not in compliance with the Federal Motor Carrier Safety Regulations (FMCSR) by not adopting 49 CFR Part 395, specifically Part 395.8(e) as written. As such, the state is in jeopardy of losing millions of dollars in Motor Carrier Safety Assistance Program (MCSAP) funding and Kansas highway funds. 49 CFR Part 395.8(e) states: Failure to complete the record of duty activities of this section or , failure to preserve a record of such duty activities, or making of false reports in connection with such duty activities shall make the driver and/or the carrier liable to prosecution. If a state fails to adopt the required federal regulations, identical to or within the tolerance guidelines for the FMCSRs and identical to the hazardous material regulations (HMRs), but enacts a law or regulation that results in an incompatible rule, the state will not be eligible for Basic Program Funds nor Incentive Funds. Simply, the state is at risk of losing a large amount of federal funding and programming if the state is found to be out of compliance with federal regulations. The commission anticipates no economic impact the implementation of this regulation. The commission anticipates impact on other governmental agencies or private entities and individuals because failure of the commission to be in compliance with FMCSRs means the state loses millions of dollars in federal grants and at least 40 full-time equivalent (FTE) employees that are funded MCSAP. Due to the nature of the regulation, the proposed revision of the regulation constitutes the least expensive and least intrusive means by which to protect the public interests in this area. This 60-day notice of the public hearing shall constitute a public comment period for the purpose of receiving written public comments on the proposed rule and regulation. No Kansas Development Finance Authority Notice of Hearing A public hearing will be conducted at 8:30 a.m. Thursday, April 6, in the conference room in the office of the Kansas Development Finance Authority, 555 S. Kansas Ave., Suite 202, Topeka, on the proposal for the KDFA to issue Housing Development Revenue Bonds in an amount not to exceed $8.5 million for Senior Homes of Kansas LLC, a limited liability corporation, or an affiliated entity (the developer). The bonds will be issued, pursuant to K.S.A et seq., to finance the costs of construction of a 96-unit affordable housing community for seniors to be operated as Arbor Valley Apartments and located in Topeka, Shawnee County, Kansas, and related improvements and equipment to be used for public housing purposes (the project). The bonds, when issued, will be a limited obligation of the KDFA and will not constitute a general obligation or indebtedness of the state of Kansas or any political subdivision thereof, including the KDFA, nor will the bonds constitute an indebtedness for which the faith and credit and taxing powers of the state of Kansas are pledged. The bonds will be payable solely from amounts received from the developer, the obligation of which will be sufficient to pay the principal of, interest and redemption premium, if any, on the bonds when they become due. All individuals who appear at the hearing will be given an opportunity to express their views, and all written comments previously filed with the KDFA at its offices at 555 S. No Department of Health and Environment Notice of Available Grant Funding The Kansas Department of Health and Environment announces the availability of funds to be distributed to primary care providers and/or health care clinics for the purpose of improving the quality of care for adult patients with diabetes. Grants will be awarded to up to 15 primary care providers (family practice or internal medicine or combination thereof) and/or health care clinics that are interested in improving the quality of care for their adult patients with diabetes. A total of $10,000 will be available to be awarded to successful applicants. Interested applicants should contact Kate Watson at (785) to obtain more information. The closing date for receipt of applications by KDHE is April 3. A pre-application conference call will be held from noon to 1 pm. No Department of Health and Environment Request for Comments The Kansas Department of Health and Environment is soliciting comments regarding a proposed air quality construction permit. Coffeyville Resources Refining & Marketing, LLC has applied for an air quality construction permit in accordance with the provisions of K.A.R to modify the refinery in Coffeyville by making several modifications to process units that allow the facility to increase production. Emissions of particulate matter (PM), PM equal to or less than 10 microns in diameter (PM 10 ), volatile organic compounds (VOCs), oxides of nitrogen (NOx), sulfur oxides (SOx) and carbon monoxide (CO) were evaluated during the permit review process. Coffeyville Resources Refining & Marketing owns and operates a petroleum refinery located at 400 N. Linden, Coffeyville. A public comment period has been established until April 24 to allow citizens the opportunity to express any concerns or comments they may have about this permitting action. A public hearing has been tentatively scheduled by KDHE at 7 p.m. April 25 at the Coffeyville Community College, Wilson Hall East, ITV Conference Room, 400 W. 11th, Coffeyville, to receive comments on the proposed issuance of the draft air quality construction permit. No Department of Health and Environment Notice of Hearing on Proposed Administrative Regulations The Kansas Department of Health and Environment, Division of Environment, Bureau of Environmental Field Services, will conduct a public hearing to consider the proposed revisions to the Kansas Surface Water Quality Standards, K.A.R g, including revisions to the Kansas Surface Water Register. The hearing will be held via video conferencing at 2 p.m. Thursday, May 25, at the following locations: KDHE Northwest District Office, 2301 E. 13th, Hays; KDHE North Central District Office, 2501 Market Place, Suite D, Salina; KDHE Northeast District Office, 800 W. 24th, Lawrence; KDHE Southwest District Office, 302 W. A public availability session will be held at 1 p.m. prior to the public hearing to provide persons an opportunity to review the findings of use attainability analyses (UAAs) used to establish designated uses. If an alternate hearing location is necessary, the hearing will be held in Room 530 of the Curtis State Office Building with an informational meeting being held prior to the hearing at 1 p.m. Following is a summary of the proposed amendments: K.A.R g is the classification and use designation section of the Kansas Surface Water Quality Standards. Designated uses of surface waters are listed in the Kansas Surface Water Register, which is adopted by reference in K.A.R g. The register identifies major classified streams, lakes and wetlands and the uses that are existing or attainable. In the period of April 1-October 31, 2004, 658 stream segments and 89 lakes were evaluated by a UAA to determine the appropriate use designation. Seventy-nine stream segments are proposed to be removed from classification, 352 stream segments are proposed as secondary contact recreation, and 223 stream segments are proposed as primary contact recreation. Two stream segments are proposed for expected aquatic life, and four stream segments have been rerouted and combined to form one segment. Eighty-seven lakes are proposed for irrigation, livestock watering, domestic water supply, industrial water supply and groundwater recharge, and two lakes are proposed for primary contact recreation and food procurement. There are no additional costs of compliance resulting from these changes in recreational use designations. The department estimates an annual cost to perform 500 recreational UAAs as required by K.S.A. 82a-2004 and amendments thereto to be $200,000 per year. Currently, this cost is funded by the State Water Plan and state general fund. The time period between the publication of this notice and the scheduled hearing constitutes a 60-day public comment period for the purpose of receiving written public comments on the proposed regulatory action. No Department of Health and Environment Request for Comments The Kansas Department of Health and Environment has received a permit modification request to expand the Franklin County construction and demolition landfill currently operating under KDHE Permit 159. The landfill is located at 3323 Osborne Terrace, east of Ottawa in the Northwest Quarter of Section 28 and the Northeast Quarter of Section 29, Township 16 South, Range 20 East. Only construction and demolition wastes, as defined by Kansas statutes, would be allowed for disposal into the landfill. The landfill s proposed expansion will increase the disposal area from approximately 5.1 acres to 22.6 acres. With an estimated capacity of 463,000 cubic yards, the expanded construction and demolition landfill s estimated life is about 17 years. The Franklin County Commission has certified that the application described herein is consistent with the county s solid waste management plan and local land use restrictions or zoning. KDHE has reviewed the application and found it to be in conformance with state solid waste statutes and regulations. KDHE is providing public notice of its intent to approve Franklin County s proposed landfill expansion. However, a final decision to approve the expansion has not been made, and KDHE will consider information gathered during the public comment period before making a final decision.
