34 3c page 1 Agenda Item Staff Report To: From: Initiated by: Subject: Honorable Mayor and Members of City Council For the meeting of 3/12/19 Blaine Michaelis, City Manager Michael O Brien Revision to the City s Bingo Permit Application and Amend Municipal Code Chapter 5.94 of Title 5 SUMMARY To adopt a revised version of the City s Bingo Permit for Charitable Purposes application and amend Municipal Code Chapter 5.94 of Title 5. BACKGROUND Chapter 5.94 of the City of San Dimas Municipal Code, which governs the City s Bingo for charitable purposes, was last amended on May 9, Bingo games may be conducted within this City by organizations licensed by the City and which are exempted from the payment of the bank and corporation tax by Sections 23701a,b,d,e,f,g,k and w. The current fee for a bingo permit is $25 which mirrors the filing fee for each application for exemption filed with the Franchise Tax Board. From time to time changes are made to State of California Tax Code which governs Bingo gaming. Due to such changes revisions to the Municipal Code have become necessary along with necessary adjustments to the process and handling of Bingo Permit applications to be performed more efficiently.

35 3c page 2 Revision of Chapter 5.94 of Title 5 Page 2 3/26/19 DISCUSSION/ANALYSIS The City s existing Bingo for Charitable Purposes Municipal Code does not reference Sections k or w of the Revenue and Taxation Code which pertain to the tax filing requirements for Religious or Apostolic Corporations and the eligibility of Bingo games for veteran organizations defined by Section 501(c)(19) of the Internal Revenue Code. Those Revenue and Taxation codes have been included in the proposed revision of the City of San Dimas Municipal Code Chapter The revised ordinance also proposes a shift in the responsibility of processing the Bingo application and distributing the Permit from the City Clerk s office to the Finance Division per section Revised code section (F) includes revised language that clarifies the eligible uses for profits derived from a bingo game which includes the following: (1) Such proceeds may be used for prizes. (2) A portion of such proceeds, not to exceed 20 percent of the proceeds before the deduction for prizes or $2, per month, whichever is less, may be used for rental of property; overhead, including the purchase of bingo equipment and administrative expenses; and the hiring of security personnel. (3) Such proceeds may be used to pay permit fees. Finally the revised ordinance clarifies that no organization authorized by this article to play bingo shall conduct bingo games between the hours of 10:00 P.M. and 7:00 A.M. 36 Attachment A page 1 ORDINANCE 1266 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN DIMAS, COUNTY OF LOS ANGELES, AMENDING CHAPTER 5.94 (BINGO FOR CHARITABLE PURPOSES) OF TITLE 5 OF THE SAN DIMAS MUNICIPAL CODE WHEREAS, non-profit organizations provide important and essential educational, philanthropic, and social services to the community of the City of San Dimas ("City"); WHEREAS, many such services would not be available if non-profit organizations did not provide them; WHEREAS, there is a need to provide methods of fundraising to non-profit organizations to enable them to provide these essential services; WHEREAS, historically, non-profit organizations in the City have used charitable bingo games as one of their key fundraising strategies to promote the mission of the organization; WHEREAS, the California Legislature recently amended state law regarding "traditional" bingo games; WHEREAS, the City Council desires to amend the San Dimas City Code to reflect the recent changes regarding traditional bingo, and to permit remote caller bingo games in the City. WHEREAS, all other prerequisites to the adoption of this Ordinance have occurred. NOW, THEREFORE, the CITY COUNCIL of the CITY OF SAN DIMAS, County of Los Angeles does hereby ordain as follows: Section 1. Findings. The City Council finds that the above Recitals are true and correct, and are incorporated herein by reference. Section 2. Chapter 5.94 of the San Dimas Municipal Code is hereby amended to read, in its entirety, as follows:

37 Attachment A page 2 Ordinance 1266 Page 2 Amend Chapter 5.94 of the Municipal Code Bingo for Charitable Purposes Chapter 5.94 BINGO FOR CHARITABLE PURPOSES Bingo Game Definition. As used in this chapter, Bingo means a game of chance in which prizes are awarded on the basis of designated numbers or symbols on a card which conform to numbers or symbols selected at random Bingo Game Authorized. Bingo may be lawfully played in the City of San Dimas pursuant to the provisions of Section 19, Article IV of the State Constitution and Penal Code and , The game of bingo may be played within the city, but only under the conditions set forth in the Penal Code and this chapter; to the extent it is consistent with State Law Permit Required. Bingo games may be conducted within this City by organizations licensed by the City and which are exempt from the payment of the bank and corporation tax by Sections (a), (b), (d), (e), (f), (g), (k), (l) or (w) of the Revenue and Taxation Code, and by mobile home park associations, senior citizens organizations, and charitable organizations affiliated with a school district provided that the proceeds of such games are used only for charitable purposes; and provided further that a permit obtained as provided for herein. (Ord , 1977) Application. The application shall be upon a form prescribed by the Finance Division, shall be personally signed by three officers of the non-profit charitable organization or by a person specifically authorized for that purpose by the organization, be accompanied by a copy of the articles of incorporation or other evidence of the charitable nature of the organization and a certificate issued by the State Franchise Tax Board and the United States Collector of Internal Revenue certifying to the exempt status of the non-profit organization Permit Fee. The application shall be accompanied by a non-refundable permit fee in the amount of $25.00 which is the amount determined by the City Council to be the actual cost of verifying the information in the application and issuing the permit. The permit shall not be issued until the Finance Division has verified the facts stated in the application and has determined that the applicant meets the requirements of this chapter and is entitled to the permit.

38 Attachment A page 3 Ordinance 1266 Page 3 Amend Chapter 5.94 of the Municipal Code Bingo for Charitable Purposes Annual Permit Required. Any permit issued pursuant to this chapter shall be subject to the conditions contained in Section of the Penal Code and this chapter and shall be valid for a period of one year. The permit can only be renewed upon the filing of a new application and the payment of the permit fee Conditions. Each permit issued pursuant to this chapter shall be issued subject to the following conditions: A. No minor shall be allowed to participate in any bingo game. B. A bingo game shall be only conducted on property owned or leased by the non-profit charitable organization which holds a valid permit issued pursuant to this chapter and which property is used by such organization for an office or for the performance of the purposes for which the organization is organized. The property shall have been owned or leased and occupied by the non-profit charitable organization for a period of at least six months prior to the date of the application for the permit. C. All bingo games shall be open to the public and not limited to the members of the nonprofit charitable organization. D. A bingo game shall be operated and staffed only by members of the non-profit charitable organization which holds a valid permit issued pursuant to this chapter. No member of the non-profit charitable organization shall receive a profit, wage or salary from any bingo game. Only the organization holding a valid permit to conduct a bingo game shall operate such game or participate in the promotion, supervision or any other phase of such game. E. No individual, corporation, partnership or other legal entity except the organization holding a valid permit issued pursuant to this chapter is authorized to conduct a bingo game or to have a financial interest in the conduct of such a game. F. With respect to organizations exempt from payment of the bank and corporation tax by Revenue and Taxation Code 23701d, all profits derived from a bingo game shall be kept in a special fund or account and shall not be commingled with any other fund or account. Such funds may be expended only for the use and benefit of such charitable organization, except as follows: (1) Such proceeds may be used for prizes. (2) A portion of such proceeds, not to exceed 20 percent of the proceeds before the deduction for prizes or $2, per month, whichever is less, may be used for rental of property; overhead, including the purchase of bingo equipment and administrative expenses; and the hiring of security personnel. (3) Such proceeds may be used to pay permit fees. At the time of the application for the renewal of a permit, the Finance Division may require the applicant to file with him a copy of an audit of the special

39 Attachment A page 4 Ordinance 1266 Page 4 Amend Chapter 5.94 of the Municipal Code Bingo for Charitable Purposes fund or account prepared by a certified public accountant showing the gross revenue received from all bingo games, the costs incurred in the operation of the games including the amounts paid out in connection therewith, the amount deposited in the special fund and any expenditures made from the special fund. No renewal permit shall be issued until a copy of the audit report is filed with the Finance Division if the filing of such a report is required. G. No person shall be allowed to participate in a bingo game unless the person is physically present at the time and place in which the bingo game is being conducted. H. The total value of prizes awarded during the conduct of any bingo game shall not exceed $ in cash or kind or both for each separate game which is held. I. The non-profit charitable organization to which a permit to operate a bingo game is issued pursuant to this chapter shall be responsible to see that the conditions contained in this chapter are complied with by the organization, its officers and members. Any violation of one or more of the conditions of the permit shall constitute cause for its revocation by the City Council. If requested to do so by the organization, the City Council shall hold a public hearing before revoking any permit issued pursuant to this chapter. (Ord , 1976) J. The non-profit charitable organization to which a permit is issued shall not be allowed to conduct bingo games more frequently than one time in any seven-day period unless the City Manager approves a special permit to do so. Said special permit shall only be issued if the City Manager determines that: 1. a similar request for a special permit was not approved within the preceding 12- month period; and 2. the occasion for which the special permit is requested is part of a special event of the permittee; and 3. the special permit, if issued, may provide for the conduct of bingo games on not more than three consecutive nights. (Ord , 1978); and K. No organization shall conduct bingo games between the hours of 10:00 p.m. and 7:00 a.m. SECTION 3. EFFECTIVE DATE AND PUBLICATION. This Ordinance shall take effect 30 days after its final passage, and within 15 days after its passage the City Clerk shall cause it to be published in the Inland Valley Daily Bulletin, a newspaper of general circulation (GC 40806) in the City of San Dimas hereby designated for that purpose.

69 5a page 1 CITY OF SAN DIMAS MEMORANDUM DATE: March 26, 2019 TO: FROM: Mayor and City Council Community Development Department SUBJECT: Annual Housing Report to HCD for Housing Element On April 1 of each year the City is required to file with State Housing & Community Development an Annual Report on progress with the adopted Housing Element. Excerpts from the Report are attached. Due to changes in the Report format not all tables are included in the packet but will be available under separate cover. It includes housing construction (permits issued in 2018) information and an update of each of the 16 programs adopted with the Housing Element. In 2017 and 2018 there have been considerable changes to all aspects of State Housing law. Preeminently those changes have changed the RHNA planning targets to production requirements, reduced a City s ability to apply discretion to residential development projects, increased the Annual Report requirements, required proactive management of the HE site inventory, increased HCD purview over HE and Annual Reports and increased City obligations. The City is currently on the SB 35 list requiring streamlined processing of certain qualifying affordable housing projects. Pending 2019 legislation appears ready to further reduce local control over housing related land use and potentially withhold transportation funds if production requirements are not met. San Dimas has never come close to the annualized targets in any year or any income category. While Staff is proactively participating in the RHNA process for the next HE cycle, it is very likely that our production requirements will increase and the City will lose at least half of the land currently zoned for low/very low (i.e. 30 unit per acre default density zoning). An update is planned for the April 1 Spring Retreat.

Seven new residential building permits issued (all above moderate) [NOTE: HE production requirements are 121 Very Low; 72 Low; 77 Moderate; 193 Above Moderate 463 TOTAL. Through 2018 we have issued permits for 36 above moderate units and 1 moderate unit.] 2. At Risk Housing Sunnyside covenants expire in 2021 (34 Low & VL units at risk with covenants expiring December 31, 2021) 3. Second units - Ordinance updated; more legislation expected in 2019 requiring further changes 4. Single Family Rehab 15 units assisted through CDBG Program (3 Extremely Low, 7 Low, 5 Moderate) 5. Energy Conservation Through Green Building 363 participants in the HERO Program. 6. Mobile home Park Preservation Accord in effect until 2020; 24 residents assisted with rehab grants (8 Extremely Low, 11 Low & 5 Moderate). 18 Charter Oaks residents provided rental assistance.
