I am today seeking information on key offices at the agency that are presently led by senior officials who have long records of working on behalf of the polluters they are now charged with overseeing. 1 These officials are David Dunlap, a former Koch Industries official, and now the Deputy Assistant Administrator for Research and Development in the EPA's Office of Research and Development, and Bill Wehrum, a former coal lobbyist, who is now the Assistant Administrator for the Office of Air and Radiation. ' The agency's Office of Research and Development (ORD), is "the scientific research arm of [the] EPA, whose leading-edge research helps provide the solid underpinning of science and technology for the Agency" and "provides the foundation for credible decision-making to safeguard huiilfln health and ecosystems from environmental pollutants." 2 The Office of Air and Radiation (OAR) "develops national programs, policies, and regulations for controlling air pollution and radiation exposure" and "is responsible for administering the Clean Air Act, the Atomic Energy Act, the Waste Isolation Pilot Plant Land Withdrawal Act, and other applicable environmental laws."3 Both of these offices serve a crucial role in supporting the EPA's mission to "protect human health and the environment."4 However, the current senior leadership of both of these offices appear to be severely compromised by their previous work on behalf of polluters who continue to have significant interests at stake in EPA actions. 2 Concerns about Mr. Dunlap's Conflicts of Interest Mr. Dunlap joined the Agency as Deputy Assistant Administrator of the Office of Research and Development in September 2018, and has played a prominent role in the "research that will shape how the government regulates a class of toxic chemicals contaminating millions of Americans' drinking water." 5 But Mr. Dunlap has an extraordinary conflict of interest: prior to joining the agency, he worked as the Director of Policy & Regulatory Affairs at Koch Industries for eight years. 6 In this role, Dunlap was considered the company's "lead expert on water and chemical regulations" and sought to help private entities "limit regulatory restrictions and liability for cleanups." 7 Public disclosures in 2018 indicate that Koch Industries spent at least $90,000 on policies affecting chemical regulations, 8 and decisions made by Mr. Dunlap at the EPA have "major financial repercussions for his former employer." 9 Since joining the EPA, Dunlap has played a key role in Agency decision-making on the regulation of per- and polyfluoroalkyl substances (PFAS), including perfluorooctanoic acid (PFOA) and perfluorooctanesulfonic acid (PFOS). Categorized as "contaminants of emerging concern," these toxic compounds have been found to have a "toxicity, mobility and bioaccumulation potential... 3 Recently released documents have indicated that Mr. Dunlap was involved in at least nine PFAS related meetings in his first six weeks at the EPA. 15 Two weeks ago, the PFAS Action Plan 16 that was formed based on the ORD's research-was released. This plan lacks concrete, enforceable steps and a clear deadline for a regulatory determination, which would allow the agency to delay rulemaking for years. 17 As a result, Georgia Pacific and other companies that use or have used these chemicals can stand to benefit. Concerns about Mr. Wehrum's Conflicts of Interest Mr. Wehrum was nominated as Assistant Administrator of the Office of Air and Radiation in September 2017, and confirmed two months later. Prior to his nomination, Mr. Wehrum spent ten years as a partner at Hunton Andrews Kurth, a law firm that represents clients that include "most major industrial groups that are affected by air quality regulations" and raises frequent court challenges to EPA regulations. 18 He served as the firm's head of administrative law, representing a number of polluting companies, including an entity called the Utility Air Regulatory Group (UARG). Documents released to Politico reveal that this group includes "twenty-five power companies and six industry trade groups [that] agreed to pay the firm a total of $8.2 million in 2017 alone...less than three months before Trump tapped Wehrum for his EPA post." 19 Nearly a third of the group's funding from power companies came from just three organizations: Duke Energy Corporation ($726,108), Southern Company Services ($663,453), and American Electric Power ($555,395).20 These documents also indicated that, just months before his nomination by President Trump, Mr. Wehrum met with the UARG in June 2017 to discuss how to "limit the adverse effects of such overly-broad Agency actions" taken during the Obama Administration.21 Since joining the agency, Mr. Wehrum has taken numerous actions that appear to align with his previous clients' priorities rather than the interests of the public. 4 from power plants. 23 The EPA proposed this change on December 27, 2018, just a month after Mr. Wehrum was confirmed. The proposal cites the Office of Air Quality Planning and Standards, an office that falls under OAR. 24 The Washington Post also reported that - without consulting with ethics officials - Mr. Wehrum met with some of his former clients in December 2017 to discuss the agency's rollback of environmental rules. 25 Days later, Mr. Wehrum also participated in the drafting of an agency memo on "New Source Review Preconstruction Permitting Requirements." The findings of this memo -which concluded that the agency "would not be 'second guessing' companies' projections about how much their expanded operations might increase pollution" could benefit the litigation efforts of DTE Energy Company, another one of his former clients. 26 Conclusion I have numerous concerns about Mr. Dunlap's and Mr. Wehrum's compliance, or lack thereof, with both the spirit and letter of federal ethics requirements. Despite his years of work in the chemical industry and on behalf of the Koch Industries, Mr. Dunlap's ethics agreement only bars him from "participating in any particular matter involving specific parties" related to Koch Industries and formaldehyde related issues. 27 This means that despite Koch Industries extensive legal and financial interests in EPA decisions about PFAS chemicals, Mr. Dunlap is not prohibited from involvement in EPA PFAS policies that could have significant impacts on the company. In Mr. Wehrum's case, he has recused himself from decisions related to Duke Energy Corporation, Dominion Research Services, Inc., and Salt River Project but not from decisions related to any of the other UARG member companies. 28 He has wiggled through narrow loopholes by asserting that UARG's status as a "legal entity" means that he worked on behalf of the group and not its individual members. 29 In addition, while federal regulations prevent Mr. "\. 5 Wehrum from working with his former clients, he is still able to work directly on regulations and policies - like weakening clean air law policies and enforcement - that could benefit these former clients. On January 28, 2017, the Trump Administration announced Executive Order 13770, which aims to minimize conflicts of interest amongst executive branch appointees. 30 However, the White House has repeatedly weakened this order by granting ethics waivers to former lobbyists and corporate lawyers. 31 As of January 24, 2019, Mr. Dunlap and Mr. Wehrum have not received any such waivers. 32 Despite his pledge to "drain the swamp," President Trump has expanded the influence of the fossil fuel industry under his Administration by nominating and appointing numerous former lobbyists and corporate advocates to senior positions at the EPA. When individuals like Mr. Dunlap and Mr. Wehrum are put into positions that provide them with the power to influence environmental policies and impact the lives of millions of Americans, it is clear that this Administration cares more about serving the fossil fuel industry than it does about the health and wellbeing of the American people. I request that you answer the following questions by March 12, Questions regarding Mr. Dunlap 1. Did Environmental Protection Agency ethics officials make any ethics determinations regarding Mr. Dunlap's participation in meetings, decisions, or any other actions on the following topics or companies? a.
