Ferguson, County Counsel RE: RESOLUTION AUTHORIZING THE COUNTY EXECUTIVE TO ACCEPT FUNDING FROM THE U.S. DEPARTMENT OF JUSTICE, BUREAU OF JUSTICE ASSISTANCE FOR THE STATE CRIMINAL ALIEN ASSISTANCE PROGRAM. WHEREAS, the Atlantic County Department of Public Safety desires to accept federal funding to reimburse the County for costs associated with the incarceration of undocumented criminal aliens, and WHEREAS, the U.S. Department of Justice, Bureau of Justice Assistance, has funding available for this purpose. NOW, THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders of the County of Atlantic that: 1. The County Executive is hereby authorized to accept a grant from the U.S. Department of Justice, Bureau of Justice Assistance, for funding in the amount of $124,553.00, for reimbursement of costs associated with the incarceration of undocumented criminal aliens for the period commencing July 1, 2016 through June 30, 2017, pursuant to the State Criminal Alien Assistance Program. BOX 1149, PLEASANTVILLE, NJ WHEREAS, an emergency affecting the public health, safety and welfare requires the County to enter into an agreement with Rich Fire Protection for the installation of a new fire sprinkler system in the youth shelter located at 201 Shore Road (rear), Northfield, NJ, and WHEREAS, pursuant to a November 1, 2018 lease agreement Center for Family Services (hereinafter "CFS") leases and occupies the first floor of the building for the operation of a youth shelter, and WHEREAS, on December 20, 2018 the City of Northfield Building Department notified the County that it will not issue a Certificate of Occupancy for the leased youth shelter space unless and until a new fire sprinkler system is installed, and WHEREAS, there is an immediate need for these services as a result of the lessee being unable to actively use the space until the new sprinkler system is installed, and WHEREAS, the failure to have fully functioning fire sprinkler system in the youth shelter could cause a health and safety threat to the occupants of the youth shelter, and I, Sonya G. 9 43 WHEREAS, the County obtained quotes from two (2) vendors with Rich Fire Protection being the lowest responsive bidder, and WHEREAS, the Director of Facilities Management has certified to the purchasing agent the surrounding facts, and that an emergency existed, and WHEREAS, pursuant to LPN of the Local Finance Board, the provisions of the Pay to Play law, N.J.S.A. 19:44A are deemed waived with respect to the award of emergency contracts pursuant to the requirements of the Local Public Contracts Law, and WHEREAS, the County of Atlantic's Qualified Purchasing Agent, pursuant to N.J.S.A. 40A: 11-6, being satisfied that an emergency existed, recommends a contract be awarded to Rich Fire Protection. The County Executive is hereby authorized to enter into a professional services agreement with Deer Oaks EAP Services, LLC, to provide an employee assistance program for the period beginning January 1, 2019 and ending December 31, 2019 for an amount not to exceed $25, This contract is awarded without competitive bidding under the provisions of the Local Public Contracts Law, N.J.S.A. 40A:ll-5(l)(a), because the services to be provided are to be performed by a person who is authorized by law to practice a recognized profession, whose practice is regulated by law, and the performance of which services requires knowledge of an advanced type in a field of learning acquired by a prolonged formal course of specialized instruction and study. 3.
