5 Date: 12/13/2018 To: John Copeland, Chairman of the Wyoming County Public Safety Committee From: Wyoming County residents concerned about losing rights Subject: The loss of Constitutional, Civil and Natural Rights Dear Chairman Copeland and all Public Safety Committee members: A group of Wyoming County residents has become increasingly concerned over the loss of Constitutional, Civil and Natural Rights in New York State. The New York State Legislature and Governor s Administration have demonstrated a willingness and the ability to callously violate many citizens right to free speech; the right to be secure in their persons, houses, papers and effects; the right to keep and bear arms; the right to Life, Liberty and Property; the right to due process; the right to equal protection under the law. The violations of basic rights that we are referring to revolve around the right of private firearm ownership and possession, as codified in the Second Amendment of the US Constitution and in New York State Civil Rights Law. Our rural communities understand the history, heritage and importance of this essential aspect of our founding documents. We also understand and honor the incredible sacrifices made by countless brave American men and women throughout our history in securing and preserving our freedoms. If we ignore the repeated and intensifying attacks on our rights, not only do we diminish the sacrifices of the past, we also foolishly deny our posterity the many blessings of liberty. Furthermore, if we overlook any occurrence of injustice we inadvertently condone it. With this in mind, we respectfully request that the Public Safety Committee carefully consider this resolution and move to pass it on to the full Wyoming County Board of Supervisors for adoption. You will notice that this proposed resolution contains significant language lifted directly from the February 12 th, 2013 resolution passed by the Wyoming County Board of Supervisors as they stood strongly with approximately 52 other counties across New York State opposing many aspects of the NY S.A.F.E. Act. Our group is honored by the opportunity to present this carefully crafted document and to work with the Public Safety Committee should any modifications be necessary. As of this date, Niagara and Genesee Counties have passed similar resolutions and other WNY Counties are considering doing so as well. In closing, we extend our most sincere appreciation for your service to our communities and we truly value a strong and productive working relationship with our locally elected officials. XX-XXXX (DATE) By Mr. Copeland, Chairman of Public Safety Committee: OPPOSING INFRINGEMENTS ON THE RIGHTS OF LEGITIMATE FIREARM OWNERS WHEREAS, Members of the Wyoming County Board of Supervisors, being elected to represent the people of the sixteen towns of Wyoming County, are duly sworn by their oath of office to uphold the Constitution of the United States and the New York State Constitution and laws, including New York State Civil Rights law; and WHEREAS, The right of the people to keep and bear arms is guaranteed as an individual right under the Second Amendment to the United States Constitution; and WHEREAS, The New York State Civil Rights Law Article 2 Section 4 (Right to keep and bear arms) clearly states; A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms cannot be infringed ; and WHEREAS, The right of the people to keep and bear arms for defense of life, liberty, and property is regarded as an inalienable right of the people of Wyoming County; and WHEREAS, The Wyoming County Board of Supervisors has gone on record opposing legislation which infringes upon the right of the people to keep and bear arms; and WHEREAS, There are numerous Bills in the NYS Legislature under the guise of gun control that if passed would also violate a citizen s right to free speech; the right to be secure in their persons, houses, papers and effects; the right to Life, Liberty and Property; the right to due process; and the right to equal protection of the law; now therefore BE IT RESOLVED, that the Wyoming County Board of Supervisors stands in strong opposition to any and all legislation that would intentionally or non-intentionally violate the rights of lawful citizens that are guaranteed in the Constitution, the supreme law of the land; and be it FURTHER RESOLVED, that the Wyoming County Board of Supervisors considers such bills, legislation and laws to be egregious and beyond lawful legislative authority granted to our State representatives; and be it FURTHER RESOLVED, that a copy of this resolution be sent to President Donald Trump, Vice President Michael Pence, Governor Andrew Cuomo, United States Senators Charles Schumer, and Kirsten Gillibrand, Congressman Chris Collins, NYS Senator Patrick Gallivan, NYS Senate Majority Leader Andrea Stewart- Cousins, NYS Senate Minority Leader John J. Flanagan, NYS Assemblyman David DiPietro, NYS Assembly Speaker Carl E. Heastie, NYS Assembly Minority Leader Brian M.
