1 Last Updated November 2015 Constitution of the NDSU Gaming Guild Article I Name and Purpose Section 1 Name A: The name of this organization shall be known as the NDSU Gaming Guild, henceforth referred to as The Guild. Section 2 Purpose A: The purpose of The Guild shall be to: 1. Provide a safe and fun environment for all types of games on and off campus. 2. Create a social network of students and faculty who enjoy playing games within the tri-college area. 3. Expose students and faculty to game styles that they might not have previously considered.
2 Section 3 Gambling Free Statement: A: The Guild is fully committed to be a gambling free organization in accordance with the rules and regulations set forth by the University and the CSO. There will be no events held by The Guild where gambling by putting up a wager against another person is allowed. Section 4 Non-Profit Statement: A: The Guild is committed to being a non-profit organization. Any dues collected from members or from events, will only be used for purposes of furthering The Guild. Individual members will not receive monetary benefits from The Guild, with the only exception being in the event that a member wins a prize at an event held by The Guild. B: Should The Guild disband at any time, a final meeting will be called by the President. At which time, any balance or funds left in The Guild account will be donated to a charitable organization to be determined at that meeting. Games and materials that have been purchased with money given from the Student Government will become property of the SG. Games and materials that have been donated to The Guild or purchased with money from the bank account of The Guild will be donated to an organization also to be determined at this meeting.
3 Article II Membership Section 1 Non-Discrimination and Anti-Hazing Statements: A: North Dakota State University does not discriminate on the basis of age, color, disability, gender expression/identity, genetic information, marital status, national origin, public assistance status, race, religion, sex, sexual orientation, or status as a U.S. veteran. Direct inquiries to: Equal Opportunity Specialist, Old Main 201, or Title IX/ADA Coordinator, Old Main 102, B: Hazing is prohibited regardless of location, intent or consent of participants. Hazing is defined as any action or situation that intentionally or unintentionally endangers a student for admission into or affiliation with a student organization or group. Such activities and situations include, but are not limited to, paddling in any form; creating excessive fatigue; forced consumption of any substance; forced road trips; morally degrading, demeaning, unsanitary, humiliating games or stunts; and harassment, ridicule or other activities prohibited by law or university policy. It is the responsibility of the organization and its leadership in conjunction with the (inter)national organization, if any, to protect potential members, members or other persons associated with the organization from any hazing activity or practice conducted, condoned, or encouraged by the current members of the organization, alumni or other associates. The university or individuals may file a complaint of hazing with the Dean of Student Life Office. Individuals and/or groups may also be subject to criminal and/or civil liability beyond the jurisdiction of the university. Section 2 Membership Requirements and Restrictions A: Anyone may become a member who: 1. Is a student/staff/faculty member of NDSU 2. Is a Tri-College Student/staff/faculty B: Alumni members shall consist of persons who: 1. Obtained a qualifying degree from NDSU, or will be graduating at the end of the current semester
4 2. Met the minimum requirements for Alumni membership as set forth by the by-laws 3. Paid the required dues as set forth by the by-laws C: Official Members shall consist of members who: 1. Are Student/staff/faculty members of NDSU 2. Have paid the required dues as set forth by the by-laws D: Unofficial members may: 1. Attend meetings and game nights 2. Suggest events to be held by The Guild 3. Nominate members for leadership positions 4. May be nominated for leadership positions if they will be a student of NDSU for the entire duration of the position 4.1 If at the time of transition the requirements for officer-ship are not met by the time of position transition, the position will be treated as a vacancy and corrected thusly. E: Privileges of Official Members 1. All benefits of Unofficial Members (see above) 2. Vote on new leaders, removal of leaders, changes to the constitution or by-laws, events to be held by The Guild, choices for new games, and Guild memorabilia 3. Lower entrance fee for specific events, which will be determined at the time of the event creation. 4. Access to the Guild Library F: Privileges of Alumni Members: 1. All privileges of Unofficial Members (see above) 2. Lower entrance fee for specific events, which will be determined at the time of the event creation 3. Access to the Guild Library
5 G: Privileges of Officer-ship: 1. Membership is paid for from Guild funds Section 3 Removal of Members: A: Grounds for removal of members include: 1. Violation of University Policy 2. A submitted claim of misconduct by another member (see below) 3. Failure to complete duties of an officer, if in that position, as stated by this document and the bylaws B: Should a situation arise where there is a dispute between two or more members where one party feels that another party needs to be removed from The Guild, there is a specific timeline of events which must be observed which is defined as follows. 1. One member must first petition for the removal of a member by obtaining signatures from at least 5 other members and one member who is in a leadership position on a document containing the claims of the offended party 2. The Guild is then responsible for notifying the accused party and leaders of The Guild within the timeframe of the proceeding meeting, or three business days, whichever allows for more time, of receiving the petition from the offended party 3. The member(s) in question shall be provided an opportunity time of two business weeks to present a defense to The Guild either in person, or in writing. 4. A two-thirds majority vote of the voting members present, at time of the inquiry shall decide upon removal, with voting not to occur sooner than one hour after the presentation of the grounds and defense have been made. There must be quorum of two-thirds of all current official members present for the vote of removal. 5. Should an official member of The Guild be found of misconduct, they will be removed from The Guild as an official member, without status, including loss of privileges given to official members.
6 Section 4 Appeal of Removal of Members: A: Members may appeal their removal within two weeks for the vote of removal by requesting the President to call a special meeting of the organization. The president shall notify all members of this meeting, which is to occur at least one week and not more than one month after the appeal request is received by the President. B: The decision to uphold the vote for removal shall require a two-thirds majority vote of the members present at the special meeting. Section 5 Vacancy of an Office: A: Should a situation arise where a member is removed from The Guild and that member was in an office, provisions will be made to fill that office as follows: 1. In the event of a vacancy in the office of the President before the expiration of a full term, the Vice President shall assume the duties of the president until a special election can be held. 2. In the event of a vacancy in an office other than the President before the expiration of a full term, a special election shall be called by the President within two weeks to fill the vacancy. Article IIIElected Positions Section 1 List of Officers: A: The Guild will have officers in the following positions 1. President 2. Vice President 3. Secretary 4. Treasurer
7 Section 2 Qualifications for Holding Office: A: In order to be in an officer position in The Guild, you must be an official member B: Meet the minimum requirements set forth by the University for Student Organizations Section 3 Not An Easter Egg A: Congratulations! You have found the hidden Easter Egg of this document. This section has nothing to do with the rules and regulations of The Guild, but is here solely to amuse ourselves because let's face facts the rest of this document is pretty boring, and we're gaming nerds. 1. Section 4 Nomination & Election Process: A: The Guild will nominate members for voting to new leadership positions through the following process 1. A nomination will be held before the last meeting of the spring semester 2. A member may nominate themself or another member for a leadership position 3. The motion for the nomination must be seconded by another member 4. The nominee may at any time decline the nomination and will no longer be considered for the position. 5. Once a nominee has been seconded without decline their name will be added to the ballot.
8 B: The Guild will periodically change leadership members through a process of election by other members as follows 1. Once all nominees are decided before the last meeting of the spring semester, an election will occur by show of hands. 2. Each official member present at the meeting will receive one vote per position for the people that have been nominated. 3. The ballots will be counted and a winner by a simple majority vote for each leadership position will be declared. 4. If there is a tie in the votes for one or more positions. A tiebreaker election will be held after dropping the candidate/s with the fewest votes 5. The old leaders will continue to hold their position until the first meeting of the next fall semester after the election at which time the new leaders will take over. 6. The members of the outgoing session shall be responsible for orienting their replacements to their positions. Section 5 Duties and Privileges of Officers: A: President 1. Barring special circumstances, be present at all meetings. 2. Submit paperwork needed for continuing enrollment each semester as is required by the University 3. Ability to hold off on a vote until three-quarters of voting members are present at next meeting. 4. Call special meetings of The Guild if necessary 5. Delegate tasks to other members of The Guild, if necessary 6. Appointment of unofficial positions for The Guild, of members of The Guild, as necessary B: Vice President 1. Barring special circumstances, be present at all meetings
9 2. All duties of the president fall to the vice president should the president fall ill or be declared unable to fulfill his position 3. The default delegate to the Congress of Student Organizations for The Guild 4. In charge of all meetings and to keep meetings flowing smoothly 5. Supervisor of the appointed officers, and to bring to the attention of the President if there is a decline in duties, or they have broken the rules of NDSU or The Guild C: Secretary 1. Barring special circumstances, be present at all meetings 2. Take minutes of all meetings and keep a running log of minutes from semester to semester 3. Notifying members of changes to The Guild, events upcoming, and the minutes of each meeting through the use of the university Listserv system, or other such mediums recognized by The Guild. 4. Checking The Guild's mailbox at the CSO office and notifying the members of mail pertinent to The Guild 5. Schedule all events and meetings to be held by The Guild and to obtain proper facilities for said events. 6. To present to the new secretary a running log of minutes of The Guild, and any needed paperwork, at such time that the positions are switched over. 7. In charge of meetings should the vice president be unable to attend. D: Treasurer 1. Barring special circumstances, be present at all meetings 2. Collect dues from official members at the beginning of each semester if they haven't paid, or collect money from the Head of Membership if one has been appointed.
10 3. Requesting money from the Student Government if necessary 4. Collecting money from persons entering into an event sponsored by the Guild if an entrance fee is required 5. In charge of making sure that a winner receives the specified prize after an event held by The Guild, if necessary 6. Keep accurate records of finances of the guild from Semester to semester 7. Creation and submission of a financial report to the CSO or other organization if required 8. To present to the new treasurer a running log of financial information of The Guild, any needed paperwork, The Guild PayPal account, The Guild ebay account, and assist with transferring the names on The Guild bank account at such time that the positions are switched over. Article IVConstitutional changes Section 1 Constitutional Ratification 1. The Guild constitution must be ratified a minimum of every 2 years Section 2 Section II Necessity of Quorum 1. In order to amend, alter, or in any other way change the Constitution and/or Bylaws, no less than two-thirds of current official members must be present. 2. Any proposed constitutional changes which receive a simple majority of votes will pass
