3 Gallatin County Board of Park Commissioners ORDINANCE NO FIRST READING OF AN ORDINANCE OF THE GALLATIN COUNTY BOARD OF PARK COMMISSIONERS PROHIBITING ANIMALS INSIDE THE BEACH AREA AT THE GALLATIN COUNTY REGIONAL PARK THIS was introduced by the Board of Park Commissioners, moved by Commissioner, and seconded by Commissioner. This resolution was adopted. Section 1.Applicability Section 2.Definitions Section 3.Enforcement Section 4.Animal on the Beach Section 5.Penalty Section 6.Effective Date 1. APPLICABILITY AND AUTHORITY A. This ordinance shall apply to the area marked as Beach at the Gallatin County Regional Park. B. Animals present inside the enclosed Beach area present a danger to the health safety and welfare of the users of the Beach. The Board of Park Commissioners pursuant to the powers vested with them under Montana Code Annotated gives the Board of Park Commissioners the authority to control dogs within County Parks. 2. DEFINITIONS A. Animal shall mean all domestic pets, livestock, or farm animal. B. Beach means the area inside the enclosed fence of the Gallatin Regional Park marked Beach. C. County Park Warden means Gallatin County Park Warden appointed under (2) (b). D. Owner shall mean any person, group of persons, partnership, corporation or limited liability company, knowing or willingly, bringing an animal inside the enclosed fence of the Beach. 3. ENFORCEMENT The provisions of this ordinance shall be enforced by the Gallatin County Park Warden.

4 4. ANIMAL ON THE BEACH An owner of an Animal on the Beach is guilty of a civil violation. 5. PENALTY The owner of an Animal on the Beach in violation of this ordinance shall be subject to a fine of $25 TWENTY FIVE DOLLARS for the first offense, $50 FIFTY DOLLARS for the second offense and $100 ONE HUNDRED DOLLARS for the third and subsequent offenses. 6. EFFECTIVE DATE This ordinance shall take effect 30 days after its second Reading and Approval. 5 RESOLUTION NO A RESOLUTION OF THE GALLATIN COUNTY BOARD OF PARK COMMISSIONERS AUTHORIZING THE 2013 BOZEMONSTER CHALLENGE AND DINO DASH FUN RUN THIS RESOLUTION was introduced by the Board of Park Commissioners, moved by Commissioner, and seconded by Commissioner. This resolution was adopted unanimously. WHEREAS, on October 5, 2004, the Gallatin County Commissioners, pursuant to Mont. Code Ann et. seq., created a Board of Park Commissioners (Resolution No ); and WHEREAS, the Board of Park Commissioners manages and oversees county park and recreation lands within Gallatin County; and WHEREAS, Mont. Code Ann authorizes the Park Commission to make contracts. NOW THEREFORE BE IT RESOLVED, The Gallatin County Board of Park Commissioners hereby authorizes FRIENDS OF REGIONAL PARKS INC. to conduct the 2012 Bozemonster Challenge and Dino Dash fun run on the County s behalf, at the Gallatin County Regional Park on August 24, The Gallatin Regional Park will be closed to the general public on August 25 th 2012 from 8 am to 5 pm except for participation or spectators of the Bozemonster and Dino Dash races.
