1 TITLE 12 S-12 PARKS AND RECREATION Chapters: Parks and Recreation Committee Properties and Facilities - Designated New Positions and Salaries Kevin McReynolds Sports Complex Tobacco Free Environment North Hills Park Property CHAPTER PARKS AND RECREATION COMMITTEE Established Advisory capacity Terms of members Members - how appointed; vacancies Parks Maintenance generalist position established Parks closed - hours given Penalty Established There is hereby established a Parks and Recreation Committee for the city of Sherwood, Arkansas; consisting of three (3) aldermen and two (2) residents of the city of Sherwood. (Ord. No. 714, Sec. 1.) The Parks and Recreation Committee is hereby increased from five to seven members and the additional two positions will be filled with two residents of the city of Sherwood. The Mayor shall appoint and the City Council shall confirm the two residents and their terms shall run from January 1 to December 31 and shall be for one year each, and each successive appointment shall be for a five (5) year period. (Ord. No. 1104, Secs. 1-3.) Advisory capacity Said Parks and Recreation Committee shall act in an advisory capacity only in regards to anything pertaining to the development and planning of the Parks and Recreation program of Sherwood. (Ord. No. 714, Sec. 2.) 286

2 Terms of members A. The three (3) aldermen serve on said committee until the expiration of their term of office and the senior alderman shall be chairman and if he declines; then the Committee shall determine the chairman. B. Two (2) residents of the city of Sherwood who shall serve staggered terms; One (1) with a two (2) year term, One (1) with a four (4) year term. The original appointees shall determine their terms by lot. Said terms shall expire on December 31 of the year their term expires. (Ord. No. 714, Sec. 3.) Members - how appointed; vacancies Said members of the Parks and Recreation Committee shall be appointed by the Mayor and confirmed by a majority of the City Council and in the event there is a vacancy then the successor shall be filled in like manner for the expiration of the term of the vacancy. (Ord. No. 714, Sec. 4.) Parks maintenance generalist position established A new position of Parks Maintenance Generalist is hereby created in the Parks and Recreation Department and a new position of Clerk 1 in the City Clerk s Office. The Budget Ordinance shall be amended to transfer $17, from the General Fund to the Parks and Recreation Department and $13, to the City Clerk s Office for this action. (Ord. No. 1341, Secs. 1-2.) Parks closed - hours given Henceforth, it is a misdemeanor for anyone to be on the premises of any of the parks or recreational facilities located in the city of Sherwood during the hours of 10:00 p.m. through 6:00 a.m., unless authorized by the Mayor or his designee. (Ord. No. 1054, Sec. 1.) 2.) Penalty The fine for such action will be $ (Ord. No. 1054, Sec. CHAPTER PROPERTIES AND FACILITIES - DESIGNATED Park - named Athletic fields - named Softball and soccer complex named Senior citizens center - funding through E.D.A Facility exclusively for senior citizens Park - named The new park to be constructed shall be named Sherwood Park. 287

3 (Ord. No. 921, Sec. 1.) S Athletic fields - named Within Sherwood Park the athletic fields shall be known as the Kevin McReynolds Sports Complex. (Ord. No. 921, Sec. 2.) Softball and soccer complex named The softball complex is named The Bill Harmon Softball Complex and the soccer complex is named The Bob Love Soccer Complex. (Ord. No. 1327, Sec. 1.) Senior citizens center - funding through E.D.A. Whereas, the city of Sherwood is applying for Arkansas Community and Economic Development Program funding through the AIDC in order to facilitate the construction and operation of a Senior Citizens Center. (Ord. No. 1185, Sec. 1.) Facility elusively for senior citizens The proposed facility is hereby dedicated exclusively to services and programs benefiting senior citizens. (Ord. No. 1185, Sec. 2.) CHAPTER NEW POSITIONS AND SALARIES Administrative Cashier/Supervisor Special Services Coordinator Increase of nine members Child sitting coordinator, Facility Night Manager and other positions Parks and Recreation Director s salary Administrative Cashier/Supervisor A new position of Administrative Cashier/Supervisor in the Parks and Recreation Department is hereby created. (Ord. No. 1370, Sec. 1.) Special Services Coordinator A new position of Special Service Coordinator is hereby created in the parks and Recreation Department. (Ord. No. 1400, Sec. 1.) Increase of nine members The Sherwood Parks and Recreation Department staff shall increase by nine fulltime staff members and seventeen part time staff members. The positions of those additional staff are reflected in Exhibit A of this ordinance and incorporated herein by reference. (Ord. No. 1534, Sec. 1.) 288

4 A. The salaries of the full time positions are set forth in Exhibit B to the ordinance and incorporated herein by reference. S-7 B. The positions and salary appropriation for the part time staff is attached to this ordinance as Exhibit C and incorporated herein by reference word for word. C. The budget ordinance for the city of Sherwood for the calendar year of 2001 is hereby amended appropriating the sum of Three Hundred and Fifty Two Thousand, four Hundred and Eighty Five Dollars ($352,485.00) from the general fund to the Sherwood parks and Recreation budget. (Ord. No. 1534, Secs. 2-4.) Child sitting coordinator, Facility Night Manager and other new positions One new position of child sitting coordinator, one new position of facility night manager and approximately six new part-time positions are hereby created in the Parks & Recreation Department. The budget ordinance shall be amended to transfer $84,000 from General Fund to the Parks & Recreation Department. (Ord. No. 1579, Secs. 1-2.) Parks and Recreation Director s salary The salary of the Parks and Recreation Director shall be increased to $58,000 per year and the budget ordinance shall be amended to transfer $577 from the General fund to the Parks and Recreation Department for the remainder of the year (Ord. No. 1555, Sec. 2.) CHAPTER KEVIN McREYNOLDS SPORTS COMPLEX Acreage purchase Description Budget ordinance Acreage purchase There is hereby appropriated $363, from the General Fund to purchase acres adjoining the Kevin McReynolds Sports Complex. (Ord. No. 1426, Sec. 1.) 288.1

5 S Description The legal description is as follows: 20 acres within Section 36, T- 3-N, R-12-W 8.38 acres: See Exhibit A and Exhibit B attached (Ord. No. 1426, Sec. 2.) Budget ordinance The 1999 Budget Ordinance is hereby amended to reflect said appropriation. (Ord. No. 1426, Sec. 3.) CHAPTER TOBACCO FREE ENVIRONMENT Tobacco free environments Fine Tobacco free environments The Kevin McReynolds Baseball Complex, the Bill Harmon Softball Complex, and the Bill Love Soccer Complex are henceforth to be tobacco free environments. The use of any tobacco products is prohibited henceforth within the confines of the enumerated three (3) locations. This prohibition shall include all types of tobacco products and shall not be limited solely to those which are ignited for use. The use of tobacco products is allowed in vehicles in the parking lot with disposal to be contained in the vehicle. (Ord. No. 1522, Sec. 1.) Fine A violation of the ordinance shall result in a Twenty-Five Dollar ($25.00) fine and any repeated offense shall be deemed a separate offense punishable by additional fines. (Ord. No. 1522, Sec. 2.) CHAPTER NORTH HILLS PARK PROPERTY Rehabilitation Restoration Re-opening Appropriation 288.2

6 S Rehabilitation The City Council hereby finds that the North Hills Park property should be rehabilitated for use as a golf course facility. (Ord. No. 1820, Sec. 1.) Restoration The Director of Parks and Recreation is to immediately begin restoration of the North Hills property. (Ord. No. 1820, Sec. 2.) Re-opening The Director is further directed to take all necessary steps to insure re-opening of the facility by spring of 2010 or sooner if practical. (Ord. No. 1820, Sec. 3.) Appropriation The sum of Three Hundred Thousand Dollars ($300,000.00) is hereby appropriated from the general fund to allow commencement of this project. (Ord. No. 1820, Sec. 4.) 288.3
