Eight hours for every ordinary worked day, 0.4 of an hour on each day with accruing towards the twentieth day, which will be taken as a paid day off. For General building and construction and metal and engineering construction: Ordinary time plus 50%; - Afternoon shift; finishing between 9pm and before 11pm. - Night shift; finishing between 11pm and before 7am. Ordinary time plus 25%: - Morning shift; finishing after 12:30pm and before 2pm. - Early afternoon; finishing after 7 pm and before 9pm. Award Type: NAPSA and Modern Award Page 4 of 6
5 Meal breaks Clause 35 Overtime Clause 36 and Penalty Rates Clause 37 Redundancy Clause 17 For Civil Construction: - Day shift; starting on or after 6am and before 10am. - Afternoon shift; starting at or after 10am and before 8pm. - Night shift; starting at or after 8pm and before 6am. - Rostered shift; with at least 48 hours notice.. Refer to clause for further details. A cessation of working time each day for at least 30 minutes taking between noon and 1.00 pm or as otherwise agreed between parties if employees works more than five hours. Employers may require employees to work outside the ordinary hours so long as it is reasonable and according to the following conditions: - Monday-Friday work beyond ordinary times 150% for the first two hours and 200% thereafter. - Public holidays or substituted days instead thereof 250% for all time worked (minimum of four hours). - Saturdays 150% for the first two hours and 200% thereafter, provided that all work after 12 noon is at 200% (minimum 3 hours). - Sundays 200% for all time worked (minimum 4 hours). Where an employee works so much overtime that they do not receive 10 consecutive hours off work before the start of their next ordinary hours, they shall continue to get paid 200% until they receive 10 consecutive hours off work. No employee under 18 years old will be required to work overtime or shiftwork. Refer to HIA Redundancy information sheet. Leave and public holidays Part 6 Clause Annual leave Clause 38.1 Payment of annual leave Clause 38.2 Personal/carer leave and compassionate leave Clause 39 Public holidays Clause 41 Award Flexibility Clause 7 Description An employee s entitlement accrues progressively for each year of service: (a) 4 weeks of paid annual leave. (b) continuous shift workers 5 weeks of paid annual leave. As per National Employment Standards. Annual leave payment must be made in advance. Loading is calculated at 17.5% of the applicable rate, prescribed by: - clause 19.1(a) Minimum wages; - clause 21.2 Industry allowance; - clause 21.3 Underground allowance; - clause 20.1 Tool and employee protection allowance; - clause 24 Living away from home distant work; - clause 25 Fares and travel patterns allowance; and - clause 19.2 Leading hands (if applicable). An employee is entitled to 10 days of paid personal/carer s leave which accrues progressively during a year of service. The following are prescribed public holidays: - 1 January (New Year s Day) - 26 January (Australia Day) - Good Friday - Easter Monday - 25 April (Anzac Day) - the Queen s birthday holiday - 25 December (Christmas Day) - 26 December (Boxing Day) Any work on public holidays must be paid at the relevant penalty rate. For more State-specific public holidays, please contact the InfoCentre In accordance with clause 7 an employer and employee may agree to vary the following terms of the award to suit the individual needs of the employer and employee: (a) arrangements for when work is performed, Award Type: NAPSA and Modern Award Page 5 of 6
6 (b) overtime rates, (c) penalty rates, (d) allowances, and; (e) leave loading. The agreement between the employer and the individual employee must: 1. be confined to a variation in the application of one or more of the terms listed above, 2. not disadvantage the individual employee in relation to the individual employee s terms and conditions of employment, and; 3. be in writing. If the individual is under 18 years of age, the employee s parent or guardian must sign the agreement. The agreement does not need to be lodged, however the agreement must ensure that the employee is better off under the varied conditions of engagement.
