2 DISTRICT OF SPARWOOD BYLAW 1038 A Bylaw to Establish Benefits for Officers and Officials of the District of Sparwood. WHEREAS Section 8 of the Community Charter provides broad fundamental powers that allow Council to fix benefits provided for its Officers and Officials; NOW THEREFORE the Council of the District of Sparwood in open meeting assembled enacts as follows: SHORT TITLE 1. This Bylaw may be cited for all purposes as, "Officers and Officials Benefits Bylaw 1038, 2012". INTERPRETATION Bylaw In this Bylaw: CONTINUOUS SERVICE means the time from the first day of employment, less any voluntary leave or break in service; or, if the employee has severed their employment with the District, the time from the last date of rehire, less any voluntary leave or break in service COUNCIL means the elected Council of the District of Sparwood. DISTRICT OR MUNICIPALITY means the District of Sparwood. OFFICER means a person appointed by Council to one of the following positions: Chief Administrative Officer Director of Corporate Services Deputy Director of Corporate Services Director of Finance Deputy Director of Finance OFFICIAL means a person appointed by Council to one of the following positions: Director of Community and Facility Services Deputy Director of Community and Facility Services Director of Engineering Director of Fire Services (Fire Chief) Deputy Director of Fire Services (Deputy Fire Chief) Director of Operations Manager of Planning PENSION AND RETIREMENT 3. (a) Superannuation shall be provided in accordance with the Pension (Municipal) Act, R.S.B.C. Chapter 355 and amendments thereto together with the Canada Pension Plan. Retirement for the Director of Fire Services and Deputy Director of Fire Services shall occur effective the first day of the month following their sixty-fifth (65) birthday. HEALTH AND HOSPITAL INSURANCE 4. (a) Health and Hospital Insurance shall be provided by the District at no direct cost to such Officer and Official as follows: Medical Services Plan Extended Health Benefits Plan Eye Glass Allowance - Similar to Union Agreement Officers and Officials Benefits Bylaw 1038, 2012 Consolidated Page 2 of 6
3 Dental Care Plan Direct Payment Pharmacy Plan Vision Care Eye Examination Employee and Family Assistance Program Benefits listed in paragraph 4(a) shall be provided to each Officer and Official by the District at the commencement of employment subject only to the policy of the insurer. In case of absence due to illness or other authorized absence, the District shall continue to provide coverage set out herein for not more than one (1) year from the commencement of illness or other authorized absence. Following the expiration of the said one (1) year period and for the full period of any authorized absence only, an Officer or Official shall have the option to continue such coverage. In the event they shall exercise such option they shall pay monthly the full premium costs of such coverage to the District and the District shall ensure that such coverage is maintained in force. LIFE INSURANCE AND ACCIDENTAL DEATH AND DISMEMBERMENT 5. Group Life Insurance and Accidental Death and Dismemberment shall be provided by the District to each Officer and Official at no direct cost to such Officer or Official in an amount equal to twice their annual salary. SICK LEAVE 6. (a) On January 1 of each year each Officer and Official having completed the required probationary period shall be entitled to six (6) days paid sick leave. Notwithstanding the (d) BEREAVEMENT LEAVE foregoing, an Officer or Official completing their probationary period on or after July 1 shall be entitled only to three (3) days paid sick leave for that year. If an Officer or Official has sick days remaining on December 31st the Officer or Official will be entitled to carryover a maximum of four (4) unused sick days to the following year. At no time shall an employee have more than ten (10) sick days available at one time; The District shall pay one hundred percent (100%) of the premiums for a weekly indemnity plan providing short term income replacement benefit for Officers and Officials unable to work due to sickness and/or accident for which benefits are not compensationable under the Workers' Compensation Act; Any such weekly indemnity plan shall provide benefits and be subject to such restrictions as may be set out in any such plan established for the District's unionized employees; The District will pay one hundred percent (100%) of the premiums for a long-term disability insurance plan providing a long-term income replacement benefit for Officers and Officials unable to work due to a total disability; Any such long-term disability insurance plan shall provide benefits and be subject to such restrictions as may be set out in any such plan established for the District's unionized employees; The District agrees that if payments from the District's weekly indemnity and long-term disability insurance plans arrive late, the District shall make these payments to an Officer or Official and the Officer or Official will endorse to the District on their arrival any cheques received from the insurance company for which they have already received an advance from the District as reimbursement for such payments. 7. An Officer or Official shall be granted three (3) continuous working days leave without loss of salary, including the day of the funeral, in case of the death of a parent, spouse, brother, sister, child, grandparent, or grandchild. The above shall include all common-law, step, and in-law relationships. Officers and Officials Benefits Bylaw 1038, 2012 Consolidated Page 3 of 6
4 LEAVE OF ABSENCE 8. (a) Leave of absence with pay shall be granted to Officers and Officials for any absence on District business, approved conferences or training programs, and may be granted for compassionate reasons with the approval of the Chief Administrative Officer. ANNUAL VACATION Leave of absence without pay for Officers and Officials may be granted for reasonable periods with the approval of the Chief Administrative Officer on such terms and conditions as may be deemed reasonable. In the event of a Leave of Absence with pay on District business, approved conference or training programs, Officers and Officials shall be entitled to payment of the same expenses as are approved for payment for members of Council on approved District business. 9. (a) Subject to any special arrangement at the time of appointment, annual vacation with pay shall be granted as follows: Year 1 Years 2 and 3 Years 4 to 9 Year 10 going forward 2 weeks pro-rated to start date 3 weeks 4 weeks 5 weeks (d) (e) (f) An Officer or Official leaving the service at any time in their vacation year before they have had their vacation shall be entitled to a proportionate payment of salary or wages in lieu of such vacation. When an Officer or Official dies, their estate shall be credited with the value of vacation credits owing to them. Annual vacations shall be scheduled at such time as may be mutually agreed between an Officer or Official and the Chief Administrative Officer. Requests for vacation dates shall be given in writing to the Chief Administrative Officer on or before March 31 in each year. Preference in the choice of vacation dates shall be determined by seniority of service. In the event that no request for vacation dates is given as aforesaid, vacation dates shall be assigned by the Chief Administrative Officer. In the event of the severance or termination for any reason of an Officer or Official before they have taken vacation time to which they are entitled, a proportionate payment of salary in lieu of such vacation time shall be paid to such Officer or Official. Where an Officer or Official is hospitalized (certified by a Medical Practitioner), on bereavement if funeral attended or any other approved leave during their period of vacation, there shall be no deduction from vacation credits for such absence. The period of vacation so displaced shall either be added to the vacation period or reinstated for use at a later date, by mutual agreement, in the calendar year. For each period of thirty (30) consecutive days an Officer or Official is absent from work in the calendar year there shall be deducted from the vacation pay to which they would otherwise be entitled in the succeeding year, one twelfth (1/12) of such vacation pay. Only time spent on vacation for which an Officer or Official is paid or time lost because of sickness or accident and compensated under other provisions of this bylaw shall be considered as time worked. An Officer or Official absent in excess of one (1) year due to sickness or accident will not be eligible to accrue further vacation entitlements until they return to active employment. 5 STATUTORY HOLIDAYS Statutory Days First day of WorkSafe BC Claim and time on an accepted WorkSafe BC Claim Paid sick leave Jury duty Approved time off Floater Bereavement Leave 10. (a) The following days shall be observed as Statutory Holidays: New Years Day Family Day Good Friday Easter Monday Victoria Day Canada Day British Columbia Day Labour Day Thanksgiving Day Remembrance Day Christmas Day Boxing Day In addition to the Statutory Holidays listed above, Officers and Officials shall be entitled to one (1) additional holiday (Floating holiday) to be taken during each calendar year as scheduled by the Officer or Official with the consent of the Chief Administrative Officer. When a Statutory Holiday falls on a Saturday or Sunday and is not proclaimed to be observed on some other day, the preceding Friday and/or following Monday shall be deemed to be the statutory holiday subject to the right of the Chief Administrative Officer to finally determine any such allotment in order to ensure the orderly operation of the District. GRATUITY FOR LONG SERVICE 11. An Officer or Official who has completed a minimum of five (5) years of Continuous Service shall be entitled on termination other than dismissal for cause, to a gratuity equal to one (1) days regular salary for each year of Continuous Service. CHRISTMAS BONUS 12. (a) A Christmas bonus of $ shall be paid to each Officer and Official with at least one (1) years' Continuous Service as at December 1 of each year, such bonus to be paid one pay day prior to Christmas in each year. NORMAL WORKDAY Any Officer or Official having less than one (1) years' Continuous Service as aforesaid shall be entitled to a Christmas bonus as aforesaid but which shall be reduced by 1/12 for each month during the said year when such Officer or Official was not employed by the District. 13. (a) The normal workday of Officers and Officials shall be as follows: Bylaw 1118 (i) (ii) Director of Engineering, Director of Community and Facility Services, and Director of Operations - seven (7) and one half (1/2) hours exclusive of one-half (1/2) hour paid lunch; All other Officers and Officials - seven (7) hours exclusive of one-half (1/2) hour paid lunch. Each Officer or Official shall be at work during the same normal working hours of District employees supervised by them and/or as approved by the Chief Administrative Officer. TIME OFF IN LIEU OF OVERTIME 14. Council may by policy provide for additional time off without loss of salary in lieu of overtime for Officers and Officials Benefits Bylaw 1038, 2012 Consolidated Page 5 of 6
6 Officers and Officials on such terms and conditions as Council may, from time to time, determine. CLOTHING ALLOWANCE 15. (a) After six (6) months Continuous Service each Officer and Official except the Fire Chief and Deputy Fire Chief shall receive an annual clothing allowance of $150.00; JURY DUTY In lieu of the allowance provided in Section 15(a) above, the District shall provide the Fire Chief and Deputy Fire Chief with such uniforms and for the cleaning of such uniforms as Council may from time to time by resolution determine and direct. 16. Officers and Officials shall be allowed full salary less any funds received as jury fees while serving on jury duty. MATERNITY LEAVE 17. Upon written request, Officers and Officials shall be entitled to and granted Pregnancy Leave and Parental Leave without pay in accordance with the Employment Standards Act of British Columbia and any other Federal Regulations. TRAINING 18. Council may by policy, provide for the reimbursement of instructional courses to better qualify the Officers and Officials to perform their duties, including establishment of guidelines that apply to eligibility and funding. VEHICLES 19. Repealed by. BOOT ALLOWANCE 20. Any Officer or Official required by WorkSafe BC Regulations and/or the District to wear safety footwear shall be provided with a boot allowance similar to the Union Agreement, upon proof of purchase. IMMUNIZATION HEPATITIS A AND B 21. Any Officer or Official choosing to be immunized for Hepatitis A and B shall be reimbursed by the District provided they are done as a combination immunization package. REPEAL 23. The bylaw cited as, "Officers and Officials Benefits Bylaw No. 938, 2006" and any amendments thereto are hereby repealed.
