2 MEMORANDUM TO: Governing Board FROM: Megan Wetherington, Senior Professional Engineer THRU: David Still, Executive Director Jon Dinges, Department Director DATE August 26, 2010 RE: Authorization to Enter into a Contract with Consultant in Order of Ranking for Surfacewater Quality and Biological Sampling and Laboratory Analysis RECOMMENDATION Staff recommends the Governing Board authorize the Executive Director to enter into a contract with Water & Air Research, Inc., for an amount not to exceed $275,000. BACKGROUND The District established the water monitoring network in 1989 to evaluate the status of water bodies and identify changing conditions in water quality. Monitoring includes water chemistry sampling, flow measurement, aquatic biology sampling and analysis, and data management at 72 surfacewater stations and the laboratory analysis of water chemistry from 91 wells. Typical parameters include nitrate, phosphorus, dissolved oxygen, and biological diversity. The proposed contract will be renewable on an annual basis for a total term of up to three years. On May 21, 2010, the District issued Request for Proposal, RFP 09/10-033WR. Three companies responded to the RFP. The selection committee (Jon Dinges, Tim Sagul, and Charlie Houder) met for presentations and ranking of the proposals on July 7, The selection committee rankings are as follows: Firm Rank Proposed Cost Water & Air Research, Inc. 1 $441, ENTRIX, Inc. 2 $542, Environmental Services, Inc. 3 $425, WSRM 1

3 Staff negotiated with Water & Air Research for a reduced cost of $275,000. Proposed changes to the program include reduction of sampling frequencies at many sites, the reduction of sampling stations to one each on Alligator Lake and the Aucilla and New Rivers, the reduction of sites to two on the Steinhatchee River, and the reduction of biological sampling sites to one per major river reach. Table 1 contains a list of proposed surfacewater monitoring sites. Funds for this contract are in the proposed FY 2011 Water Resources Monitoring budget in Fund Code 36. /dd WSRM 2

5 MEMORANDUM TO: FROM: THRU: Governing Board Megan Wetherington, Senior Professional Engineer David Still, Executive Director Jon Dinges, Department Director DATE: August 26, 2010 RE: Authorization for Extension of Contractual Services with Nestlé Waters North America, SRWMD Contract #05/ RECOMMENDATION Staff recommends the Governing Board authorize the Executive Director to amend the current revenue contract with Nestlé Waters North America for an additional year of service from October 1, 2010, until September 30, The additional term of service is for a fee of $96,800. BACKGROUND The water use permit for Nestlé Waters North America (NWNA), , requires flow monitoring for the Withlacoochee River and Madison Blue Spring. Staff finds that it is efficient and effective for the permittee to pay the District to include the gages in the cooperative network with the U.S. Geological Survey (USGS). The annual cost of the two gages is $70,000. In addition, NWNA requested that monitoring be continued on the Wacissa River, a gage discontinued in July 2010 by the Florida Department of Environmental Protection. The annual cost of the Wacissa gage is $26,800. The revenue will be passed through to a contract with the USGS to conduct the monitoring. MW/dd WSRM 4

6 MEMORANDUM TO: Governing Board FROM: Megan Wetherington, Senior Professional Engineer THRU: David Still, Executive Director Jon Dinges, Department Director DATE: August 26, 2010 RE: Amend Contract #07/ with Vieux & Associates, Inc., to Purchase Gage Radar-Rainfall Data RECOMMENDATION Staff recommends the Governing Board authorize the Executive Director to renew the contract with Vieux & Associates, Inc., for fiscal years 2011 and 2012 and to purchase radar rainfall for fiscal year 2011 for an amount not to exceed $26,500. BACKGROUND The District has acquired gage-adjusted radar rainfall data since February The service will continue to provide radar-derived daily rainfall estimates on a 2- kilometer by 2-kilometer grid throughout the District. Precipitation data from this process is essential for the estimation of groundwater recharge, for use as inputs to hydrologic modeling efforts, for the support of agricultural, regulatory, and District land management activities, for the maintenance of District rainfall records, and for the development of accurate water budgets. The District also uses this data to analyze rainfall extremes such as drought, floods, and hurricanes on a scale ranging from small watersheds to the entire District. The District is proposing to buy the services of the radar-rainfall data provider under the prices negotiated by the St. John s River Water Management District, pursuant to Chapter (5)(b), Florida Statutes, and the District Procedures Manual Section Governmental Contracts, which states the District is WSRM 5

7 eligible to take advantage of offers for services extended by providers to other governmental entities. The District may, at its discretion, purchase from a provider extending State of Florida Contract, Federal GSA Contract, PRIDE, RESPECT, Water Management District, County, City or other Governmental Contract established prices in lieu of obtaining its own bids on any particular service. This provider services all five water management districts. Funding associated with this purchase is budgeted under the Water Resources Monitoring budget in Fund 36. MW/dd WSRM 6

8 MEMORANDUM TO: Governing Board FROM: Megan Wetherington, Senior Professional Engineer THRU: David Still, Executive Director Jon Dinges, Department Director DATE: August 26, 2010 RE: Authorization to Enter into a Contract with the United States Geological Survey (USGS), Georgia District, for Streamgaging Services RECOMMENDATION Staff recommends the Governing Board authorize the Executive Director to enter into a contract with the USGS in the amount of $27,200 for streamgaging services of which $15,650 will be provided by the District. BACKGROUND The proposed FY 2010/2011 contract with the USGS, Georgia District, is a joint funding agreement totaling $27,200 and consists of USGS and District contributions of $11,550 and $15,650, respectively, for two gages on the Alapaha River and one on Little River, a major tributary of the Withlacoochee River. The purpose of the contract is to continue the existing long-term streamgaging program in major streams in Georgia contributing to river flows in the Suwannee River Water Management District. More than fifty percent of the Suwannee River Basin lies in Georgia. The gages in this program were critical during the April 2009 flood when they reported historic high flows on the Alapaha and Little Rivers and provided advance notice of extreme flooding downstream. The program supports essential flood warnings and forecasting for the District through the National Weather Service, drought monitoring, and data to support the minimum flows and levels (MFL) program. Data obtained through this program are available in real-time to the public via the internet and upon request. WSRM 7

9 Table 1 provides a list of the monitoring stations and a breakdown of the proposed cooperative budget for FY 2010/2011. The Environmental Protection Division of the Georgia Department of Natural Resources matches District funding for two of the gages. Funds for this contract are budgeted in the FY 2010/2011 Water Resource Monitoring budget in Fund Code 36. BACKGROUND The proposed FY 2010/2011 contract with the USGS is a joint funding agreement of $486,200, with the District providing $286,500 and the USGS contributing $199,700. The USGS provides maintenance of gages to USGS standards, quality assurance and archiving, availability of real-time and long-term data, and satellite delivery of data to the National Weather Service River Forecast Center. The contract adds three stations to the network: Manatee Springs, Fanning Springs, and Wacissa River, which were formerly paid for by the Florida Department of Environmental Protection. Nestle Waters North America will fund three gages including the Wacissa River gage for a total of $96,800 of the District s share of the agreement. This long-term program provides essential information for floodplain mapping, minimum flows and levels, flood warnings and forecasts through the National Weather Service, drought monitoring, and recreational support including implementation of no-wake levels. Data obtained through this program are WSRM 9

11 available in real-time to the public via the internet, river level phone line, and upon request. Table 1 provides a list of the monitoring stations and a breakdown of the proposed cooperative budget. RECOMMENDATION Staff recommends the Governing Board authorize staff to: 1. Publish Notices of Rule Development for sections 40B and 40B-2.041, F.A.C.; 2. Publish Notices of Proposed Rule for sections 40B and 40B-2.041, F.A.C.; 3. File 40B and 40B-2.041, F.A.C., with Department of State if no comments or objections are received. BACKGROUND The District amended chapter 40B-2, Florida Administrative Code (F.A.C.), in January As a result of these amendments, changes must be made to rule citations within 40B-1.706, F.A.C., the section entitled Fees. Additionally, the 2010 Legislature approved Senate Bill 550 that deletes mandatory delegation of water use permit approvals to the Executive Director and authorizes the Governing Board to establish the scope and terms of any delegation. At its June 2010 meeting, the Governing Board approved a staff recommendation that the Governing Board approve water use permit applications consisting of the following thresholds: WSRM 12

14 1. All bottled water use applications; 2. Applications equal to or greater than 1.0 million gallons per day; 3. Denials; and 4. Division of Administrative Hearings Final Orders. This June 2010 Governing Board action requires amendment to section 40B , F.A.C. If no objections or requests for workshop are filed within 21 days after publication, the District will file the proposed rules with the Joint Administrative Procedures Committee (JAPC) for review. Governing Board authorization is now required by (3), Florida Statutes, for filing of the rules for adoption. Filing with the Department of State will occur following JAPC review. The rule will become effective 20 days after filing with the Department of State. A copy of the notices of proposed rule is attached to this memorandum. /lgw WSRM 13

Except as provided in subsection (3) above or (5) below, a general water use permit is required under the general permit procedures in paragraph 40B (1)(c), F.A.C., for all withdrawals or diversions which are less than ten million gallons per day maximum daily rate of withdrawal and less than two million gallons per day average daily rate of withdrawal. Either the Executive Director, the Assistant Executive Director, or the DepartmentDeputy Executive Director shall approve general permit applications under this paragraph for all withdrawals or diversions less than 1.0 million gallons per day without a hearing, except that any application recommended for denial shall be presented to the Governing Board for final agency action. 20 MEMORANDUM TO: FROM: THRU: Governing Board Jon Dinges, Department Director David Still, Executive Director DATE: August 26, 2010 RE: County and City Fee Waiver for Fiscal Year RECOMMENDATION Staff recommends the Governing Board authorize waiver of permitting fees for qualifying counties and municipalities for Fiscal Year BACKGROUND In accordance with Florida Statute , the governing body must certify that the cost of the permit processing fee is a fiscal hardship because of one of the following factors: 1. Per capita taxable value is less than the statewide average for the current fiscal year; 2. Percentage of assessed property value that is exempt from ad valorem taxation is higher than the statewide average for the current fiscal year; 3. Any condition specified in section , Florida Statutes, that determines a state of financial emergency; 4. Ad valorem operating millage rate for the current fiscal year is greater than 8 mills; or 5. A financial condition is documented in annual financial statements at the end of the current fiscal year indicates an inability to pay the permit processing fee during that fiscal year. The draft Water Supply Assessment will be provided to the Governing Board on September 14, Staff and the consultant will present the results of the Water Supply Assessment on September 28, The District will host public meetings to present the draft Water Supply Assessment and gather citizen comments. The meetings will be at 7 p.m. and held on October 7 in Starke at the Andrews Center Auditorium; October 12 in Fanning Springs at the City Hall meeting room; and October 19 in Perry at the Holiday Inn Express. Upper Santa Fe River Basin Water Supply Plan: - Consultant continues work on the Water Supply Plan for the Upper Santa Fe River Basin. - Staff is meeting regularly with St. Johns River Water Management District (SJRWMD) via conference calls to coordinate activities in the water supply planning process. Staff met with SJRWMD on August 20, 2010, to discuss minimum flows and levels prevention and recovery strategies. - SJRWMD has postponed completion of their Water Supply Plan until the spring of Future meeting dates remain tentative based upon the completion of tasks by SJRWMD staff. - Staff met with Clay County Utility Authority on August 12, 2010, to discuss water resource trends, water conservation strategies, and reuse of reclaimed water. Springs: - Staff completed design and publication of a new Conserve Water, Protect Springs brochure that will be distributed District-wide. The brochure contains information about the District s irrigation rule, Florida-Friendly Landscaping, and how they tie together to protect our springs. WSRM 20

22 - Contracts with the Florida Department of Environmental Protection and the Columbia County School District were executed for projects associated with the Learning in Florida s Environment (LIFE) and Ichetucknee Springs PARKnership programs at Richardson Middle School and the Fort White middle and high schools. - The Ichetucknee Partnership (TIP) set up an informational display about springs protection and water conservation in the lobby of the Super 8 motel at the I-75/SR 47 interchange in Lake City. As the motel closest in proximity to the Ichetucknee Springs State Park, the Super 8 attracts many visitors to the springs. The manager has reported that hundreds of visitors and local residents alike are now more informed about springs protection as a result of the display and companion printed materials, which will remain at the motel through Labor Day. - Staff continues to revise and update its website pages for springs. - Staff continues to monitor and update The Ichetucknee Partnership s Facebook page, which now has 339 fans. Spring Protection, Surfacewater, Groundwater and Biological Monitoring: - Staff collected water chemistry samples at 20 groundwater sites. - Staff observed levels and maintained gaging stations at 181 wells, 21 lakes, and 19 stream stations. - Staff assisted St. John s River Water Management District staff with the video logging of 4 District wells. - Staff added Alligator Lake in Lake City to the District s real-time rainfall network. - Staff replaced stage recording equipment at three former USGS monitoring sites: Troy Springs, Blue Hole, and Ichetucknee River at Dampier s Landing. - Staff participated in the quarterly North Central Florida Local Emergency Planning Committee meeting. - Discharge was measured at 3 streams. - Rainfall from 39 telemetered sites was reported to the Southeast River Forecast Center. Water Use Monitoring: - Staff monitored 126 telemetered water use monitoring devices on 39 agricultural operations. Water use on monitored wells in July was 506 million gallons, averaging 16 million gallons per day. - Staff continues the assessment of water use permits that use between 100,000 and 500,000 gallons per day in the Upper Santa Fe Basin. Minimum Flows and Levels (MFLs): - Staff is in process of developing a new project charter, plan, budget, and schedule to establish MFLs as presented to the Governing Board in the June 2010 workshop. 23 - Staff continues to meet with SJRWMD staff and consultants on development of water use permitting criteria for the Upper Santa Fe and Suwannee rivers. - Staff is reviewing and commenting on work products prepared by SJRWMD related to MFLs, water supply assessment, and planning. - Staff continues to work on MFL implementation in water use permitting. - Staff continues to develop a scope of work for revisions to the North Florida Groundwater Model. The draft scope is being reviewed by SJRWMD staff. Suwannee River Partnership Activities: - Staff has worked with the Suwannee and Levy Soil and Water Conservation Districts to develop farmer contracts and to assist farmers with the Best Management Practices (BMPs) Crop Tools cost share program that the District s Governing Board is funding. - Staff gave presentations at county Farm Bureaus, Soil and Water Conservation Districts, and Cattlemen s meetings. - Staff continues to work with farmers and other partners in the Suwannee and Santa Fe river basins by providing technical assistance to participating farms in nutrient and irrigation management. Staff has continued to assist farmers in taking crop tissue, soil, and manure samples to determine nutrient levels and adjust fertilizer management. - Staff continues to work with University of Florida - Institute of Food and Agricultural Sciences (IFAS) staff to develop crop irrigation and fertilizer BMP demonstrations at the research center and on progressive farms. - Staff assisted IFAS with a farmer field day at the research center to demonstrate irrigation and fertilizer management. - Staff helped organize a workshop on sod-based rotation that included speakers from the Flint River Basin in Georgia and extension specialists from the University of Florida. - Staff attended the Georgia Upper Suwannee Partnership Shines dinner that was patterned after our CARES dinner to recognize farmers. - Staff has continued to work with farmers to adopt BMPs as part of the Florida Department of Agriculture and Consumer Services BMP Program. Regulatory Activities: Water Use - Staff issued an extension of time to city of Chiefland to develop a plan to reduce their per capita water use. - Water Use Permits were issued for city of Lawtey and Newberry. - Staff met with Creech Engineering to discuss the proposed Suwannee Catalyst project and promotion of reclaimed water. Contracts with BCI Engineers and with the Florida Fish and Wildlife Conservation Commission have been executed. The District and the City of Starke have executed the Interlocal Agreement. BCI Engineers and Scientists are in the process of modeling and designing the proposed system. - Columbia County Stormwater: The County is in the planning stages with several projects. There will be no construction of projects in fiscal year 93 WSRM 23

25 2009/2010 because the County and the District mutually agreed to suspend construction due to budget constraints. Staff is working with land acquisition staff on the purchase of lands for the Clay Hole Creek flood abatement project. FEMA Map Modernization: - Levy County: Since receipt of the results of the Bronson Stormwater Drainage Ditch restudy by URS Corporation on June 25, 2010, Steve Minnis has been meeting with the Town of Bronson and Levy County to educate them regarding the engineering accuracy of the studies. Steve has another meeting scheduled with the Town of Bronson Council. Our study consultant URS will explain the changes to the Bronson North and South Ditches at the meeting. - We received the restudy of the Long Pond area southwest of Chiefland on May 21 and Steve Minnis has met with the Vice Mayor City of Chiefland, and Chairman of the BOCC to discuss and educate them regarding the study and results. The restudy lowered the Base Flood Elevation (BFE) from 1 to 3 feet. We are working with interested property owners to educate them and help them file a protest if needed. - Bradford County: The official 90 day appeal period to the Preliminary Digital Flood Insurance Rate Map (DFIRM) began July 1, 2010, and will end September 30, We are working with interested property owners to educate them and help them file a protest if needed. - Jasper Stormwater: Construction has commenced. Approximately 80% of the drainage pipe replacement has been completed and 50% of the proposed pond site has been cleared. - Lake City Reclaimed Water Project: The storage tank is complete. Delivery of the filter is expected in mid-august. Finishing work for piping and grading is underway. - Monticello Reuse Project: Construction progress is on schedule. The sides and embankments of the wet weather pond are near final elevation. The precast concrete wet-well is expected to arrive in a week. The monitoring wells have been completed and initial samples are being taken. - Greenville Stormwater: The District has developed an Interlocal Agreement (ILA) with the Town of Greenville (Town) to provide financial aid for the Town s efforts in solving its stormwater problems. The ILA provides matching funds, upon Town s purchase and request for reimbursement, of construction materials used to enhance and improve its drainage problems. However, spoils from the excavation were deposited within the floodplain mapped on the Oldham's property that could potentially jeopardize his neighbor, who is likely the individual that called-in the complaint. The complaint was a flooding complaint. Mr. Oldham was mailed a request for a compliance schedule, due on 05/18/10, addressing pond permitting and fill removal from the floodplain. Called and left message on 07/07/10, requesting a return call to discuss compliance. No return call was received in response to the 07/07/10, phone call. Called and left message on 07/13/10, requesting a return call and advising that District staff will refer enforcement to legal counsel and set a compliance deadline with a Compliance Agreement. Mr. Oldham returned the 07/13/10, phone call and stated that he was slowly moving the fill material. Staff informed him that a deadline must be established and is drafting an Enforcement Worksheet. In the meatime, Mr. Oldham is contacting local contractors to determine if they can assist in fill removal for a more timely compliance schedule. SRWMD Project Review Staff Patrick Webster, PE, CFM, Senior Professional Engineer and Bill Spencer, PhD, Senior Environmental Specialist, reviewed the project application. Project Location The project is located at the bridge crossing the Aucilla River on SR 30/US 98 on the Taylor and Jefferson County Line, in Township 4 South, Range 3 East, Section 12, and Township 4 South, Range 4 East, Sections 7 and 18. Project Description This project consists of the replacement of a short main bridge and a relief bridge with a single long permanent bridge within the same footprint. A temporary bridge will be built along the south side of the existing bridge in order to maintain traffic during construction. Technical Information on Permit The Florida Department of Transportation proposes to replace the existing 700 foot main channel bridge and the 315 foot relief channel bridge on SR 30/US 98 over the Aucilla River in Taylor and Jefferson Counties. The new bridge structure will consist of the construction of a single permanent 1,365 foot bridge WSRM 34

36 in the same alignment. A temporary bridge will be constructed just to the south of the existing bridge to maintain traffic during construction. The project will be built in accordance with the roadway plans signed and sealed by Derek Johnson, PE, on July 9, 2010 and bridge structure plans signed and sealed by George Patton, PE on July 6, 2010, both from EC Driver & Associates, Inc. Wetland Mitigation Review There will be 0.61 acres of permanent wetland impacts and 4.26 acres of temporary wetland impacts. The Uniform Mitigation Assessment Method (UMAM) was used to quantify wetland impacts as Functional Loss Units. The U.S. Army Corps of Engineers requires 0.87 mitigation credits based on the Wetland Rapid Assessment Procedure (WRAP). The District is required by section , Florida Statutes, to provide mitigation associated with FDOT construction projects. Wetland impacts will be mitigated through the purchase of forested wetland mitigation credits at the San Pedro Bay Mitigation Bank located in Taylor County at a cost of $43,500, which will be required from the applicant. Mitigation for temporary impacts is not required because FDOT will restore disturbed areas as specified in the Aucilla River Bridge Replacement Restoration, Monitoring, and Maintenance Plan for Temporary Impacts report received by the District on June 2, Special Conditions on Permit 1) The Florida Department of Transportation (FDOT) will be required to pay $43,500 to the Suwannee River Water Management District (District) for the purchase of the required mitigation credits from the San Pedro Bay Mitigation Bank to offset proposed wetland impacts as required by the District and the U.S. Army Corps of Engineers (USACOE) within 30 days of the date of issuance of this permit. 2) The FDOT will be required to pay the District $46,760 in order to compensate for required water quality treatment within the Aucilla River Basin to the District within 30 days of the date of issuance of this permit. 3) FDOT must provide annual restoration reports as specified in the Aucilla River Bridge Replacement Restoration, Monitoring, and Maintenance Plan for Temporary Impacts report received by the District on June 2, WSRM 35

37 Interagency Coordination Taylor County, the Florida Fish and Wildlife Conservation Commission, the Florida Department of State-Historical Resources, the FDEP- Division of State Lands, and the United States Army Corps of Engineers, and FDEP-St. Martins Marsh and Big Bend Seagrasses Aquatic Preserve are aware of the proposed project.
